Plus: The media reacts to the second Trump assassination attempt.

The U.S. Court of Appeals for the District of Columbia Circuit heard TikTok's defense on Monday, as the social media company sought to persuade the three-judge panel that Congress's attempts to ban the platform are a violation of the First Amendment.

It's not clear that the judges were persuaded. Judge Neomi Rao, a Trump appointee, and Judge Douglas Ginsburg, a Reagan appointee, both seemed skeptical of TikTok's argument that Congress lacked the authority to force a sale of the app to a U.S.-based company.

"I know Congress doesn't legislate all the time, but here they did," said Rao. "They actually passed a law. And many of your arguments want us to treat them like they're an agency."

The federal government's initial attempts to ban TikTok took place under the Trump administration. In August of 2020, President Donald Trump issued an executive order that required TikTok's Chinese-owned parent company, ByteDance, to sell the app to a U.S.-based firm. President Joe Biden cancelled that executive order, but instructed his administration to investigate whether concerns about Chinese malfeasance on the platform were justified.

Then, in March of 2024, Congress passed legislation to again force the sale, and Biden signed it. Trump has since changed his tune on TikTok, and now claims—not wrongly—that banning TikTok would reduce competition and enhance Meta's dominance.

But unless TikTok prevails in court, the app will be banned by the end of the year unless it finds a U.S. buyer. Failing that, the iPhone app store will be forced to stop updating, and eventually carrying, the app. That's the real First Amendment question at stake: Can the U.S. government prohibit Americans from creating, viewing, and engaging with the speech on the platform?

"The speech on TikTok is not Chinese speech," said Jeffrey Fisher, an attorney for TikTok, during the Monday hearing. "It is American speech."

U.S. actors who claim that TikTok is a national security threat have generally failed to explain precisely what they mean, though it is of course possible that the Chinese government—a repressive, authoritarian regime—uses its influence over the company to promote propaganda or anti-American speech. That's bad, but censoring propaganda isn't the answer; let people view it, if they wish to.

Sen. Rand Paul (R–Ky.) has called the TikTok ban a "disturbing gift of unprecedented authority to President Biden and the Surveillance State that threatens the very core of American digital innovation and free expression." He's exactly right. The federal government cannot be trusted with the authority to police social media platforms. We already know what federal bureaucrats will do with such power: use it to censor contrarian and provocative speech.

No matter how the Court of Appeals rules, the case is likely to make its way before the Supreme Court.

A second assassination attempt against former President Donald Trump inspired some truly awful takes. Rachel Vindman, wife of Trump impeachment witness Alexander Vindman, wrote on X, "No ears were harmed. Carry on with your Sunday afternoon." She later deleted the comment.

Former Republican Congressman turned anti-Trump CNN commentator Adam Kinzinger seemed to imply that it the assassination attempt was Trump's own fault because he has used violent rhetoric.

Look violent rhetoric is wrong, and has no place.

But MAGA pretending they didn't light this fire is gaslighting to the 100th power. Since Trump showed up our politics has gone to crap.

Trump, for his part, lost no time in blaming the thwarted attack on his own political enemies, Joe Biden and Kamala Harris.

"Their rhetoric is causing me to be shot at, when I am the one who is going to save the country, and they are the ones that are destroying the country—both from the inside and out," Trump told Fox News.

Politicians on both sides of the aisle love to blame violent rhetoric for real-world violence. For years, Democrats wrongly attributed the horrific shooting of former Rep. Gabby Giffords (D–Ariz.) to conservative rhetoric. Now the shoe is on the other foot, and Trump and his supporters have unhesitatingly embrace an argument they correctly found ridiculous several news cycles ago.

When deranged lunatics do violent things, lay the blame on those who are actually responsible(the deranged lunatics)—not other people's speech.

Two of the worst headlines responding to the assassination attempt came from The Cincinnati Enquirer and TIME magazine. An opinion piece in The Enquirer held that "There is no place in politics for violence. That said, the former president, Donald Trump, brings a lot of this stuff on himself."

Meanwhile, TIME wrote that the alleged shooter—Ryan Wesley Routh—had an "unclear political ideology." This could not be further from the truth. Routh was outspoken on social media, was interviewed by the mainstream media—including The New York Times and Semafor—and self-published a book. He is very clearly a one-time Republican who now hates Trump, is fanatically pro-Ukraine and anti-Russia, and vigorously supports Biden and Harris. That doesn't mean Democratic anti-Trump rhetoric is to blame for the shooting, but no one should pretend that his ideology is some giant mystery. It's not.

    That's not entirely clear, either. What he has said is that he voted for Trump in 2016 because he didn't like Hillary. He originally was supporting Bernie Sanders in the Democratic primary that year.

              I know this is hard to believe, but Joe Biden is still president. There is no precedent for a president dying between the election and the inauguration—not sure what would happen then. Of course, there is virtually no chance of Trump winning the election, regardless of how people vote.

                  And the new Congress is inaugurated on Jan. 3. So if there are shenanigans again in this election, and the "counted votes" put the Dems as the winner of the House, that Dem majority on Jan 6 (inaugurated three days earlier) would decide who becomes president if no candidate gets a majority (270) of the electoral college votes or the one who won is no longer alive. However, the House would vote by state delegation, so each state represented in the House would have one vote, and it would need to be a majority (26 states) to select the president. If a state has an even number of seats in the House, say 12, but evenly split between Rs and Ds, I don't know how that tie would be broken to decide how that state would vote in this situation.

                  I've heard that the Republicans would likely still control the majority of states, even if the Dems have a slim majority of overall members of the House, but I'm not sure, and don't know how to look it up without devoting serious time that I don't have. I'm guessing it would be true, though, since states like Wyoming, which has one US Representative, would count as one vote, the same as CA that has dozens of Representatives.

                  No, all Congress can do then is certify the result of the electoral college vote. As far as I know, there is no statutory process for what happens if the winning candidates have died.

                A little pedantic here, but, regarding Trump, before the inauguration, he would be the President-Elect not the President.

                Hmm? What happens in the case of a death between the election and inauguration is specified.

                First, we have the 20th Amendment, Section 3:

                "If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified."

                Then we have 3 U.S. Code § 19(a)(1):

                "If, by reason of death, resignation, removal from office, inability, or failure to qualify, there is neither a President nor Vice President to discharge the powers and duties of the office of President, then the Speaker of the House of Representatives shall, upon his resignation as Speaker and as Representative in Congress, act as President."

                Between them, we see that since both the President elect and Vice President elect are dead (and thus the Vice President elect doesn't qualify), the Speaker of the House resigns and acts as President.

                This is actually more solid than the succession due to simultaneous death in office because the 20th Amendment says "person", while Article II, Section 1, Clause 6, says "Officer", and while it is disputed by some lawyers whether the Speaker of the House is an "Officer" within the meaning of the Constitution, he's definitely a "person".

                    Most military members have at least in the past come from red states. In the case of aa civil war I would expect a 25-50% desertion rate making the military ineffective. Furthermore most military bases are in red states so I would not be surprised if those bases immediately surrendered to all of the state militaries. And finally most of the food comes from red states. Within a couple weeks I would expect food riots in the blue cities. CW2 would be over quicker than most might believe.

      Sometimes the hypocrisy of the machine amazes me, although it shouldn't, because hypocrisy is the point. Its a tool purposefully deployed for several reasons.

      On of which is it's a display of power for disheartening opponents. We can lie about you, call you a threat to humanity and foment violence against you, and then when you're harmed by our rhetoric, we can flip it around and say it's your fault for fomenting violence and you're getting your comeuppance.
      And the corporate press will 100% relay our narrative and you will sit there intimidated and flabbergasted.

          You can have whatever academic discussion you wish, but if I have to reserve my ire for groups doing bad things, labeling the group that parades around with Trump flags and trolls the left with "white supremacy" symbols that arent actually meaningful other than they know it pissed them off, while there are groups that commonly vandalize, loot, burn, and murder...it seems a bit silly to refer to the Proud Boys as "extreme" in that sense. Seriously, what have they done thats politically extreme? Can you name some examples?

          This is in the context of left wing radicals literally burning down cities. Just so we are clear

      I was told for years that Trump and team red's words were leading to violence, and now im holding the people who specifically said that accountable for the standard they set, as there has only been one side committing violence and one side getting shot at.

      Does that clear things up for you?

          That’s the left’s standard. I am happy to hold them to their own standard, and if they choose to actually live by it, ill consider changing my own, but for now, they can be judged by the rule set they put in place.

            Ya know, you could actually hold all sides to the same absolute standard. That would indicate a level of intellectual integrity. It's not as much fun, because then you can't run around and call people hypocrites as much. But it would be more consistent.

    I disagree with Judge Rao. Congress is not being treated like an agency by a judicial denial of its power to amend the 1st Amendment.

    In the absence of a clear, and temporary, emergency, Congress has no power to deny the free speech rights of Tik Tok users or to rescind their freedom of association.

    Congress is not the Supreme Court, which is the only branch of government with exclusive power to make the final determination regarding the Constitution’s meaning (as clearly constrained by rules of standing and the existence of a case or controversy).

    Funny. I don't see anywhere in the US Constitution where the 1st Amendment is required to be upheld for China.

    That said; With the latest massive attacks on 1st Amendment by the Biden Administration and lack of excuse validation; I'm more persuaded it might have everything to do with a US Government-ran media monopoly than it has to do with China at all.
