Justice Department Sues Oklahoma Over Law That Would Imprison Undocumented Immigrants
State law enforcement groups have warned that H.B. 4156 “conflicts with many existing directives” and could “destroy” their relationships with immigrant communities.

In April, Oklahoma Republican Gov. Kevin Stitt signed House Bill 4156, an immigration crackdown law that criminalizes "impermissible occupation" in the state. Any immigrant who "enters and remains" in Oklahoma "without having first obtained legal authorization to enter the United States" could face jail time and be forced to leave the state.
The U.S. Department of Justice (DOJ) filed a lawsuit against Oklahoma yesterday, arguing that H.B. 4156 "is preempted by federal law" and "violates the U.S. Constitution." The lawsuit is the latest entry in the ongoing battle between the federal government and the growing list of states passing their own immigration laws.
Under H.B. 4156, a noncitizen convicted of being in Oklahoma without legal authorization to be in the U.S. will be guilty of a misdemeanor that carries a punishment of up to a year in county jail. A subsequent offense is a felony and carries a punishment of up to two years in Department of Corrections custody. The unlawfully present person must also leave the state within 72 hours of conviction or release from custody, whichever comes later.
"We have brought this action to ensure that Oklahoma adheres to the Constitution and the framework adopted by Congress for regulation of immigration," said Principal Deputy Assistant Attorney General Brian M. Boynton, head of the DOJ's Civil Division. Oklahoma Attorney General Gentner Drummond has vowed to defend H.B. 4156, arguing in a May 17 letter that Oklahoma has "not only the sovereign right, but also the solemn legal obligation, to protect its own borders and its own citizens."
Several other states are facing similar legal action over their immigration laws, which have prompted a debate over whether the federal government has the sole authority to regulate immigration. Challenges to those laws are ongoing; one of the most controversial state-level policies, a Texas law that allows officers to arrest and deport undocumented immigrants, is currently on hold following "a dizzying volley of courtroom maneuvers," as the Associated Press put it.
Lawmakers framed H.B. 4156 as an effort to "protect the citizens of Oklahoma" and combat organized crime, drug cartels, and sex trafficking. Others aren't so sure that these will be the primary targets. "This bill would affect people who have been here for decades and contributed millions in tax dollars without ever having a criminal offense," explained Catholic Charities of the Archdiocese of Oklahoma City. The Migration Policy Institute estimated that 90,000 undocumented people lived in Oklahoma as of 2019. Of those, about 80 percent had lived in the state for five years or more.
Some have warned that the bill will make policing more difficult and reduce community trust. Oklahoma City Police Chief Wade Gourley told KOCO, the local ABC affiliate, that "it's almost like everybody we come in contact with, we have to check their immigration status," given the bill's phrasing. "We have found that this law conflicts with many existing directives governing law enforcement practices throughout Oklahoma," the Oklahoma Association of Chiefs of Police and Metro Law Enforcement Agency leaders said in a joint statement. It "places crime victims at risk by increasing the fear of reporting to law enforcement" and "brings forth legal challenges in fair and impartial policing."
"This law has the potential to destroy the connections and relationships we have built within our local immigrant communities and set us back for many years to come," the statement continued. H.B. 4156 is slated to take effect on July 1.

I'm willing to hand out work visas like candy. But ONLY to people who have not already demonstrated a willingness to break the law, and multiple laws, repeatedly. If you've been illegally present in the US at anytime in the last, say, 5 years you cannot obtain said easy-to-get work visa. Holders of that work visa should be subject to some stipulations in order to maintain their presence. Background checks. Any felony and certain misdemeanor convictions will result in summary deportation. Any attempt to access federal welfare programs would be a felony (fraud). The visas would be for a certain fixed period, say 5 years or 7 years. Overstaying your visa would be a felony; if you had applied for citizenship during the period, you can wait for that process to complete outside the US. Having children while present under the visa will not serve as any sort of anchor for the parent (preferably, a Constitutional amendment would get passed to change birthright citizenship from jus soli to jus sanguinis).

It is certainly true that many of the illegal aliens have been in this country for some time, working hard and trying to be a respectable part of the community. But the fact remains that they are constantly violating any number of laws. If I violated the same laws, I'd be fined thousands of dollars and put into prison for several years.
First they knowingly and with forethought violate any of several immigration laws when they enter this country: they come without visas, they do not come through a legal port-of-entry, they bypass customs, they are not registered and fingerprinted as required by Title 8 of Code of Federal Regulations (8 CFR). That is, there is little or no presumption of lawful admission as required by 8 CFR.
Once they are here, they are likely to continue to violate other laws. Fraudulent papers are often used to obtain work. This may include Social Security numbers and related documentation, falsified work visas, and so on. In this case, it seems that Title 18 Section 1028 "Fraud and related activity in connection with identification documents, authentication features, and information" should come into play.
If they bypass the fraudulent paperwork and simply work for cash "under-the-table" they are certainly involved in some level of tax evasion. In this country, even people who earn income by illegal means are required by the Internal Revenue Code to report this income when filing annual tax returns. But they usually don't claim this income, let alone file the required return, because doing so would serve as an admission of guilt. They are also more likely to be working at less than the minimum wage, facilitating their employer's choice to bypass Title 29 Section 206 "Minimum wage" as well as requirements to withhold and pay their portions of the FICA and Medicare payroll taxes [conspiracy to commit, on both the illegal immigrant and the employer; perhaps RICO could even be applied to the employers].
An aside here: often the claim is made that "They do jobs Americans won't do" when the reality is "They do jobs that Americans won't do at those wages." Thousands of employers are also violating our laws, notably Title 8 Section 1324a "Unlawful employment of aliens", by hiring illegal aliens and by paying them under-the-table to avoid our laws about minimum wage, overtime, workers' compensation, unemployment compensation, family leave, Americans with disabilities and so on. These employers must also be stopped and prosecuted.
When illegal aliens drive a car, they are doing so without a valid license and probably without insurance (a requirement in most states). It is not uncommon for many unrelated illegal aliens to share a single house or apartment, in violation of local codes.
The list of violations could go on and on.
Alien Smuggling -- Subsection 1324(a)(1)(A)(i) makes it an offense for any person who -- knowing that a person is an alien, to bring to or attempts to bring to the United States in any manner whatsoever such person at a place other than a designated port of entry or place other than as designated by the Commissioner, regardless of whether such alien has received prior official authorization to come to, enter, or reside in the United States and regardless of any future official action which may be taken with respect to such alien.
Domestic Transporting -- Subsection 1324(a)(1)(A)(ii) makes it an offense for any person who -- knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, transports, or moves or attempts to transport or move such alien within the United States by means of transportation or otherwise, in furtherance of such violation of law.
Harboring -- Subsection 1324(a)(1)(A)(iii) makes it an offense for any person who -- knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation.
Encouraging/Inducing -- Subsection 1324(a)(1)(A)(iv) makes it an offense for any person who -- encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law.
Conspiracy/Aiding or Abetting -- Subsection 1324(a)(1)(A)(v) expressly makes it an offense to engage in a conspiracy to commit or aid or abet the commission of the foregoing offenses.
Even if paid the same wage they get exempted from requirements such as ACA making them cheaper from a regulatory cost than citizens while still using medical resources cost shifting uncompensated costs to taxpayers and those woth private plans. Ever heard of the H-1B visa? Employers who take foreigners on those visas must hire any American who applies for the job. By law. Also they get paid a prevailing wage set by the federal government, not minimum.
Why not expand that program? I'll bet you that many who come here illegally for work applied for that program but didn't get one because the number of visas is capped.

I bet you’re wrong, for most reasonable values of “many”. Perhaps many individuals, but a tiny fraction of the inflow. Besides, being turned down for a visa is not justification for ignoring the law and doing what you want. If someone fails their CCW permit application, just going ahead and carrying anyway is not the logical answer and is not supposed to be allowed and excused. If you fail your driver’s test, just going ahead and driving as if you had one is not supposed to be permitted and excused.
