Mothers Are Losing Custody Over Sketchy Drug Tests
Some hospitals are even reporting women for testing positive for drugs that were given to them during labor.

A Georgia mother claims that she lost custody of her newborn daughter due to faulty drug tests from a lab with a documented history of inaccurate results. When a drug court and her OB-GYN ran tests on Kristen Clark-Hassell, her results were clean. But the tests from Georgia's Division of Family and Children Services (DFCS) came back positive, and so the government took her youngest child.
"They literally took her off my breast in the hallway with her screaming after the court hearing," Clark-Hassell told the Savannah-based outlet The Current. "For her to just be ripped like that just cut a hole in our hearts."
In a 2021 whistleblower complaint, a former lab director for Avertest—the company that processed Clark-Hassell's drug tests—claimed that as many as 30 percent of the lab's test results were inaccurate. She further alleged that "meeting deadlines for test results is more important to Avertest than accuracy" and that the company manipulated data and set arbitrary detection cutoffs, increasing false positives. Avertest settled the Justice Department lawsuit relating to these claims in 2024, paying a $1.3 million settlement.
Clark-Hassell's legal battle began with a DFCS-ordered Avertest drug screening in 2020. According to documents obtained by The Current, that test was taken on August 5, and it came back positive. Then a test from her OB-GYN taken on August 11 was negative. In September, a court-ordered drug test came back negative, but the DFCS ordered another round of testing in October. That time, her urine sample came back clean, but her hair follicle test was positive—raising serious concerns about the reliability of the results. While it's still possible that the sporadic positives Clark-Hassell experienced were the result of drug use, this exact circumstance is why accurate testing matters when deciding whether or not to take the drastic step of removing children from their parents' care.
Clark-Hassell's case is not unique. Last year, The Marshall Project published two investigations revealing that CPS removed children based on unreliable drug tests. Some mothers tested positive after consuming over-the-counter drugs or poppy seeds. In other cases, hospitals reported women for testing positive for drugs that were given to them during labor.
Separating kids from their parents can be devastating. To do it on the basis of a dubious test result is even worse.

When my mother was in labor for me the OB/GYN resident gave her an injection of heroin to slow down her labor until her attending OB/GYN could arrive to do the c-section. He was giving some of the heroin to me too, of course, and so at delivery I was rather blue, did not breathe for 1 or 2 minutes, and had to be intubated. I was told that the OB/GYN department kept some legal heroin around for a research project.
If something like that happened now, the hospital would have to settle the malpractice case out of court. Back then my parents didn't sue the resident and the hospital, nor did Americans in general during those post-war years. The fact that my father was an internal medicine resident in the same hospital might have influenced their thinking, but I've always thought my mother and I both being discharged in fine shape influenced them even more.
There have been so many unfortunate intersections between the medical profession and the legal profession in my lifetime, and all of them have involved money. Neither medical science nor civil jurisprudence have been greatly advanced by all those lawsuits. Somebody wins, somebody pays, all parties sign NDA's, and everyone goes home (the survivors at any rate).
Of course, there have been some important advances over the years, and this post discusses one of them. That is the fact that more and more scrutiny has been given to the reliability of test results coming from the mega-labs, which are far from infallible. It's also true that stricter scrutiny has been given to other types of evidence used civil and criminal cases, such as fingerprints, bite marks, hair and fiber matching, and so-called "lie detector" testing. A big part of this whole problem is that the general public thinks that CSI-type movies and TV are factual depictions of the forensic arts and that DNA evidence is 100% reliable. On top of that is the fact that the currently fashionable forensic analyses are hyped by the police and prosecutors as new gold standards, and these LE types continue to brandish such evidence in court even after it's been shown to be fallible.
All of this means that there can be severe consequences for those on the wrong end of evidence from a mega-lab or police lab, and we know that innocent people have been put to death because of inaccurate forensic analyses. We know that. Apparently we also now know that bad evidence can be and is used to justify the removal of children from their mother's breast. It's bad science to claim that this or that test is 100% accurate at all times and in all weather. It's good science to hold up a myth of evidence infallibility for examination by the courts and the general public.

Just say it, Emma. It was the result of drug use. You beclown yourself when you take the old wives tale of, "Maybe she was just eating poppy-seed muffins!"
Why do you take the stupidest position possible?
Why not just take the obviously correct position of, "Moms, and everyone else, don't do drugs. Ever."
Are you one of those people who imagine poppy-seed never positively tests for drugs?
Not only does it actually sometimes test for opiates, but some people actually use it to *make* hallucinogenic drugs.
If you're crushing up the poppies and injecting them into your veins, then yea, I imagine you would test positive.
How about don't do that.
