A 10-Year-Old Boy Shot and Killed His Mother. Wisconsin Is Charging Him As an Adult.
There is little utility to charging 10-year-olds as adults, yet Wisconsin still mandates the practice in certain cases.

On November 21, Wisconsin 44-year-old Quiana Mann was killed when her 10-year-old son shot her, apparently in a dispute over a virtual reality headset. While the case is tragic, a strange feature of Wisconsin law is making a terrible situation even worse.
In the state, children as young as 10 charged with certain serious crimes must be charged as adults. This means that Mann's son—at only 10 years old—was charged as an adult in his mother's killing.
According to NBC, the 10-year-old whose name has been withheld from the media, was charged with first-degree reckless homicide in Mann's death. If convinced, the boy faces up to 60 years in prison—notably six times greater than his current age.
This latest case is far from the first time Wisconsin preteens have been charged as an adult in a homicide case. Most recently, a 10-year-old girl was charged as an adult on homicide charges in 2018, after she apparently beat a 6-month-old baby to death. The girl, who had recently been placed in foster care and suffered from PTSD, was eventually ruled incompetent to stand trial.
Higher profile cases, like the 2014 "Slender Man" stabbing, resulted in two girls, who were 12 at the time of the attack, being charged as adults, though both were later found not guilty by mental disease or defect and later sentenced to lengthy confinements in state psychiatric hospitals.
Thankfully, defense lawyers can motion to move cases like this to juvenile court. However, attempts to do so have failed to convince judges even with very young defendants. For example, a 13-year-old girl with a history of trauma and sexual abuse unsuccessfully attempted to move her homicide trial to adult court in 1999. She was eventually convicted and sentenced to life in prison.
In this most recent case, as with many others, the child at the center of this case clearly needs intensive psychiatric care, not decades in prison. It is obvious that young children who commit terribly violent acts are universally troubled. In this most recent case, the boy's sister claimed in a criminal complaint that he has experienced serious mental health problems for much of his young life. According to NBC, the boy had apparently been given a "concerning diagnosis" by a therapist, and the boy's mother had installed cameras in the home to monitor him.
Charging disturbed children as adults—and possibly sending them to prison for many decades longer than their age when they committed the crime—doesn't make people safer and doesn't provide justice to crime victims. When a young child commits a horrific act of violence, their tender age indicates the need for intensive mental health, not a purely punitive sentence.

I have often wondered how society and the legal system would change if there were absolute differences between children and adults. Only adults can use drugs (alcohol and tobacco included), vote, join the military, buy/possess/use guns, mutilate their bodies (including tattoos), and make other decisions for themselves. Children cannot do any of these things, with a couple of exceptions:
* Use guns with adult supervision.
* Use drugs with adult supervision.
Those exceptions are because the uses are temporary. If science, real science, not the pseudo crap, shows some drugs do have permanent affects (which would not surprise me either way), take them off the ok-if-supervised list.
Forget liberty for a minute, because the definition of child is someone who is not competent of making decisions for themselves.
Whether the distinction is by age, by test, by brain wave scan, does not matter for the purpose of asking how this would change society and the legal system.

The best argument against that proposal is non-partisan. To wit, how does a youth develop the maturity, judgement and skills to be an adult if they are not allowed to do any of the things that approach adulthood? In this case it was as simple as making sure the kid did not get the keys. That could mean keeping them on your person at all times or putting them in a place known only to yourself. The larger question is should a person have a gun in a house if an individual in that house is experiencing mental health issues. It might well be for the best to have the gun placed with a friend or family member until the issues in the house are resolved.
I have said this before, the 2nd amendment to the Constitution gives you the right to have a gun. It does not say that you should have a gun. That is a decision each person must evaluate and decide upon.

My kid was ten three years ago. Do you have any kids? Not trying to make this about you, I’m just wondering if you understand. I don’t think children who think a month is a long time because they’ve only been aware of a couple hundred of them deserve to have the rest of them taken away. No matter what they do. He doesn't belong in a jail cell, at least not yet; but if he turns 18 or 21 and competent study thinks he is still a danger, then transfer him to a real jail and wash your hands of special treatment trying to cure him.

Also, the article is disingenuous in its presentation. All states have adult courts and juvenile courts. All states have means by which cases work their way from one court to the other. WI just happens to have a system by which murder 1-3 starts in adult court and gets referred to juvenile. Emma acts like Mann and “The Slender Man Stabbing” are somehow exceptional when, really, she has to go all the way back to 1999 to find a tween killer tried and convicted in adult court. And, the funniest part about the article on La’Tasha? Despite all the focus on La’Tasha’s juvenile status and all the hash made about her rough upbringing, all the supposed adults involved in questioning and reporting on her. No one mentions Charlotte Brown’s 5 kids, whom she (La’Tasha) orphaned, twice. Adult teenagers leading juvenile teenagers.

It's a sad case when a mentally disturbed child does something horrific when you know he's not mentally capable of understanding what he's done. It's also a sad case when a rabid dog bites somebody for the same reason. But you know what we do to rabid dogs despite the fact that it's not their fault they have rabies? And the person he murdered was his own mother. There's nothing here to say he was being abused, she was trying to be a good mom and making sure he got up every morning at 6 or 6:30. She's downstairs doing laundry when she gets murdered. She clearly buys some stuff for him since he expected she'd buy him this other thing. So the person he shot was the type of person even serial killers never consider hurting.

Actually it says a lot about the parents failure as parents, if there are even two parents involved. The mother paid the price for her poor parenting, and leaving a gun available to a child. Yet the child being willing to murder his mother at age 10, certainly makes him a threat to society. Maybe we need a third category for these kids? Try them as kids,but with much tougher penalties and their records never being sealed, still less than adults so they have a chance at life someday, if they can be reformed.
Of course, we all know that it was the gun and the gun alone that killed the evil gun owner.

Looking this case up, he apparently showed enough premeditation to secure the keys to the gun safe earlier in the day, and go around the house disconnecting all the security cameras mom had installed, so that he wouldn't be recorded shooting her.
I don't suppose the proof that this was premeditated rather than done in a fit of anger helped his case any.
I mean, obviously he's got bad judgement, thinking he'd get away with it. That's common among criminals (who get caught...) But if he's this hard core at the age of 10, what are the odds that he's suddenly going to develop a conscience? Indistinguishable from zero, that's what they are.
So, what's the alternative to life in prison? We don't have loony bins anymore, and if he's released he's just going to kill other people, maybe with a bit more preparation so that he gets away with it the first few times.
Really, what does Emma want to do with him instead of locking him up? Is she up for adopting him so that she can be the next victim?
