Justice Brandeis became well known for his free speech opinions and for generally supporting the constitutionality of progressive legislation.
His concern about “bigness” made him concerned about certain aspects of the New Deal. He is famous for co-authoring a law review article about privacy, which he later applied in a constitutional sense in his Olmstead dissent.
Mr. Olmstead later received a presidential pardon.
