An Iowa Man Published Body Camera Footage From His Arrest. The Cops Are Suing Him for Defamation.

An Iowa man published body camera footage of his arrest at the hands of two Newton, Iowa, police officers last year. Now, he's being sued for defamation.
In August 2022, 19-year-old Tayvin Galanakis was driving in Newton just after midnight when he was pulled over by police officers Nathan Winters and Christopher Wing.
"How much have you had to drink tonight?" Winters asks Galanakis in body camera footage from the incident.
"None," Galanakis responds. Winters incredulously asks, "What do you mean none?" Galanakis said, "Great, let's do a test then."
The footage then shows Galanakis undergoing a series of field sobriety tests. After Winters claims Galanakis failed them, he administered a Breathalyzer test, which showed that Galanakis had a blood-alcohol level of 0.00. Almost immediately after proving his sobriety, body camera footage shows Winters asking Galanakis about how much marijuana he had consumed.
"Despite previously claiming he could smell alcohol on Tayvin, Officer Winters now claimed he believed Tayvin was intoxicated due to his use of marijuana," reads a legal complaint later filed by Galanakis. "Tayvin continuously told the officers that he did not use marijuana and that his placement on the William Penn [University] football team renders him unable to use marijuana because of his weekly drug tests."
"I've had no weed tonight," body camera footage shows Galanakis telling officers. "Why do you think it's tonight? I blew a zero, so now you're trying to say I smoked weed. That's what's going on. You can't do that, man. You really can't do that."
"Absolutely I can," one of the officers responded.
According to Galanakis' suit, the officers arrested Galanakis and took him to the Newton Police Station, where he agreed to undergo drug tests, which came back negative. Eventually, he was released.
Less than a week after his arrest, Galanakis published body camera footage from his arrest to YouTube, where it eventually gained over 2 million views. According to the Newton Daily News, viewers flooded the Newton Police Department with hundreds of calls expressing outrage over the arrest.
Galanakis filed a lawsuit against Winters and Wing in February 2023, alleging that the officers violated his Fourth Amendment rights, wrongfully arrested him, and caused "humiliation, degradation, public ridicule, loss of personal reputation, and emotional distress."
Soon after Winters and Wing filed a counterclaim against Galanakis, arguing that he had defamed them by publishing the footage and making derogatory comments about the officers on social media. In several posts, Galanakis made statements such as "basically I got kidnapped then raped by the NPD all night," "they didn't show the clip of Nathan sexually harassing me," and stated falsely that Winters had been convicted of domestic abuse.
In May, a federal judge dismissed most of Winters and Wing's defamation claims. "Galanakis made extensive video footage from his encounter with Winters available on YouTube and TikTok," wrote Judge Stephen H. Lochner. "Viewers therefore had the opportunity to see for themselves what Winters said and did. With this context in mind, it would be even harder for a listener to interpret Galanakis's statements as anything other than his opinion or 'rhetorical hyperbole' about what happened during the encounter."
However, Lochner also ruled that several of Galanakis' statements—namely, his claims that Winters was convicted of domestic abuse or had abused an ex-girlfriend—were possibly defamatory, and thus the defamation suit could move forward in part.
This isn't the first time Newton police have lashed out against a disgruntled citizen. Last year, they arrested Noah Petersen, then 22, and charged him with disorderly conduct after he claimed during a City Council meeting regarding Galanakis' arrest that the police department was employing a "domestic abuser," in reference to Winters.
Petersen was found not guilty, and the city ordinance allowing his arrest was overturned for violating the First Amendment.
"What's the First Amendment for if not criticizing the government?" Petersen told the local TV station KCCI last October. "I think government can handle three minutes of criticism."

My non-lawyerly legal advice, don't do that. Because that's clearly defamatory.
Yeah, I was wholly sympathetic even willing to say a civil suit should go in his favor right up until "basically I got kidnapped then raped by the NPD all night". At which point I have to say, even if he's joking, somebody, pro-police, anti-police, pro-truth, anti-rape, pro-human decency... whatever has to take a long, hard look at the evidence. There's a time and place for rape jokes, while you're conducting a PR campaign against officers you assert violated your rights is not the place to do it.
Yeah, unnecessarily over the top. I wonder though, is the “rape” allegation related to how he might have been frisked? Perhaps Officer Winters or Wing or both spent a little too long in a particular area searching for contraband or probed somewhere. Not that I’m alleging anything! I.e. please don’t sue me!
Doesn’t rape also mean “to take by force”, or am I inconveniently failing to adopt the modern lexicon? Is the term not routinely, metaphorically used to indicate abuse of force or under threat of force, or even applied in the case dishonest dealing, especially when no practical alternative exists?

Quit being the speech police. Jokes are fine, and someone will almost always be offended, if it applies to them. And while they may be offended, that's a result of their actions and people making fun of their stupid actions. Speech doesn't harm anyone, even those who don't like to be called out for what they did.
Remember, anyone who claims your speech offends then, assuming you're being truthful, is engaging in offensive speech as in lying or not owning up to the truth, so should shut up themselves per their standards. That's what I tell someone who claims my truthful speech is offensive.
My standards for speech I find offensive to me, is to let it reflect on the person who's speaking, unless they're lying about me and then I'll call it out as such, and sometimes provide evidence they're lying. It' does wonders for their reputations and leads people to not believe them, even when they are later truthful, and get a dose of their own medicine.
If their lies harm my financial situation or reputation (as above in the case of claiming the policeman abused his wife/girlfriend, assuming it's not true - but I suspect there is evidence it is - hopefully the victim didn't fly off the handle and make it up like the policeman did about smoking pot), then I can sue for the loss based on slander or libel.
Finally, I'm not surprised the mayor is a Democrat. Abuse of the public is what D mayors and their chief of police (who reports to the mayor alone), have shown they do to victims like George Floyd. It's amazing their absurd distractions of "Defund the Police" and "systemic racism" worked leading to our VP contributing to a fund to bail out the rioters and looters, pretending she was on their side. A lot of people weren't smart and got fooled by the Democrats responsible for all the abuse, to their detriment.

There apparently was a protection from abuse taken out on Winters. I don't think that's clear at all. The rest, as the judge noted, is either hyperbole/opinion or not in dispute as allegedly false.

Missing from Reason's knee jerk anti-cop story is why was Galanakis pulled over. Did he drive dangerously? Was his tail light out? He was put through the sobriety and marijuana tests, as would any of us if stopped. He was then released. Is it an outrage that the cops didn't believe him? They have heard plenty of drunks say they haven't had a drop. Galanakis was a fool to post this non story to the internet and perhaps to libel the police. My sympathy level is quite low for this whining lad.
You have to be kidding. If you watch the video, the kid is clearly not intoxicated. But the cop still said he failed the subjective sobriety test and then switched from alcohol to marijuana when the objective alcohol test was negative. But the 'odor of alcohol' was the whole reason for the sobriety test in the first place.
OK, I guess you have never been pulled over by a cop who's been tailgating you for three miles waiting for you to cross the outside line in a crosswind or using your brakes or anything else that enters into their little polluted heads so they can find some excuse to jerk you around.

Yeah, I've been on the other end of this. Teetotaller with drugs, never a drop of drink before driving, and had some cop harass the shit out of me expecting to find something.
It happens. And when I complained it got way worse for quite a while. I got pulled over for an awful lot of brake light and license plate light failures that suddenly started working afterwards. Darned intermittent electrical problems!
The kid shouldn't have gone into the hyperbolic bitching, but the facts remain. He was not drunk or high, proved it, proved it again, and posted exactly what the cops did from their own cameras. If there was a legitimate reason to pull him over, they should have cited him for it and let him go on his way.

One of his headlights was out. He turned on his high beams and used them to drive around in town. So the initial stop was justified.
Traffic stops happen according to certain rules and they violated those rules in multiple ways.
Galanakis was entirely justified in posting the video to YouTube. Any claims related to his posting of the video per se have been thrown out.
The remaining defamation claims are related to Galanakis making factually false statements. If true, the court ought to find him guilty... and penalize him to the tune of $1.

I doubt you have ever been arrested. IF in fact the jail there perfumes the "standard" examination before placing a prisoner into cells, it may or may not include anal penetration in the search. If that happened it by state and federal definition IS and WAS rape.

Place me on the jury, and if touch or penetration happened I will add treble damages to any other award. This citizen stated that he was on a football team and was tested for drugs WEEKLY and could not do any drugs. That should have been enough for any rational police officer. These two cops are ABUSERS and CRIMINALS without a doubt in my mind at least. They deserve PRISON TIME for kidnap and false imprisonment at least.
