The War on Backpage.com Is a War on Sex Workers

The government's latest moral crusade shields traffickers, empowers pimps, and undermines free speech online.

On the morning of April 6, 2018, the FBI arrested Michael Lacey and James Larkin and seized Backpage.com, the website they created in 2004, on allegations that it was a platform for underage sex trafficking. Lacey and Larkin were later charged with money laundering, conspiracy, and facilitating prostitution. The two men have maintained their innocence and are now confined to Maricopa County, Arizona, via ankle monitors. Their trial is scheduled for 2020.

Veteran newspaper publishers, Lacey and Larkin see their arrest and prosecution as an assault on the First Amendment. In the early 1970s, they built an alt-weekly empire specializing in muckraking journalism. In the process, they made enemies of powerful figures in Arizona politics, including John McCain, his wife, Cindy, and former Sheriff Joe Arpaio.

After the internet and Craigslist gutted their business model, Lacey and Larkin launched Backpage.com, an online version of the classified sections of their print newspapers. Illegal activity was never allowed on Backpage, but sex workers advertised their services via innuendo. Connecting with clients online turned out to be considerably safer than walking the streets or working for a pimp. The internet empowered sex workers.

Lacey and Larkin were able to fend off legal challenges thanks to Section 230 of the Communications Decency Act (CDA), which said that website platforms aren't responsible for third party content. As sex work became conflated with sex trafficking, that defense was eroded.

Lost in the panic was Lacey and Larkin's behind-the-scenes collaboration with law enforcement in responding to subpoenas and even training vice officers on how to use the site to catch traffickers. Backpage's Carl Ferrer even received a certificate from then-FBI Chief Robert Mueller for his outstanding cooperation helping with sex trafficking investigations.

This is the story of the rise and fall of a newspaper empire, and how a new moral crusade is endangering sex workers, shielding traffickers, empowering pimps, and undermining free speech online.

The same FBI that Lisa Page and Peter Strzok were members of? Pretty sure that certificate is worth jack squat.

  Could have just said the same fbi mueller was in charge of. The asshole who harassed two military members, one to suicide, trying to set them up to take the anthrax fall.     Is there a concise cite for this narrative somewhere? Not saying Mueller isn't a d-bag. Just got to sit down with the FBI and talk about anthrax once and am not entirely clear on what "anthrax burns" are.

        If one of the hijackers had just showed up in the ER with cutaneous anthrax, which would not be “skin irritation “ or a single lesion and not been diagnosed and aggressively treated he would probably have died.
        
        Also my understanding is the strain in the attacks was determined to be the Ames strain a highly virulent form which is kept at USAMRIID.

        The British refused, but I don't think it's inconceivable that they or some other player might have obtained some -- it's not like the US would want to publicize it if they knew it had happened.

This article is a great example of why Libertarianism is on a train to nowhere.
Conflating vices with freedom is NOT a classical liberal approach to policy. It is simple license or libertinism. Promoting this garbage does nothing to promote the general welfare, which is what gov't *should* be doing. Promoting vice makes someone who thinks they are for freedom nothing more than a common Marxist, bent on destroying civilization.

  I disagree. Classic liberalism suggests that the government's main purpose is to promote civil and economic liberties in a way that minimizes abuse and conflict. If prostitution is an act between two consenting adults that results in no harm to either party and is free from outside coercion or exploitation, then there is no inherent conflict.
  
  Meanwhile, vice laws are entirely arbitrary and capricious. If you approve of vice laws in general, would you be okay living under Sharia vice laws if a hardline Muslim came to power? Could you watch your daughter being caned for showing some ankle in public?

I’m sick and tired of hearing the whining that law enforcement “endangers sex workers”.

They are in danger because they work in the shadows with clients that know they shouldn’t be seeking what they’re offering.

Do you want to keep sex workers safe? Then make sure every transaction is recorded with identification.

Of course they will all go out of their filthy business. Fucking sex clowns.

Whatever happened to Section 230 protections?? Or maybe I misunderstood their purpose in the last discussion of Trumps "rumored" E.O. to stop bias filtering.

I was under the assumption Section 230 released companies of any liability for the "means" of criminals and their activity.

Which makes sense - are we to sue the Department of Transportation for drug traffic because it was the "means" of transport?

I disagree. Classic liberalism suggests that the government’s main purpose is to promote civil and economic liberties in a way that minimizes abuse and conflict. If prostitution is an act between two consenting adults that results in no harm to either party and is free from outside coercion or exploitation, then there is no inherent conflict. Yes this is right but not sure that this is 100% sured.
