Movement in Abrego Garcia case: Yesterday, a panel of judges with the 4th Circuit Court of Appeals rejected the administration's attempts to stay a court order that would have released Kilmar Abrego Garcia from El Salvador's Terrorism Confinement Center (CECOT).
"The U.S. Supreme Court ordered the Trump administration last week to facilitate the release of Abrego Garcia, a Salvadoran man that three government officials admitted was mistakenly sent to El Salvador's most notorious prison, along with several hundred other alleged gang members," writes Reason's C.J. Ciaramella. "However, the Trump administration has done nothing to comply with that order; it insists it has no power to return Abrego Garcia from another sovereign state—nor does a court have the authority to force it to do so."

Note too that Salvadoran President Nayib Bukele was in the Oval Office on Monday, so it's not like Trump has no contact or sway with the foreign power holding Abrego Garcia in its custody.
"The federal courts do not have the authority to press-gang the President or his agents into taking any particular act of diplomacy," the Trump administration argued, requesting an emergency stay from the 4th Circuit, which did not find its arguments compelling.
"The government is asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order," writes Judge J. Harvie Wilkinson, who was appointed under President Ronald Reagan, in yesterday's ruling. "Further, it claims in essence that because it has rid itself of custody that there is nothing that can be done. This should be shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear."
"The government asserts that Abrego Garcia is a terrorist and a member of MS-13. Perhaps, but perhaps not," continues Wilkinson. "Regardless, he is still entitled to due process. If the government is confident of its position, it should be assured that position will prevail in proceedings to terminate the withholding of removal order. See 8 C.F.R. § 208.24(f) (requiring that the government prove 'by a preponderance of evidence' that the alien is no longer entitled to a withholding of removal). Moreover, the government has conceded that Abrego Garcia was wrongly or 'mistakenly' deported. Why then should it not make what was wrong, right?"
Wilkinson then takes issue with how the Trump administration has responded to the Supreme Court's demand that it "facilitate" the return of Abrego Garcia: "'Facilitation' does not permit the admittedly erroneous deportation of an individual to the one country's prisons that the withholding order forbids and, further, to do so in disregard of a court order that the government not so subtly spurns. 'Facilitation' does not sanction the abrogation of habeas corpus through the transfer of custody to foreign detention centers in the manner attempted here. Allowing all this would 'facilitate' foreign detention more than it would domestic return. It would reduce the rule of law to lawlessness and tarnish the very values for which Americans of diverse views and persuasions have always stood."
"We yet cling to the hope that it is not naïve to believe our good brethren in the Executive Branch perceive the rule of law as vital to the American ethos," concludes Wilkinson, who strikes a properly alarmed tone. "This case presents their unique chance to vindicate that value and to summon the best that is within us while there is still time."
It's not clear what the Trump administration will do in response.

Van Hollen had told reporters in San Salvador that denying Abrego Garcia access to his lawyers "is a violation of international law" and that "El Salvador is a party to the international covenant on civil and political rights. El Salvador has signed and ratified that covenant. And that covenant says, and I quote, 'A detained or imprisoned person shall be entitled to communicate and consult with his legal counsel,'" Van Hollen added. It's not clear what will happen to Abrego Garcia from here on out; as for Bukele, expect more gleeful tweeting.

This is especially true since, regardless of how much this X post insists, the Federal Government has already conceded that they deported him mistakenly.
Let's repeat that: Trump's Admin has specifically disagreed with you, and this X poster, and said Garcia should not have been deported.
This is all a cynical ploy by the Trump administration to "encourage" people on asylum status to self-deport. He wants every person here in the US on an Asylum visa to fear being rounded up and "accidentally" sent to a gulag. I do not like the asylum system, and what Biden did was evil to exploit and overload it. All that can be true and it still be wrong for Trump to deny Garcia due process, or refuse to fix their mistake.
An immigration judge heard his asylum claim in 2019 and denied it. He appealed to the BIA which hears appeals of the denials. He again was denied asylum. His asylum claim has been heard by the proper court. His appeal was heard by the proper venue as prescribed by Congress for appeals. This is the due process Congress created. There is no reason to re-adjudicate his asylum claim. It has been heard, ruled, appealed, and ruled. Deportation was to follow.
He had two courts already do so. He could have had a CIS interview letting him know the 18th street gang was gone, but the initial judges order wasn't even based on a law. He just added the condition judicially.
Why then should it not make what was wrong, right?
Oh, if only all three branches of government - judicial included - were held accountable for their mistakes. The courts have made certain that's not how it works. There is no guaranteed redress where government officials are the perpetrators.

It is very shocking. But it is accurate. Just because something is shockingly evil doesn't mean the Judiciary can fix it. Just as some things (like war) can be shockingly evil but the Constitution still allow it.
I'm sorry for the 4th, but they just do not have the power to compel Trump to fix these things- any more than they have the power to compel Obama to bring back to life Anwar al-Awlaki after President Murder Drone had him killed back in 2011.
It is frustrating as fuck, I get it. But there are many other things that can be done. Clearly, the US Government has failed Mr Garcia's civil rights, meaning that a suit can be brought on his behalf, and continuing penalties assessed against the Government so long as Mr Garcia suffers the infringement. Further, the Public gets to decide whether the government (who has admitted they made a mistake here) should face consequences at the election booth. Finally, there could be charges leveled against whomever signed off on skipping this man's due process rights, looking to hold him accountable for this crime.
None of this will get Mr Garcia back, but the civil suit could certainly incentivize it, and further actions could make the government less likely to do so in the future.

He'd had his full due-process and was properly ordered removed, with the caveat of not El Salvador.
Presumably, if he hadn't been sent to El Salvador, there would be no recourse. Crying about "due process" or "sorting them out" deflects from the base reality: even if he is returned to the US, he rightfully will be put on a plane to be deported to a 3rd country 5 seconds later.
That and putting him in the prison anyway.

But what "3rd country"? Most nations have actual (and enforced) immigration rules, so unless the US negotiates entry he can't just show up. IMO, default deportation is indeed back to the person's country of origin.

Now, suppose some people were deported to Israel on October 5, 2023. The government concedes that the deportations were legally erroneous. The courts order the officials to bring the deportees back to the United States.
And some of these deportees were taken hostage by Hamas on October 7, 2023.
An order to make transportation arrangements for those deportees taken hostage, as soon as they are able and willing, would not be controversial.
But can a court order the Administration to send in SEAL Team Six to rescue these deportee-hostages?
Could they order the Administration to invade Gaza?
Could they order the Administration to negotiate with Hamas, let alone accede to any demand Hamas makes?

A few years ago, the World Values Survey, a large-scale international research project, asked more than 73,000 people in 57 countries if they believed democracy was a good way to govern a country – and nearly 92% said yes. But that same survey found that in the past 10 years, around the world, there has been a considerable increase in calls for a strong leader “who does not have to bother with parliament and elections” – and that trust in governments and political parties has reached a historical low. It would appear that people like the idea of democracy but loathe the reality.
Trust in the institutions of democracy is also visibly declining. In the past five years, the European Union’s official research bureau found that less than 30% of Europeans had faith in their national parliaments and governments – some of the lowest figures in years, and an indication that almost three-quarters of people distrust their countries’ most important political institutions.

Although a Constitutional Crisis should be avoided whenever possible, it is no longer possible. God knows that a constitutional crisis is long overdue! Congress abandoned its responsibilities long ago by passing thousands of unconstitutional laws and ceding its authority to the Executive branch. The Judiciary abandoned its credibility long ago through a combination of legislation from the bench and refusing to uphold the original intent of the Constitution. And the Executive branch gleefully stepped into the vacuum by accepting more and more power and abusing it for the implementation of socialism. Now finally Trump is proving that there is no effective opposition to his budding dictatorship. Pretty sad ...

Straw man. No one is saying it's okay to violate the Constitution of the United States of America because someone else did it first. What we ARE saying is that after almost everyone in official office has abandoned the Constitution then there is no credible official standing to oppose this particular most recent violation. In the absence of a credible Constitutional authority, all that is left to support or oppose is whether this particular violation is for a good purpose or for a bad purpose. In my personal opinion, unconstitutionally shutting down unconstitutionally created agencies and departments is a good thing; and unconstitutionally deporting foreigners without due process is a bad thing.
Isn't Sen. Van Hollen's efforts some sort of Logan Act or Hatch Act violation?
Question(s): If SCOTUS can simply order the facilitation of Garcia's return, doesn't that facilitation apply The Government and not just Trump? It doesn't say Trump personally has to go down and get him (and bring him back), right? So, really, anyone from a lowly FBI or CBP Agent up to and including a US Senator can go down there and get him and, if they don't, are "ignoring SCOTUS" every bit as much as Trump is. How is Van Hollen's failure to facilitate not equivalent to Trump's (please say mens rea or good faith)?

KREM 2 is choosing not to name the student because he is not being investigated or charged.
The student claims that Mahoney grabbed his “Take America Back” hat and threw it on the road. The student responded by throwing his food at Mahoney. He says Mahoney and his friend then grabbed him and took him to the ground.
Police contacted Mahoney later that night, and he reportedly admitted to throwing the student’s Trump hat and telling him to “go get it.”
Mahoney told police he thought that would be the end of it, but claims the student “body checked” him and they started to fight. He told officers he had seen the student on campus before and was aware of the student's "right-wing" views.
Police then arrested and cited Mahoney and his friend for 4th-degree assault.
The university confirmed that Mahoney was relieved of his teaching duties indefinitely, but remains a graduate student at WSU. His codefendant was an hourly employee at WSU and the university says he was terminated following the school and police investigations.
The only thing surprising about this is that WSU is smack dab in the middle of what's left of red Washington. Surprised there is only one "right-wing" student and that Mahoney has never had to deal with the reality of MAGA supporters existing just by going into town.
