Big thief On Friday, the Department of Justice charged 38-year-old government contractor Charles Littlejohn with having stolen private tax information from the IRS, which he then leaked to journalists. 

The outlets he leaked to were ostensibly ProPublica and The New York Times, though the DOJ did not specify. In June 2021, ProPublica's Jesse Eisinger, Jeff Ernsthausen, and Paul Kiel published a "vast cache" of private IRS information, revealing the tax burdens—or strategies used to minimize such burdens—of some of the wealthiest Americans, including Donald Trump, Elon Musk, Jeff Bezos, Carl Icahn, Warren Buffett, and Michael Bloomberg. 

Littlejohn worked as an IRS contractor from 2017 to 2021. The indictment claims he stole tax information from as far back as 15 years ago. IRS information is not supposed to be made public without the individual's consent, and this breach made clear that the agency's protection of people's personal information was not up to snuff. (I've reported on the agency's bad behavior a bunch over the years, if you need more reasons to hate them.) The breach also "renewed calls by Democrats to enact a so-called wealth tax that would prevent billionaires from using creative financial strategies to lessen their tax burdens," adds The New York Times. 

"The government has a fundamental obligation to protect the confidentiality of Americans' sensitive information, whether it be tax records or healthcare records," said Ken Griffin, a hedge fund manager whose records were part of the leak and is now suing the IRS. Littlejohn faces up to five years in prison.

Gaetz vs. McCarthy Yesterday, Rep. Matt Gaetz (R–Fl.) brought forth a resolution declaring the speakership vacant, a clear sign of antagonism toward House Speaker Kevin McCarthy (R–Calif.). The resolution will, over the course of the next few days, force a vote, meaning members of the House must decide on whether McCarthy will remain in leadership. Only two other speakers have been removed over the House's 234-year history. 

"It is becoming increasingly clear who the speaker of the House already works for, and it's not the Republican conference," said Gaetz, accusing McCarthy of making a "secret deal" with President Joe Biden to pass the stopgap measure which allowed the federal government to remain funded until mid-November in lieu of a shutdown.

Fantasy world Last week, Judge Arthur Engoron handed New York Attorney General Letitia James a huge victory in the state's civil case against Donald Trump, ruling that the real estate magnate and former president committed fraud by overvaluing his business assets. "In defendants' world: rent regulated apartments are worth the same as unregulated apartments; restricted land is worth the same as unrestricted land; restrictions can evaporate into thin air…and square footage subjective," Engoron wrote. "That is a fantasy world, not the real world." 

Though Engoron conceded that square footage can sometimes be overvalued by mistake, generally falling in the realm of 10-20 percent, Trump's properties were in some cases inflated by 200 percent, which strains credulity.

But that ruling dealt with only one of the seven total claims that James had brought against Trump. Yesterday, the first day of the trial—which will deal with the remaining six—started. Previously, Engoron had "revoked Mr. Trump's licenses to operate his New York properties," but now the attorney general is seeking more from Engoron, "asking that he impose the $250 million penalty and that the former president be permanently barred from running a business in New York," reports The New York Times. The trial will determine Trump's penalty, both in terms of fines and in terms of the degree to which he will be allowed to continue to do business in New York real estate.

"The substance of Mr. Trump's defense is that his annual financial statements were merely estimates, and that valuing real estate is more art than science," reports The New York Times. "The banks to which Mr. Trump submitted his statements, his lawyers argued, were hardly victims: They made money from their dealings with Mr. Trump and did not rely on his estimates."

The best part is not the hefty price tag for tomatoes, tofu, and sunflower; the best part is the hidden meat room, where up until relatively recently, diners who had booked private experiences still had beef, lobster, foie gras, and sturgeon available to them. Or possibly the fact that the massive price tag did not go down at all over the course of the restaurant's pivot to vegan (in fact, it went up, after reports criticizing worker pay surfaced).

To me, this is all very New York: outwardly posturing as morally superior but still raking it in from big chunks of cow in an even more exclusive setting. Brilliant.

        Fraud requires reliance on the false information. Banks have their own duty to do valuations, they don’t blindly accept the words of loan applicants. At least one bank has now admitted to doing their own valuation.

    The new method of New York judges seems to be to pre judge all the facts at the start if the trial yo remove any defense when Trump goes to trial. This was seen last week when the judge pre judged the facts of the case that Trump committed raud using laughable assertions such as Mar a Lago being worth just 18M. The justification of this was tax assessments. The tax assessors office in Florida even responded this week regarding how incorrect the judge was in his ruling.

    In addition to local real estate experts, the article also cites Palm Beach County Property Appraiser’s Office public information officer Becky Robinson, who said that her unit has a "specific scope of responsibility when it comes to valuation of property for the purposes of taxation," but does not focus on the market value.

    "I do not believe that our office would be the best to answer these questions," Robinson said when asked about the assessment of market value.

    So the judges ruling is false on its face.

    On top of that it now turns out banks did in fact do their own valuations. Fraud requires the injured party to have relied on false misrepresentations. But the banks are admitting they did not.

    Deutsch bank has admitted they lowered the valuation by 2B but offered the loans at the same terms as requested.

    Sad to see Reason didn’t point out the lack of any victim of Trump’s alleged crime of allegedly overestimating the worth of his properties, given the estimates were given to get a loan, the banks did their own investigation/estimate of the value of the properties, and have been paid back.

    Libertarians don’t believe in victimless crimes, which are just means by which government abuses people for the benefit of the people in government. And seems to me, Reason has lost its libertarian foundation, along with the donation in my will. There are now far better organizations protecting our liberty. Sad to say.

          It was bound to happen. Poland first, then Slovakia, and now the US and UK laying the grounds to withdraw funds. Ukraine had really one shot, have success in their quixotic spring offensive, which didn't happen. Now, the real world is infringing. NATO has two options, fish or cut bait. Since there is no stomach in any of the NATO countries for open warfare, they'll have to admit the inevitable, and force Ukraine to negotiate.

            The big problem is that Ukraine really can't do shit on an operational level without US-level control of the air. We've been massively successful on that front over the last 40-odd years because the Air Force in particular has taken quick control of the skies and then was able to operate with impunity. Even going against Russian SAMs, a concerted air campaign on our part would probably wipe out their ground and armor forces in short order, force a withdrawal back to the border, and cut off Crimea completely.

            Ukraine has a bunch of shitty Cold War-era air assets from their own pre-war stockpile, and others that the NATO countries are essentially giving them just to clear out their own inventories of the old crap.

    The indictment claims he stole tax information from as far back as 15 years ago. IRS information is not supposed to be made public without the individual's consent, and this breach made clear that the agency's protection of people's personal information was not up to snuff.

    Here's the thing--"protection" of any kind of data in the government is only as good as the willingness of its workers to do so. The simple fact of the matter is that anyone with access can take this information and do what they please with it, irrespective of the actual consequences of doing so, and that's exacerbated in a world connected by the internet. There isn't a dime's worth of difference between the Pentagon Papers, the Manning/Snowden/Winner files, Joe the Plumber's personal info that the county clerk leaked, the info that Air Force Guardsman released online, or the PII tax info that this IRS contractor took. It's all data that's subject to the personal whims of the people who work with it every day. This stuff is all ridiculously easy to just copy and release to anyone that's interested in it.

    There's no actual "protection measures" that can be taken here other than relying on people's personal decision to not put it out there.

        It would, but with the IRS and county clerks, that’s inevitable, and in some cases isn’t entirely bad. I certainly don’t want some squatter coming in and trying to live in my house, for example, because there’s no record of deed with the county that I bought it. The overall surveillance state bullshit is what's really egregious. In the IRS case here, it's simply a hyper-partisan bad actor with Main Character syndrome.

          Yeah, registering ownership of real property is useful. But that's usually public information anyway.
          I think income taxes are one of the biggest drivers of government invasion of privacy and most of what they collect is information no one has any business knowing unless they have an actual financial relationship to you.

    Philadelphia journalist Josh Kruger is shot and killed by intruder in his two-story townhouse: Suspect shot him seven times in the abdomen and chest before fleeing. A journalist and advocate who rose from homelessness and addiction to work social media for his city’s mayor was shot and killed at his home early Monday. The incident happened overnight in Philly, and left 39-year-old Josh Kruger collapsed on the street outside his Point Breeze home, police said. An incident report further revealed how Kruger, at about 1:30am ET, was shot a total of seven times during the home invasion, and that the suspect – or suspects – are still at large…

    Kruger, incidentally, was a hyperpartisan left-wing big-mouth with a media platform, not a journalist.

    Fantasy world Last week, Judge Arthur Engoron handed New York Attorney General Letitia James a huge victory in the state's civil case against Donald Trump, ruling that the real estate magnate and former president committed fraud by overvaluing his business assets. "In defendants' world: rent regulated apartments are worth the same as unregulated apartments; restricted land is worth the same as unrestricted land; restrictions can evaporate into thin air…and square footage subjective," Engoron wrote. "That is a fantasy world, not the real world."

    Though Engoron conceded that square footage can sometimes be overvalued by mistake, generally falling in the realm of 10-20 percent, Trump's properties were in some cases inflated by 200 percent, which strains credulity.

    You know what strains credulity? That the lender had NO idea, and made no internal evaluation of the value of the property.

    It also strains credulity that in a case where literally no one was defrauded out of a single dime, that the state can just swing in and decide that a property was overvalued, and then slap a laughable value to the property... all done by a judge with a known grudge against Trump.

    Stop carrying water for the Banana Republic.

      It is fucking bizarre that this civil case is being brought by the state. I don’t see any way in which the state was harmed here (or the banks, who aren’t suing him). How does the state even have standing?
      And everyone else gets to live in fantasy world now, why not Trump?

      I've mentioned this before. I haven't seen a movie at the theater since the third Lord of the Rings movie. Television isn't even worth the effort to pirate anymore, much less pay for streaming. I cannot be alone in this assessment.

      Let 'em pay 20 writers for a 6 episode series, for all I care. They can easily run up $200 million budgets on horrible woke remakes of some old Disney film or Feminist Star Wars. Obviously they've got money to throw around, at least until they finally don't. When that happens, I say, let 'em crash.
