'Transparency' Mandate Would Burden Small Brewers and Distilleries
Government pre-approval for every label could crush craft breweries. And do you really want to force the Carthusian monks who make Green Chartreuse to reveal their ingredients?

The Alcohol and Tobacco Tax and Trade Bureau (TTB) is considering new rules for alcohol labeling, including a mandate to display nutritional information and ingredients on booze bottles and cans. Some people are heralding this as a common-sense transparency reform. In fact, it's another combat theater in the government's war against alcohol.
In 2022, the TTB issued its "Competition in Markets for Beer, Wine, and Spirits" report, which recommended that the agency consider a new mandate to print nutritional information, ingredients, and food allergens on alcohol product labels. (Alcohol is not currently subject to nutritional and ingredient labeling mandates, since it falls within the ambit of the TTB rather than the Food and Drug Administration.) To judge from recent listening sessions hosted by the TTB (and some rumblings in the industry), the agency appears to be leaning toward taking the report's advice.
Groups like the Center for Science in the Public Interest and the Consumer Federation of America have been petitioning for mandatory labeling for more than two decades. After the 2022 report, these organizations sued the TTB to force it to move, citing a "nearly nineteen-year delay in responding to a 2003 petition." (Maybe bureaucratic inertia isn't always a bad thing?)
These two groups portray their goal as a simple and unobjectionable pursuit of "enhanced transparency," a "commonsense step" that can not only help "address the health and safety concerns related to the consumption of alcohol" but also "allow consumers to make informed choices about the alcoholic products they purchase."
It's hard to oppose "transparency," "common sense," and "informed choices." But labeling mandates always fall heaviest on the smallest of businesses.
The concept of nutritional and ingredient labeling is even more complex in the alcohol space since the TTB uses a pre-approval system for alcohol labeling, meaning that alcohol producers have to submit their proposed labels to the agency for approval before the product ever hits the market. No approval, no market access. This is in marked contrast to most food labeling, which the Food and Drug Administration enforces after a product goes to market.
Not only are most craft breweries, distilleries, and wineries small, local businesses, but much of their appeal is the ever-changing array of products that they offer. Some of the most cutting-edge and popular microbreweries in America release multiple new beers per week or month alongside seasonal releases that vary in availability depending on the time of year.
Breweries often release annual products, such as Christmas Ales, that use the same base set of spices but may have some small variations and tweaks from year to year. If these mandates are in place, a brewery could face the prospect of having to get new labels preapproved every single year, a time and cost burden that few small breweries could absorb.
In the distilling process, products that go in at the front end are sometimes stripped out during the distillation. Do these products need to go on the ingredients label? If so, at what trace level is an ingredient deemed significant enough to be included? (Even outside the alcohol context, nutritional labels rely on arbitrary delineations and assumptions). Would the government accept labels featuring QR codes, so producers can make changes without triggering the pre-approval process for a whole new label?
And what should regulators do with specialty spirits like the legendary Green Chartreuse? Green Chartreuse, which is made by a group of Carthusian monks in the alps, has 130 different herbs and plants in it—and, famously, only two of the monks know the full proprietary recipe. Do these two brothers have to cough up a full ingredients list?
It is very easy for seemingly "commonsense" transparency reform to give way to more alarmist and intense health warnings on booze and, eventually, more draconian restrictions on alcohol sales and higher booze taxes.
Meanwhile, much of the alcohol industry is already adopting voluntary labeling practices, with most of the larger companies—who can afford it—including such information anyway.
Consumers who are concerned about the amount of sugar in their hard seltzer or the exact ingredients in their beer can find plenty of options on the shelf that contain such information. Consumers who don't care should be free to buy what they want.

What's really wrong with food labels and all other certification from the practical point of view, for those who don't care about the principles, is how useless they are.
* Any company which sold intentionally shoddily-designed products, which is all the certifications can "prevent", is that labels and certifications don't shift the accountability to the government. The company would be sued into oblivion whether certified or labeled or not.
* The labels and certifications can only test products as designed, not as actually manufactured, unless they require pulling random units off the production line for testing. Far as I know, only company QA departments do that; no governments require it, except for some procurement for government use, such as ammunition.

The FDA came into being because ‘patent medicine’ companies were committing outright fraud re the term ‘patent’ and were putting things like arsenic into their snake oil. Those companies could not be sued because – it wasn’t illegal merely to put arsenic into a concoction. It wasn’t illegal to sell that without a label. It wasn’t illegal to lie about the products claims. Hell it wasn’t illegal to drink such a concoction. For those who died – they drank the evidence and their heirs thus had no basis on which to claim wrongdoing. Even if they did have the evidence – that sort of poisoning is damn near impossible to prove in a court system which is designed to move those proceedings towards a trial based on murder and malice (no motive, means may not be in evidence, no evidence even of opportunity absent a video showing the product being drunk) – not negligence or such. So the FDA made those actions a crime against govt itself which did have the standing and the power to go up against those companies without the risk of dying and losing all the power to resist that.
There may have been ways for the FDA to find ways to create these laws with an enforcement mechanism that doesn’t involve regulators but instead involves competing claims in court. But that is extremely difficult – and it is precisely your ilk who doesn’t even want that done.

It was about hugely reducing the probability - by about 85-95% - of a serious case that might involve death or hospitalization or such. For most people, the thought of one's own demise was sufficient to make a decision based on the risk of that. For 'the community', it is the cost of hospitalization that transfer costs to others - and also changes the odds of death IF admitted and treated in hospital. That latter was the element of a decision that was never included in anything (and esp not in anyone under maybe 65 or so) and that my proposal did attempt to include.

Requiring explicit pre-approval does sound like a problem, giving the government a means to obstruct things that they don't like despite said things not actually being illegal.

I presume their regulated status entitled Macquarie to earn a fixed profit margin on all gas supplied via the pipeline, so by paying more for the product, their profits also increased.
But these are just allegations in a lawsuit, so who knows if any of it makes sense.
But limiting gas supply and arbitrarily raising prices is a good thing. Biden (remember him?) told me so.
But he was senile (at least since he decided not to run for office again). Why is he still in office? 25th amendment, where are you?
If I’m understanding that correctly, the AG thinks that Macquarie overpaid for natgas just so they could overcharge the end consumers? A stupid take to be sure, but not price controls (yet at least).

Pre clearance of labels has not hurt the pharmaceutical industry.
They discovered that if they list a large number of side effects, people will mentally discount the perceived probability of the most dangerous ones.

hear, hear. there are numerous breweries, cideries, and distilleries in VA, but there is still less consumer choice than there could be. many refuse to enter the market in the Commonwealth because they already have a similarly excessive labeling law. I have to go out of state to get certain products that I like, simple because we have an horrific overbearing bureaucracy running the show here. don't let it happen nationally.

So I know few people will read this, having to scroll through tons of Jesse and Sarc bickering... But anyway...
I operate a Nano-winery, batches basically as small as you can get. The TTB is already a giant pain in my ass, and my least favorite part of the job is dealing with them and label approvals. If they were to require ingredients and calorie information... I can handle the first but it would probably more than double my labeling costs. The second, I'm not even sure how to go about calculating it accurately without some prohibitively expensive equipment.
Even ingredients are tough though. Am I supposed to say "yeast" even though really not much yeast ends up in the finished wine? Or am I supposed to say Lalvin RC-212? .
This just looks like regulatory capture. Little guys like me struggle enough with the TTB. Big Corporate operations can handle this easily. I cannot.
As a follow up, did some research on the calorie and nutritional information testing. The costs would put me out of business.
I wouldathunk you could outsource that to a lab that specializes in that sort of thing. Is that what you found? And I'm sure the government will help you with labeling requirements. There must be published rules and you can no doubt call a helpful bureaucrat to walk you through it. Just like the IRS helps taxpayers.
I presume this is tongue in cheek, but that is what I actually checked. Looks to be around $800 per batch to outsource it to a lab. Which might explain who is pushing for this sort of mandate. That's not a lot for an operation that's much larger than mine, but it's prohibitive on the majority of what I do, which is less than 10 cases.
This is why we can't have nice things.
