The Myth of the Migrant Crime Wave
The "data that exist for this year show consistent declines in major crimes in major cities."

"The United States is being overrun by the Biden migrant crime. It's a new form of vicious violation to our country," said former President Donald Trump during a visit to the U.S.-Mexico border in Eagle Pass, Texas, on Thursday.
Trump's remarks come at a tense moment in the nation's sentiment toward immigration. Americans now say that immigration is "the most important problem facing the U.S.," according to the results of a Gallup poll published this week. Earlier in February, 57 percent of Americans surveyed by the Pew Research Center said that "the large number of migrants seeking to enter the country leads to more crime." For many, those ideas became more salient last week, when Jose Antonio Ibarra, a Venezuelan man who immigrated to the U.S. illegally, was charged with the murder of Georgia college student Laken Riley.
Riley's murder, along with incidents such as migrants drinking alcohol and consuming drugs in public and getting into fights in New York City, have spurred increased coverage of a "migrant crime" wave. "Over the past month, Fox News hosts, guests and video clips have mentioned 'migrant crime' nearly 90 times, more than half of those in the past 10 days," reported The Washington Post's Philip Bump on Thursday. Numerous right-of-center media outlets have similarly warned about the "migrant crime wave" in recent headlines.
There's no question that some undocumented immigrants have committed heinous crimes. But there are many reasons to be doubtful that recent incidents are evidence of a surging migrant crime wave.
For one, crime is down in the cities that received the most migrants as a result of Texas' busing operations under Operation Lone Star, per an NBC News analysis. "Overall crime is down year over year in Philadelphia, Chicago, Denver, New York and Los Angeles," NBC News reported.
David J. Bier, associate director of immigration studies at the Cato Institute, a libertarian think tank, echoes that finding. "We don't have real-time data, but the partial crime data that exist for this year show consistent declines in major crimes in major cities," he says. "The most significant crime spike in recent years occurred in 2020—when illegal immigration was historically low until the end of the year."
"National crime data, especially pertaining to undocumented immigrants, is notoriously incomplete," since it "comes in piecemeal and can only be evaluated holistically when the annual data is released," cautions NBC News. What's more, "most local police don't record immigration status when they make arrests."
However, several analyses conducted at both the state and federal levels find that immigrants—including undocumented ones—are less crime-prone than native-born Americans. Looking at "two decades of research on immigration and crime," criminologists Graham Ousey and Charis Kubrin found that "communities with more immigration tend to have less crime, especially violent crimes like homicide," wrote The Washington Post's Glenn Kessler. A 2015 Migration Policy Institute report indicated that undocumented immigrants have a lower rate of felony convictions than the overall U.S. population does.
The Cato Institute's "research has consistently shown that immigrants are less likely to commit crimes and less likely to end up incarcerated than natives," Bier continues. An article this week by Alex Nowrasteh, vice president for economic and social policy studies at the Cato Institute, indicated that illegal immigrants have a lower homicide conviction rate in Texas than native-born Americans do, while legal immigrants have a lower conviction rate than both groups.
"Few people are murderers, and illegal immigrants are statistically less likely to be murderers. Still, some illegal immigrants do commit homicide, and that statistical fact is no comfort to victims and their families," wrote Nowrasteh. But "we should understand that more enforcement of immigration laws will not reduce homicide rates."
This has not been Trump's conclusion. "Migrant crime is taking over America," he said in a video posted to Truth Social on Wednesday. "How many more innocent victims must be harmed and how much more innocent blood must be spilled until we stop this invasion…and remove these illegal alien criminals from our country?"
Politicians on both sides of the aisle have proposed tightening legal pathways, such as asylum, as a way to reduce border crossings and improve security. "Banning asylum is not the answer," counters Bier. "Under Title 42 from 2020 to 2023, asylum was completely banned for many crossers, which only led to more people evading the Border Patrol, eliminating the opportunity for people to be screened at all."
Rather than relying on broad-stroke enforcement to capture once and future criminal migrants, there are several more targeted policies the U.S. government could adopt. "It should be legal [for migrants] to obtain a visa in their home countries, which would allow more people to be vetted more carefully abroad and free up Border Patrol to interdict those who evade detection," Bier says. The U.S. could also "negotiate better access to criminal databases in other countries and improve the quality of their data," and "supply foreign governments with advanced fingerprinting and booking technology on the condition that U.S. border agencies have access to the data," he continues.
Riley's death is unquestionably a tragedy. But U.S. immigration policy will be better served by statistically informed conclusions than the emotions sparked by individual crimes.

A majority of Americans (86%) say illegal immigration is a critical or important threat to the United States.

If by your action or inaction you lead to a death of a person, you have to accept the blame. If we did not allow illegal aliens into the country this young woman would be alive. That is the bottom line to the "open borders" crowd. There is blood on the hands of the local sheriff who didn't report the scum to ICE. America does not need the criminal class walking across the southern border and murdering our kids. Fiona really needs to look at herself in the mirror....your pov is just inhuman.
I think Fiona needs to spend more time jogging in parks in sanctuary cities.
Figures don’t lie, but liars do figure! Or as pResident Brandon would say, “C’mon man. Who you gonna believe – me or your lyin’ eyes?” Remember that there are three kinds of liars: (1) regular liars (whose lies do no particular harm), (2) damn liars (whose lies do cause harm), and (3) statisticians (whose lies are calculated and promulgated for the purpose of causing harm or advancing an agenda).
Since we are dependent on government in one form or another for most statistics, one can safely assume that most released statistics are (1) azalea fertilizer, and (2) supportive of the current agenda of the day (else they never see light the light of publication!)
I don’t know if the risk that any one single
illegal immigrant, asylee, huddled poor yearning to breath free newcomerinvader represents a greater risk of committing some form of mayhem than the risk that any one single native born citizen doing the same (and no way short of “statistics” of determining such risk. What I do know is that any risk of an invader causing harm is an unnecessary risk that only fools tolerate and mountebanks support – why would we elect to take whatever additional risk that the toleration of invaders amongst our population entails?Edit: I just read the notice above the comment section that henceforth the privilege of commenting on Reason articles will be restricted to those who have a subscription (paid). Folks like me, who do not and will not have a subscription will, after a short "grandfather" period be banned from commenting. I wish them the best of luck in maintaining their readership, as post-change I will not be among the readers (nor am I willing to pay to post on any forum!) I suppose it will "clean up the comment section" with commenters thereafter being largely restrict to those who believe the claptrap that Reason is in any way truly libertarian and not a party organ and proselytizer for liberal causes.
I agree with your edit. I myself will certainly give Reason fewer clicks and certainly won't pay to comment.
Of course I expect that a late reason that Reason is going to paid comments is to reduce criticism of their articles by chasing away the critics.
This page has NEVER been worth paying for. The comments are worth FAR more than the articles.

Posted this yesterday, too.
After the UGA nursing student Laken Riley was murdered, and it became clear that the suspect is an illegal alien who had previously been in custody and released, having committed multiple crimes before graduating to murder, the media has papered over all of that. Obviously, it doesn’t fit the narrative.
Some outlets depict the murderer as simply an “Athens resident.” if they cover it at all (it’s just a local murder, after all).
From Townhall.com:
As Guy reported last week, an “outrageous cascade of ‘progressive’ failures precipitated the murder of Laken Riley. Noting that “step after step,” the illegal alien suspect’s “lawbreaking was accommodated and indulged.” And even though he “should never have been in the US to begin with…his additional crimes came with little to no repercussions” until “he graduated to murder.”
Meanwhile, the mainstream media still won’t cover such tragedies honestly. They pretend they have a monopoly on the “truth,” which is just their warped version of events prescribed to them by ruling Democrat elites.
After the Venezuelan illegal alien was arrested, mainstream networks and outlets couldn’t bring themselves to report the inconvenient-to-Democrats truth about the suspect. As our friends at MRC noted, “ABC, NBC, and CBS had three underwhelming, yet widely varying approaches to the news that a released illegal immigrant has been charged with the murder of a Georgia college student on the respective editions of Good Morning America, Today and CBS Saturday Mornings.” Specifically, “ABC mentioned the illegal immigrant part, but not the released part…NBC mentioned the murder but omitted the illegal immigrant angle, and CBS ignored the story altogether.”
Mary Katharine Ham, a University of Georgia alumna herself, noted even more egregious coverage of the tragic murder of Laken Riley. The Atlanta Journal-Constitution referred to the alleged killer as merely an “Athens man” and then attacked Republicans who “quickly tied the killing of a student on the University of Georgia campus to President Joe Biden’s immigration policies.” The disgust with the truth’s emergence and scrambling to reframe the narrative to a friendlier-to-Democrats story was palpable.
The Associated Press decided to frame the story as being about “the fears of solo female athletes,” because of course it couldn’t be about the dangers of open-border and soft-on-crime policies enacted by Democrats. AP also chose to describe the illegal alien suspect as just an “Athens resident.”
Since the initial feigned ignorance displayed by the media, such outlets have only gotten more outrageous with their attempts to protect the Democrat narrative. The Atlanta Journal-Constitution, for example, jumped into the fray this week with a story not about the dangers of an unsecured border, but about how it’s “not fair” for Venezuelans in Georgia who now “worry about a backlash” as a result of Laken’s violent murder.
Right, because parks in cities have always been safe spaces for female joggers. But those dang immigrants. They've ruined EVERYTHING!!!!
It's heartening to read "If by your action or inaction you lead to a death of a person, you have to accept the blame." The January 6th rioters whose actions led to the death the following day of Capitol Police Officer Sicknick certainly deserved the priosn sentences they received. If there had been no attack on the Capitol, this man would be alive.
And your evidence that Sicknick's death was in any way related to the January 6 protesters?
"If there had been no attack on the Capitol, this man would be alive."
Not according to the results of the autopsy.
But Trump!
Oh FUCK OFF, you lying Prog.
The ONLY death proximately related to the events of 1/6 was Ashli Babbitt, shot and killed by a Capitol Police Officer.
And you KNOW it, Fucktard.
EdG has a reputation for lying!
29% of cities are NOT reporting their crime data. So the entire premise of this article is utter dogshit.
Amen!!
He starts the article with a statement that he supports with a link to a tweet that itself is just an empty statement. Clearly the author here wants to create a narrative and then try to support it, not actually do journalism. I'm so glad I cancelled my subscription.
Are you not familiar with Fiona's work? This is ALL it EVER is. Just like Shikha before.
That's not how statistics work. Duh.
The way the Democrats and the media have covered the Laken Riley case is the most shameful thing I've ever seen
https://notthebee.com/takes/the-way-the-democrats-and-the-media-have-covered-the-laken-riley-case-is-the-most-shameful-thing-ive-ever-seen
Fuck Democrats. And the media. Sorry for repeating myself.
Here's the formula: declare something that wasn't illegal before to be illegal now. Collect "crime" data for a year and declare a crime wave crisis as the incidence of the new crime skyrockets from "zero" to "astronomical" during the last year. Immigration is only illegal because some power-grabbing ass in government said it was. I have never needed protection against immigrants or immigration; have never asked for protection or voted for protection or for any of the asses who imposed it on us; and don't approve of any of the response they want me to pay for or the unintended (or intended) consequences thereby.
and don’t approve of any of the response they want me to pay for or the unintended (or intended) consequences thereby.
And yet taxpayers are paying in 10s of billions a year for your preferred ignorance on the policy.
Many paying with costs from crimes you deny as well. Including even assaults and death. But who cares. Your feels are more important.
Isn't amazing how stupid this author on reason.com think we are? We are seeing crimes not witnessed in decades committed by people that are not citizens! And when the media doesn't mention their names, we know that they are either illegal or some other 'protected group' that they don't want to talk about. I guess blacks are not really committing half the homicides, right? This must be written by people living behind huge walls and ignorant to the everyday lives of Americans. And for the record, we are the only country people 'walk' into and go to the front of the line! And you wonder why most Americans can't save for retirement when you pay through that ass for people that don't belong here? It's also ridiculous to be giving them rent free housing, food, clothing, and education that those of us born here can't get!
Taxpayers are paying billions of dollars a year to fight a non-crime. If you're paying taxes to your local or state government to support undocumented visitors to the United States you'll just have to fight that in your state legislature or local county. It is illegal for undocumented visitors to the United States to collect Federal welfare or other support and almost none of it is actually happening at that level. I will back you up any way I can to fight supporting visitors to the United States - documented or undocumented - with any tax-funded programs at all levels of government as long as you eliminate welfare for everyone in America first. Anyone who commits a crime while visiting America should be investigated, charged, prosecuted and punished as long as we eliminate victimless crimes like drugs and working for your living first. I will support prosecution of illegals, but only after you agree to let anyone visit America who wants to, let them work for pay at whatever job and wage they find acceptable while they're here having crossed at any of a large number of legal ports of entry with a simple criminal background check and screen for contagious diseases. If you're not willing to do those things, then go peddle your seething hatred elsewhere, because I'm not buying it.
It's a crime. It's illegal. It's on the books. Just because you don't like doesn't make it a crime.
"let anyone visit America who wants to, let them work for pay at whatever job and wage"
Geez, ok so we let everyone in - India, China, Koreans, Africans, the world because most would like to come here. Let them work and pay whatever. So you flood the market with labor, which will lower the pay of everyone. Oh, you only want to pay them cheaply. Basically, you want slaves.
Illegal immigrant is a crime because a country can only take in a certain amount of people that will assimilate to the culture.
But hey, you keep virtue signalling as long a it doesn't affect you
"It’s a crime. It’s illegal. It’s on the books."
Walking your pig through town on Sunday is "on the books" somewhere too, but it isn't a crime. Being in the country without permission is not a crime, it's a minor misdemeanor, so blow it out your bunghole ... oh, wait ... that's a crime too!
Yeah, it hasn't been legal to jump the border like this for decades if not longer. That piece of lame sophistry doesn't work.
This is one of the dumbest comments on here. You do realize that there as always been illegal immigration in every country for as long as records right?
I can use the "I have never needed protection against .." for everything.
You do realize that immigrant isn't the issue. There are paths, and ways for immigratns to do it. I just dated a Turkish lady that took 5 years, and lot so money to because a citizen.
Better question - do you just let your neighbors into your yard? Why have a fence? Why should the US decide which immigrants it wants?
Is Fiona just blindly pushing WH admin talking points now? Not prosecuting something doesn't mean a crime didn't happen. We have seen an abundance of left leaning DAs reduce crime and prosecution statistics. Major cities still have police staffing issues. Crime is up in all major cities if you bother talking to residents. But like with inflation, dont trust your lying eyes.
The same admin who lies on every GDP and jobs report; the same admin pushing the rise if far right extremism by declaring all political violence as far right; surely we can trust them on crime statistics. Just ignore the citizens and business owners.
This is Shreeka level stupidity.
You can’t trust them:
https://kansasreflector.com/2023/10/29/politicians-love-to-cite-crime-data-its-often-wrong/
FTA:
“Across the country, law enforcement agencies’ inability — or refusal — to send their annual crime data to the FBI has resulted in a distorted picture of the United States’ crime trends, according to a new Stateline analysis of the FBI’s Uniform Crime Reporting program participation data.”
And:
“A year ago, when the FBI initially released its 2021 national crime data, there wasn’t enough information to tell whether crime went up, went down or stayed the same. The FBI had estimated results for areas that declined to submit data or were unable to do so.
That’s partly because the FBI had rolled out a new reporting system. The data collection system, called the National Incident-Based Reporting System, or NIBRS, gathered more detail on individual incidents but also required training and tech upgrades by state and local policing agencies.
For the first time in two decades, the national law enforcement reporting rate fell below 70% in 2021, primarily due to the FBI’s transition. In 2022, many law enforcement agencies across the country were not NIBRS-certified in time to submit their 2021 crime data, which contributed to lower reporting rates.”
Crime is rising. But as usual, the democrats have their thumb in the scale.
Citing the Washington Post is always a bad sign.
No. She's not blind. This is here beliefs. It's been Reasons belief for every
Sure its declined. They don't bother arresting anyone anymore in major cities with progressive DA's. Grow up and check your facts. Easy to reduce crime when you don't bother to acknowledge it.
Many big cities just stopped reporting stats to the FBI 3 years ago as well
See what I posted above.
In many blue areas they have a policy to not charge any immigrants if it could lead to deportation. Success! No crimes!
Document describing the policy.

Lazarus Long would be spinning in his grave if he had ever died. Lazarus Long was a (fictional) strong supporter of minding your own damned business and leaving other people alone as much as possible. You should be ashamed of yourself for culturally appropriating a libertarian hero and icon and then spouting authoritarian trash here.
"There's no question that some undocumented immigrants have committed heinous crimes."
And there is no question every single one has committed a crime by illegally crossing the border.
Ergo, ipso facto, there IS a "migrant" crime crisis.
8 U.S. Code § 1324 - Bringing in and harboring certain aliens
(A)Any person who—
(i)knowing that a person is an alien, brings to or attempts to bring to the United States in any manner whatsoever such person at a place other than a designated port of entry or place other than as designated by the Commissioner, regardless of whether such alien has received prior official authorization to come to, enter, or reside in the United States and regardless of any future official action which may be taken with respect to such alien;
(ii)knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, transports, or moves or attempts to transport or move such alien within the United States by means of transportation or otherwise, in furtherance of such violation of law;
(iii)knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation;
(iv)encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law; or
(v)
(I)engages in any conspiracy to commit any of the preceding acts, or
(II)aids or abets the commission of any of the preceding acts,
shall be punished as provided in subparagraph (B).
(B)A person who violates subparagraph (A) shall, for each alien in respect to whom such a violation occurs—
(i)in the case of a violation of subparagraph (A)(i) or (v)(I) or in the case of a violation of subparagraph (A)(ii), (iii), or (iv) in which the offense was done for the purpose of commercial advantage or private financial gain, be fined under title 18, imprisoned not more than 10 years, or both;
(ii)in the case of a violation of subparagraph (A)(ii), (iii), (iv), or (v)(II), be fined under title 18, imprisoned not more than 5 years, or both;

(iv)in the case of a violation of subparagraph (A)(i), (ii), (iii), (iv), or (v) resulting in the death of any person, be punished by death or imprisoned for any term of years or for life, fined under title 18, or both.
If only you actually understood the meanings of the latin phrases you idiotically toss around like it makes you look informed and intelligent. Just because you say there's no question doesn't mean there aren't any questions or that you know any answers. Ipso facto you are an idiot.
While it appears that migrants offend at a rate lower than native-born citizens, the point here is that there at least three opportunities to offload Jose Antonio Ibarra:
At the time he was apprehended after crossing the border, when he should have been returned to either Mexico or Venezuela, or after his two subsequent arrests. That this didn't happen makes the Biden Administration and any other agencies under whose jurisdiction Ibarra was detained complicit in his subsequent crimes.
As Sonny Bono anwered when asked what he thought of illegal immigration, "It's illegal, isn't it?"
That’s bullshit. Illegals committing crime against other illegals doesn’t get reported, due to fear of reprisal, fear of deportation, language barrier, etc etc
The Lott study in Arizona showed illegal immigrants have a higher rate of incarceration.
What bleeding open border advocates do is combine illegal with legal migrants. The latter are pre screened against criminal databases prior to receiving a Visa or green card. It is a pre screened population. So they combine the two and hope you dont notice.
Oh, wow, open borders advocates conflating legal and illegal immigration? Well, I never!
Crime wave or not, illegal immigration is a problem. Acting like nothing is a problem because there is no actual crime wave is insane.
Their argument is so strong that they have to lie.
What else do Democrats like to fortify?
Several states also refuse to ascertain the immigration status of criminals that they arrest. In Oregon state law even forbids law enforcement from doing so ( and that prohibition extends to every local municipality). A version of don't ask don't tell.
“the point here is that there at least three opportunities to offload Jose Antonio Ibarra”
No, it’s NOT the point here. The point here is that the vast majority of immigrants in America are not committing crimes. The point here is that it should not be illegal for immigrants to come to the United States to live and work. The point here is that the failure of the criminal justice system in America has nothing whatever to do with either of the first two points. Quoting Sonny Bono is the stupidest means of trying to support your overly simplistic policy opinion I’ve seen in a very long time! Maybe after some of the more idiotic regulars here drop out over the paywall I won’t have to wade through so much bullshit to get to the more interesting and intelligent comments on Reason.
Fvck you you lying hack.
Crime is down on big D cities because they stopped prosecuting low level crimes and people stopped reporting them.
Venezuela has emptied their prisons, which is one reason for all the high profile news involving Venezuelan “immigrants” recently.
Murders of citizens by illegals went from 15 a year under Trump to 167 a year under Biden.
If “mass shooting” deaths involving “assault rifles” increased elevenfold, we would shut down the country.
No one ever talks about migrants being the victims of crimes thereby denying Americans from being the victim. Another opportunity stolen from an American.
The sarc effect is strong with this one.
He had white mikes hall monitor act going in the roundup.
That's fair. Slow work day today. I was bored.
Well, I think we both have a strong contrarian streak and feel the need to go against the popular opinion in any setting. This was more an attempt at humor than a serious argument though.
Will Sarc dip into his booze money (which is pretty much all of his money) to pay for Reason ‘Plus’? And what of his socks?
Reason will gift Sarcasmic a complementary subscription to boost comment quality.
Then they will probably give complimentary accounts to Pedo Jeffy and Shreek too. If so, I wouldn’t be surprised if they hired either of them to write forthcoming pedophile advocacy columns.
That would seem the logical progression for Reason narratives.
They took er jerbs! And our social security numbers!
Arithmetic and logic are not Fiona's strong suits.
"we should understand that more enforcement of immigration laws will not reduce homicide rates."
But it would reduce the NUMBER OF HOMICIDES, dipshit.
"Arithmetic and logic are not Fiona’s strong suits."
Bachelor of Arts from Arizona - - - - - - - - - -
The over riding and obvious fact ignored by this supercilious essay is that Laken Riley would still be alive had not our public officials unleashed Jose Antonio Ibarra to murder her.
Multiple times he was in custody and then released.
People living (or trying to live) in cities such as East St Louis or San Francisco will be overjoyed reading this piece.
And then triple-lock their doors as they decide to skip their once-regular evening walks.
Crime wave or not, illegal immigration is a problem. Acting like nothing is a problem because there is no actual crime wave is insane.
Counterpoint:
Murder rates in most of Latin America dropped significantly based on the latest data.
Where did all the criminals go?
El Salvador -69.2%
Venezuela-33.7%
Paraguay -22.2%
Belize -14.1%
Honduras -13%
Mexico -7.6%
Nicaragua -7.5%
https://twitter.com/KimDotcom/status/1763618143937888585
In El Salvador: cárcel, prisión, cadena, talego, encierro.
"immigrants are less likely to commit crimes and less likely to end up incarcerated than natives,"
Even supposing that is true, so what? Does each new criminal immigrant convince two native criminals to go straight? Does the entrance of a new criminal immigrant mean that two native criminals leave the U.S.?
No matter how "less likely" an immigrant is to commit a crime, the entry of each new criminal immigrant adds to the total number of criminals in the country.
One of the problems with Fiona's statement is that for it to be true it has to exclude every crime that an illegal alien commits that is related to their immigration status. It has to exclude the illegal use of fake ID and other documents for example and it has to exclude the use of social security numbers that belong to citizens. And of course it relies heavily on the fact that if law enforcement doesn't ascertain the immigration status of a criminal it is presumed to having been committed by a citizen thus skewing the statistic.
Illegals aren’t ‘immigrants’. Don’t get caught up in that line of bullshit.
The other issue is that illegals are also very heavily the VICTIM of crimes.
To get here, they often work with Coyotes, who are about the worst human beings imaginable. They are preyed upon and abused, robberies, assaults, and rapes of illegal migrants are remarkably common and these people have nowhere to turn.
All so they can come to a place where they ARE NOT LEGALLY ALLOWED TO WORK.
Seems a really shitty thing to do, encouraging people to put themselves at such risk, go to such expense, to go somewhere they're not even legally be able to hold a job.
It is certainly true that many of the illegal aliens have been in this country for some time, working hard and trying to be a respectable part of the community. But the fact remains that they are constantly violating any number of laws and an amnesty for illegal aliens implicitly forgives these violations. If I violated the same laws, I'd be fined thousands of dollars and put into prison for several years. But many people (and politicians) seem to want to grant them eventual citizenship and all the benefits thereof instead.
First they knowingly and with forethought violate any of several immigration laws when they enter this country: they come without visas, they do not come through a legal port-of-entry, they bypass customs, they are not registered and fingerprinted as required by Title 8 of Code of Federal Regulations (8 CFR). That is, there is little or no presumption of lawful admission as required by 8 CFR.
Once they are here, they are likely to continue to violate other laws. Fraudulent papers are used to obtain work. This may include Social Security numbers and related documentation, falsified work visas, and so on. In this case, it seems that Title 18 Section 1028 "Fraud and related activity in connection with identification documents, authentication features, and information" should come into play.
If they bypass the fraudulent paperwork and simply work for cash "under-the-table" they are certainly involved in some level of tax evasion. In this country, even people who earn income by illegal means are required by the Internal Revenue Code to report this income when filing annual tax returns. But they usually don't claim this income, let alone file the required return, because doing so would serve as an admission of guilt. They are also more likely to be working at less than the minimum wage, facilitating their employer's choice to bypass Title 29 Section 206 "Minimum wage" as well as requirements to withhold and pay their portions of the FICA and Medicare payroll taxes [conspiracy to commit, on both the illegal immigrant and the employer; perhaps RICO could even be applied to the employers].
An aside here: often the claim is made that "They do jobs Americans won't do" when the reality is "They do jobs that Americans won't do at those wages." Thousands of employers are also violating our laws, notably Title 8 Section 1324a "Unlawful employment of aliens", by hiring illegal aliens and by paying them under-the-table to avoid our laws about minimum wage, overtime, workers' compensation, unemployment compensation, family leave, Americans with disabilities and so on. These employers should also be stopped and prosecuted.
When illegal aliens drive a car, they are doing so without a valid license and probably without insurance (a requirement in most states). It is not uncommon for many unrelated illegal aliens to share a single house or apartment, in violation of local codes. The list of violations could go on and on.
We cannot continue to bear the costs of education for their children, free medical care, in-state tuition at colleges and universities, and now, amazingly, Social Security benefits to be paid on their illegally-earned wages.
Open borders combined with a welfare state is a form of mutually assured destruction.
Clearly we cannot reasonably round up and deport millions of people at one time. But we can work diligently to prevent additional illegal aliens from entering the county (however, I doubt that any sort of wall or fence will be effective and probably a waste of funds). Stepping up the border patrol and immediately deporting anyone caught crossing the border illegally is a first step. We can also increase deportations. If we deported about 1500 illegal aliens per day, we would reverse part of current flow of by about 550,000. Even deporting a few dozen daily would send the right message.
We must also dry up the incentive to come here. That means punishing, severely, employers who continue to use illegal aliens for their work-force. It also means prohibiting access to any and all social benefits other than life-preserving acute emergency medical care. Birth-right citizenship must not be automatically conveyed to children of illegal aliens.
We can then address a guest worker program if such a thing is truly necessary. A good first step in that program is that the application process must be completed at a US Consulate in the home country of the potential worker. Anyone in this country illegally who wishes to join the legitimate guest worker program must leave this country to do so. I'm willing to forgo the various fines, back taxes, and so forth simply to have them leave the country to get into line to legally entry this country.
Perhaps we can't round up and deport all of the illegal aliens in a short period of time but what we can do is start deporting at a faster rate than they arrive and we can make life difficult for the ones here and perhaps they self deportation.
As to the latter steps we can take include making E-verify mandatory ( for both employment and receiving government benefits), double or triple the fines employers receive for hiring illegal aliens, prohibit banks from giving accounts to those not legally present in the USA and make illegal presence in the USA a sentence enhancement for crimes committed.
The problem was created overnight so it will take time to solve but sooner started the better and sooner done.
And it's the wrong way to look at it. Every crime committed by an illegal immigrant in the country 100% preventable by keeping them out of the country.
The Myth of the Migrant Crime Wave is far less important than the myth of national borders, right?
And like clockwork, here's Fiona.
Hey, I think you need a Venezuelan cook, Fiona.
Or jogging "buddy".
“For one, crime is down in the cities that received the most migrants as a result of Texas' busing operations under Operation Lone Star, per an NBC News analysis.”
And the stock market changes with the length of women’s skirts. Make those skirts short enough and your stock values will double.
Make those skirts short enough and I won't have the bandwidth left to worry about my stocks.
"For one, crime is down in the cities that received the most migrants as a result of Texas’ busing operations under Operation Lone Star, per an NBC News analysis.”
Well, hell, then let's send them a few thousand more per day, and drive their crime rates to 0!
Isn't it immoral for us to accept all these newcomers, knowing that their departure will drive up the crime rates in their home countries?
data that exist for this year show consistent declines in major crimes in major cities
Similar to the data showing
Bidenflationthe US economy being better than everI’ll fess up to the fact that I was one of those guys saying, “shit, I’ll take Venezuelan refugees . At least they’ll probably hate communism.” a few months back.
But then the commies just opened up their prisons. You win this round commies.
David Bier says we don’t have real time date. Nuff said. This whole premise is ridiculous and shame on Ms. Harrigan. I wonder who put her put to this.
Dishonest lying motherfuckers. Immigrants (not "migrants," they have no intention of going home again) are committing more crime than in years. To the extent that crime rates haven't gone up it's because natives have been committing less crime while migrants have been committing more.
Total criminal convictions of noncitizens:
Trump FY17-FY19: 19,498
Biden FY21-FY23: 38,058
2017: 8,531
2018: 6,698
2019: 4,269
2020: 2,438
2021: 10,763
2022: 12,028
2023: 15,267
If you're going to be dishonest lying motherfuckers, try not to be so blatant about it.

Interesting. So Reason journalists cherry pick and infer data to suit their beliefs. I guess free minds are not open minds. How disappointing.
If you make the denominator big enough, an increased numerator shows a decreasing ratio.
Hence, Joe's master plan.
The fact that leftists no longer bother to hide their bullshit seems like a tipping point.
A large majority of those entering the US illegally are law-abiding (with the obvious exception of immigration law.) So, apparently in order to feel good about letting everyone without any sort of attempt to discover just who they are we will have to accept a certain number of robberies, shootings, rapes, and murders. Just the price someone has to pay.
And oddly, it is never the people who make it possible for all those illegal migrants to enter the country who have to pay that price.
Fact check, anyone?
Crime is down in some cities because people are fleeing them and DAs aren't prosecuting.
undocumented immigrants have a lower rate of felony convictions than the overall U.S. population does.
Lower rates of FELONY CONVICTIONS or convictions in general does NOT mean crime hasn’t increased!!!!
You have to catch the criminals before you can even begin to charge or convict them.
What a dishonest, disgusting and actually irresponsible piece of garbage this article was.
Catching them is not really the problem.
It is when no one investigates beyond writing up a police report. I’m talking about the car break ins/thefts, home burglaries, multitude of scams etc. that the police have no time or resources to investigate.
On top of that because a lot of police departments/emergency services districts have transitioned to digital communications ( no more analog old school radios )the public have no way to track in real time what’s happening in their communities.
Lies, Damn Lies and Statistics.
The amount of crime in the US is irrelevant to the fact that people crossing the border are doing so illegally. If they want to allow more immigrants into the country then change the admission rules. But encouraging illegal activity because you disagree with the rules is what got the Jan 6th folks in the Super Prison where Batman villains are kept.
>The “data that exist for this year show consistent declines in major crimes in major cities.”
**HARRIGAN!**
Did you sort out crimes committed by illegal immigrants from the rest? Bet you didn’t. Bet the crimes committed by illegals is increasing even as crimes by others are decreasing.
Did you control for lack of reporting? Theft is way down in San Francisco, for example – because the city won’t make arrests (and thus generate reports) for thefts under 1k.
So even though stores are closing across the city due to a wave of gangs robbing these stores the rate of theft is – in the official statistics – going down.
Also, 'lower rate of convictions' is not the same as 'lower rate of committing crimes'. It just means they never get through the justice system far enough to get a conviction. Typically they flee the jurisdiction - no-cash bail, remember - and crime somewhere else.
They aren't nil though. American citizens are dead because the government allowed non-citizens murderers in.
Change this to cops killing innocent people. It's a small number, but it's too many, whatever the number. Both are basically government sanctioned murder.
If Laken Riley had been murdered by Jose Antonio Ibarra with an assault rifle, the left would be screaming about needing a ban on assault rifles, nay, all firearms.
P.S. An "assault rifle" is basically a made-up term that largely involves black plastic parts on a semi-automatic firearm.
Maybe they would say that immigrants need assault rifles to protect themselves against White Christian Nationalist Racist Nazis.
She conveniently leaves out the 2021 illegal immigrant crime surge that occurred which includes increases in homicides, assaults and DUI convictions.
https://www.foxnews.com/us/crimes-committed-illegal-immigrants-surged-2021-declining-previous-years
The Center for Immigration Studies has lots of data on illegal immigrant crime. Here is an op-ed CIS’s director of research, Steven Camarota wrote that was published in the New York Post last year.
https://nypost.com/2022/10/19/what-the-media-tell-you-about-illegal-immigrant-crime-is-plain-wrong/
Even if you set aside the fact of they're being here illegally, if we subsequently catch them committing a crime, they should then be held and deported ASAP. Not released under some misguided sanctuary city BS.
Green card-holders are flat out told their status can be revoked if they break the law, why should illegals be held to a more lenient standard?
"Green card-holders are flat out told their status can be revoked if they break the law, why should illegals be held to a more lenient standard?"
Because Progs.
Crime is down my ass. Reporting of crime might be down since the police mostly hide in their cars waiting until they reach pension age and can get the hell out.
That aside, NONE of these crimes by ILLEGALS would be committed if the illegals were not here. THAT is the concern. If in fact crime is down, it would have been down ANYWAY... it sure as hell isn't down because there are an extra 10 million criminals in the country.
"How many more innocent victims must be harmed and how much more innocent blood must be spilled until we stop this invasion…and remove these illegal alien criminals from our country?"
It's a valid question. I'm not even one of the orange bootlickers, but I can see the merit of that point. Why can't you?
Even IF it's only a minority - exactly how much harm should we suffer from illegal aliens entering the country? Especially when the talking point of Leftists everywhere is "harm to one is harm to all" among their sacred cows.
But U.S. immigration policy will be better served by statistically informed conclusions than the emotions sparked by individual crimes.
Did you know that Venezuela has recently enjoyed a record low violent crime rate? Like, in two decades.
Know why?
Come on snail, I'll wait for you to reach the finish line.
And once you do, I want you to name me one - ONE - reason why any border jumping illegal shouldn't be immediately deported, and barred from re-entry, after having committed a crime.
ONE.
Only one fact matters in this debate. It isn’t crime or economics, it’s the law. The law is never to be questioned because it is the law. Illegal immigrants are breaking the law, and the law is the law. Authority is what matters. So fuck illegals, fuck anyone who defends them, fuck facts that don’t make them look worse than Americans, and fuck any magazine or website that doesn’t portray them as an invading army of vermin poisoning the blood of the nation. This is an invasion, which means we need a military solution. As in kill them. Kill them all.
Did I do that right?
No.
Holy shit brother, the way you redirect and convert your hate has something rather eerie and concerning to it.
Call me skeptical. Call me suspicious. Just do not call me unless I ask you to. But what good is that, you say? How am I to have any gain unless I get it from another? If you do not reach out to me, I will be without. If I do not intrude, you will not notice me. If you do not notice me, where is my opportunity to obtain more than what I can get on my own? I need to be noticed. I demand to be noticed and you pay attention to ME! I am outraged. (so someone will notice me) I want outrage. I demand outrage. I demand your outrage. (so I will be noticed). So you will not leave alone? No. You will intrude on my consciousness regardless of my wishes? Yes. Damn criminals. We should know when we are being played.
This is uhm... uh... is this your hobby language model project talking to us? No shame in that, it looks kinda like its getting somewhere if youre training it at home.
“The Cato Institute's "research has consistently shown that immigrants are less likely to commit crimes and less likely to end up incarcerated than natives," Bier continues.“
Well that’s nice, but we didn’t need to let them in to commit ANY crimes now did we?
Because of the entitlements this country provides, no immigration should be allowed without an extensive background check and some sort of buy-in of the immigrant candidate. Like hell they should be getting the social security and Medicare/Medicaid dollars we’ve paid in and are being paid in by our children without a significant contribution of their own. Or Obamacare, or welfare, or unemployment, or EIC, etc, etc.
We can’t apply libertarian principles to immigration in the current state. It just doesn’t work.
Know what's really cool? Immigrants have little choice but to go on welfare because it can take months or even years before they can legally be allowed to work. So by barring them from work and forcing them onto the dole, we can demonized them for being leeches! Heads we win, tails they lose!
Perhaps if they came legally they could get jobs? If they come illegally why should we reward them by letting them gain the benefits that the broke the law for in the first place?
If they come legally it takes months to get a permit , if they claim asylum they can’t legally work for years. If they come illegally then they work illegally right away.
So if they can't work why allow them in? Why reward them for breaking our laws?
Immigrants have little choice
They can choose not to come here.
I suggest Fiona read CBP non-citizen crime statistics. in all but a few categories crime has risen steadily and substantially. https://www.cbp.gov/newsroom/stats/cbp-enforcement-statistics/criminal-noncitizen-statistics
So someone who breaks into places illegally probably aren't angels saving us all?
Who knew!!!! Sometimes being hit with a stupid stick still isn't enough for reason propaganda to change.
Migration and Asylum:
There is no question but that there is a huge influx of migrants to the US. I propose that the solution is NOT to totally prevent it but to institute a ban on migrants being eligible for government welfare and aid at any level. This should be accompanied by a change in policy to allow non-citizens to work without permission. This would solve a number of problems, especially the low birth rate among US citizens that will pose a significant issue in the future.
Unauthorized migrants should be documented and tracked as to which border they entered from and returned to that country if they cannot support themselves or if they commit a crime. This would put the onus on those countries to control their own unauthorized migrants as well.
One particular issue is that this would require US citizens to provide documentation of their citizenship which opens a bit of a can of worms. OTOH, citizenship is a PRIVILEGE, not a natural right, so the requirements of citizenship are within the realm of national and state powers.
Let's start with the facts. 100% of all illegal aliens that enter the United States committed a FELONY to do so. The Democrats will NOT prosecute and will not allow the deportation of any illegal alien that may wind up voting in the future.
Secondly, in ALMOST every group of illegal aliens there are children that are "unescorted" tag alongs in age from 5 to 16 years old. In the United States taking such a child across the border is a FELONY, and the state and even federal government would make that felon arrest and DFC would be there to make sure the charges were filed. Instead an illegal alien is EXEMPT from State and Federal LAW just by illegally crossing the border.
I have had enough of this. It MUST END and the illegal aliens sent home. If they can afford $8000 for a Coyote to help them cross then they can afford to create their own businesses and live well in their own country,.
It was even more of a myth that police were targeting Black men, but that didn't stop the Democrats from running with the George Floyd fable to gain the White House.
If the migrants are working, they're probably doing so illegally which makes them criminals
Really?

I know it is a difficult concept, but ALL illegal immigrants are actually criminals. You see, immigrating illegally is a crime.
It is a crime that usually goes hand in hand with identity theft as it is usually illegal to have a job while committing the crime of being an illegal immigrant. So just for an illegal immigrant to be able to work and earn a living in the US it requires perpetually committing 3 federal crimes.
Don't get me wrong, I am pro immigration. We in the US NEED immigration. Not because we need an underclass of exploited workers (which is what the Democrat's argument usually is "Who will pick the fruit and clean our houses?"), but rather because we cannot have a shrinking population with our current entitlements and safety net. A shrinking population will bankrupt our already teetering Social Security, Ponzi Scheme.
But I am also a realist enough to realize that you cannot have a country that provides "Free Money" in the most desirable country in the world, to unlimited immigrants by using the method of taxation at gunpoint to the legal population.
Its absurd to believe we can have open borders until AFTER we establish an economy where it won't entice freeloaders. Until that happens we need laws around how many people can immigrate and whether they are financially stable enough to do so without becoming yet another freeloader. People who violate the laws preventing that are in fact criminals.
Hence ALL illegal immigrants are criminals.
I thought correlation wasn't causation?
Crime is down not because of so many migrants, but because cities and states have backed off of BLM and "defund the police" demands that led to a record rise of homicides in the past two years.
Most migrants are not violent criminals, but there is evidence that Venezuela has taken a page from Cuba's playbook in the 80s and emptied their prisons, and sending their criminals to the United States.
The idea that crime is falling or that illegals have lower crime rates and therefore illegals are not a crime problem is total nonsense. The illegal who killed the young nursing student is a perfect example. No matter what the crime ratio etc excuses of the “progressives”, the truth is that if that scumbag had not been in the US that young lady would still be alive.
No matter what this journal says: If migrants commit 1000 violent crimes this year then without them Americans would have suffered from 1000 less violent crimes this year.
Dear, dear Fiona, if you're so sure that illegal aliens are no threat, why aren't you housing them at your place and leaving the Wusthofs laying around in plain sight?
Which is to say, Jane you ignorant sl^t, what bleeping difference does the trend make? Even one is too many. But you must think that you're so exceptional that you'll never be a downward-trending statistic.
