Teen Boy Kissed Girl on a Dare. Now He Faces Assault Charges.

KissDreamstimeA Pikesville, Maryland, 13-year-old will be charged with second-degree assault for kissing a 14-year-old girl on a dare. The "assault" happened at Pikesville Middle School on Friday. Police were called to the scene.

According to WBFF:

School officials took a report regarding a 13-year-old boy who kissed a 14-year-old girl during school hours. The unwanted kiss was allegedly the result of a dare made by students.

Police confirm that the boy is now facing a second-degree assault charge as a juvenile. No one was injured during the incident, police say, and disciplinary actions related to suspension or expulsion will be handled by the school system.

No one was injured. Is that really surprising?

It's of course true that every 14-year-old has the right not to be kissed. I'm not saying the boy's transgression should go unpunished. What I'm saying is this: he should not be charged with assault. He's 13. Thirteen-year-olds do stupid stuff. They screw up. And when the consequences of their actions are as minor as this, it's better to reprimand them in a manner that does not involve the criminal justice system.

By all means, give this kid detention. Make him apologize to the girl. Tell his parents to teach him better manners.

But don't charge him with assault. That would be a far greater crime than a stolen kiss.

    I suspect that the girl did nothing more than report the incident to a teacher, if even that. The teacher and principal, armed with the mental acuity that an Education degree confers, and backed by asinine "zero-tolerance" policies, reported it to the police who (hopefully) also recognized it as a bullshit complaint, but could not just ignore it.

    Yes, it is assault for an adult man to kiss an adult woman when she doesn't want him to. And I think it certainly merits misdemeanor assault charges, should she care to press them.

    As to slapping vs. law enforcement ... consider this. If the 30-year-old man makes a habit of kissing 22-year-old women, he's going to kiss a few who will slap him .... hard. And then there will be others who might slap him to no effect, or who might withdraw from him. So ... the lesson becomes that he should not kiss women who are physically strong enough to repulse him. While there might be some specific alteration from the general common law definition of assault in that jurisdiction that technically makes the act qualify as assault the act does not meet the general definition.

    More importantly however the actual point of the article went completely over your head. Soave was not arguing whether the act meets the technical definition of assault he is arguing that whether or not it does using law enforcement to resolve the issue is inappropriate

    The idea that every infraction no matter how minor must be resolved in a court of law with criminal charges is a problem. The criminal justice system can't even handle actual rape cases effectively and you want to bring them in on a stupid kids prank?

Today the boy is at risk of having his character defamed & a criminal record where in the past it was the girl who was forced to drop out of school or leave the area – often the state in order to continue school, yet her crime of complaining about anything from ripped clothes to actual rape left her with the scarlet letter that gave the new school district cause to label her a trouble maker if anything happened involving boy girl relations regardless how innocent, or obvious an assault against her. Do I agree that the young man should be tormented as young ladies were in yesteryear? No. Do I think the situation requires more attention than the perpetrators of yesteryear want the boy to experience? Oh Yeah! These men have yet to learn to respect & cherish women & girls therefore they have not taught their sons such social skills. Therein lies the problem. Let these men grasp the fact that they are the problem & correct the errors of their past & we will see a drastic improvement in how the school boys are treating the girls, as well as see the girls develop respect for the young men that has not been a part of society in many years; without society's need to go from one extreme to the other till a balance is formed.

    I developed early, and when I started having those kinds of problems in grade school, an adult at home told me to, 'just start kicking them in the balls.' So that's what I did. The next time a horny preteen touched me inappropriately, I turned around and knee'd him in the groin. I had to drop kick a few people, but it wasn't too long before I started getting respect on the playground.     There is much more than a simple assault involved here. The boys who dared this young rapist constitute a conspiracy to commit assault. They must all be tried and punished as adults.     So, what should the punishment be? Well, I have a few ideas that cover different aspects of making him understand the seriousness of an unwanted kiss.

    1. Make him kiss all the boys (in the same way he kissed the girl) that dared him to do the deed in the first place. That will give everyone involved an idea of what an unwanted kiss means.

    2. Build a pillory and lock him in it during his free time at school until every girl in the class (through anonymous vote) agrees to let him out. Encourage them to keep him locked up until he can explain why what he did was wrong. This would show him how seriously girls take such an affront and probably force him to see the kiss from the girl's point of view.

    3. Make him let a dog lick peanut butter out of his mouth.

    Since everybody is doing the "when I was in school" thing, I'll join in. When I was in school, you'd get a detention for dropping the F-bomb in front of a teacher. Does grabbing a girl and forcing your tongue into her mouth against her will really merit no more consequence than that?

    When I was in grade school in the the early 1980s people started having sex at 12. Spin the bottle was 11. I'd be willing to bet it's more widespread and perhaps earlier now. 13 and 14 are freshmen in high school so they may be sexually active men and women . So don't assume thrre was no Mature sexual intent. But these things are illegal and can't be discussed publicly.

They're laughing about the odds of her ever being kissed again. They're hailing this boy as some kind of martyr because he got in serious trouble for grabbing a girl by the shirt and forcibly sticking his tongue into her mouth against her will. How is that a war on boys?

    So officials are taking steps to correct that oversight by laying the mother of all guilt trips on this youngster.
    They will convince him in his underdeveloped mind that he is a virtual rapist, and doesn't deserve to live in a free society.
    The kid will do one of three things:
    1. Turn gay
    2. Commit suicide
    3. Become the sex offender the system will convince him he is.

    The chances for a young lad to grow into a productive adult man in today's feminized society are slim to none!

    Everyone, including the article's author, assumes the boy was dared to kiss a pretty girl he liked, and he 'stole a kiss' from a touchy little Venus; now he is being treated unreasonably by adults who are absurdly overreacting. You've forgotten that that is NOT what would be the typical junior high school scenario. What most likely happened is that the girl was being bullied and the boy's friends dared him to kiss her because she was 'so ugly'. Junior high school boys don't find it hilarious if someone kisses a pretty girl on a dare.--They find it hilarious if someone kisses a 'repulsive' girl on a dare. 98% of the time, in order for junior high school boys to find something concerning girls amusing, CRUELTY has to be part of the picture. So, that boy is probably not as sweetly innocent as everyone thinks. The dare, and kiss, were probably part of an act of vicious bullying.
