NSA's General Counsel speaks on 702, cybersecurity, and more

In this episode, Jamil Jaffer and I interview Glenn Gerstell, the General Counsel of the National Security Agency. Glenn explains what it was like inside the effort to reauthorize section 702 of FISA. Jamil and I ask him whether the FISA court has the authority to deal with material omissions in FISA applications, and he actually answers. Glenn also touches on how it feels to discover that data subject to a judicial retention order has been inadvertently deleted, on his secret exercise regime, on his future plans, and on how the United States should respond to the cybersecurity crisis.

I wish everyone would just relax, and everything could just go back to the way it was before all this nonsense. I don't know what else to say. People attach way too much significance to things, it starts to get crazy and scary.

Just for the avoidance of doubt, if it turns out that:

(a) Trump is in fact Dr Evil, who conspired fiendishly, illegally and successfully with Russia to install himself as President of the United States, fraudulently displacing the true winner of the election, or

(b) a group of senior officials in the Obama administration, the FBI, the DOJ and the various intelligence organisations conspired to spy on the Trump campaign by getting FISA warrants on false pretences, and then having failed to prevent him getting elected, attempted to frame him as the afore mentioned Dr Evil

In the end, people may happily allow the destruction of their constitutional freedoms in exchange for the sweet embrace of ignorance, satiety and a sense of security. Reality and freedom is too scary.
