Arkansas Ban on Gender Transition Treatments for Minors Ruled Unconstitutional
Plus: New rules limit asylum applications, the bad math behind economic doomerism, and more...

A federal court has permanently struck down Arkansas' ban on gender transition procedures for minors. The law violated the rights of Arkansas children and their parents, as well as the rights of health care providers, held the court, finding that the ban went against the Constitution's Equal Protection Clause, Due Process Clause, and First Amendment.
In 2021, Arkansas banned the prescribing of puberty blockers or hormone treatments to address gender dysphoria in minors, as well as surgical interventions for transgender kids. The law also banned health care providers from referring minors to doctors who would provide gender transition treatments. The state's Republican governor, Asa Hutchinson, vetoed the measure, saying it would create "new standards of legislative interference with physicians and parents as they deal with some of the most complex and sensitive matters concerning our young people." But the legislature had enough votes to override that veto.
Since then, a number of states have followed in Arkansas' footsteps. But lately, these bans have recently been suffering some blows in federal courts. Earlier this month, "a federal judge in Florida issued a preliminary injunction that will permit three transgender children to receive puberty blockers, even as the state has banned gender-affirming care for minors," as CNBC reported. Similarly, a federal judge last week stopped Indiana's "ban on puberty blockers and hormones for transgender minors from taking effect" on July 1, notes NPR.
Both the Indiana and Florida rulings were preliminary—the cases are still playing out in their respective courts, with final decisions from the district judges still uncertain.
But the Arkansas ruling, issued yesterday, represents a final decision and is the first final merits ruling on a state law banning gender transition treatments for minors.
The decision comes in a lawsuit (Brandt et al v. Rutledge et al) filed by several Arkansas families with transgender children, who were represented by the American Civil Liberties Union.
"Transgender kids across the country are having their own futures threatened by laws like this one, and it's up to all of us to speak out, fight back, and give them hope," said Dylan Brandt, a 17-year-old transgender boy and one of the suit's plaintiffs, in a statement.
"The undisputed evidence at trial established that, if the Act were to go into effect, (i) three of the Minor Plaintiffs—Parker Saxton, Dylan Brandt, and Sabrina Jennen—would have to discontinue treatment that they, their parents, and their doctors all agree is medically indicated for them and benefitting their health and well-being, and Minor Plaintiff Brooke Dennis would be unable to obtain treatment she will imminently need," wrote James M. Moody Jr. of the U.S. District Court for the Eastern District of Arkansas in yesterday's decision. In addition, "the Physician Plaintiff, Dr. Kathryn Stambough, would be unable to treat her patients who need care, leaving them to suffer, and unable to refer them to other doctors to provide care when necessary." Thus, the plaintiffs had standing to bring the case.
As to the Equal Protection Clause claim, the judge noted that "Act 626 discriminates
on the basis of sex because a minor's sex at birth determines whether the minor can
receive certain types of medical care under the law." For instance, a minor being treated for conditions other than gender dysphoria could still be prescribed hormones. The law is therefore a sex-based classification that "discriminates against transgender people," the judge wrote.
"The evidence at trial showed that the prohibited medical care improves the health
and well-being of many adolescents with gender dysphoria," continued the decision, which spent pages detailing expert testimony on both the benefits and risks of various treatments for childhood gender dysphoria.
For instance, "it is undisputed that when estrogen is used to treat birth-assigned males, it can sometimes impair their fertility" and "estrogen treatment follows puberty blockers at certain stages of the adolescent's development, the adolescent can become infertile." And "when estrogen or anti-androgens are given to birth-assigned males, the hormones can limit the patient's sexual arousal or ability to orgasm," the judge points out. But "these risks are discussed with patients and parents. The risks can be managed by the doctor to preserve fertility or treatment can be provided to address a decrease in sexual satisfaction in most cases."
In other words, the ruling doesn't shy away from acknowledging the drawbacks involved in certain gender transition treatments. But it situates these firmly in the realm of considerations to be left to patients and doctors, not the state.
"Even if the Court found that Act 626 passed constitutional muster under the Equal
Protection Clause, it fails under due process analysis," states the decision. "As the Court has previously found, the Parent Plaintiffs have a fundamental right to seek medical care for their children and, in conjunction with their adolescent child's consent and their doctor's recommendation, make a judgment that medical care is necessary."

New rules limit asylum applications. A new Biden administration policy says that for the most part, people who travel through a third country on their way to the U.S. but don't seek asylum from there before entering the U.S. without authorization are ineligible to seek asylum here. The change "has dramatically lowered the percentage of migrants at the southern border who enter the United States and are allowed to apply for asylum," according to the Los Angeles Times:
Since the expiration of Title 42 rules that allowed border agents to quickly turn back migrants at the border without offering them access to asylum, the administration has pointed to a drop in border crossings as proof that its policies are working.
But immigrant advocates and legal groups have blasted Biden's new asylum policy, arguing that it is a repurposed version of a Trump-era effort that made people in similar circumstances ineligible for asylum. (Under Biden's policy, certain migrants can overcome the presumption that they are ineligible for asylum.) The ACLU and other groups have sought to block the rule in federal court in San Francisco, in front of the same judge who stopped the Trump policy years ago.
The new filing provides the first look at how the Biden administration's asylum policy is affecting migrants who have ignored the government's warnings not to cross the border.
"This newly released data confirms that the new asylum restrictions are as harsh as advocates warned," said Aaron Reichlin-Melnick, policy director at the American Immigration Council. "The data contradicts conservative attacks on the rule for being too lenient. Less than 1 in 10 people subject to the rule have been able to rebut its presumption against asylum eligibility."
According to new court documents filed by the Biden administration, just 46 percent of single adult migrants were able to pass an initial border screening between May 12 and June 13—down from 83 percent between 2014 and 2019.

The bad math behind economic doomerism. "Whereas 40 weeks of the typical male worker's income in 1985 could provide the middle-class essentials for a family of four, by 2022 he needed 62 weeks of income—a problem, there being only 52 weeks in a year," asserts American Compass founder Oren Cass in a new book. Cass' claim is based on data from his 2023 Cost-of-Thriving Index, which divides the combined cost of five goods and services (groceries, health insurance, higher education, housing, and transportation) by the median weekly earnings of men working full time.
But Cass' math is all wrong, write for the American Enterprise Institute. Their report takes aim first at the way Cass calculated the "cost of thriving":
We first improve on Cass' cost estimates by correcting conceptual and measurement errors and using better source data. For instance, while Cass uses the average sticker price of attending an in-state four-year public university as his education estimate, we account for the fact that institutional and federal grants reduce the average considerably. Cass' health insurance estimate treats the part of the premium paid by employers as if it were paid by workers. (One might argue that it actually does come out of worker pay, but then one has to include it in earnings, too.) Improving his estimates in these and other ways knocks down the increase in COTI from 22 weeks to 10 (and puts the 2022 COTI below 52 weeks).
Cass also overlooks "changes in the quality of goods and services over time," suggest Winship and Horpedahl:
Take housing costs. He compares rents for three-bedroom apartments in Raleigh, North Carolina, in 1985 and 2022, but he ignores the possibility that the typical three-bedroom rental in 2022 is much nicer or larger than what was typical in 1985. An increase in what families typically spend that reflects their ability to afford nicer things is not an increase in costs. When we adjust for quality change using price indexes to translate the improved 2022 costs into 1985 dollars and then re-estimate the change in COTI, we find it increases by just four weeks.

Seems might be time to revisit bans on gay conversion therapy.
The problem is they keep passing laws that have criminal consequences attached that are constitutionally iffy. What they need to do is follow the Dems playbook on guns, for medical institutes and doctors hefty liability that has a statute of limitations 5 years past there 21st birthday that if the child says they were not adequately counseled as to the pitfalls of taking puberty blockers and or surgery the doctors are liable and they must carry insurance that will cover this. Make it too expensive to continue doing this but not outlaw it.

BMI is not perfect, but there is a high correlation, esp in the morbid category, with disease (ie, morbidity, hence the term). The appropriate method going forward would be either clarification of the metric as its used, and pointing out where it IS a very useful indicator (extreme underweight, 35, certainly over 40). In addition to clarification, talking about BMI in the context of the entire patient. A patient with stone cold normal lipids, A1C, BP, and strong cardiovascular endurance but a BMI of 31 should not be of any significant concern, as an example.
But of course, this is proof that the AMA is another expert panel/group that is captured by the woke, and is therefore not to be trusted. Labeling this as a white supremacist, racist framework will allow more blacks walking around with undiagnosed diabetes and hypertension to keep feeling that they are just fine the way they are at a BMI of 45, because damnit that is an old timey racist metric.
Our hospital in town has already seen this happening. Was a panel about how we can improve AA morbidity and mortality on the labor and delivery unit. It was brought up that this specific population in our town has significantly higher BMI (very often new moms coming in 300+ lbs in the BMI's of 50+) and without any prenatal care. This line of thought was labeled as racially insensitive, not joking.

BMI is an objective number. The problems with it have to with trying to distill a number of factors down to one universally applicable calculated number. But the issues there have more to do with different body builds and male/female differences, not race.

The federal government set high-flying goals for the production and use of sustainable aviation fuel, but the high cost of the fuel has sunk them.
In March, the U.S. Government Accountability Office found that sustainable aviation fuel production reached 15.8 million gallons in 2022. That's less than 0.1% of the total jet fuel used by major U.S. airlines and far short of federal goals.
"The high price of sustainable aviation fuel compared to conventional jet fuel is a key factor inhibiting increased production and use," according to a report from the U.S. Government Accountability Office. "Other factors inhibiting market growth include the long time frames and high costs of developing new sustainable aviation fuel production facilities."
The White House announced a sustainable aviation fuel Grand Challenge in September 2021 with a goal to supply 3 billion gallons of sustainable aviation fuel per year by 2030 and around 35 billion gallons per year by 2050, which would be enough to meet 100% of projected U.S. domestic commercial jet fuel demand. Sustainable aviation fuel is made from renewable and waste feedstocks that can reduce greenhouse gas emissions on a lifecycle basis.

The majority of a unit of nursing support, clerical and environmental staff have voted to remove a union’s officials from power at Mankato Mayo Clinic.
Members of the unit signed the petition May 9 to oust American Federation of State, County, and Municipal Employees Local 1856 union officials, according to a National Right to Work Legal Defense Foundation news release. Mankato Mayo employee Melody Morris, with free legal aid from the foundation, filed the petition asking the National Labor Relations Board to hold a union decertification vote at the hospital. The majority of her coworkers supported the petition, the release said.
“My colleagues and I want to provide the best support we can to the medical staff at Mankato Mayo Clinic Hospital, and we determined that having AFSCME in the workplace wasn’t helping us do so, nor was the union looking out for our interests,” Morris said in the release. “I’m grateful that we came together to free ourselves from the union, and we’re also grateful for the help of the National Right to Work Foundation in helping us accomplish this.”

Lawsuits challenging Illinois’ gun laws are well underway in state and federal courts with separate challenges to the constitutionality of the recently enacted gun and magazine ban and the decades old Firearm Owners Identification card.
In January, Gov. J.B. Pritzker signed into law a ban on more than 170 semi-automatic rifles, shotguns and handguns. He also banned the sale and possession of magazines with more than 15 rounds for handguns and 10 rounds for rifles.
<i.Earlier this month, Illinois’ briefs in the consolidated case in front of the Seventh Circuit U.S. Court of Appeals argued modern firearms are dangerous because of advanced technology, are only used by criminals, and recent mass shootings require the ban.
Plaintiffs filed their briefs this week. Tuesday, attorney David Sigale, who is representing a plaintiff's group, said firearm technology isn’t new, it’s been around for hundreds of years. He also said as horrible as violent crime is, that also is not new.
The FOID card has been Illinois law for decades. Any Illinoisans wanting to buy or own firearms or ammunition must have a valid card or face criminal penalties. There are more than 2.4 million FOID card holders in Illinois. Only four states have such a requirement for the purchase and possession of firearms.
In Illinois, Guns Save Life founder John Boch brought a case challenging Illinois’ FOID law in 2019. He said recent U.S. Supreme Court precedent requires courts to evaluate the text, history and tradition of the Second Amendment in such challenges.

Summary Geopolitical Update
As we pass another solstice here on our increasingly vexed planet, I note the following salient developments:
1) The empire's proxy war in Ukraine is a lost cause, and Russia will emerge from it exceedingly stronger than when it began.
Matters have reached the point where the imperial masters will be forced to choose between a humiliating disengagement and abandonment of Ukraine to its fate, or otherwise blunder into a calamitous direct military intervention.
In recent weeks, all of the most important voices in Russia have spoken boldly and unequivocally regarding their demands of the NATO bloc: it must withdraw its forces to their pre-1997 posture.
In other words, NATO presence in Ukraine must cease forthwith; Ukraine must be entirely demilitarized, and a neutral regime must be installed in whatever Ukrainian rump state the Russians choose to leave unrestored to mother Russia.
Additionally — and this demand has been explicitly stated — American missiles must immediately be removed from Poland and Romania, and NATO military presence in the other Russia-adjacent nations must be withdrawn in course of time.
Clearly, the Russians are emboldened by both their burgeoning military strength as well as NATO's manifest military debility.
This war has achieved precisely the opposite effect that was envisioned by its neocon authors: it has served to strengthen Russia, and also forged an unbeatable alliance between Russia, China, and Iran.
That said, I cannot shake the haunting worry that the #EmpireAtAllCosts cult may yet succeed in persuading the powers-that-be in the Pentagon to put to the test the myth of American military supremacy against what was so long imagined to be Russian military ineptitude.
I believe we will see the answer to that question between now and the next winter solstice in December.
2) Like its new allies in Russia and Iran, China has now declared in unmistakable terms that it will no longer abide by the arbitrary "rules-based international order".
They will no longer tolerate US meddling in Taiwan, nor permit the US to dictate the geopolitical relationships of the nations in east Asia and the western Pacific.
The days of a patient and grudgingly submissive China have come to an end.
In other words, as I have written on several occasions, we have well and truly arrived at an unprecedented hinge moment in world history.
The greatest empire the world has ever seen has long-since receded from its high-water mark and is now in rapid and increasingly chaotic decline.

For years, the political and media elite have struggled to “resolve” the disaster that is Hunter. They have finally done so with a long-predicted “controlled demolition” of the scandal by having the President’s son plead guilty to a couple of minor tax violations without a serious threat of jail time.
They even threw in a phantom felony allegation that will evaporate since Hunter enters a diversion program.
The diversion program is particularly insulting to the intelligence of the American people. Hunter is reportedly no longer an addict, having attended treatment and taken up painting. Yet he will be treated like he is a junkie picked up in a drug sweep, and everyone will pretend that this is about addiction rather than corruption.
There is reason to be suspicious. First, no one can explain why it took five years for the investigation of two minor tax counts and a gun allegation that could have been confirmed in one month.
Hunter also never faced any charges after videotaping himself engaged in interstate violations involving a host of prostitutes and drugs. That is now simply material for his scrapbook.
There is a glaring omission of any charge under the Foreign Agents Registration Act (FARA) despite the Justice Department using this charge freely against Trump associates like Paul Manafort.
The most notable omission is the failure of any apparent investigation into the expanding scandal surrounding the influence-peddling operation of the Biden family.
Despite the release of evidence by the House Oversight Committee showing potentially millions of transfers to Biden family members from foreign sources, Attorney General Merrick Garland has blocked any appointment of a special counsel.
What is particularly chilling is that the establishment in Washington is not even trying to rebut the widespread view of a two-tiered system of justice. Attorney General Garland has failed in his pledge to restore trust in the Justice Department, which is now lower than it was under his predecessor, Bill Barr.
Why would anyone expect anything different? That happens at all levels of government. I watched someone get away with DUI, and even get an apology from the cops, because their father sold cars to the department. If having a father who sells cars to the department is a Get Out Of Jail Free card, then having a Senator/President for a father is a Get Away With Felonies For Free card.
That's just the way it is and always will be.
But it need not be. And when it happens, to anyone, even if you seriously hate that person, it needs to be called out for the shit it is.
Sure, but it won't make a difference. There's always been two justice systems: one for the people on the inside and another for the rest of us.
And that's what's happening to Trump. He's on the outside now.

By 12, she alleges, she was prescribed puberty blockers and testosterone by doctors who failed to provide sufficient psychological screening and who told her parents: “It’s better to have a live son than a dead daughter.”
At 13, Kayla had her healthy breasts removed in a double mastectomy to masculinize her chest. And, by 17, she’d realized it was all a mistake — and that the professionals around her had failed to protect her.
“The hardest part was being sold something that I believed was going to help me and make me feel better, only to do it and come out on the other side not feeling any better,” Kayla said in a YouTube interview. “I could always have waited, but I can’t undo it.”
I first reported on detransitioners a year ago, when the phenomenon was still little known.
