What Do Republicans Want To 'Prosecute Fauci' for, Exactly?
Elon Musk reignited the GOP’s interest to bring charges against Anthony Fauci.

"My pronouns are Prosecute/Fauci," Elon Musk tweeted early Sunday, launching a new round of condemnation from his progressive critics and glee from his growing base of right-wing fans. But Musk, while admittedly a skilled pot-stirrer, is little more than that where the substantive demand of the post is concerned: He can't investigate—let alone prosecute—retiring National Institute of Allergy and Infectious Diseases chief Anthony Fauci.
The Republican lawmakers who cheered his tweet, however, can do exactly that, particularly after the GOP regains control of the House in less than a month. Yet there's a crucial piece missing in the vast majority of "prosecute Fauci" discourse, from legislators as much as from Musk: What, exactly, is the anticipated charge?
Reason reached out to the offices of six GOP lawmakers who had positively engaged with Musk's post and/or previously expressed intent to investigate Fauci next year: Sens. Ted Cruz (R–Texas) and Rand Paul (R–Ky.) and Reps. Andy Biggs (R–Ariz.), Marjorie Taylor Greene (R–Ga.), Ronny Jackson (R-Texas), and Kevin McCarthy (R–Calif.), the latter of whom is the embattled front-runner to be the new House speaker. Are there specific charges, I asked, which the lawmakers expect to be brought against Fauci after a probe by Congress or some other investigatory body?
All four representatives' offices ignored the question. But the senators' offices did reply and, in doing so, staked out the better of two ways this cause célèbre could be pursued.
Cruz's team gave the less specific answer of the two. They pointed me to a recent interview the senator gave on Fox, his face placed next to a photo of Musk. "Dr. Fauci lied to Congress—he flat-out lied to Congress when he said that, No, the federal government had not funded gain-of-function research at the Wuhan Institute for Virology," Cruz said. "Subsequently the NIH [National Institutes of Health] has made clear that was a lie, and yet, you know what, [Attorney General] Merrick Garland and the Biden DOJ, they won't prosecute him, so when [Twitter staff] come in front of Congress and perjure themselves, I am sadly confident that Merrick Garland will not prosecute them."

I asked if it would be fair to say Cruz has a federal perjury charge (or something in that ballpark) in mind for Fauci, but his office was unwilling to commit to the specific statute.
Paul, however, was willing to commit. His office referred me to a July letter he sent to Garland pressing for investigation into Fauci's congressional testimony about National Institutes of Health (NIH) funding for gain-of-function research in Wuhan, China, the city where the novel coronavirus first infected the public in late 2019. Paul's letter specified 18 U.S. Code § 1001, a portion of federal criminal code concerning fraud and false statements knowingly made to a congressional investigation, as the statute Fauci may have violated.
In a comment sent by email, Paul reiterated his interest in pursuing "a robust and bipartisan investigation into the origins of COVID" in his new role as ranking member of the Senate Homeland Security and Governmental Affairs Committee next year. "Daily we are discovering new information that we will reveal as the investigation continues," he wrote.
Whether a perjury, fraud, or similar charge would stick is far from certain. As Reason science correspondent Ronald Bailey has detailed, whether the research in question is actually gain-of-function work is legitimately disputable, though the more recent NIH statement Cruz seemed to reference may indeed tip the balance of evidence toward "yes." Still, that statement describes the NIH grant recipient, EcoHealth, failing to make a required report, which means it's possible the funding did go to gain-of-function research and that Fauci sincerely believed it didn't.
That scenario points to a tricky aspect of this sort of allegation: It requires proving knowledge more than action, and it's not always feasible to prove what someone knew and when. But Fauci's long public employment means he has reams of correspondence in federal records, so testing a charge of this sort may be easier than it would be in most circumstances. If he's committed fraud or perjury as a high-ranking federal official, by all means, let's prosecute (but not imprison).
The trouble is this sort of specific, dis/provable, and fairly narrow allegation of willful deception is not where the great bulk of the "prosecute Fauci'' conversation is going. (None of those four House members, for example, clearly have it in view. "I affirm your pronouns, Elon," said Greene's reply.) What Cruz and Paul are trying is the better of two versions of this cause—but it also seems to be, by far, the less popular.
More common is something in the realm of Musk's follow-up tweet, which cast Fauci as the corrupt Wormtongue to President Joe Biden's decaying King Théoden in a scene from The Lord of the Rings. "Just one more lockdown, my king," Fauci whispers.
But giving bad advice is not a crime—and baseless calls for prosecution are no improvement over failure to prosecute powerful figures at all. They might be good for collecting likes and donations, but that doesn't make them good for bolstering the rule of law.

In Scott Atlas’ book, he describes all the times that he went to meetings bringing in scholarly papers on COVID, lockdowns, pandemics in general, etc. He couldn’t get Fauci, Birx or Collins to discuss any of the papers. They evinced no interest in actual research.
That is negligence of the kind that is criminally liable since there is solid evidence that the policies advocated and followed by the CDC, NIAID and others was killing people and at no time was this fact even discussed much less used to change the course.
Fauci should be prosecuted for criminal negligence and put away to spend what’s left of his life asking himself “Was it worth it?”

These people view government (at least the parts of government that they don't object to) as full of well-meaning public servants who sometimes make mistakes and who therefore deserve the benefit of the doubt, because they mean well. Also, there's virtually no possibility of anyone who even tries to seriously examine the costs of the Covid Response, as opposed to the costs of the virus unchecked will be allowed to retain any credibility long enough to publish a result. For a similar reason, the non "single-payer" side of any discussion about health care policy has already lost the long game; those same factions in the media have it planted in the heads of most of the US public that any opposition to State-run health care needs to have an "alternative policy" by which the State remains responsible for ensuring that everyone everywhere has unfettered access to every aspect of health care. Fauci certainly knew GOF research was being funded by his agency, when it was actually happening, and when he lied about if to Congress. That is the most likely criminal charge, and if pursued (it probably won’t be), he will get a slap on the wrist.
Unfortunately, he will never be brought to justice for his much larger crimes against humanity, which include (i) his extreme hubris (“I am Science, I am correct”) not allowing any competing/better plans, eg the Great Barrington Declaration, from getting a hearing; (ii) using the power of his and Collins’ offices to crush any dissent on the preposterous “natural origins” theory, giving the CCP political cover for over a year; (iii) telling US citizens, ad nauseum, that the vaxxes are safe and effective with little or no evidence to back it up; (iv) masking children (some freaks are still doing this); (v) undermining public confidence in institutions.

That might be a very valid avenue for prosecution. If the claim is that the research funded by EcoHealth was actually in connection to Bio-Warfare/Defense projects, then there's either a lifetime's worth of ITAR violations happening, or there's someone at the State Department who would have paperwork on the licensing for that research.
Whether that prosecution can get above the level of Eco Health Alliance and target Fauci would be another matter altogether and would likely require that Dr Daszak flip on Fauci. It would seem that there'd at least be grounds for an investigation into some kind of criminal conspiracy between Fauci and Daszak, but conspiracy charges are harder to convict on that purjury charges, and if they've been smart enough to not do critical communication via email (or do do like HRC and pre-emptively destroy the evidence), such an investigation could get very difficult and would definitely take years either way.
There might be something actionable in the awarding of a new contract to Eco Health just a few weeks after having revoked another one for failing to file required oversight reports, but that's pretty deep into "process" crime and not very sexy for the news cycle.
And employs the pathetically weak (high school) rhetorical device of lumping all those who want Fauci prosecuted into one political party.

I think it would be much easier to impeach the guy, actually. There's a long history of congressional investigations that did no more than ruin reputations. Aaron Burr, who actually was tried and acquitted of treason, comes to mind. Or Sen. The real disappointment for me on this topic is the medical community, and specifically the Scienced Based Medicine folks.

Writing years before covid, it was Novella who told me that masks don't work. In looking into the evidence behind people in Asian cities wearing masks in public, particularly on trains, he found that the research shows that cloth masks do nothing to prevent spread. He was surprised, because he supposed that at least some virus must be blocked, and it would at least stop you from touching your nose and spreading it around.
But the research showed that in the real world it didn't help at all.

Ultimately it boils down to semantics. What exactly is "gain-of-function"?
If I purposefully try to manipulate a virus to make it more infectious, that is clearly "gain of function".
But what if I am performing another type of experiment on a virus, and as a result of the experiment, the virus accidentally becomes more infectious. Is that type of research "gain-of-function"? And if the NIH funded my research, would it be fair to conclude that "the NIH funded gain-of-function research" even though that was never the intended result of the experiment?
It seems as though that is the type of gray area that the NIH-funded research at Wuhan fell into. It was definitely research about studying bat coronaviruses. But was it research that was deliberately and intentionally trying to manipulate viruses to give them additional functions? Or was it research to explore what these viruses could do, without trying to make them more infectious?
Also, let's look at it from a pre-pandemic point of view. Let's suppose, pre-2020, Fauci really is deliberately trying to fund intentional gain-of-function research in violation of the NIH ban on the practice. Then why would he choose only this one place to violate the ban? The Wuhan lab and EcoHealth were not the only groups doing research on viruses. You would think there would be evidence of gain-of-function research, or perhaps even other prohibited research, from other NIH-funded virus labs that Fauci would have permitted to evade the ban.
So sure it's worth looking into precisely what happened at the Wuhan lab, and worth looking into precisely what the NIH did fund. It is not hard to imagine that there are some people at NIH who screwed up and allowed research to go forward that they weren't supposed to. I would think it is strange that these types of individual grant-funding decisions would be made by Institute Directors, but hey I don't know exactly how NIH works, so maybe it was Fauci personally approving every single NIAID grant, okay.
As to the lockdowns. Fauci had no formal authority to order any lockdown. It was always up to governors and those with actual elected power to do so. Fauci ended up recommending some policies that turned out to be wrong-headed, but in the end they were always recommendations. Governors were free to refuse those recommendations, and some actually did (South Dakota did, I believe). The people responsible for lockdowns are the people who ordered the lockdowns.
Fauci clearly approved "gain of function" research and knew about it because he talked about publicly how important such research was. Furthermore, he didn't say that he didn't know, he unequivocally denied that such research was funded by him. That means he lied to Congress.
I suspect you can also hold him legally accountable for corruption, fraud, and conflict of interest, given the large amounts of money he and others appear to have received through patents and possibly other channels.

I’m just a confused old fart, so you can’t take any of this seriously. But just imagine that something happened.
And I’m not saying this happened, but let’s suppose that an unnamed government official funded some research in a foreign lab through an NGO, then when a virus escaped, a group of western researchers, who had determined that an unnamed virus was 80% likely to have been of lab origin, reversed their view after he had a ‘chat” with them to change that report to ‘definitely not of lab origin’ to hide his guilt. Then paid off those unnamed researchers with 70 million in research funds that he happened to control. After that, through his government connections with the mass media, had them censor any comment to the contrary and block any information regarding the efficacy and danger of any vaccines, thus preventing a better focussed response to the virus that never escaped from a lab not doing gain of function research he was not funding through an NGO. I’d say 16.9 million cases of manslaughter and maybe a hundred million cases of conspiring to commit grievous bodily harm – that that might be entirely inadequate for a pretty bad guy.
That would be a decent start for an indecent creature. Of course, this was done after the past president of this unknown country had made gain of function research illegal. Then there is the evidence of guilty knowledge, as in trying to hide the fact that he had used government money to fund it, that he induced viral researchers to hide it, that he induced the media to hide it (perhaps there is evidence coming out of a little bird’s beak right now), that he argued with a certain politician of an unknown country that it was not gain of function research (which that country’s former president had forbidden in what may have been another self-serving memo).
Of course, arguing strenuously that it was not gain of function research is pretty much an admission of guilt. Why argue about such a trivial point if he had nothing to do with it? Why should he care if it was gain of function research, after all, it came from another country? Nothing to do with him, hence nothing to argue about.
But a better question might be, “Why do so many libertarians wish to cover for a certain political party that is most certainly no friend of liberty?” It really puzzles me. But what can you expect from a 74 year old suffering from myocarditis, barely able to stand, due to an adverse reaction to a certain harmless vaccine that was claimed to prevent a certain illness. Oh yeah, he got the illness anyway, despite being fully vaxxed. Twice.
Now, completely untested on children prior to its use on them, a certain ex president stated, “Well, it’s been tested on them now!”, It sure has. It will be interesting to see the long term effects. My wife is a speech pathologist who has had to deal with some of the consequences on children who have been masked with cloth masks that do nothing to stop the spread of an airborne virus far to small to be filtered by a cloth mask. But those masks are sure great for blocking them from seeing people speak, never mind the consequence of wearing a wet mask for hours on end and breathing through it.

Yeah I'm another old guy who just can't stop believing my own lying eyes. Seems to me that your summary of events matches my own observations pretty much. I've spent a half century watching as the government/media narrative doesn't make as much sense as the competing "conspiracy theories". In the case of Covid we actually knew the effects of the disease in the very beginning thanks to an unplanned laboratory experiment on a Princess Cruise ship. We knew the infection rate, those who would be symptomatic, and who would be at risk for fatality. Everything that happened thereafter was clearly not done in the interest of public health but was done to promote a malevolent agenda. In the case of Fauci much of the evidence is in the public record thanks to emails released in response to FOIA and other public government documents. His personal profit motive acting as a sales rep for Pfizer is undeniable and continues to this day. The man is a thoroughly corrupt psychopath who deserves to be executed. But I'm generally opposed to capital punishment so natural life at hard labor works for me.
They republicans are accusing Fauci of certain things. They have prosecution in mind. With house under control, they first want official investigation into Fauci. We can hear from witnesses, whistleblowers, examine documents, etc etc. Senator Paul confirmed his desire for a bipartisan probe on this matter with an email reply to Reason. Senators are not prosecutors and do not need to wait until format criminal charges to launch hearings, probes, additional background checks, etc. The democrats did this to both BK and Trump.

And they end up answering their own question in the article. Covid was a once in a generation viral outbreak. It killed a lot of people and upended modern society. The origin is suspected to be at a Chinese lab. It was possibly man made. No, she lied to the FBI - according to notes about her interrogation by agents who would not allow the session to be recorded so there would be an accurate record not influenced by the agents. She never disputed the FBI's account, so it probably was mostly accurate in her case. There have been other cases where it was proved that such notes were typed up several times, with the details changing.
But the reason she was prosecuted for that is that she embarrassed the FBI and DOJ by publicly claiming she was innocent of the charges they were very publicly investigating, and by actually being innocent.

Senator Paul provided the receipts, as they say, right in the hearing you reference. Not only did the researchers publish their results as gain of function, Fauci had his agency change the definition of gain of function in an effort to obfuscate the fact.... and remember, spending US money on this was banned at that time.
Fauci also lied about the funding altogether.... he said that we didn't fund the lab, then pretended that he never said that and simultaneously pulled a "it depends on the definition of "is"" on the whole thing to explain away that lie.
He lied directly to me in a way that worked. He told me that a team of scientists had examined the DNA sequence and it proves that the lab leak didn't happen. I believed it. That would be ironclad proof. Nobody would lie about that.
And then I learned that the "scientists" who did that investigation were the ones who funded the research (you know, the funding Fauci was hiding). And I learned that at least some of the guys who's names were mentioned never saw the sequence. And that several sequences from the lab were missing. And that other virology researchers did examine the sequence when they said the bat theory was bunkum, and they had actual details instead of vague generalities. And ultimately, everyone decided to pretend that they never said it couldn't possibly be a lab leak.

This one is not borderline. The borderline questions are of the "what did he know" variety. The pushing a vaccine on kids that has no direct benefit to kids and may harm them in greater absolute numbers than simply letting them go unvaccinated. He has been asked about financial interests and refused to answer. This is a red flag. The government is spending billions to fill this mandate. The incentives are clear. So... bad policy... or payoff? That is a very real question. That is where the point of the spear should be... not "did he lie?" That is indisputable.

Cover up is always where any bureaucratic crime or misdeed starts. Fauci is no exception. And the very very early 'debate' among virologists about whether SARS-COV2 was a product of 'natural selection' (hence the Wuhan Seafood Market origin) or 'serial passage' (hence the Wuhan Virology Institute origin) is where it becomes possible to at least investigate cover up. That debate made it into a final published form by mid March 2020 - and that publication served to shut investigations down and distort the later WHO investigation into origins.
Many of those early emails between Farrar, Fauci, Collins, Vallance, etc smell really bad.
But the reality is that discussions about a 12 nucleotide insert (aka furin cleavage) have nothing to do with the public health advice (bad or good) about SARSCOV2. They occur mainly in the useless and incompetent US and UK pandemic response - where the rest of the world didn't give a shit about the origins only about what it IS. And they don't fit neatly into the sort of bullshit political take which is the only thing elected critters will give a shit about.
So we'll head down the bullshit-strewn path and fling poo everywhere - all while ensuring that NOTHING will actually change. The US and UK will remain the MOST INCOMPETENT wealthy countries when it comes to public health (and maybe even uncorrupted medical research/cronyism).
Nothing will actually change in the current geopolitical environment but that assumes that the empire can somehow survive. I have my doubts.

We call the intentional act of killing other people "murder". We investigate it and hold people accountable.
The fact that sometimes similar mechanisms kill people accidentally doesn't excuse murder.
Because the claim is that a laboratory in China, funded by the US, deliberately designed a virus that would be more deadly and harder to control, perhaps for use as a biological weapon. Whether that is true or not is an important question for Congress to consider.
That's a totally different situation than smallpox, which has occurred naturally since the dawn of time.
If it originated naturally, as a mutation of a previous virus strain, it doesn't matter much.
If it originated in the same city where researchers experiment on ways to make contagious diseases deadlier, as a means to study prevention or for use as a possible bio-weapon, and went on to kill millions, then the people who operated and funded the lab have a lot of explaining to do, and could answer to charges of criminal negligence and enormous civil financial liability for allowing the virus to escape the lab.

Apart from whether Fauci lied or not, whether the US funded research into making a virus more deadly and/or more difficult to control is a legitimate and important part of Congress' oversight. For that matter, even if the US did not fund it, but China did it on its dime (or Yuan), that is an important thing to know. The whole world was turned upside down by the virus. If it was artificially modified, we need to know about it and control the next time.
The Republicans found the man; they will now find the crime.
Same with the Democrats and Trump. There are thousands of laws and these guys violated several of them.

From what I know about US law, Trump did not commit any crimes. The Democrats and half the Republicans have spent almost 7 years searching the US Criminal Code to find something they could charge him with. I would be surprised if they don't come up with something.

I'm not a republican and I favor Fauci being charged and prosecuted on a number of items. If we want government to represent the citizens hen they have to be held accountable. Fauci purposely lied to the citizens on multiple occasions. Other times he purposely misrepresented the facts to support his narrative. We need to expect more from our public officials regardless of if they are appointed or elected. Fauci has a long history of being on the shady side of medicine.
