Tariff Legal Battle Plays Out

Reverse, reverse: Yesterday, I reported that a three-judge panel of the U.S. Court of International Trade had issued a ruling that would put a pause on President Donald Trump's tariffs announced on "Liberation Day," as well as those levied on Canada, Mexico, and China the month prior.

"The decision would have forced the Trump administration to unwind many of the president's steep tariffs over the next 10 days, but the government quickly petitioned a federal appeals court to intervene," reports The New York Times. The administration "asked a panel of judges to hold that order at bay while it weighed the administration's fuller arguments that its tariffs were lawful." This bid was successful, and the U.S. Court of Appeals for the Federal Circuit issued a pause yesterday, allowing the tariffs to remain in place. This essentially gives the courts more time to consider the legal issues at play and to determine what type of authority the administration has, in a case that will probably be ruled on by the Supreme Court.

The case hinges on whether the International Emergency Economic Powers Act (IEEPA), a 1977 law that Trump has invoked, allows him to levy tariffs. The IEEPA gives the executive sweeping authority "to deal with any unusual and extraordinary threat, which has its source in whole or substantial part outside the United States, to the national security, foreign policy or economy" of the country. Trump has, of course, made bold "national security" arguments in an attempt to politically make the case for tariffs: First, the flow of fentanyl through our country's borders justified the imposition of tariffs on Canada, Mexico, and—most especially—China. Then, national security arguments were used to justify further ratcheting-up of tariffs on China, with the administration arguing that the risk of relations with China souring at some point in the future means we must take steps to reshore critical industries right now. And, more broadly, the current trade deficit we run with many other countries has been portrayed as a threat to American competitiveness—whether true or false.

This is the first time IEEPA has been used by a president to impose tariffs, though. In the past "presidents have imposed tariffs in response to national security threats using Section 232 of a 1962 trade law," reports The New York Times. "That legal provision differs from IEEPA in part because it requires an investigation and report that has to be issued within 270 days. The provision also focuses on certain imports that 'threaten to impair' U.S. national security." In other words, there are slightly more strings attached when done via that mechanism, and the tariffs are generally expected to be more targeted and narrow in scope.

You might expect the administration to be in a sort of waiting posture, given that Trump's use of the IEEPA might at a future date be struck down by the Supreme Court. Instead, Trump has decided to attack the judges who initially ruled against his use of the act, asking "Where do these initial three Judges come from?…Is it purely a hatred of 'TRUMP?'"

Well, for Judge Timothy Reif—a Trump appointee—probably not. Trump, never one to take responsibility for his choices or appreciate the independence of the judiciary, appears to recognize his culpability in appointing Reif (who committed the heresy of ruling against him!) and has now taken to attacking the Federalist Society, which helped recommend conservative judges during his first term.

More deportations in defiance of court orders: Earlier this month, a panel of federal judges with the 2nd Circuit Court of Appeals granted Salvadoran man Jordin Melgar-Salmeron permission to remain in the United States while his immigration case made its way through the court system. Twenty-eight minutes after that ruling was issued, Melgar-Salmeron was on an Immigration and Customs Enforcement (ICE) flight from Louisiana, where he was being detained, to El Salvador's Izalco prison. "ICE officials argue in court filings that a communication breakdown left them unaware of the court's order until after his flight had departed," reports Investigative Post. His lawyer "said he plans to seek criminal contempt of court charges against the Trump administration. Such a request is due in court June 2."

I'm sorry, I love him: "After denouncing it as a propaganda tool for the left, Argentina's libertarian President Javier Milei is relaunching a state-run TV channel for kids set to feature a cartoon teaching free market economics while stressing the evils of taxes and communism," reports Bloomberg. The channel is Paka Paka, which was originally created by former President Cristina Kirchner in 2010, and it will soon start showing Dragon Ball Z, Tuttle Twins, and Zamba, a cartoon about history. "Thrilled to announce that Tuttle Twins will be coming to millions of Argentine kids on Paka Paka!" write the show's creators on X. "They're replacing literal Marxist cartoons with hilarious education about freedom, economics and individual rights."

"On the series, Ethan and Emily Tuttle travel through time and space with their libertarian grandma to learn about the glories of capitalism," adds Bloomberg. "In one episode, the siblings discover the evils of government overreach in a ravaged, garbage-strewn Cuba run by Fidel Castro. In another, they realize money loses its value when governments print too much." Here's a sampling:

Obviously, the best possible approach would be no state-run TV at all. But Milei is probably correct that decades of Peronism have led to plenty of citizens having an insufficient appreciation for free markets. If these cartoons can help restore a little bit of balance, then that may be a good thing.

      This is silly. There are downsides to any government policy. You can try to do the utilitarian juggling, but I prefer to default to the less coercive option. And I thought the aim of the tariffs was supposedly to achieve unrestricted trade, which we don't have now and never have had.

            You have to also look at the other effects we are seeing. Believe they are now up to 12T domestic investment. 90% of companies olan to restore a lot of their supply chains, at least with risk Mitigation and domestic supply.

            We are already seeing the labor effects with unemployment decreasing even with public jobs decreasing by a significant amount.

            You can't think of this as a single input single output reaction. That is why all the "economists" have been wrong. That's what their models assume. Their models are wrong.

            Ironically this has been explained through multiple people discussing the multi stage effects of the plans. On top of it there is a deregulation push to decrease domestic costs as well.

            Ultimately you'll see domestic costs go down, income rose, welfare decrease, markets expand as domestic products can be exported, etc.

            Well we got the greatest most fair free trade deal ever in the USMCA... still didn't stop Trump from raising tarrifs on those nations afterwards.

        That's one aim. Another aim is to replace the income tax, while yet another aim is to protect domestic businesses. So the tariffs will simultaneously be zero for unrestricted trade, modest so as to generate revenue, and high to be protectionary. All depends on who Trump or Jesse is lying to at the time.

          The inconsistency does concern me. It would be nice if someone would clearly articulate the end goal here. If it is indeed to have freer trade in the end, and the tariff approach somehow works, then great. But the talk of trade deficits meaning we are getting "ripped off" somehow and similar things don't fill me with confidence that there is a coherent plan.

              What evidence is there for this besides Mullin's unsubstantiated claim, that he has since dropped without providing a shred of evidence, that this jet was ever offered to or accepted by Biden?

              He called the new jet a “beautiful, big, magnificent, free airplane for the United States air force”. Trump continued: “They tried to say: ‘Oh, it’s Trump’s airplane.’ Oh, yeah, sure. It’s too big, frankly, it’s much too big.”

              Meaning, it is available for his personal use, but it's too big so he won't use it...until he changes his mind.

                Democrats continue to beat the drum that Trump is being gifted a 747 from Qatar. It’s a lie. Let’s look at the facts.

                The Qatar B-747 was built in the US by Boeing. They are offering a newer 747 to replace one of the two current AF-1s that have been flying for 40 years. Which are tired and need to be replaced. The wing based at Andrews has also purchased aircraft from other countries in the past which are currently flying our VP and senior government officials. This is NOT new.

                The acquisition contract with Boeing to replace the older jets was initiated by Barack Obama 10 years ago. Boeing is woefully behind with no firm delivery date in the future. So, in the meantime, the old 747s (there are 2) continue to fly.

                As a stop gap measure, the Biden administration (yes Biden) began negotiations with Qatar to acquire one of their 747s. Qatar agreed and now are offering the jet to the US military, not Donald Trump. Modifying a future AF-1 is not a simple or cheap proposition. It will take a few years. The DOD contractor is based in the US, in fact my dad (a retired Air Force general) used to work for them. They are, not unironically, also working to upgrade the FAA technology as we speak. You know, Newark and elsewhere. They will get the aircraft and perform all of the security and the installation of the systems that AF-1 requires to safely move our president around the world. Not the Qatari’s. And you and I will pay for that but not the $400 million the 747 would normally cost. I could tell you exactly what is required to modify the AF-1 for safe flight but that is Top Secret. We’d never trust a foreign government to do that.

                This AF-1 will serve the sitting president, whether they be Republican or Democrat until Boeing gets their shit together to complete the new, upcoming improved 747s that started under Obama, was renegotiated under Trump, and was completely ignored by the Biden administration. So here we are. The Trump Library has requested an AF-1 through the National Archives after he leaves office. It’ll be one of the old ones and it won’t be flown on by Trump. It’ll be a “static display” just like the old AF-1 hanging in the Reagan Library.

    State data shows only 41% of students in third through eighth grade could read at grade level in 2024 and just 31% in 11th grade. In math, 28% of third through eighth graders were proficient and 26% of 11th graders.

    Lowering proficiency benchmarks will inflate the percentage of students meeting proficiency standards, but it does little to improve students’ performance or their actual mastery of subject matter. Rather than providing a more accurate view of student performance, it simply obscures the crisis of students struggling to meet proficiency in core subjects and likely denies students the extra help they need.

    Illinois students matched or outperformed the national average proficiency level in reading for fourth and eighth grade and slightly underperformed and outperformed the national average in math for both grades.

    Outperforming the national average is a low bar for students. Even as Illinois students outperform the national average on the NAEP, most Illinois students do not meet NAEP’s proficiency benchmarks.

    Illinois’ outperformance of the national average still meant only 1 in 3 eighth-grade students met NAEP proficiency standards in reading. The story is similar for math proficiency rates.

    “Many parents are already underestimating the degree to which their children are lagging behind,” said Tom Kane, a Harvard researcher who has been tracking students’ recovery from COVID learning losses. “Lowering the proficiency cuts now will mislead them further.”

    Lowering the proficiency benchmarks threatens to not only mislead parents but also to leave some students without the academic support they need. Schools use proficiency benchmarks to determine if students need extra help, said Christy Hovanetz, a senior policy fellow at ExcelinEd. Lowering the bar means some students won’t receive the help they need.

    Rather than lowering expectations for students, Illinois ought to invest in efforts to increase student mastery of core subjects and help more students achieve the proficiency benchmarks currently in place.

    A Democratic Illinois congressman argues jobs will be lost as a result of Supplemental Nutrition Assistance Program cuts, saying Albertsons' Jewel in Moline will lose 20% of their revenue. A former congressional challenger pushed back.

    At a recent committee hearing, Illinois U.S. Rep. Eric Sorensen, D-Moline, highlighted the importance of food assistance programs and community connection through a personal story from his hometown.

    “It’s not just that people in my neighborhood will go hungry. Steve [Sorensen’s grocery clerk] loses his job after 50 years,” Sorensen said. “The people in the meat department lose their jobs. The pharmacist loses her job. The florist loses their job.”

    Ray Estrada, a former 17th Congressional District candidate, criticized Sorensen’s rhetoric, saying he relies too heavily on emotional language and personal stories instead of offering substantive policy solutions.

    “Sorensen doesn’t seem to care about what’s really happening with EBT and SNAP. Instead, he uses it to play the victim and blame Republicans, ignoring how Democratic policies over the last four years have contributed to the increased need for assistance,” said Estrada.

    In the committee hearing, Sorensen, a former meteorologist, said it doesn't take a meteorologist to forecast that there's going to be food deserts everywhere.

    "He [Sorensen] shares personal stories, like his midnight dinners of peanut butter jelly sandwiches or shares pictures of his dog. I'm still looking to hear anything substantial from this guy,” said Estrada, referring to several social media posts where Sorensen is pictured with peanut butter sandwiches. “What is he going to do about taxation?”

    Estrada estimated around 200,000 people in the 17th Congressional District are in need of food assistance.

    “They tout the high number of people in need of the services. I mean, it's almost comical. It's like they're proud of it,” said Estrada.

      Fun fact, I live in a food desert. Well, looking it up, ALMOST. The poverty rate here is a not quite 20%, but it is more than 10 miles to a grocery store. A lot of people living in BFE are in food deserts or something close to it.

      "A food desert, as defined by the USDA, is an area where residents have limited access to healthy and affordable food, typically characterized by a poverty rate of 20% or greater or a median family income below 80% of the area median. Additionally, in urban areas, at least 500 people or 33% of the population must live more than 1 mile from a supermarket, while in rural areas, the distance is more than 10 miles.

        I found USDA food desert mapping tool (https://www.ers.usda.gov/data-products/food-access-research-atlas/go-to-the-atlas) and it seems I'm about 2 miles outside of the actual local food desert. Ironically, people living 2 miles closer to the grocery store are included in the local food desert, but my zip code has a bit more income than the zip code farther south (due to proximity of lake and rich lake-house owners in the other direction). And also there's a Dollar General about 6 miles away, so I guess USDA counts that as food available...

    As the spring legislative session winds down in Illinois, sponsors of assisted suicide legislation are trying get passage by including the measure with a food prep bill.

    State Rep. Robyn Gabel, D-Evanston, attached the stalled assisted suicide bill’s language to a food preparation safety bill as an amendment.

    “Medical aid in dying is a trusted and time-tested medical practice that is part of the full spectrum of end of life care options,” Gabel said during Wednesday’s House Executive Committee hearing.

    Known as the “End of Life Options for Terminally Ill Patients Act,” the House amendment to Senate Bill 1950 would allow a person considered terminally ill to receive and self-administer lethal drugs after a physician determined they had less than six months to live.

    State Rep. Bill Hauter, R-Morton, who is a practicing physician, takes issue with the fact that this important legislation is tucked inside a food prep sanitation bill.

    “I have to object to the process that we are tackling today,” said Hauter. “When you have a process of fundamentally changing the practice of medicine, and we’re putting it inside a shell bill.”

    I kid you not, the actual bill is for food safety, and the assisted suicide part is tucked inside of it.

    Amends the Sanitary Food Preparation Act. Provides that the registered sanitarian of a county health department of where a food distribution facility is located shall have the power to enforce and observe the rules and orders of the Department of Public Health and the provisions of this Section. Defines terms. Authorizes a qualified patient with a terminal disease to request that a physician prescribe aid-in-dying medication that will allow the patient to end the patient's life in a peaceful manner. Contains provisions concerning: the procedures and forms to be used to request aid-in-dying medication; the responsibilities of attending and consulting physicians; the referral of patients for determinations of mental capacity; the residency of qualified patients; the safe disposal of unused medications; the obligations of health care entities; the immunities granted for actions taken in good faith reliance upon the Act; the reporting requirements of physicians; the effect of the Act on the construction of wills, contracts, and statutes; the effect of the Act on insurance policies and annuities; the procedures for the completion of death certificates; the liabilities and penalties provided by the Act; the construction of the Act; and other matters. Provides that the Department of Public Health and the Department of Veterans Affairs may adopt rules for the implementation and administration of the Act. Makes conforming changes in the Freedom of Information Act. Effective 9 months after the Act becomes law.

It seem irrational to think that a the law that gives the President the authority to wave his hand and grant TPS to hundreds of thousands of people, does not also give the President the authority to allow the TPS to expire on schedule and/or to even revoke it.

      Justice Ketanji Brown Jackson said the Supreme Court is allowing the government "to do what it wants" in a scathing dissent after justices allowed the Trump Administration to strip temporary legal protections from hundreds of thousands of immigrants.

      The court has also allowed the administration to revoke temporary legal status from about 350,000 Venezuelan migrants in another case.

      Jackson said the decision "allows the government to do what it wants to do regardless, rendering constraints of law irrelevant and unleashing devastation in the process."

    But Milei is probably correct that decades of Peronism have led to plenty of citizens having an insufficient appreciation for free markets. If these cartoons can help restore a little bit of balance, then that may be a good thing.

    This is why left wing demonization of Trump is so important. It makes his actions seem extreme when in reality the only difference is that the Dems actions were decided and executed behind closed doors and then actively hidden by Jake Tapper and the rest of the Democratic Party Press Corps. This feeling that Trumps actions are different is what prevents many people from applying balancing tests similar to the one Liz applies here.

    Propaganda works which is why so many people volunteer their time for it including in these comments.

    That laws emergency powers have been used 45 times or so to impose sanctions on foreign individuals. Which is, not at all surprisingly, probably a way for the federal government to violate the constitutional prohibition against bills of attainder.
