Google Says Biden Admin Pressured Company To Remove Content

Senior officials in the Biden administration, including some White House officials, "conducted repeated and sustained outreach" and "pressed" Google- and YouTube parent-company Alphabet "regarding certain user-generated content related to the COVID-19 pandemic that did not violate [Alphabet's] policies," the company revealed yesterday.

While Alphabet "continued to develop and enforce its policies independently, Biden Administration officials continued to press [Alphabet] to remove non-violative user-generated content," a lawyer for Alphabet wrote in a September 23 letter to House Judiciary Committee Chairman Jim Jordan. Administration officials including Biden "created a political atmosphere that sought to influence the actions" of private tech platforms regarding the moderation of misinformation.

The company will now restore the accounts of certain content creators removed as part of efforts to tamp down on misinformation related to COVID-19 or the 2020 presidential election. "YouTube will prove an opportunity for all creators to rejoin the platform if the Company terminated their channels for repeated violations of COVID-19 and elections integrity policies that are no longer in effect," the letter said.

These announcements came in response to Judiciary Committee subpoenas sent as part of the committee's investigation into government efforts to "weaponize" tech companies to suppressing disfavored speech.

Jordan has been crowing about both Alphabet's admissions and its pledge to reinstate creators whom he described on X as being "censored for political speech" on YouTube. "This is another victory in the fight against censorship," Jordan posted.

I agree. Some have defended the Biden administration's pressure on social media companies, saying that since it only amounted to suggestions and requests—not demands—and that it was fair game. But when those suggestions and requests come amid a bevy of bills aimed at big tech companies, a slew of congressional hearings where lawmakers excoriated big tech, pledges by the administration to use antitrust laws to break up big tech companies (and follow through there from both the Department of Justice and the Federal Trade Commission), and condemnation from the highest levels of government—including the president—it's hard to take seriously the idea that this was just friendly and harmless repertoire. At the very least, it's easy to imagine how tech companies might have taken the Biden administration's comments as more than mere requests.

This is what has come to be known as "jawboning," and the fact that it doesn't involve direct censorship may make it even more insidious. Direct censorship can be challenged in court. This sort of wink-and-nod regulation of speech leaves companies and their users with little recourse.

All of that being said, the Biden administration's attempts to pressure private companies into doing their bidding with regard to free speech seems quite quaint in comparison to what the Trump administration has been doing.

Just yesterday—the same day that Jordan pledged that Congressional Republicans would "not stop fighting for free speech"—the Republican president, Donald Trump, threatened to sue ABC for putting Jimmy Kimmel back on the air.

Kimmel's show was indefinitely suspended by ABC following comments from Federal Communications Commission (FCC) Chair Brendan Carr, who suggested that the FCC would take action if companies didn't pull Kimmel. "I mean, we can do this the easy way, or the hard way," Carr told conservative podcaster Benny Johnson. "These companies can find ways to change conduct, to take action, frankly, on Kimmel, or there's going to be additional work for the FCC ahead." Carr went on to say that broadcasters could face fines or license revocation if they didn't act.

First, Nexstar—which owns myriad local TV stations and is seeking approval from the Trump administration to merge with Tegna—said it would replace Kimmel's show on the ABC affiliates it owns. Then ABC announced that "Jimmy Kimmel Live will be pre-empted indefinitely" across the nation.

The Republican spin has been that private companies independently decided to get rid of Kimmel, and that this couldn't be described as censorship because neither the FCC or any other government actor had directly taken action.

But even if Carr didn't directly order any actions here, his comments are a pretty clear threat. The same goes for Trump's comments with regard to Kimmel and other late-night TV hosts.

At the very least, this is jawboning several orders of magnitude above what we saw from the Biden administration. It's certainly not the behavior of an administration or a party that rejects censorship or respects the First Amendment. And it represents just one of many similar attempts by the Trump administration to directly or indirectly censor free speech.

With all that the Trump administration and other Republicans are doing right now to erode the First Amendment and create a climate of free speech fear, it may seem silly to still care about some pressure put on social media companies by a previous administration. But bigger wrongs being done now don't make previous wrongs right, of course.

What's more, each time authorities stray from the spirit of the First Amendment, it makes it that much easier for future authorities to do so. And each time Democrats (or Republicans) use government power to try and suppress free speech, it gives them even less standing to say it's wrong when their opponents do that while also giving their opponents room to suggest they're only doing the same thing that's been done before by the other side.

"It's called soft power. The Left uses it all the time," Johnson posted after asserting that Carr's comments are indeed what got Kimmel canceled. "Thanks to President Trump, the Right has learned how to wield power as well."

Biden administration jawboning of Alphabet and other big tech companies was bad in its own right, of course. But it's also having a long tail of badness.

The Biden administration's actions do not justify what the Trump administration is doing now. But for a lot of Republican leaders and MAGA faithful, they provide perfect cover to undertake or cheer their side doing the same—and much more.

Once again, the Department of Homeland Security and Immigration and Customs Enforcement were involved.

• A national security threat—or a simple scamming operation? Robert Graham at Cybersect makes a case for the latter, contradicting claims from the Secret Service and major news organizations. • "We've been wrong about new technology before. Are we wrong about AI?" asks Dylan Matthews at Vox. The piece contains this tidbit: "If the number of messages sent to it keeps growing at the current pace, there will be more ChatGPT queries than Google searches by the end of next year."

• Human error fuels self-driving car crashes: A large majority of crashes involving autonomous car company Waymo "were clearly not Waymo's fault, including 24 crashes where the Waymo wasn't moving at all and another 7 where the Waymo was rear-ended by another vehicle," notes Kai Williams at Understanding AI.

• Judge tosses tribe's "porn addiction" defamation claims. "A Los Angeles judge dismissed an Amazon tribe's defamation lawsuit against two media outlets that reported on the effects of remote community's sudden access to Starlink satellite internet," reports Courthouse News:

The New York Times reported that after nine months with Starlink, the Marubo saw teens glued to phones, social network addiction, violent video games, scams and minors watching pornography. Tribal leaders expressed concern about social behaviors changing rapidly.

Other outlets picked up the story, including TMZ, which ran the headline, "Tribe's Starlink hookup results in porn addiction!!!" despite The Times never making such a claim.

• Scottish prostitution plan unworkable: Scotland's Crown Office and Procurator Fiscal Service (COPFS) says a proposed prostitution bill criminalizing the purchase but not the sale of sex would be unworkable. The office also rejected claims "that sex workers would not need to be dragged to court to testify against people with whom they had had consensual sex, in order to secure convictions," Scotland's The National reports.

It's when they actively work to try to suppress the rights of others that it becomes a problem. So, please get your history lesson straight.

          This is different than what your team is doing, which is trying to get people fired only over their speech. These people who are getting fired didn't murder Charlie Kirk, a large number of them didn't "celebrate" ANYTHING, they didn't try to oppress anyone, they just made a snarky or mocking comment that your team didn't like.         My favorite aspect is that unlike the bad faith reading of "good people on both sides", a bad or even fairly good faith reading of Yglesias' post reads as an abjectly tone-deaf endorsement of shooting immigrants.

      Personally, I blame the guns. If they were more discerning about the shooter's intent rather than just mindlessly firing wherever they were pointed, the fact that the shooter killed and injured only immigrants before killing themselves would make the motivation for this shooting as clear as Thomas Crooks' assassination of Corey Comperatore.

      If Robertson were using a properly designed firearm rather than an old M98, the gun probably wouldn't have gone off for fear of the foreseeable consequences to Jimmy Kimmel's caree- I mean free speech.

    There is nothing "quaint" about the Biden Administration's Censorship Industrial Complex, which was enforced by numerous federal agencies, including the State Department. State, among other things, funded a British organization to rate the bias of U.S. media companies based on the level of alleged disinformation they published. And guess what? That organization warned advertisers to avoid Reason!!

    If Reason doesn't get its head out of its butt, I, too, will avoid Reason!

    This is bullshit. The Biden Administration identified specific accounts and political themes to be censored as part of a regular and recurring business process they set up with the tech companies. The process specifically accepted their identifications.
    While Trump's focus on people who piss him off shows a greater character flaw the Biden process is actually far more dangerous because of this widespread targeting of specifically political information and opinions. It was also underground meaning effective opposition was impossible which is why we only found out about it because Musk bought Twitter. This is a fundamental mistake caused by ENBs (and others) irrational hatred for Trump drawing all their concern while ignoring which is actually more damaging.

    But the worst failure of this article is that it defends only the First Amendment rather than free speech broadly. The American free speech tradition is far broader than the first amendment including the acceptance that people will not be punished for their speech by non-government actors unless it is truly extreme. The left has been manipulating this tradition for roughly 50 years to allow virtually anything on the left and virtually nothing from the right. So we end up in the current circumstance where the left believes it's ok to cheer a politically motivated murder but not ok to assert that women are women. Libertarians are first in line to argue that this free speech tradition is important and should be widely acclaimed, unfortunately this doesn't seem to include anyone from Reason.

    Google and Zuckerburg did a mea culpa on their government backed censorship before Reason Magazine. I don't know what to say.

    I'm trying real hard to comprehend ENB's argument. Biden directly contacted social media companies to wage a constant pressure on banning NON VIOLATIVE content, and resulted in thousands of likely suspension and shadow banning. Brandon Carr goes to a podcast, threatens action on speech that could be interpreted as a call of violence at a heated moment in the country, but doesn't actually contact any affiliates. How is the latter worse?

    Bondi and the left saying "hate speech is not free speech" is wrong, but it's not worse than what GBR has done, which actually tossed people in jail over free speech.

    Did I mention that Biden pushed for censorship on NON VIOLITVE content? Meaning they pushed to censor material that was either deemed to be true or not disinfo by the hosting platform. They forced an American company to LIE.

    Listen to me very carefully. There is a world of difference between what Biden and Trump did. Just like there's a huge difference between rhetoric that "might" lead to violence, which scares the shit out of liberals and gets them all excited, and........ actual violence in which people are shot and hacked to death. If you can't rise above their ignorance, we can't take you seriously as a person, much less a journalist.

Unfortunately for those writers, they are now living in "The Mosaic", a fanciful name for the poorly camouflaged, global patchwork of fifteen-minute factory/cities between which travel is regulated with diabolical precision, and within which pretty much every other natural human right has been vanquished.

      The are far from lonely, but that comes with a cost: Living mostly on bugs, and scattered among the numberless communes of festering humanity, they live in constant fear that someone might recognize them. That is not likely; ironically, they just weren't Elite enough to begin with, and starving peasants all tend to look alike after awhile.

      THE ELITES' PARADISE - PRELUDE: ARE YOU HERE FOR THE FESTIVAL?

      The Players:
      KVW - Raison Editor-in-Chief who bears an uncanny likeness to an old VW Beetle
      ENV - Raison Senior Editor, believes her feminist cred disguises her being a dumb blonde
      Nick Gilooly - Raison Editor at Large who strives for largess.
      Chuck Schmoozer - A Buffoon from NY who is also a US senator
      Security Guard - A security guard with dark aviator sunglasses

      In an alternate universe, on the eve of what would become known as the "Greatest Displacement", some of the Elite and their minions are gathered at none other than the Watergate Hotel, for an event some will remember as "The Last DC Cocktail Party." The mood is upbeat, despite the sound of explosions and sporadic gunfire in the distance.

      With cocktails in hand, KVW, ENV and Gilooly are standing together chatting. Presently Chuck Schmoozer enters the room, his beady eyes scanning for opportunity. While most attendees ignore him, Gilooly casts a glance toward him. That is all Schmoozer needs to invite himself into their midst.

      Schmoozer (with a wink): Are you here for the festival?

      Gilooly: Festival?

      Schmoozer: Oh come on. Didn't you ever see that old Start Trek episode, "Landru"? They visit a planet where all the people behave like mind-controlled robots, but it turns out that the entity in control of the planet, a super computer known as Landru, has figured out that because all of the primal urges of the population are being constantly suppressed, they must have at least one day to cut loose. That's the Festival. Landru shuts down for 24 hours, and absolute mayhem, death and debauchery ensues.

      ENV: Ah! Like what happens when all your sexual urges are suppressed for long periods.

      Schmoozer (winks at ENV): Well, you wouldn't have a problem like that, would you?

      (KVW rolls her eyes)

      Gilooly: Are you saying that's what all that gunfire is out there?

      Schmoozer: Antifa.

      Gilooly: No shit...

      Schmoozer: I shit you not. We've taken a page right out of that Star Trek script and applied it. We like to give our chosen goons a lot of free reign when it comes to creating violence. It keeps them easy to control and less apt to question our authority. Don't you worry, we have six ways from Sunday to keep these mobs on our side. And it makes Antifa feel really powerful.

      ENV: I must say, they all look rather menacing in their all-black garb, masks and goggles.

      KVW (rolls her eyes again): Oh come on. Have you ever seen them without the costume? They all look like Far Side kids. Soft, pink. Near-sighted mouth breathers.

      Schmoozer: But they do a lot of damage. Billions of dollars worth.

      ENV: Yeah, tell me about it. I've had to gloss over that shit for years at Raison.

      Gilooly (looks at Schmoozer): ENV is the best gaslighter we have on staff.

      Schmoozer: Well, you've all done a great job on the psy-op. You've worked six ways from Sunday to keep the libertarian movement from ever coming together.

      (KVW Rolls her eyes yet again and giggles. Schmoozer excuses himself and walks away)

      Gilooly: Did you notice how he kept referring to our efforts in the past tense?

      ENV: Nick, you're just being paranoid.

      After a moment a security guard walks up to the trio

      Guard: Excuse me, Mr. Schmoozer has instructed me to escort the three of you out to the parking lot where has a car waiting. He has invited you to a bigger and better cocktail party across town.

      The three Raison staff look at each other and one by one, follow the security guard out of the room.

      Upon arrival at the parking lot they come upon not one, but three Town Cars, lined up single file, Schmoozer stands by the open door of the lead vehicle.

      Schmoozer: Here we are, then. I hope you will all enjoy the next, rather special party. Mr. Gilooly, you will ride in the second car. Ms KVW, you will ride in the third. And Ms. ENV, you will ride in the lead car with me.

      ENV (sighs heavily): Ah well...
