Thomas Massie Has a Point When He Says Congress' Antisemitism Resolution Has a Free Speech Problem
Massie was the only House member to vote against a resolution demanding social media companies do more to track and suppress antisemitic content.

Rep. Thomas Massie (R–Ky.) is stoking outrage for being the lone dissenting vote on a seemingly unobjectionable resolution condemning antisemitism. But the congressman's opposition looks a lot more reasonable considering the resolution's implications for free speech and internet regulation.
On Wednesday, the House of Representatives passed H.R. 1125, which broadly condemns antisemitic speech and violence while also endorsing calls for more online monitoring and censorship of antisemitic views and conspiracy theories.
It passed the House 420-1. Massie's solitary "no" vote attracted heated criticism from some of the organizations that pushed for the resolution.

That's fair enough given some of the language contained in the resolution.
For starters, it includes a call for social media "to institute stronger and more significant efforts to measure and address online antisemitism while protecting free speech concerns."
Social media companies obviously can moderate content however they wish. If demoting or removing antisemitic speech is something they want to spend time and resources doing, that's their prerogative.
But politicians demanding social media companies adopt certain content moderation policies or priorities inherently raises free speech concerns, even if those demands are in the form of a nonbinding resolution.
The implication that social media companies will suffer political or regulatory consequences is inescapable, even if it does come with a free speech proviso.
That's particularly true in this context. The primary author of yesterday's resolution, Rep. Debbie Wasserman Schultz (D–Fla.) has pinned some of the blame for the fatal shooting in Buffalo, New York, on social media companies' amplification of "radicalizing content and conspiracy theories."
In response, she has argued for amending Section 230 of the Communications Decency Act (often described as the internet's First Amendment) so that social media companies can be held legally liable for views expressed on their platforms.

Yesterday's resolution also calls on Congress to work more closely with the Inter-Parliamentary Task Force to Combat Online Antisemitism—an international working group whose membership includes lawmakers from the U.K., Canada, Israel, the U.S., and Australia.
The task force's first briefing in November 2020 featured presentations from groups also calling for Section 230 reform and holding platforms and their executives accountable for antisemitic speech.
The House's antisemitism resolution also endorsed increasing funding for a Department of Homeland Security program that provides security grants to "at-risk houses of worship, schools, and community centers."
Given that the Department of Homeland Security shouldn't exist, expanding its funding doesn't sound like a good idea. One can see why a libertarian-leaning budget hawk like Massie wouldn't like that provision either.
It goes without saying that antisemitism, like any sort of racial or religious bigotry, is horrible. But the House's resolution does more than merely condemn it. Rather, it calls on social media companies to suppress otherwise protected speech and endorses more federal spending. That's reason enough to oppose it.

This is just Misek being Misek, but I want to address why some countries, and by proxy why some Jews, ask for criminalization.
The thing about Holocaust denial, and more broadly speaking disinformation, is that the process of proving truth is not simple. There isn't necessarily a broad government interest in proving truth, but there is a government interest in dispelling lies.
Truth can't be refuted and sooner or later people learn the truth, but the lies told about Jews are designed to make you distrust and hate them. The pipeline from Holocaust denial to wild conspiracy theories is well documented. The intent of denial isn't to seriously debate the Holocaust, but to harden the heart against Jews. After the damage is done, you can't eliminate someone's biases just by providing them the truth. There's a reason why libel laws exist. We constantly decry the media for lying about a variety of issues because the damage is already done and redactions are hidden away in the back pages. The people who believed the lies told earlier hardly ever see the correction and there's a well known human bias to believe the first thing we hear. Why does anyone lie? Because they can and because there are advantages to it.
Holocaust deniers have made the same shitty arguments over the past 75 years. The arguments have not changed one bit and they're so easy to disprove that many people feel there's no pressing need to educate or suppress. I do feel there's a need for continued education, but I'm in a minority of a minority for not supporting excessive regulation of speech. Something has to be done, but speech isn't the right avenue and government isn't the right instrument.

The mens rea or intent of Anti-Semitism is at least 3000 years old in the Babylonian, Assyrian, Persian, and Roman Empires. And Anti-Semitism was most pronounced with the advent of Christianity and the verses in the Christian New Testiment Matthew 27: 20-25 which were cited to justify the claim that not just some Jews, but all Jews for all eternity are collectively responsible for killing Jesus Christ.
(Never mind that other New Testiment passages blame the Romans exclusively and that Jesus Christ dying for the sins of the world that he as God created was supposed to be the plan of the God that Jesus supposedly was. Technically, if you read all this literally, the Deicide was a suicide. Thinking too hard on all that will cause dain brammage.)
Anyway, the mens rea has existed for millennia and up until the Enlightenment was carried out with pogroms, persecution, and murder throughout Christendom and in the Christian-cribbing Islamic world.
After the brief pause of The Enlightenment, Anti-Semitism made a comeback in Europe under the guise of Pseudoscientific Racism. Both the older and newer Anti-Semitism was certainly reiterated and expressed in Adolf Hitler's Mein Kampf. Then, when Hitler became Chancellor of Germany, Hitler's Anti-Semitism was implemented in The Enabling Act, The Race Laws, The Law of Weapons, and the Nuremberg Laws, all a matter of legislative record.
In carrying these out, millions of Jews had their jobs, their title to their property, their weapons, their status as equals in society all confiscated, and they were forced to wear yellow stars and later, when they were round up into death camps, they were tattooed with numbers. All of this is a matter of written and photographic record and Jews have the Yellow Star patches, along with other patches if they were Homosexual, Disabled, Mentally Ill, "Asocial," etc. and Jewish Holocaust survivors today still bear the marks of tattooed numbers.
Most telling of all, the Waffen SS, the Einsatzgruppen,, and the Concentration Camp Doctors and administrators such as Dr. Joseph Mengele and Adolf Eichmann all documented their round up, enslaving, forced experimentation on, and extermination of Jews and others. And when Simon Wiesenthal captured Adolf Eichmann and put him on trial in Israel, Eichmann denied nothing he did, thought he was "doing his duty for the Fuhrer and Fatherland'" and before he was hung, hoped he'd meet his family and friends in Paradise.
All that was documented by stenographers and by broadcasting on worldwide radio and television and available in Betamax, VHS, DVD, and digital downloads for all to see.
In other words, finding and documenting none of this is "hard." Which is why Holocaust Deniers and Holocaust Outlawers like Misek are the penacle of irrationality and evil.

You're right that finding and documenting isn't very hard, but what good has it done? I don't think of people like Misek as necessarily being evil, and I certainly don't see criminalization of his thoughts as a productive measure.
But hey, that's why I said what I said. There's a strong camp in favor of banning speech because they feel the damage done to people like Misek can't be undone, so they would rather censor anyone who goes against the truth.
It is sadly true that nothing has 100 percent market share and respect for historical fact is no exception. (Hell, even the best ideas in the world such as Libertarianism don't have 100 percent market share.)
Despite this, one thing people of good will can do is make sure that rotten ideas like Holocaust Denial don't get any market share in our own own individual heads or the heads of children in our care and around us. This means homeschooling, private schooling, and/or, if finances don't permit, at least mini-lessons to counter-act irrational things children encounter.
Also, we can also donate to legitamate causes and foundations that teach about the faculty of Reason and the social product of Reason, which is Freedom.

In effect, you've told a private company to do the censorship. In this case, hoping to brand your political opponents as "hate" mongers. If too many people call out the overheavy handling of the issue you say "Well, they're a private company, we told them to respect free speech" while getting what you want.

More constructively, the House could have instituted an inquiry to find out if any of its members promoted antisemitism, and to kick them out of they do.
Of course, there's always the risk that the expelled member(s) would just get sent back by their constituents, but that's a cost of representative government.
Another example of an omnibus bill, putting in a clause saying it's wrong to stick puppies in blenders, and then adding a clause repealing the First Amendment.
