New Jersey Wants Your Baby's Genes
Collecting and analyzing newborns' blood could allow the state to surveil people for life.

Mandatory genomic sequencing of all newborns—it sounds like something out of a dystopian sci-fi story. But it could become a reality in New Jersey, where health officials are considering adding this analysis to the state's mandatory newborn testing regime.
Genomic sequencing can determine a person's "entire genetic makeup," the National Cancer Institute website explains. Using genomic sequencing, doctors can diagnose diseases and abnormalities, reveal sensitivities to environmental stimulants, and assess a person's risk of developing conditions such as Alzheimer's disease.
Ernest Post, chairman of the New Jersey Newborn Screening Advisory Review Committee (NSARC), discussed newborn genomic sequencing at an NSARC meeting in May. An NSARC subcommittee has been convened to explore the issue and is expected to issue recommendations later this year. It's considering questions such as whether sequencing would be optional or mandatory, the New Jersey Monitor reported.
Such schemes have attracted criticism from civil liberties groups such as the American Civil Liberties Union (ACLU) and the Institute for Justice (I.J.). "What we're talking about is information from kids that could allow the state and other actors to use that data to monitor and surveil them and their families for the rest of their lives," Dillon Reisman, an attorney with the ACLU of New Jersey, told the Monitor.
Perhaps this wouldn't be as worrying if New Jersey had strong safeguards on what could be done with the genetic material it already collects. But the state's practices, as is, raise ample cause for concern—and legal action. I.J. is currently representing a group of New Jersey parents in a class-action lawsuit concerning the state's newborn testing practices.
Like every other state, New Jersey requires hospitals to collect blood from newborn babies and turn it over to state health authorities, who use it to screen for various diseases. And like many states, New Jersey is less than transparent about this process. Parents are simply told that the testing is mandatory. They are not told that they can object on religious grounds. They are not told what the state does with newborn blood samples after health screenings are completed.
In fact, the state holds on to these blood samples for 23 years, putting no legal restrictions on how they can be used.
In at least one instance, a newborn blood sample was used to tie the baby's father to a crime, according to the New Jersey Office of the Public Defender. Some states were found to be selling the blood samples to researchers, or turning blood over to the Pentagon's DNA registry.
Now, New Jersey parents are seeking a court order requiring the state to return or destroy the blood samples taken from newborns, or to get informed consent from parents to hold on to it. "The government cannot take your newborn's blood to test for diseases, and then secretly keep it for 23 years and use it for other purposes, without your consent," declared I.J., summing up its case, Lovaglio and Jedynak v. Baston and Scotto-Rosato, in an Instagram post.
The I.J. lawsuit serves as an important reminder that even absent a genomic sequencing mandate for newborns, states still collect sensitive bioinformation on residents starting at birth, and there are often few limits on how they can use it and no real safeguards on privacy. Taking advantage of the fact that new parents are too preoccupied to pay close attention to exactly what tests are being conducted and where the results will go, authorities are able to obtain and hold on to genetic material that parents might otherwise object to them having. Even when parents have the right to opt out, or to have the blood samples destroyed after testing, many aren't aware they have those options.
As genomic sequencing becomes cheaper and more common, it's all but a given that more states will begin adding the process to newborn testing regimes. It's imperative that we work out safeguards before these programs are implemented.

I mean, go modern medicine. That is incredible if true. (To say nothing of the fact that it would make the health/life insurance industry obsolete.)
But, just like bringing dinosaurs back, the question "should we" takes a backseat to "can we." I don't know. This is a good one. Does the marvel of modern medicine and its ability to predict/prevent health problems outweigh the nefarious things the State might also do with that data? I mean, I don't have a problem with: a newborn blood sample was used to tie the baby's father to a crime. But I am a little less keen on: the Pentagon's DNA registry.
This is why Gattaca is one of the best movies ever, incidentally. It really tackles the subject head on. If you haven't watched it, find time this weekend.
If it's such a good idea, then you'd think parents would be signing up for the testing voluntarily and a government mandate would be unnecessary. The fact is that it's not.
Why is somewhat complicated. There are several factors at play including:
- Why diagnose if you're not going to do anything about it? For a personal example, we started our family very late. We knew we were at risk of Down's Syndrome. We intentionally did not test for it because there was no scenario in which the tests would change our decisions.For genetic disorders in particular, why test after the baby is born? Regardless of your position on abortion, post-natal testing is too late.
- Why pretend to diagnose when the diagnosis is at best questionable? Allergies and other "environmental sensitivities" remain very poorly understood. Attempts to claim a genetic predisposition are barely into the realm of speculation and decades away from reliability.
- Why test when the stigma will likely be worse than the disease? That was my take-away from Gattaca.
- And as you say, why create temptation for Big Brother to do all sorts of unauthorized things with that data?
"Just because we can" doesn't mean "we should" but "if parents aren't already doing it voluntarily", that's a really good sign that government's alleged public health arguments are a pretext.

If it really is the medical marvel it's being touted as, we should be making great strides with what can be done with that data. Obviously, as it stands now, we're not.
And we should look at the motivation for the technology. Is it to predict/prevent disease, or is it for a DNA registry? Right now, it obviously seems the latter. BUT, if we've perfected it as much as its sellers are suggesting, a cost/benefit analysis might be in order.
Why test when the stigma will likely be worse than the disease? That was my take-away from Gattaca.

Abortion is NOT the only option for some genetic disorders. There are treatments. E.g., for the mutation that causes hemophilia, the missing blood-clotting agents can be administered. But first the doctors have to know that the person has this condition, and it's better if the doctor knows at birth than to figure it out once the symptoms become severe and persistent.
Is the possibility of detecting and beginning treatment earlier for a rather rare condition worth the possible mis-use of other things revealed by DNA collection? Not in my opinion, given the grossly untrustworthy nature of our and every other government.
Individual genetic sequencing wouldn't make health/life insurance obsolete, it would make it unaffordable for those who are at high risk.

And then the info would come in handy when the death panels start prioritizing who has to go first. And it always comes down to death panels.

Those who were completely healthy would have no reason to purchase it, those who were guaranteed to be sick would be 100% uninsurable.
The only possible reason for marketing it would be random accidents. And to determine premiums, insurers would have to dig into the lifestyle choices of their risk pools (eg. eating habits, drug use, adventuring, exercise frequency, etc.) Which they can't really do even now but for voluntary disclosure.
For the young, random accidents are already the number one reason to purchase health insurance. I can say with good confidence that I won't have a heart attack or diabetes within the next year.
I can't say I won't get hit by a car, or that a more happy accident won't happen which leads to a lot of medical bills for another kid.
Genetic predisposition is hugely overblown for many things. It's one factor our of many, and likely not the biggest by a mile.

For most of human history, most homosexuals married and had children just like everyone else because societal rules demanded it. Today, they make babies using sperm donors and surrogates. If there is in fact a genetic component to sexual orientation, and there is evidence that that there is, those genes are still being passed on.
