Tempe Police Watch as Man Drowns

Tempe police watched a man drown while refusing to offer assistance. "I'm not jumping in after you," one of the officers says in a transcript of body-cam footage from the encounter, which took place at Tempe Town Lake around sunrise on Saturday, May 28.
The man, Sean Bickings, repeatedly asked the officers for help. After the Tempe Fire Department's dive and rescue team pulled him out of the water, he was pronounced dead.
Body-cam footage released by the Tempe Police Department shows the lead-up to Bickings' death, in which Tempe police officers responded to some sort of altercation between Bickings and a woman named Susan. She tells the officers they had been having a "conversation," not a physical confrontation, and that Bickings "didn't do anything wrong."
Police then go to talk to Bickings, who after several minutes climbs over a railing that leads to the lake. Asked what he's doing, Bickings says: "I'm gonna go for a swim. I'm free to go, right?" The officers tell him he's not allowed to swim in the lake, but Bickings keeps swimming. Eventually he stops and treads water under a pedestrian bridge.
Video shows police discuss the situation from the shore, with one officer telling the others to keep watching Bickings while he calls for a boat. It's unclear if he actually does call for a boat at this time.
Two officers slowly walk up the bridge. Then Bickings can be heard yelling before the video cuts out. "Due to the sensitive nature of the remaining portion of the recording, a transcript of the sensitive portion of the event is being provided for full transparency," a video placard states. A local CBS affiliate has published the transcript.
"So what's your plan right now?" asks an officer.
"I'm going to drown. I'm going to drown," says Bickings.
The officer tells him "No, you're not."
Bickings repeats the he is drowning.
"OK, I'm not jumping in after you" says one of the officers.
"Please help me. Please, please, please," says Bickings.
Police keep instructing him to swim to a pylon as he continues to ask for help.
Police then argue with Susan, who has approached the bridge. "Stop. Get off of me. He didn't do nothing wrong," she says in the transcript. "I love, I love him. Please stop being so aggressive."
They tell her to "chill out" and "get off of the bridge."
"Oh my God, is he OK? Stop, why are you doing this? I'm trying to help my fucking, please don't [inaudible]," Susan continues. She says she's trying to go over to help Bickings. "He's drowning, he's drowning," she says.
"If you don't calm down, I'm going to put you in my car," says one of the officers.
After several more back and forth, one of the offices "OK, the officer is going to get the boat right now."
It's unclear what exactly is happening, but one officer in the transcript says to someone "we got the female" who "was trying to jump over the railing."
"No, I was worried about him. He's drowning down there," says Susan. "I'm just distraught because he's drowning right in front of you and you won't help."
One of the officers says, "Mark that he went underneath and hasn't come up since about 30 seconds ago." Then the officers continue arguing with Susan.
The whole thing is disturbingly reminiscent of police behavior during the recent mass shooting in Uvalde, Texas. Police stood around outside the school while the shooter killed children inside and aggressively prevented parents of school children from going in to help.
Police have no legal duty to risk their lives to save lives ("regardless of the fact that most citizens believe that is precisely what all those tax dollars are being spent to ensure," writes Michael Schaus at The Nevada Independent). Both the Uvalde killings and Bickings' death serve as disturbing reminders of that. What's especially chilling is how police in both instances not only failed themselves to help but actively attempted to stop bystanders from helping.

The Foundation for Individual Rights in Education (FIRE) is rebranding as the Foundation for Individual Rights and Expression (still FIRE) and expanding its effort to fight for free speech. We are very lucky in that the gun control nuts are also morons. The way you get people to give up their guns is to make society so safe that public is lulled into a false sense of security such that they don’t think they need guns anymore. Gun confiscation has always happened in western countries with low crimes during times of political stability.

I was one of those kids. It was our school guidance counselor who arranged the note from the doctor, not my parents, who were barely involved in my life at that point (I left home at age 14). I learned later that these deferments were routine in those days and that most guidance counselors knew a local doctor who would write the notes. Had I not gotten the note, I would not have finished high school. That’s probably true of most of the kids who got these excuses. In retrospect, I realize that if I had dropped and taken a GED, my life probably would have turned out about the same or better—a high school diploma is worth far less than I was led to believe at the time. No, I do not vote D, and no one who knows me would describe me as “childlike”.

You don’t just jump off a bridge into a lake fully clothed with a vest and bat-belt on. I have tried to swim in shoes with full clothes- it isn’t easy to tread water let alone save someone else from drowning. So you have to disrobe and your partner needs to safeguard your weapon. It’s probably unlikely that cops have lifeguard training, so we have to wonder if that is even something the police officers on the scene are capable of doing.
I think it is a rather big stretch to compare this officer to Uvalde. We don’t expect police to be coast guard. We do expect them to stop active shooter situations.

People who have a problem with the cops here have problems with cops even if they rushed in to a burning building to save a baby but not the dog.
This result is fully on the guy who went swimming. It was his free choice. He didnt slip and fall in. We have dozens of stories of cops jumping into ice lakes when kids fall through. This is not that case.

If she was in fact trying to help him when he was in fact drowning, this would be manslaughter by preventing her from saving him.
What I expect from cops is to at the very least not make things worse by existing. Don’t prevent people from helping people they aren’t going to help.
And when she drowned because they let her jump in they’d be blamed for that.

Unequivocally, if the guy had been sitting in his office and the lake came and found him and 18 other co-workers, there might be some sort of comparison. As it stands, this guy was told he couldn’t get into the lake and rather than incapacitating him from getting into the lake, the officers deferred penalty until after he emerged. We talk about cops being barred from executing no-knock warrants against suspects but, apparently, some people’s definition of ‘barred’ includes ‘unless the cops think the suspect is going to hurt themeselves.’ Which, when cops inevitably wind up beating or shooting someone who was intent on hurting themselves anyway, they’ll turn right back to ‘Cops should be barred from no-knock warrants.
If the cops had physically 0revented the guy from jumping in they’d find fault with that too.

Apparently there’s some confusion on whether they called a boat when he first jumped in. They also physically prevented someone else from attempting to help him.
So that’s two things: (1) follow-through on calling a boat (may have happened, but there’s reason to doubt it), and (2) letting someone willing to accept the risk of helping him do so.

How did they ignore him? They directed him to the pylons, told him not to jump, etc. There are dozens of stories of cops jumping into ice lakes to save kids. They will do things where they believe a life is in danger and they have to act.
Here they have a kid who willingly jumped in, disregarded directions to swim to a pylon to remain safe. The fact he was swimming prior and then began drowning puts the question as to whether they believed the kid or not.

As someone who was a lifeguard in scout camps it is utterly true a kid who is fighting a rescuer can take both people down. I have no issue with the cops here due to it being a willfull act on the person.

Tell me, Sarc, really. What should they have done. When he first jumps into the water and swims away from him, should they have done something? They are not allowed to detain him- he asked if he was free to go, and they did not say no which means they had nothing to hold him on.
Unfortunately, we can’t SEE the circumstances of his death. We see at the end of the shared footage, that he is out in the middle of the lake- 300 feet away from the officers. What are the officers to do here?
The only thing I can see an officer doing in this situation is going back to their police cruiser (if it is near), and getting out around 300 feet of rope (if they have it) and then going to the pier that is in that film and trying to give the rope to the guy. That also assumes that the guy was close enough to the pier to execute such a move. But that requires so many “if’s” that I can see it not being plausible here.
Haven’t seen the video but if he was 300 feet out before he asked for help there really isn’t much they could do. I know I couldn’t swim out 300 and rescue someone who was already going under.

And while this bill theoretically applies to both sexes, in practice it will apply just to girls’ sports.
So, girls as young as middle-school age will have to go through something like an invasive pelvic exam (“the participant’s internal and external reproductive anatomy”), and blood tests, likely at their own expense, to prove that they were born with ovaries, just to play on team sports. All to try to eliminate the <0.1% of the population who are transgender who choose to participate in sports.
This is the very definition of moral panic. It is applying the "logic" of TSA airport screenings to all of middle-school and high-school athletics. Everyone must endure indignities and frustrations in order to try to track down that miniscule percentage of people who might cause trouble. At least with the TSA, the people they are trying to find actually do have murderous intent and want to kill people. Transgender athletes? Not so much.
And what level of testosterone is expected? The bill doesn't say. Especially for children going through puberty, how is anyone supposed to know what is the "correct" amount?
Even if you do think transgender athletes is such a serious issue, surely you can come up with a better plan than forcing every single girl in every single sport to undergo invasive medical tests to "prove" their birth sex?

Every physical already includes a hernia check. This is just about a doctor checking a box. A teen isn’t going to fool a doctor.

A genetic test is not substantially different from the blood work that is generally required of all atheletes who compete. My daughter just had to take a blood-based drug test to compete in cheer. That same operation could provide the evidence that she is biologically female.

In my experience, Chemjeff wants to do everything except grapple with this problem. A few months ago, he suggested that they just open sports to everyone. When I pointed out that the end result is that men would push out all except a handful of women, he went silent. From there he has rejected every potential remedy attempting to keep a place for biological females to compete while offering no alternatives.
From that, I can only deduce that, in fact, Chemjeff has no problem with biological males competing in women’s competitions. So he should get up and defend that.
The purpose of women’s sports- whether legally required (e.g. Title IX) or voluntarily (e.g. WNBA) is to provide women a place where they can safely compete in a sport. Because the alternative is that they are dominated by the men. In the BEST case, women get crowded out. In the worst case, the women are INJURED by men playing with them. See, for example, the grievous injuries a trans woman did to a biologically female in a UFC fight.
I can understand being skeptical of States interfering in this issue. But then you really need to address the fact that states have largely captured the regulation of Women’s programs. From grade school through universities and into the Olympics, almost all of these women’s sports are driven by government or semi government regimes. So it isn’t as simple as saying “Let the private market deal with it.” And this also includes the fact that many of the private organizations are being pressured by threats of legal discrimination.

There are many reasons why people want to see women participating in sports. Competing builds fitness, leadership, discipline and other skills that are highly correlated with success in life. The whole reason why Title IX exists is that Women didn’t have the same opportunity at schools to enjoy the benefits of competition.
I think it is great that my daughters go out for sports. If they had to play against boys, they’d be sat out. Or potentially injured. Watch a tackle in soccer between two women and between two men. If it were a man tackling a woman, there is a high chance that the woman is injured.

Sure, but at that point, he’d swam more than some 25-50 yds. away from the bridge. Sure, the cops could prevent you from ODing on rat poison, bleach, or cyanide but they’d probably have to use, potentially excessive, force to do it. Regardless of whether they do/don’t use excessive force, you expressing regret in the final few seconds before you bleed out or whatever doesn’t transfer the blame to whomever might be around you.

You can see on the film- it’s a foot bridge that is like 10 – 15 feet off the water. It is not clear where he ended up drowning, as the film cuts off past that point. It is even difficult from the body cam footage to see how far he was from the foot bridge per se. Is it possible they could have found something to protect him? Sure. It is also possible that there was no readily available mechanism for them to help him.

Here is the conflict. Police are given kinglike authority and protection. Rarely does the government rule that it js OK to defend yourself from police, even if they are acting illegally. But we have a right to use force in self defense and defense of others.
So let’s look at the lady in this vignette. Her loved one is drowning right in front of her. He is literally dying. This part is not even hypothetical… he actually dies.
The police are using force to stop her from saving him. There is plenty that could be done. If a hand can’t reach, a pair of pants could make a 6 foot rope.
But they stop her. Physically.
She was powerless. They were bigger, stronger and armed.
But let’s posit an alternate version. She is armed. She has her 15 shot 9mm on her.
Is she justified in using it to defend others?
Can she legally pull her gun, train it on the lead officer and order them off the bridge? Can she legally shoot them if they draw on her?
We all know what the answer is practically. They would kill her or she would get the death penalty for shooting cops.

Surely that would be a justified use of force absent the king’s rights bestowed upon those with a badge. But does the sovereignty of the badge extend to the ability to legally enforce a death sentence… to the point of being immune from any intervention?
This does actually happen. We saw this with Jose Guerreno. Police gunned him down in his own kitchen and then prevented medical attention for 2 hours while he bled out as his wife begged for help and paramedics tried to get past the police to help him.

There is a clear contradiction in the law here. One that normally is resolved in favor of cops get to do what they want and you can’t lift a hand against them.
But we do have a ruling or two on the other side. In Indiana (or Illinois?) the state courts ruled that you can use force to deny entry by police conducting an unlawful search (good luck with that in the real world).

There was a video making the rounds a while back of a teenage girl on the beach in Jersey. A cop is badgering her about her ID and has her blow a breathalyzer as she sits on her blanket with friends. The test shows she has not been drinking, but the cop doesn’t let it go. He demands her ID and when she questions why he needs hee ID he begins threatening to arrest her. It quickly escalates and he takes her and then gets on top of this 15 year old girl and starts punching her.
I don’t know the further context, but the video was rage inducing. People are yelling for them to stop, but it gets quite violent.
It immediately made me think someone was going to grab and restrain this really big guy. Who is armed. And has an armed partner or two. And who can arrest you and charge you with a felony for interfering with an arrest and for assaulting an officer.
Which made me think the only practical way to stop the beating probably involved a baseball bat.

I don’t see how much more de-escalating they could be and I don’t see a clear course of action, again save having a boat at the scene as he was climbing in, that would’ve definitively saved anyone. Even if they had a boat at the scene, they likely would’ve had to manhandle him to get him out of the water.
In all the time you took to list out these items, you could have gone and reviewed the footage. It is pretty clear to me that there was little to nothing around to help this person, and that the footbridge is high enough up that it would probably take 30 or 40 foot of rope to help this person.

In my own humble state the high school activities association is chartered by and to some extent regulated by the state, though most matters are decided by votes of the member schools.

EPA Boosts Biofuel Blending Requirements Amid Skyrocketing Gas Prices
The Biden Administration has boosted biofuel blending requirements to the largest amount on record to support the renewable fuel alternative to oil amid skyrocketing gas prices.
The Environmental Protection Agency announced the new requirements on Friday for how much biofuel, such as corn-based ethanol, the oil industry must blend into the fuel supply.
Oil refiners must mix 20.63 billion gallons of renewable fuels into gasoline and diesel this year, under the new requirements, slightly lower than the 20.77 billion gallons the EPA proposed in December, but the largest amount since the Renewable Fuel Standard was created in 2005.
Chet Thompson, CEO of American Fuel and Petrochemical Manufacturers, told the Des Moines Register the blending requirement for this year was “contrary to the administration’s claims to be doing everything in their power to provide relief to consumers.”
“Unachievable mandates will needlessly raise fuel production costs and further threaten the viability of U.S. small refineries, both at the expense of consumers,” Thompson added.
The EPA also announced on Friday that it denied roughly 70 exemptions for small refineries, including several exemptions that the Trump administration granted, according to the Register.
