A College Fired a Professor for Showing a Painting of Muhammad. Now, It Could Lose Its Accreditation.
"If Hamline won't listen to free speech advocates or faculty across the country, they'll have to listen to their accreditor," said FIRE attorney Alex Morey, who filed the complaint.
In December, Hamline University spurred outrage after the college fired an art history professor for showing a 14th-century painting of the prophet Muhammad in an Islamic art class. While the school was roundly criticized for its swift silencing of faculty academic freedom, the college is private, and thus largely protected from legal consequences.
However, one free speech group has found a way to penalize Hamline: filing a complaint with the school's accreditor, which explicitly requires that colleges receiving accreditation protect academic freedom.
On October 6, an art history professor at Hamline University, a liberal arts college in Saint Paul, Minnesota, showed students a 14th-century painting that depicts the prophet Muhammad receiving his first Quranic revelation. The professor, who has not been named, reportedly contextualized the image for several minutes beforehand, telling students "I am showing you this image for a reason. And that is that there is this common thinking that Islam completely forbids, outright, any figurative depictions or any depictions of holy personages. While many Islamic cultures do strongly frown on this practice, I would like to remind you there is no one, monothetic Islamic culture." According to The Oracle, Hamline's student newspaper, the professor insisted in a later email that, "I did not try to surprise students with this image."
However, one student in class that day—the president of Hamline's Muslim Student Association—took offense, complaining first to the professor, and then to school administrators. According to The Oracle, the school took swift action against the professor. On November 7, undergraduate students received an email condemning the unnamed incident as "undeniably inconsiderate, disrespectful and Islamophobic." Four days later, David Everett, Hamline's associate vice president of inclusive excellence told The Oracle that "it was decided it was best that this faculty member was no longer part of the Hamline community." The professor was an adjunct, which is what allowed the school to fire them without due process by simply declining to renew their contract.
The incident sparked outrage from free speech advocates. The Hamline administration's assertion that "respect for the observant Muslim students in that classroom should have superseded academic freedom," was subject to particular criticism. As Amna Khalid, a history professor at Carleton College wrote of the incident in The Chronicle of Education, "Barring a professor of art history from showing this painting, lest it harm observant Muslims in class, is just as absurd as asking a biology professor not to teach evolution because it may offend evangelical Protestants in the course."
However, Hamline's status as a private university seemed to afford it protection from real consequences. While organizations like the Foundation for Individual Rights and Expression (FIRE) have long argued that it is a contractual violation for private colleges to violate free speech and academic freedom, when they also make explicit promises of such protections to prospective students and faculty, the theory is largely legally untested. However, in this case, FIRE may have found a way to hold Hamline accountable.
On January 4, FIRE announced that it had filed a formal complaint with the Higher Learning Commission, Hamline's accreditor. The professor's "nonrenewal violates both HLC and Hamline policies clearly committing the university to free expression and its corollary, academic freedom for all faculty," wrote Alex Morey, FIRE's director of campus rights advocacy, in a letter to the accreditor.
"We gave Hamline plenty of time to reverse course, but it's clear they're not planning to deliver on their academic freedom promises," Morey added in a press release. "If Hamline won't listen to free speech advocates or faculty across the country, they'll have to listen to their accreditor."

I worked in higher education, and my work involved making sure we were compliant with external accreditation standards. It takes a lot more to “lose accreditation” than one standard not being met.
If the accrediting body decides to intervene, which I doubt they will, then they will provide the institution with a recommendation, and the institution will have time to implement recommendations. Typically accrediting bodies review institution self-studies on a cycle, typically every seven years, which is why this letter will likely be ignored.
I had assumed that at most, the accreditor would send a sternly worded letter. That’s just how bureaucracies work.
In addition, much as I despise wokies and recognize them all as marginal students “studying” marginal fields with marginal professors, that doesn’t make them all stupid, and if there was any real merit in this approach, the wokies would have been doing it for years.
Why? The Wokies are the administration so being barred consideration within the system FIRE is attempting another route to external pressure.
This is not a quick or even sure fix but hopefully is one more avenue to accountability to prevent higher ed from going full marxist indoctrine center.
I did not know the specifics of accredation. However it seemed facially obvious to me, that the accreditors, are simply a money making organisation, that wants as many institutions as possible to pay them dues, and has little interest in the actual academic standards implementation. Except to the extent that perception of the accredation value might be affected. It would take a concerted campaign that put a lot of egg on the face of the accreditor, to have any impact. Hamline University is a private university! They should be able to hire and fire whoever they want for any reason they want! Why should they be punished for it (including eligibility for funding)?

Furthermore, even if these academics were state employees, the state could still legitimately restrict their speech as a condition of employment.
It was meant as a reference to how the federal government through the Department of Education has taken over all institutions of higher education that receive federal money, especially in the form of federal student loans and grants. It’s how they can force schools to follow the contorted Title IX or the ineffective Cleary Act and the overzealous and misapplied FERPA. Seems like the Con would also be applied, but guess there’s gotta be some semblance of separation between “private” and state schools.

Why should they be punished
Because they explicitly present themselves as an institution practicing academic freedom, including by accepting accreditation from an organization that explicitly values and requires it.
It could be construed as breech of contract, with the teacher, with the accrediting agency, and with students who expected to get a good education, rather than a biased one filtered through the prejudices of certain favored student groups who prefer everyone to remain as ignorant as themselves.

I felt the same way about the other professor that was using the University’s logo/letterhead on her unionization stuff that FIRE sued.
FIRE’s theory is that they violated that contractual relationship by falsely claiming to honor academic freedom.

If they’d fired him in the middle of the contract FIRE wouldn’t need a theory, not having fired him in the middle of the contract, FIRE’s using a theory and administrative extortion to alter the contract more factually than any theory they dream up.

I don’t have a problem with that, as regarding private schools, but if one desires “accreditation” for ones educational institution, there are standards to be met. Not being accredited does not mean the school is necessarily “bad,” either.

If accreditation is important to you, well, it’s important. If you want what you feel is the best education for you, personally, irregardless of accreditation, then it obviously doesn’t matter.
One of the highest rated (private) high-schools on the west coast (up until the late 1970’s/early 80’s), was not accredited. It was a small school. The Senior graduating class the year I was connected to the school was seven individuals. The students wore tuxedos. The guest speaker was George Moscone, then CA State Senator and future mayor of San Francisco.
As the owner/director of the school noted, the parents of his students “…could buy half of Oakland.”
Accreditation was not an issue.
Accreditation for the institution may, or may not, be important to the operators of the school or to their students.
The problem is accreditation also feeds into careers, does it not? Many medical schools will not accept a bio degree from a non accredited school. This in turn leads into growing the DEI into professions in general. This has been the slow change leading to current race/sex based society.
So allowing corruption of an entry point corrupts an entire industry. Nobody should be supportive of this effect. It is the same as 20 years ago people saying not to worry about post modernism, it will stay in colleges. It is a naive belief that will corrupt not only industries but society. You shouldn’t ever fight truth simply as it being not a big deal. That is how culture becomes corrupted.

If you want to take somebody else’s money (or borrow it,) to pay your way through college, the college has to meet the funders’ “standards.” The lender, whoever it is, can also stipulate what kinds of classes one can take. Parents who fund their kid’s education have been known to do the exact same thing.
While I could make a case for limited financial aid in some cases, when it comes to “student loans,” the Feds shouldn’t be funding college educations anywhere. Leave it to the banks.

Tenured faculty are going to disappear. Everyone not in an endowed chair will be an adjunct. It makes them cheaper and less powerful so that the administration can run the show instead of educators.
The problem is the government uses these institutions as gatekeepers. You can’t get a job in a lot of fields without the right credentials from the right places by law. Fix that and a lot of these issues would go away. But it won’t be fixed because administrators are delighted to be able to can someone when a member of an aggrieved group complains, not because they’re woke, but because it increases their ability to use power arbitrarily.

Yep. At the university I went to, the local government wanted to issue all students special “ID cards” to help the police recognize “troublesome” students or some such crap. If the art had been offensive to Christians, administration would have barely read the complaint, and the professor would have never even heard about it.
Baloney. If the art had been offensive to “Christians”, it would have been all over the reich-wing media for weeks, and the campus would have been inundated with protest letters, protesters, and various far-right nutjobs trying to infiltrate the campus. The university would have had to roll over and fire him to quell the uproar.
The first part, probably, but only 2 or 3 months after the fact unless some right-wing student was in the class and recorded it. The second part, not so much.
Hamline’s website says that 95% of incoming undergraduates get some form of financial assistance. So things like firing this professor for the reasons stated will only end when a critical number of alumni stop writing checks and students stop applying.

The Professor should politely thank them for their employment, go find a better University that better respects free speech and the fundamentals of liberal arts education, and encourage his colleagues and former students to do the same. Unlike Harvard or Yale or anyplace else with a mega endowment, 20+ thousand students, a reputation known round the world, political connections in every corner, and a government shoveling money into their coffers on top of the endowment, Hamline’s only got like 3,000 students. If the Prof was that good and 3, or 30, or 300 students leave, the University will know.
I just wanted to say that intellectually the comparison given by the students is disingenuous. They are comparing this event to teaching that Hitler is good…that’s ridiculous. Comparing this to a man who committed genocide? The correct comparison was given in the article…this is equivalent to teaching evolution. Many Christians become uncomfortable around the topic of evolution, and some churches would like the teaching to be banned from schools, but it’s foundational to our understanding of biology…you can’t really learn biology if you don’t understand evolution. I heard these exact words from a Mormon who majored in biology at BYU. He said he had no idea that he missed a fundamental teaching until he left the church.
“Islamophobic” in an Islamic art history class to show a piece of art from Islamic history that is offensive to some Muslims, so terminations are in order. Good grief. If it were an art professor showing some intentionally provocative, deliberately blasphemous piece depicting Jesus engaged in a homosexual orgy with his disciples, I think we can safely assume college administrators would’ve backed him 100% in the name of artistic and academic freedom, with or without a supplied context, and the word “Christianophobic” would not be thrown around at all.

I can’t believe that there’s so much going on with colleges and universities, it’s like I was studying in a different century because everything was more or less calm at that time. Do students even use various essay writing services like paperhelp nowadays? I feel like the whole system has changed, or maybe just people’s opinions on some topics, idk.
