The Student Loan Debate Shows How the ACLU Has Lost Its Way
The venerable champion of civil liberties is increasingly indistinguishable from myriad progressive advocacy groups.

The American Civil Liberties Union (ACLU) last week applauded President Joe Biden's plan to cancel student loan debt, which it describes as "a racial justice issue." That puzzling position encapsulates how far the venerable organization has strayed from the mission reflected in its name.
Under Biden's new policy, borrowers earning up to $125,000 a year will be eligible for $10,000 in debt relief or twice that amount if they qualified for Pell Grants as students. The 43 million or so beneficiaries include many affluent people who could readily afford to pay off their loans, while the cost, which is projected to be at least $300 billion, will be borne by taxpayers, including Americans of relatively modest means.
Some of the people picking up the tab never attended college, while others struggled to do so without borrowing money or have already paid off their loans. But in the ACLU's view, that seemingly unfair redistribution of resources is what racial justice demands.
"This debt burden falls heaviest on Black Americans—especially Black women," the ACLU says. "Student debt cancellation will help secure financial stability and mobility for people of color—particularly Black Americans—who are disproportionately burdened with student debt while providing immediate financial relief and peace of mind for millions of Americans."
Whatever you might think of that argument, it has nothing to do with protecting civil liberties. The 14th Amendment guarantees equal protection under the law, but it does not promise to eradicate racial disparities in educational or economic success.
As the ACLU sees it, however, any such disparities result from "centuries of structural inequities and racism." The federal government therefore has a duty to ensure equal outcomes, which requires wide-ranging interventions, including welfare programs, education spending, job training, affirmative action, public housing, tax credits, and state-subsidized health care.
To give you a sense of how far afield that cause takes the ACLU from the defense of constitutional rights, the organization argues that "broadband access for all" is a racial justice issue because "people without broadband access are disproportionately Black, Latinx, Indigenous, rural, or low-income." The ACLU describes the Patient Protection and Affordable Care Act, which it urged the Supreme Court to uphold, as "a great civil rights law" because "it is not possible to fully participate in the economic, social, and civic life of our nation without stable health coverage."
If "stable health coverage" is a prerequisite for fully participating in "the economic, social, and civic life of our nation," so is stable housing, stable employment, and a stable supply of food, clothing, and transportation. Such reasoning expands the ACLU's mission to include pretty much any domestic policy issue.
The ACLU's embrace of a broad progressive agenda alienates potential allies who do not necessarily agree with that agenda but support vigorous advocacy for civil liberties. It also weakens the ACLU's commitment to the goals that once defined the organization, including the defense of First Amendment rights.
According to an internal staff memo that was leaked in 2018, ACLU attorneys who are thinking about defending a potential client's right to express opinions they find repugnant—the sort of function that the organization has proudly served through most of its history—should consider how that might conflict with "other values" supported by the ACLU. "Speech that denigrates [marginalized] groups can inflict serious harms," the memo warned, "and often will impede progress toward equality."
A case the Supreme Court will hear during its next term further illustrates how the ACLU has lost its way. The organization argues that a Colorado woman who has religious objections to gay marriage should nevertheless be forced to apply her artistic talents in designing websites for same-sex weddings, notwithstanding the First Amendment's restrictions on compelled speech.
A consistent defense of civil liberties is the ACLU's raison d'etre. But as the organization becomes increasingly indistinguishable from myriad progressive advocacy groups, it is sacrificing the principles that made its work worthy of wide support.

When I graduated high school, we were concerned about the national debt, which at the time was about $15k for every man, woman & child in the US. ($30k per taxpayer / voter)
Now it's a little over $100k per. Yikes.
And now we spend $18k per capita annually. But rest easy since we take only $13k per capita.

I guess the ACLU must not be very busy advocating for real civil rights issues as enumerated in the Constitution and Bill of Rights. Their work must be done it seems, so mission accomplished. The phrase "idle hands are the devil's workshop" comes to mind.
They are not done. They long ago stopped advocating for civil rights as enumerated by the Constitution and Bill of Rights. They now want to change them both because they are systemically racist and a tool of evil capitalism.
Clearly the ACLU is arguing for disparate impact (they want to help blacks preferentially.) But the real impact will be more cash to none of their favored groups.
So best of both worlds for ACLU; they later get to complain about the outcome of the thing which they wanted in the first place.
The ACLU has always been a radical leftists (socialist, communist, progressive, fascist) organization. They seemed to "champion civil liberties" only in the sense that those ideologies were widely suppressed and hated in the US. Now that those ideologies have gone mainstream and been adopted by the ruling party, the ACLU has simply become an instrument of the government.

The Reason staff should do a Libertarian analysis of the 2013 film “Inequality for All” with fiscal-conservative and former U.S. Senator Alan Simpson, billionaire Warren Buffet and Bill Clinton’s Labor Secretary, Robert Reich.
Part of the premise is what does government do when one group of citizens is treated “unequally” than another group - which is illegal under the 14th Amendment.

The only reason the GOP and Right wing objects to the Student Loan pay offs is that it caters to the uneducated who did not attend college and it wants to gin up internecine warfare between the college educated and those who did not get additional education. It's got zip to do with an economic reality. If politicos had to tell the truth or face execution, they'd chose execution since life without lying is unthinkable to them.
Fairness is one of the most basic of all human emotion and feeling. Everybody from the most intelligent to small children know when something is fundamentally unfair and wrong. If a subset of a voting group gets financial relief and the rest paid their debt, you better believe people are going to be upset and voice it.
It’s not about your internecine warfare theory, it’s simple economics. These progressive eggheads entered into an agreement to have their education paid for upfront as long as they paid it back later. Most people agreed to the rules and paid their debts regardless of their feelings because an agreement is an agreement. It is one of fundamental building blocks of society and our economy. It’s no wonder people are upset.
Also, the Power of the Purse lies with the Legislative Branch and not the Executive. The Supreme Court should strike it down sometime in the future.

How is a news organization so unfamiliar with the past decade of ACLU behavior? They lost their way a long time ago.
The ACLU "lost its way" when it fought for thousands of prisoners to be released due to covid concerns, but was silent when 100s of millions of Americans were locked down by the states in 2020-2021...
It's worse than that because it ignores real problems by turning them into something racist. Police reform is a great example. Turning every incidence of abuse of power into racism ignores the problem which is abuse of power.
POC, women, LGBT, and other victims groups are always the most negatively effected and least capable of dealing with adversity according to the left. Straight white males seem to have no problem navigating the vicissitudes of life, which explains why leftest hate them so much.

And only viewing things on that one dimension means that the real problems will never be solved. I'm sure racism has had a lot to do with the persistent racial inequalities that obviously exist. Yes, my own recollection has this this going back to the early 80s at least. One thing I learned is that the ACLU is not interested in defending individual rights. Their cause is in their name. CIVIL liberties. Civil means granted by government. And that means privileges granted by government. The government can grant or take away privileges as it sees fit. So its not too far a stretch for the ACLU to push for special privileges for special groups instead of defending universal individual/property rights.
