Michigan Couple Says Town Seized Their Building and Offered To Return It if They Bought Two Cars for Police
"Extortion, there's no other way to explain it," the couple's attorney says.

A Michigan couple says their town seized a building they owned and then demanded that they buy two cars for the police department to get their own property back.
The case, first reported by WXYZ Detroit, began in December of 2020 when the mayor of Highland Park and the police chief dropped by a 13,000-square-foot building owned by Justyna and Matt Kozbial for an impromptu fire code inspection.
The city officials found a marijuana grow operation inside. The Kozbials, immigrants from Poland, say they had a state license to grow medical marijuana, but the city seized the building anyway and held on to it for 17 months without charging them with a crime.
Under civil asset forfeiture laws, police can legally seize property—cash, cars, and even houses—suspected of being connected to criminal activity like drug trafficking, whether or not the owner has been charged with a crime. But not only were the Kozbials never charged with a crime, police never alleged there was any major criminal activity.
In a response to an interrogatory filed in the Kozbials' subsequent lawsuit against Highland Park, a city police officer answered "none" when asked to identify any predicate felony offenses justifying the seizure.
Things then took a highly unusual turn when the Kozbials say they received a settlement offer from the town: Stop growing marijuana and buy two vehicles for the local police department.
A February 24, 2021, email provided to Reason by the Kozbials' attorney, Marc Deldin, shows that a Highland Park police officer, ferrying a message from city attorney Terry Ford, sent the Kozbials quotes for two cars from a local Ford dealership, totaling about $70,000.
Civil liberties groups often criticize civil forfeiture for creating a perverse profit incentive for police and local governments, since forfeiture revenues often go straight into their budgets, but it's practically unheard of to see such an overt shakedown put into emails and court documents.
"Extortion, there's no other way to explain it," Deldin says.
"This is really policing for profit, because instead of finding a crime, pressing charges, and allowing the forfeiture process to work out, they just went and seized the building and said, 'Give us two cop cars,'" Deldin tells Reason. "There was no crime, and there was no forfeiture process. The goal was never to forfeit this property because Highland Park wouldn't receive anything. The goal was to extort my client into providing squad cars."
Law enforcement groups say civil forfeiture is an essential tool to disrupt organized drug trafficking. However, civil liberties groups say the practice is unfairly tilted against owners, who often bear the burden of proving their innocence and fighting in court for months, sometimes years, to try and win back their own property.
Wayne County, where Highland Park is located, has an aggressive asset forfeiture program, particularly for cars. It seized more than 2,600 vehicles between 2017 and 2019, raking in more than $1.2 million in asset forfeiture revenues, according to public records obtained by the Mackinac Center for Public Policy, a free market Michigan think tank.
Of those, 473 were not accompanied by a criminal conviction, and in 438 of those cases, no one was even charged with a crime. In 10 cases, the cars were seized under suspicion of a drug violation, even though the records say police didn't find any drugs.
Wayne County prosecutors typically offer to settle such forfeiture cases and return the owner's car for a $900 payment, plus towing and storage fees. (You can see one such forfeiture notice here.)
Deldin says, though, that the Kozbials' forfeiture case was never properly routed through the Wayne County Prosecutor's Office.
The Wayne County Prosecutor's Office did not immediately return a request for comment. In a statement to WXYZ Detroit, a spokesperson for the prosecutor's office said it was not aware that the city was negotiating its own settlement.
Today, a day after WXYZ Detroit reported on the fiasco, Highland Park informed the Kozbials that it would be giving them back their building. Their lawsuit is still ongoing.
"How many other people in Highland Park have they done this to?" Deldin wonders. "My clients are fortunate enough to have their resources to come and hire me. They're paying me to fight for their rights, but this is expensive. How many people in Highland Park didn't put up a fight?"
Highland Park city attorney Terry Ford did not immediately return a request for comment.

Judge Abattoir would rule that the Kozbials have their property returned, and the town forfeit their town hall and police buildings to them, since they're involved in criminal activity.

Highland Park is a small municipality, but I wouldn't exactly call it a 'town' - that makes it sound like it's out in the country somewhere. In fact, it's an urban enclave city completely surrounded by Detroit.
You might be familiar with it as the original location of the Ford assembly plant.
Another small claim to fame is that Gran Torino was mostly filmed there.

I find this unbelievable. the city or whatevber it is should be liable for all the lost revenue and punative damages to these people. if the facts are as reported any attorneys fees should be in there as well. That would stop this nonsense. Again, if it is as reported this should be an open and shut case. Rest assured i would go after them if they jacked my car. But then I don't do crimes and have the resources to do it. But any attorney worth their salt would take this case on contigency. Just make damn sure they can't charge you with anything. This isn't the only case of this in Michigan Maybe their governor (A Democrat) or the senators (One the Squad lady, another Democrat) should be earning their money. As a friend of mine said "When was the last time you were glad the cops showed up".

Something isn't right here. If you read the email that contains the supposed extortion it says something about a missing/stolen trailer, which this article mentions nothing about. I'm as anti-forfeiture as they get but something tells me we aren't getting the whole story here.
I am someone who know first hand about this story. What this article can’t show is the video surveillance of the mayor and police chief entered the building with no search warrant, circling the building until someone walked out and then detained them by holding their drivers license to get access to the building. It was Xmas eve and the workers were cleaning the location, the Kozbials just bought this place a few days before from a previous care giver. Yes they had plants legally and only 30 in one room only. All the surveillance footage shows what really happened and what was actually in the building ;it will be used in court as the lawsuit continues. They took 3 vans and a trailer, auctioned off the vans never had the trailer listed as part of the seize. That trailer has been spotted in HP used by another neighboring company. The offer was very much real for two squad cars in exchange for getting the building back and would not seek Criminal charges. In the meantime everything in the building was stolen. Two different break in that we know about, the alarm would go off in the building but the police wouldn’t give us access to see the damage by time we starting having court hearings they gave us access one time for an expert to go in and assess the damage - it was horrible and depressing. The building had gone to shit. All the damage that happened under their watch. Mayor Yopp is not running again and his city attorney will be leaving with him. The city attorney was appointed by the mayor because the council would not sign off on his contract. So much more to this story. WXYZ.com could only cover so much in 6 mins. HP is suppose to open for application for state use for marihuana cultivation, they are only allowing in certain areas and you better believe this building was prime location for the zoned area the city created. Asset forfeiture and padlocking were primary causes of the Great Depression which began with the 1929 Crash. Any amount of liquid containing 3/4oz of alcohol per gallon was criminal. Any car or truck containing it was confiscated and any home or large industrial complex padlocked for a year to ensure bankruptcy and repossession or auction for property taxes. George Dubya's policies made this happen in the asset-forfeuture upsurge of 2007-8 which again wrecked the economy. Prohibition & Crash are cause & effect.

There is a SIMPLE solution. Pass state laws that revoke all sovereign immunity for seizing under forfeiture laws without a felony conviction. Make it SPECIFIC that the authority having jurisdiction and the officers that seized the property are subject to civil prosecution by the harmed party.
This would end the ability of any government agent to make seizure without prosecution for a felony crime. We already know that anyone in an airport with more than a few hundred dollars could have their money seized without ANY CHARGE AT ALL. This has happened and has even been publicised by undercover reporters investigating.
The constitution FORBIDS seizure without without warrant and warrants must have reasonable proof of criminal activity and the property related to the crime. The way that all this can come together is IF the OFFICERs and the Authority having Jurisdiction must place BOND against all seizures and that the BOND require that the property owner be arrested, prosecuted, and found guilty of a felony related to that property. Without the connection to the property seized a felony should not allow the seizure at all!
Should the AHJ and officer not obtain conviction or the conviction not be proven related to the property, the AHJ and Officers would forfeit bond to the accused. The bond should be the entire VALUE of all property and lost business due to to the actions of the AHJ and officers.
