Brickbat: Close Enough

Randal Quran Reid spent six days in an Atlanta jail after local officers picked him up on warrants for theft from Louisiana, a state he has never been to. He was not told why he'd been arrested. But a Louisiana attorney Reid's family hired found that he was accused of theft from a consignment store. When he was shown store security video of the suspect, he saw that the man looked sort of like Reid but was obviously heavier. Talking to the police, he came to believe that they had used facial recognition technology to ID Reid as the suspect, which an anonymous source close to the investigation confirmed to The New York Times. But that isn't reflected in any of the documents in the case. And no one from the Jefferson Parish sheriff's office will confirm that on the record, even though public records show the sheriff's office has a contract with a facial recognition vendor. Reid was freed and his warrant was withdrawn after his attorney gave the sheriff's office photos of him and they saw that he has a mole on his face the suspect did not have.

If there's a warrant there has to be an affidavit showing probable cause, right? The facial recognition has to be on there if it was used, right? The guy has a right to see that warrant, right?
No, no, and no.
This is the kind of thing I think of when I hear "defund the police." Police agencies seem to be awash in money to buy any dystopian "crime fighting" technology or data sets that they like. Even in relatively poor states like Louisiana.
A lot of their technology, especially the military kind, is gifted from the federal government.
Release the warrant application. If the judge signed off on this with only this flimsy id he should be removed from office immediately. Cops should be fired as well. And both should personally be held to pay back the family with interest.

Pretty sure judges enjoy complete immunity and can only be removed by impeachment.

However (correct me if I’m wrong) state judges aren’t immune from federal criminal charges, and the feds surely have laws making it a crime to violate civil liberties; broadly worded and with breathtakingly harsh penalties. So that federal officers and DAs could easily get warrants and indictments if they ever decided they wanted to. They could even do kick-door black-mask raids and lengthy pretrial detentions of state judges if they wanted to.
It’s all about getting people who are seriously interested in doing something about it.
The founders created checks and balances. They didn't imagine collusion.

There's another method available to remove corrupt officials. We just don't do it very often.
While I agree with you in principle, the reaction to that method would be more laws and more cops.

The judge was almost certainly lied to by a police. Judges pretty much have to accept that police making statements under oath are telling the truth, in the absence of clear reasons to suspect otherwise. The police responsible, though, should be charged with perjury (and anything else going).

If it was possible to place limitations on what police do, this would be one of those things.
Sadly, we don't live in a world where we get to tell the "public servants" what do do.

Remember when suspects had a right to be told exactly why they were being arrested? Miranda rights, they used to call them. But that was back in the old days when it wasn’t just another authoritarian state.
This article states: "He was not told why he'd been arrested."
But the linked article states that at the time of arrest The suspect says:
"“What did I do?” Reid asked. The officer said he had two theft warrants out of Baton Rouge and Jefferson Parish"
Somebody's wrong.
Probably told him he had two warrants for theft, but didn't provide him with any additional information about the circumstances of said warrants.
Reminds one of the scene in Paul Newman's W.U.S.A., where late-night cops with flashlights intimidate by hinting "we hear you're wanted for a morals charge down in Thibodeaux..."
The guy's lucky he wasn't suspected of helping a pregnant woman escape North to freedom.
