Biden's Litany of Excuses
Plus: Illegal beach booze-selling, California's "tax apocalypse," and more...

Not making excuses! Yesterday, President Joe Biden continued his attempts to save face following a terrible debate performance that led many members of his own party to wonder aloud whether the presidential ticket ought to be swapped out.
Biden said he "fell asleep on the stage" because he'd gone "around the world a couple of times" in the two weeks preceding the debate. "I wasn't very smart," he said at a fundraiser in McLean, Virginia. "I decided to travel around the world a couple times, I don't know how many time zones."
Biden assured donors that this was "not an excuse but an explanation." Meanwhile, his press secretary kept repeating the line that actually, his poor performance is attributable to the fact that he was sick with a cold.
They should probably get their story straight. But also, though Biden had been in Italy, France, and Los Angeles in early and mid-June, he returned to Washington, D.C., on June 16—11 days before the debate—where he worked on debate prep for a whole week prior to the showdown.
It is implausible that Biden's jet lag lasted a full 11 days. And, if he is so worn out by that type and frequency of travel, he's probably ill-suited for another term in the White House, as this type of thing will be expected of him.
Biden in obvious decline: It surely comes as no shock to voters that the 81-year-old is not as cognitively sharp as he was four years ago. The White House physician, back in February, reassured the public that the president has no major health issues and that there were "no findings which would be consistent with" Parkinson's disease.
Not to belabor the obvious, but things decline quickly in old age. Just because a physician made that assessment back in February doesn't mean it holds true in July; besides, the White House has not made the physician available to reporters and has been quite tight-lipped about Biden's health status.
Now, the mainstream media omertà about Biden's decline is finally being broken. "People who have spent time with President Biden over the last few months or so said the lapses appear to have grown more frequent, more pronounced and, after Thursday's debate, more worrisome," reports The New York Times, on the heels of a Politico report about Biden's ultra-protective advisers who seem to be shielding Biden from the press.

Democrats' path forward: "Looking at polls beyond the straight horse-race numbers between Mr. Biden and Donald Trump—ones that include Democratic Senate candidate races in close swing-state races—suggests something even more troubling about Mr. Biden's chances, but also offers a glimpse of hope for Democrats," argues Nate Silver in The New York Times. "There is a silver lining for Democrats to be found in these surveys. Voters in these polls like Democratic candidates for Congress just fine. More than fine, actually: It's Mr. Biden who is the problem."
Silver goes on to describe that there are five presidential swing states this year that also have competitive Senate races: Arizona, Michigan, Nevada, Pennsylvania, and Wisconsin. Of the 47 nonpartisan surveys conducted since March of likely voters, 46 show the Democratic candidate for Senate polling better than Biden.
Silver concludes from this that the party ought to "hold an open audition for the nomination process"—possibly allowing Pennsylvania Gov. Josh Shapiro or Michigan Gov. Gretchen Whitmer a shot—in which new candidates could declare their intentions to run, give speeches, hold rallies, even debate each other. "Delegates could take this information into account at the Democratic National Convention in Chicago and make a more informed decision," argues Silver. Of course, "this plan would require Mr. Biden to declare his intention to exit the race sooner rather than later"—hardly a sure thing, as that requires putting ego aside in service of his party.
There's a tension between the standard Democratic line that "democracy is on the ballot" and Biden's discomfort with stepping aside so that a better candidate can emerge who can actually beat Trump. If democracy actually is on the ballot, then surely such personal sacrifice is worth it. If Biden can't stomach the thought of stepping aside, then it shows you just how little he meant it in the first place.

It always amuses me the tone of these articles. Here we have a sympathetic tone with what democrats should do to save face. But when the GOP House was going through the speaker changes it was all laugh at these crazies.
The fact is the DNC is so party led that instead of having open calls for nominations they did everything they could to hide the decline and protect their party leadership. This isn't a mistake. They are party apparatus over all else. It was only when polling turned drastic did these conversations start.

Compare to the way Trump treated Hillary: she was obviously guilty of thousands of felonies from destroying evidence to embezzling earthquake relief funds, and he could have landed her crooked ass in Fort Leavenworth for the rest of her miserable, sniveling life if he chose to, but simply leaving her to seethe over her failure dissipated her influence.
The Democrats will lose unless they pull out all the stops on cooking the books, but they'll be under far closer scrutiny than ever before. Their hatred for Trump will be the #2 factor in their defeat, right behind the public getting fed up with inflation.

Or create and declare a national emergency that they can use to delay the election, or at least justify voting rules that make wholesale cheating easier (again).

Of the 33 regularly scheduled elections in 2024, 10 seats are held by Republicans, 19 seats are held by Democrats and four seats are held by independents who caucus with Democrats.

You are right that the statistical evidence shows that the economy is doing quite well, except for one important statistic: inflation.
And I would argue that inflation matters more than the DJIA average because people see inflation every day in their daily lives.
It takes a great deal of time for people to adjust to what items are “supposed” to cost. And a lot of people haven’t adjusted to that. So when they go shopping they think they are being ripped off because the prices are “too high”. And who do they blame for that? The guy in charge. Fairly or not, the guy in charge gets both the credit and the blame for the economy even though the guy in charge doesn’t have all that much control over the economy.
And just to be clear, Biden absolutely deserves some blame for inflation. He pushed several huge spending bills that exacerbated the inflationary problem in the economy. Immunity is necessary, because we need more than the assurances that prosecutors will not pursue political, ideological, or baseless prosecutions. One example would be a prosecutor who happens to be a radical capital punishment abolitionist, arguing that seeking the death penalty in federal court constitutes attempted murder, and charging a federal prosecutor for attempted murder on this basis. With Trump such a prosecution should not even reach the arraignment stage.
The big problem, is that there is no clear and objective test to determine whether an act is an "official" act entitled to immunity (presumed or otherwise), or an "unofficial" act.
It would not be as big of a deal if we were back in the 1790s and the presidential powers were only a few small items. But presidential powers have grown so large, encompassing vague and arbitrary acts, that it is difficult to tell where the official act ends and where the unofficial act begins.
Take the WoT AUMF for example. It gives the president a huge amount of power to prosecute the "war on terror", and it is not precise in defining what that entails. It is difficult to think of a plausible but questionable action that a president could take, that he and his supporters won't try to rationalize and defend as being pursuant to the president's CinC powers prosecuting the WoT pursuant to the AUMF. Furthermore the president has the power to execute the laws, and quite a few of the laws are vague. So again the president can easily rationalize all sorts of questionable actions based on his constitutional power to "enforce the law".
So this decision would make sense if we were in the 1790s. In the modern era it is really questionable. I think if we are going to go this route, it behooves Congress to reform a lot of its laws and not give the president so much discretionary power. But since Congress is so dysfunctional nowadays that seems unlikely to happen.
I will quote the Court's reasoning, which I agree with.
Despite the unprecedented nature of this case, and the very significant constitutional questions that it raises, the lower courts rendered their decisions on a highly expedited basis. Because those courts categorically rejected any form of Presidential immunity, they did not analyze the conduct alleged in the indictment to decide which of it should be categorized as official and which unofficial. Neither party has briefed that issue before us (though they discussed it at oral argument in response to questions). And like the underlying immunity question, that categorization raises multiple unprecedented and momentous questions about the powers of the President and the limits of his authority under the Constitution. Personally, I believe that the Harlow v. Fitzgerald, 457 U.S. 800 (1982) test should be used, in which immunity applies unless the alleged conduct violates "clearly established" law Harlow457 U.S> at 818. The lower courts did not decide what kind of test to use, and it was proper for SCOTUS to vacate and remand so the lower courts will have a chance to decide what test is appropriate, including the Harlow test.

Strong likelihood the Cabinet members and Harris are having a lot of those embarrassing conversations where each one tries to get the other to say something first without committing themselves.
If seven of them come out in favor of pulling the trigger, and then the remaining eight vote against, the consequences are immediate: those seven are fired and their careers in the Democratic party are over. Biden would drop Harris as his VP nominee, for the remaining six months of her term she’d be uninvited from all meetings and anything else besides sitting as purely nominal presiding officer of the Senate.
They also need to feel out both Democrats and Republicans in Congress on how they’d vote. Don’t assume that Republicans in Congress would vote to remove. Consider this: Back in 1968, the Democrats controlled both houses of Congress, and LBJ was president. In the November election, Nixon took the presidency, while the Democrats retained both houses of Congress (but not by 2/3 that could override vetos). During the two month lame duck period, what criminal laws could the Democrats and LBJ pass to try and restrain the new president? Some hypotheticals, from more clear cut to less clear cut.
A: A law that makes it a felony to veto any law passed by both houses of Congress.
B: A law that makes it a felony to issue a pardon to a person convicted of a crime.
C: A law that makes it a felony to pardon any person for reasons other than evidence of innocence.
D: A law that makes it a felony to pardon any person for reasons that are improper or corrupt.
E: A law that makes it a felony to pardon any person in exchange for a cash bribe.
IMO, it would be an outrage for a court to NOT give the president absolute immunity from laws A and B, and they should grant it in C since it's improper intrusion into separation of powers.
D is still problematic, since words like "improper" can themselves be spun improperly by a prosecutor.
