Border Patrol Shoots and Kills Arizona Man Who Called Them for Help
The FBI is investigating the shooting, but Supreme Court precedent from last year's Egbert v. Boule will make it nearly impossible for Raymond Mattia's family to find justice through civil courts.

Raymond Mattia, a man of the Tohono O'odham Nation from Menagers Dam near the American side of the Arizona/Mexico border, called U.S. Customs and Border Protection agents for help last week, according to a family member quoted by News 4 Tucson. "He called to request for assistance because there were multiple illegal immigrants who had trespassed into his yard and he wanted assistance getting them out of his property."
When they arrived last Thursday night, for reasons yet unknown, those Border Patrol agents shot Mattia dead.
While no video or detailed eyewitness account has yet been released, and Customs and Border Protection are playing mum with the media so far, the detailed account from News 4 Tucson says:
The family said Mattia went outside when he saw the agents. They claimed he was just two feet away from his front door when suddenly shots rang out.
"I had heard all the gunshots like it was just a war. I just went into shock like I couldn't believe what I was hearing."
The family is still confused as to what happened that night and they want answers.
"They told us there was an estimated 38 shots fired at him. You know that's excessive and we want justice and we want to know what happened and why there were so many Border Patrol out there shooting at him."
The FBI is already investigating the shooting, but Supreme Court precedent will make it nearly impossible for Mattia's family to find justice through civil courts.
As Reason's Billy Binion reported in detail, the Court decided last June in Egbert v. Boule that immigration officials (at issue in that case) are seen by the federal courts to have more or less absolute immunity for violating citizens' rights. Plus, by neglecting to take up two other cases in which citizens tried to hold federal officials to account for rights violations, the Court seems to think, as Binion wrote, that U.S agents of all sorts have "absolute immunity for committing transgressions while policing domestically."

Ashli (I misspell her name apparently, I guess it’s “Ashli”) Babbitt clearly violated a border, was trespassing and didn’t belong inside the social construct known as the Capitol building. Weapons free, gentlemen, weapons free.
So thank you for actually confirming my statement about Ashley Babbitt that I posted long ago. That from a libertarian perspective, property owners are justified in shooting trespassers. So from a libertarian perspective, Mattia would have been justified in shooting the immigrant trespassers (or any trespassers) on his property. The Capitol Police were justified in shooting Ashley Babbitt for trespassing at the Capitol.

Okay then. Let's suppose we are living in Libertopia, and Bob decides to go to Alice's Diner. In Libertopia, of course, there are no food safety regulations. It is up to Alice to decide on how to best serve food to her customers. And Alice *means* well, but, ya know, sometimes she forgets to put the mayonnaise back in the refrigerator. She has a lot to do running a busy diner, after all. So when it's time to make a chicken salad sandwich, sometimes it's with room-temperature mayonnaise. So Bob orders a chicken salad sandwich, and promptly gets sick from the rancid mayonnaise. He suffers real economic harm when he misses work and income due to the illness that he suffered as a result of eating that sandwich.
So, does Bob have a case against Alice? I mean, Alice didn't *try* to make Bob sick. She meant well! Why would she deliberately try to poison her customers? It makes no sense. And yet Bob got sick, and he claims it's because of Alice's rancid mayonnaise. Alice says "caveat emptor" and that he should have known that his sandwich had bad mayo on it before he ate it.
So, what do you think? Because if you say "no, Bob should have known better" then I am going to argue for completely open borders - even sick migrants should be able to come here. After all, they don't *intend* to spread disease. They are only coming here for better economic opportunities, etc. It's not their fault! In the case of the diner there's clearly a duty to your patrons to serve food that won't make them sick. In the case of walking around in public it's less clear that there's any duty. I'm not even sure where the bear thing falls because it's so bizarre; bears don't ordinarily pop out of trunks and then hide in them again and it's not ordinarily reasonable for anyone to think that is happening.
I agree that under current law and custom, Alice would be guilty of negligence for serving rancid mayonnaise, while the random sick guy spreading disease would not be guilty of negligence. But this is a confusion between "is" and "ought". From a libertarian perspective, the ultimate legal authority is the NAP. That is why I specified that this is happening in Libertopia, not in the modern US. So in Libertopia, what does it matter if the "aggression" occurred via bacteria in spoiled mayonnaise, or in viruses from exhaled sputum? Neither one is intentional, but yet the result in both was that someone got sick and was harmed.

The border patrol's job may have been what you call a "war on migration", but the actions of the border patrol as described here were the reverse of their job; they killed the citizen and left the migrants alone! The border patrol *failed* to engage in a war on migration, and decided to engage in a war for migration instead.

I don't think "trespassing in the commons" is even a thing. But the US Capitol is not "the commons", and Mattia's private property is not "the commons" either.
The larger point is that trying to strictly enforce insane border security laws will lead to violation of civil liberties like this one. Just like with the War on Drugs.

In regards to your last paragraph, I don’t think this horrible incident is really an indictment of “trying to strictly enforce insane border security laws”, seeing as how they could have all been citizens and he still could have ended up dead after calling the authorities on people who were trespassing.
To the larger argument: The commons in this conversation (immigration) would be all publicly owned land (presumably ROW’s, parks, government land that’s not a military base, etc., etc. That’s the argument you make when you say that you or I have the right to invite an illegal immigrant to come work or live or shop on our property. Namely, they’d have to use the commons to get there.
The anti-illegals immigration people are saying “Now wait just a minute there, seeing as how that is public property, the public, through their representatives, gets to decide if non-citizens use it.”
