With the Trump Arraignment, Americans Are Seeing the Power of the Local Prosecutor
Alvin Bragg's case against Donald Trump has put the once-obscure position of district attorney into the national spotlight.

Manhattan District Attorney Alvin Bragg has written himself into the history books and future pub trivia questions by becoming the first prosecutor to pursue criminal charges against a former president. Whether his case against Donald Trump is successful or not, Americans nationwide are now seeing the power that local prosecutors wield, sometimes capriciously.
The Manhattan D.A.'s investigation took nearly five years, and both Bragg's predecessor and the Federal Election Commission declined to file charges on the same evidence. Reason's Jacob Sullum wrote in a recent breakdown of the case against Trump that Bragg is "relying on debatable facts, untested legal theories, and allegations that are tawdry but far from earthshaking." The New York Times somewhat more gently described the meanderings of Bragg's investigation as a "circuitous and sometimes uncertain road."
Political opponents of Trump may insist it's the destination, not the journey, that matters, but Republicans and conservative commentators have lambasted Bragg's decision to file charges as nakedly political abuse of prosecutorial discretion. Florida Republican Gov. Ron DeSantis called it the "weaponization of the legal system to advance a political agenda."

Bragg may be exercising disastrously bad judgment by pursuing a weak case against Trump. There is a fair amount of agreement he is. But he is well within the powers handed to him by Manhattan voters. Prosecutors have broad leeway and a wide spectrum of overlapping crimes at their disposal. They exercise discretion every day in which ones they charge, which ones they drop, and what sort of plea deals they offer.
The conservative criticisms of Bragg never fail to mention that his campaign was backed by financial contributions from liberal megadonor George Soros. Bragg is part of a wave of progressive district attorneys that have won elections in major cities across the country, many of their campaigns funded by super PACs aligned with Soros.
Braggs' flaw isn't that he ran as a criminal justice reformer. It's that he makes bad decisions. Bragg actually has a history of overcharging some defendants, despite campaigning to end mass incarceration. Reason's Billy Binion reported on several cases where Bragg's office pursued charges against New Yorkers who were clearly defending themselves against attackers: In one case a bodega worker was charged with murder for fatally stabbing a man who assaulted him; in another, Bragg's office pursued murder charges for nearly a year against a domestic violence victim who stabbed her estranged husband, despite Bragg publicly calling the killing "self-defense" and campaigning on her innocence. Prosecutors eventually dropped the charges in both cases, but not before there was considerable public attention.
In the criticism of "Soros prosecutors" in general, there also seems to be a misguided notion that the prosecutors they replaced were playing it straight down the middle—no political agenda, no funny business. It's a common error that mistakes the status quo for being apolitical.
It's political and discretionary when prosecutors pursue cases built on unconstitutional policing. It's political and discretionary when prosecutors decline to charge cops for conduct that would land any other person in prison for years. It's political and discretionary when prosecutors oppose DNA testing that could exonerate a wrongfully convicted person.
DeSantis condemned Bragg's decision to file charges against Trump as "un-American," but getting rung up on flimsy criminal charges by a politically minded district attorney is as American as a fighter jet flyover at an NFL game. It happens to innocent parents. It happens to teenagers who were coerced into false confessions. Hell, it happens to children.
We like to keep up appearances as a respectable country, though, so our justice system only railroads normal people, not presidents. When Trump says things like, "If they can do this to me, they can do this to you," remember that they've already been doing it to people like you.

The Soros-backed 'progressive prosecutor' I mention below, Kim Gardner, a few years back tried to take out Missouri's Republican governor over the objections of the alleged victim in a case that happened outside of her jurisdiction.
She eventually had several hearings before the MO Supreme Court to try to maintain her law license over issues relating to that case, among other things. But she did get the governor to resign before the case was thrown out, so I guess she probably still considers that a win.
And, she's currently back in court trying to keep the state Attorney General from having her legally removed from office for dereliction, basically.

The latest is not tying the felony elevation to federal election laws (a felony) but to NY State election laws (misdemeanor). So he is using a misdemeanor to raise another misdemeanor to a felony. Just as law intended or something. Ignore that federal elections are in federal jurisdiction, not state.

It's not either/or. You can think the Soros prosecutors are a big stride in the wrong direction without whitewashing all other prosecutors.
The Soros prosecutor who's currently in the process of being removed in my metro area replaced a fairly moderate Democrat / liberal prosecutor, and she's been notably so terrible at her position that something like 70% of the people in the city think she needs to go. And there's obviously an agenda with her office and it's obviously tied to politics and the Soros groups. And when I say 'obviously', I mean 'documented'.
Meanwhile, out in the county, we had another 'progressive' reform-minded prosecutor who replaced a more moderate Democrat. But he's not linked to those woke organizations, and he's been noticeably better and much more professional. He isn't facing accusations of corruption or breach of office or having to go before the Missouri Supreme Court and explain why he should get to keep his law license.

Maybe when a grand jury first meets, the judge can give them a rousing speech about how they're the first line of defense for innocent suspects, they should not hesitate to demand more evidence if they have questions, that they shouldn't dare think in terms of passing the buck for dubious prosecutions ("these problems will get solved at the trial if any"), and not to let the prosecutor rush them.

A pardon undoes a conviction, in most ways, but it would not clear you of another crime that just required “an unlawful purpose”.
As interpreted by New York courts — and, in my opinion, correctly — the purpose must entail the intent to break any law, in any country, regardless of whether you are charged, let alone convicted, of the crime, and regardless of the jurisdiction.
If you forge a New York document so you can smuggle Playboy Magazine into Saudi Arabia, and then don’t do it, that is still a felony in New York State.
And I would be okay with all this, except that Bragg is only charging Trump because he does not like Trump personally and he hopes to benefit politically from the indictment.

I'm sorry, but no. This point is extremely debatable. I'll agree with the larger point that DAs wield enormous power and discretion, but this is a case where the DA is probably violating.
Taking a completely innocent person and hiding all the exculpatory evidence in order to get an indictment: completely within a DA's normal discretionary powers.

What both of those cases mentioned relate to is someone using force to defend oneself. That's a big no-no in progressive circles and those are the kind of people they believe should be imprisoned.

The real question concerning "dumping money into elections" is: Why does that seem to work? Does it really work? If so, why do voters more frequently elect candidates with big money behind them? After reading the indictment, I'm still at a loss at how Trump is even being charged with any felony at all. Basically the case states that the bookkeeping of the payments was out of whack - in other words, the books said that the payments through or by Trumps' attorney (Cohen) at the time were postdated to represent retainer fees for a retainer agreement that did not exist in 2015, 2016, and 2017. (Hence the 34 counts - 1 for every month the so-called payments were being made to the two woman and AMI via Cohen.)
So, with that in mind, I'm wondering that if the records had recorded payments that matched the dates of the real payout amounts to two women and a notorious tabloid syndicate simply to not make a stink about Trump prior to the election, if Trump wouldn't be under fire because technically speaking all the books would be on the 'up and up'?! After all, it was Cohen who actually made the payments and he has already been successfully prosecuted for those so-called crimes.
The fact is that this is a non-story, entirely prejudicial and totally politically motivated - if Trump were not running for president in 2024, this would not have even made it in front of grand jury. And [sic] the fact that the DA attempting prosecution of Trump is tied to George Soros, a well-known NAZI sympathizer, is only icing on the cake.
Meanwhile, the Federal Reserve, an independent non-governmental central bank is quietly and openly imploding the U.S. banking industry and the fiat dollar we use, but hey, let's focus on chump change going into the hands for simply not talking to the press - as if that doesn't already happen every single day for any other high-profile politician or businessman.

But why do these "books" even matter? He's not a public company, these transactions didn't have to be reported to anybody.
I suppose you’re correct in your assessment if these had been transactions made directly from the pockets of Trump, but there were intermediaries, namely Cohen using a couple of “shell” companies that reported these transactions for “tax purposes”.
The fact is, they were recorded and handed over to the state.
Sounds more like a set-up on Cohens’ part. Nevertheless, these “books” were recorded for tax purposes and so they came under the purview of NY to prosecute Cohen and now Trump for, pardon the pun, trumped up charges that mean absolutely nothing to anyone other than those looking for a distraction. Just another dog and pony show.
NY claims falsified documents for records that show payments for something that didn’t actually occur (the retainer agreement). Therefore NY is saying that you should be imprisoned for documents that legitimized, if not obfuscated, the purpose of that money exchanging hands – even if that money was taxed and declared!
If anything, this is a “process crime”. I don’t think at any point that this DA will be able to prove beyond a shadow of a doubt that anything felonious actually occurred and that the outcome of the 2016 election hinged on the silence of two women and AMI not publishing their allegedly “damning” accounts of sex acts that occurred between consenting adults.
If anything, this is proving to be chilling for anyone who has something legitimate that may hurt them in a professional manner – not because it makes them a bad person, but delivers them into the public eye as being a deviant – even if those acts occurred in private, behind closed doors and without any harm to one or the other party. The kicker here, again, is the fact that what happened happened in private – there is no need to know, nor any positive outcome of knowing such knowledge unless it is to construed that what Trump or any number of other people have done is itself criminal in nature. Nope: the only purpose that anyone coming forth during a political campaign or in business and bringing to light things best kept in the shadows is for the purpose of destroying the character of that person.
It’s just like Canadian PM Trudeau Jr. or other politicians who at some point appeared in black face – would anyone, even black people, care if they weren’t openly supporting rewriting history and calling “white people” racists simply for being “white”? No – it comes down to their actions now as being tyrannical – not the fact that what they had done in the past was actually wrong or insensitive. Frankly, no one cares until you start infringing on peoples’ rights. At that point you show your outright hypocrisy and exposes how everything is rigged in favor of the power of ‘the state’.
Even if I morally object to the things that we’ve learned many people have done behind closed doors because they are things not even I would ever think of doing, doesn’t mean that this knowledge should be loaded into a gun to destroy that person – especially not if it comes down to that persons’ political beliefs with the exception if you're platform is one of sexual abstinence or moral high ground that clearly contradicts your past or present actions. Otherwise, it seems that the people most hurt by this are ones that the ‘establishment’ dislikes – unlike the deviants in other areas of politics that get a pass simply because they toe party lines or are useful for some end.
In a perfect world, everyone would be ‘moral’ – but to one, moral might mean Biblically strictured and to another that may simply mean “as long as I didn’t hurt anyone else…” So, in many cases, it comes down to public perception and the social mores of the time to determine what might be considered “moral” and I’d fare to say that as long as it doesn’t involve kids, many people don’t bat an eye when they hear so-and-so did the deed, no matter how kinkily, with x and y and z.
So, in the end, cases like this against Trump are done as a distraction that pose real-world consequences over the most trivial baloney.
The alleged crime(s) didn't even result in tax consequences other than OVERPAYING payroll taxes via Cohen's reimbursement. This is clearly (another) political hit-job using a hand-picked and VERY biased judge.

My assumption is that the case law regarding falsified financial documents as criminal would be related to racketeering charges against the mafia/cartels etc. that have no reason to have assets that taxes have not been paid on.

It is plain and simple, Trump is being targeted by his political opposition for purely political motives.
While I dislike Trump, I abhor what the demented leftists are doing which reeks of using authoritarian methods to eliminate your opposition and force your will on others.
The Democrat party has lost it's grasp on what is reasonable and it's only a wonder why even more rational liberals have not left the party.
We have two major parties that are dysfunctional. The Republican party has a split personality and the Democrat party is simply collection of extreme leftists with a penchant for authoritarianism.
The answer is essentially the break up both the Republican and Democratic parties by a mass exodus of members to other third parties. My preference is the Libertarian party, but others would prefer the Green party among others.
Third parties need to sharpen their focus on specific topics instead of being all encompassing. Many voters will prefer the honest approach versus the current "Us versus Them" narrative spewed by the corporate media.
