GoFundMe Rejects Fundraising for Canadian Freedom Convoy

GoFundMe calls Freedom Convoy an "occupation." What started as a protest against vaccine rules for border-crossing Canadian truckers has morphed into a massive—and more than a week long—demonstration against all sorts of COVID-19 mandates in Canada. Things have been largely peaceful, but the city of Ottawa is declaring a state of emergency and the crowdfunding platform GoFundMe is refusing to turn over millions of dollars raised for the protests.

"GoFundMe supports peaceful protests and we believe that was the intention of the Freedom Convoy 2022 fundraiser when it was first created. We now have evidence from law enforcement that the previously peaceful demonstration has become an occupation, with police reports of violence and other unlawful activity," the company declared in a statement.

Initially, GoFundMe said donations whose makers did not request a refund would be sent "to credible and established charities chosen by the Freedom Convoy 2022 organizers." In an update, it said that "due to donor feedback," it would "automatically refund all contributions directly—donors do not need to submit a request."

That means more than $8 million will be refunded, reports The Washington Post. Since the GoFundMe rejection, protesters have raised $3.5 million on the Christian crowdfunding site GiveSendGo.

GoFundMe said it's rejecting Freedom Convoy funds because the protest violated its terms of service—specifically, a prohibition on "the promotion of violence and harassment." But it's unclear to what exactly GoFundMe is referring.

By all accounts, the protests—which have included thousands of Canadians in multiple cities—have been mostly nonviolent. Ottawa Police Service reported Sunday that they've seen "extremely disruptive and unlawful behaviour" from protesters. But when they spell out what this means, most of it is relatively minor stuff. For instance, Ottawa cops issued 450 tickets for infractions that include "excessive noise," fireworks displays, seatbelt violations, disobeying a sign, an "improper muffler," an obstructed license plate, driving on a suspended license, running a red light, and "driving through a no truck route."

Criminal offense investigations have been opened, but these seem to have led to relatively few arrests. On Sunday evening, OPS said that it had opened "over 60 criminal investigations so far related to the demonstration." It reported just seven arrests—five people were arrested for unspecified "mischief," one "for mischief relating to property damage of a downtown business," and another "for driving while prohibited."

OPS also reports investigations into hate crimes, but does not offer more details. A special hate-crime hotline it set up "received over 200 calls, and Detectives are ensuring every report is investigated," the OPS statement said.

Several incidents of harassment by demonstrators have been reported. But a few alleged bad apples in a mix of thousands of protesters spanning cities seems extremely weak rationale for the GoFundMe cancellation.

One serious incident has been alleged in the days after GoFundMe's decision: an attempted arson. But this event has not been substantiated (and some of the claims surrounding it are a bit far-fetched).

As a private company, GoFundMe can associate with whatever causes it wants. But the move is, nonetheless, disappointing. It feels very much like a pretense to disassociate from a cause that's critical of government and unpopular with political leaders.

Protester James MacDonald told CNN that "the whole event has gone beyond just vaccines and it is now about the entire ordeal," including mask mandates, lockdown measures, and more. The truckers are now joined by all sorts of folks, and the protests have spread beyond their original locale in Ottawa to cities throughout Canada, though the bulk of the action remains in Ottawa.

On Sunday, Ottawa's mayor declared a state of emergency. "Declaring a state of emergency reflects the serious danger and threat to the safety and security of residents posed by the ongoing demonstrations and highlights the need for support from other jurisdictions and levels of government," said the city in a statement.

Is Web3 a scam? "At its most basic, Web3 imagines a massive shift away from the habit of accessing the web via centralized platforms such as Facebook and Google, and toward a norm of communicating, storing information, and making payments through a supposedly incorruptible, uneditable, fail-proof system," notes The Atlantic's Kaitlyn Tiffany. "But for various reasons it has so far been a bit of a farce."

"Spotify's decisions about Rogan (and Young and others) has absolutely nothing to do with Section 230. At all," writes Mike Masnick. In case you've been living under a rock: Neil Young and several other perfomers have removed their music from the digital listening platform Spotify to protest the company's ties to the popular podcaster Joe Rogan. The musicians initially threatened to go if Spotify wouldn't ditch Rogan's show; Spotify wouldn't.

Some—including Los Angeles Times reporters, tech writer Kara Swisher, and the activist group Sleeping Giants— have linked this fight to Section 230, a law that protects websites and other digital mediums from certain liabilities for user-generated content. "But the question of Spotify's decision to keep Rogan or not has nothing to do with Section 230 at all," notes Masnick:

Spotify has every right to decide whether or not to keep Rogan in the same manner that a book publisher gets to decide whether or not they'll publish a book by someone. And that right is protected by the 1st Amendment. If someone sued Spotify for 'hosting Joe Rogan,' Spotify would win easily, not using Section 230, but for failure to state any actual claim, backed up by the 1st Amendment right of Spotify to work with whatever content providers they want (and not work with ones they don't).

A lot of people want to find a way to blame Section 230 for Spotify's right to host Joe Rogan. But as with so many instances where Section 230 is blamed, what they're really mad at is the First Amendment. It's just that saying one hates the First Amendment and doesn't believe in free speech isn't so popular, so people try to complicate matters by invoking a law that many people either don't know about or don't understand, and are trying to act as if this comes down to tech companies having some sort of special rights.

Masnick points out that if Section 230 didn't exist, Spotify would still have a First Amendment right to air whatever music and podcast it chooses and cut deals with their creators:

Spotify, just like a publishing company, a newspaper, a TV cable news channel, would have a 1st amendment editorial right to determine who to allow on its platform and who not to. 230 doesn't create a right to editorial discretion (both up and down). That already exists thanks to the 1st Amendment.

Indeed, if you're thinking that Spotify might somehow be liable if someone gets hurt because they listened to someone spreading stupid advice on Rogan's podcast, that's not going to fly—but, again, because of the 1st Amendment, not Section 230. As Section 230/1st Amendment expert Prof. Jeff Kosseff explained in this great thread, book publishers have (multiple times!) been found to be not liable for dangerous information found in the books they publish.

        The biggest, most delicious irony that came out of the whole Occupy Movement shitstorm was when Occupy Charlotte members of this Fighting-The-Man, Eat-The-Rich, "We Are The 99%" movement actually sued each other over Intellectual Property rights to the "Occupy Charlotte" name and logo. 🙂

        Where are truckers are making their mistake is that they're not burning down buildings and haven't looted any stores. If they did that, then Trudeau and the media would call them mostly peaceful.

          This whole protest has been quite instructive in showing what kinds the establishment and western cultural elites actually support.

          These people are fine with protests that turn violent and destructive, as long as they promote a radical left-wing message. In fact, they'll bend over backwards to enable their bad behavior as long as the tards don't bring the protest to their doorstep.

Show me a rich "smart" democrat and I'll show you someone who enriched themselves on "govt" regulations. They bounce around from the DNC to some grifter "non profit", to some congressional or executive branch department, help to pass legislation and then run to say a hedge fund to cash in. Ending big govt would stop this. The best possible thing for the country is a 1% occupancy rate on commercial buildings in DC and Northern VA.

          Where truckers made their mistake was avoiding education and becoming drivers. When automated vehicles make drivers obsolete, should other Americans provide handouts to those who lack marketable skills in the modern economy?

        I believe they just announced that they'd be refunding the donations, after several Republican governors laid out the implicit threat of a fraud prosecution against them. So now the protest is using an alternate crowdfunding site, but this one doesn't have the reach GFM does, so their site has been crashing quite a bit due to people shifting their donations.

      It is pretty absurd how transparently evil this becomes. You can only fund protests of the government if the ruling government accepts your protest. The second they decide it is inconvenient, that funding gets stripped.

      People should take this to heart and understand that funding any sort of protest via one of these platforms is risky if it is inconvenient to the ruling government.

    That's a strange way to say "GoFundMe attempted to steal millions of dollars from donors to the Canadian Freedom Convoy".

    The scary part is that it's an open question on whether they could have done so legally. On the one hand, it's a blatant violation of the basic precepts of contract law, but on the other hand, the Section 230 Superprecedent means that Muh Priavte Company is not bound by contract law.

      Section 230 only talks about how liability is assigned to content producers. It says absolutely nothing about contract law. And in this case, with money changing hands, it is clear that funders have a case against them. It is within GFY's- er, GFM's rights to say, "We don't like your cause, we aren't going to take your money." However, once they HAVE taken your money, with the promise to give it to a cause, it is likely fraud not to give the money back. And, BTW: this is why DeSantis said he was having the AG investigate, and why they very quickly rolled over on this.

        Overt, I've brought it up before, but go read the Megan Murphy lawsuit. The Silicon Valley judge did in fact bring up that 230 protects against ToS and contract violations.

          This is not what the judge said- I think you are misinterpreting it. The judge made 3 points:

          1) Section 230 gives Twitter "immunity from liability for traditional editorial functions undertaken by publishers—such as decisions whether to publish, withdraw, postpone or alter content created by third parties."- Note: they are specifically talking about editorial decisions.

          2) The Terms of Service do not enjoin Twitter to keep her on the site. That is, nothing in the ToS *contractually* obligated Twitter to maintain her account.

          3) Even if there was a "promise" that might be taken to court, she had no injury.

          Now, there could be good reasons to argue against 2&3 but the important point is that the judge never says that section 230 prevents the TOS from being applied- just that the TOS don't give an enforceable tort. At the heart of this, the Judge is saying that Twitter has an editorial right to publish or not publish.

          In this case, we aren't talking about publish vs not publish. GFY er GFM took peoples' money. They have a 230 protected right to decide whether or not the Truckers' site is published on their platform- that is an editorial decision. But to take someone's money under the promise it is going to the Truckers, and to NOT do so is not ever, and never will be considered an "editorial decision".

          Megan Murphy does not apply here.

              You are misinterpreting what I said even more than usual. The judge said the Terms of Service don't obligate Twitter to keep her account. He didn't say "Because of 230". He said that the TOS do not obligate Twitter to keep her account.

              This is not unusual, by the way. Courts have OFTEN given broad leeway to companies and their terms of service. They are not the same as a signed contract. (And by the way, this has also been beneficial for consumers. A company cannot use its terms of service to avoid damages for negligence, for example.)

                Murphy was kicked off of Twitter for a change to the ToS made AFTER the comment Overt. She was not in violation of any pervious term in the ToS.

                I don't know how the judge can claim there was no issue involving contracts and the ToS.

                  And it's a disingenuous/self-serving refutation of what would otherwise be willfully acknowledged as a chilling effect, selectively invoking the court as microcosm.

                  "The 'no shirt, no shoes, no service' sign doesn't contractually forbid the proprietors from serving whites without shoes while forbidding blacks without shoes..."

                  If the proprietors have the ability to reject anyone they please for any reason, then they don't need the 'No shoes' sign or S230.

            Again, to be more clear- the Judge's opinion is that there was no Breach of Contract- specifically,

            1) As read, the TOS are not a promise (or contractual obligation) to let Murphy always have an account.
            2) There was no injury caused by this. (Murphy's suit claims that her "freedom of speech" was injured, but the Judge points out she still has that freedom.)
            3) Her complaint that the Speech Policies are being enforced arbitrarily is an attack on Twitter's interpretation of its policies, not a breach of promise.

            Again, you can argue that in fact the TOS were a promise, and that Twitter really DID breach that contract, but it is wrong to say that the Judge said 230 prevents it from applying here.

              Again, Murphy was in violation solely after a ToS change was made AFTER the contract.

              What use is the ToS if it is unenforceable for her following prior terms? It would be an unconscionable contract at that point. There is no way you can support that from a liberty of contracts stand point.

          This seems to be a new impulse. I can't imagine that years ago they'd've tried to fool people about the effectiveness of various materials for radiation protection in case of nuclear fallout. They made a point about the ineffectiveness of substitutes for safety belts in cars, such as holding on to children by one's arms. As soon as they knew, they'd tell you just how effective a particular batch of vaccine was against a particular seasonal flu strain.

          But now they lie their mouths off about evaluations of safety and effectiveness of, not just masks, but any of various preventions and treatments for CoVID-19, either elevating or belittling them according to whim.

    Reported live last night on multiple live streams. I watched a few, but I spent about a half hour rummaging through some guy named Portland Andy on YouTube. Seems to be a total stoner, but he had a lot of Livestream pouring in to one location. (Or maybe the stoner wasn't Portland Andy.           You both advocate for private actors to self-censor their platforms out of some common-good concern. This is an explicitly anti-liberty position.

          The solution to bad speech is good speech, not suppression.

        The oldest and most highly respected scientific journal in the world, The British Medical Journal (BMJ), recently published a report entitled, “Covid-19: Researcher blows the whistle on data integrity issues in Pfizer’s vaccine trial” that calls into question the science behind Pfizer’s vaccine.

        Because the report does not unquestioningly praise the jabs as “safe and effective,” Facebook “fact checked” it and deemed it as containing “false information.”

        Fiona Godlee, the editor of The British Medical Journal (BMJ), has written a letter to Facebook (Meta) CEO Mark Zuckerberg blasting him for the social media platform’s “inaccurate, incompetent and irresponsible … fact-check” protocols.

        It turns out that Facebook contractor “Lead Stories” was responsible for all this censorship. After learning what had happened, Godlee wrote Zuckerberg, highlighting the following points about the so-called “fact check” in her letter to him:

        - It did not present any assertions of fact that The BMJ article supposedly got wrong.
        - It used the following nonsensical title: “Fact Check: The British Medical Journal Did NOT Reveal Disqualifying And Ignored Reports Of Flaws In Pfizer COVID-19 Vaccine Trials.”
        - The first paragraph inaccurately labeled The BMJ a “news blog.”
        - A screenshot of The BMJ report that Facebook posted with a “Flaws Reviewed” stamp over the top of it failed to identify anything false or untrue.
        - It published the story on its website under a URL that contains the phrase “hoax-alert.”
        - Lead Stories was contacted by The BMJ concerning these and other issues but the company refused to make any changes.
        - The BMJ also tried to contact Facebook directly about removing the “fact check,” but was refused.

        The answer to bad speech is more speech. Shutting down bad speech, however good your intentions, is totalitarian. A parent not allowing their kid to read anything but the Bible is totalitarian. A corporation requiring a vaccine for it's employees is totalitarian. A government declaring a speech denouncing it as illegitimate as treasonous is totalitarian.

            I'm not saying anything about what I think. But Rogan seems to be a pretty kind and thoughtful guy who isn't trying to cause trouble.
            No one should be seeking medical advice from him, but that's really a very small part of what is talked about on his show. It's just people talking about stuff. Often interesting people talking about interesting stuff. Perhaps a good starting point for some people to do more research into something they hadn't thought about too much before.
            Joe Rogan is just some guy (and a pretty good comedian, I think) who accidentally stumbled on this weird 3 hour conversation thing which a lot of people seem to like. There's nothing too special about him, but I think what he is doing (just talking to people to see what they think and discussing and debating ideas) is really good and there should be more of it.

            Here was my COVID journey as a vaxxed person:

            -Day 1: Slight fever
            -Day 2-3: Fever, chills, body aches, slight cough
            -Day 4-5: Cough and sore throat
            -Day 6: Slight cough, begin expelling mucus

            Ibuprofen actually helped with the coughing, because COVID causes inflamation and ibuprofen is an anti-inflammatory. I took Nyquil at night because OTC knockout meds are fucking awesome when I get sick.

            Wife had the same symptoms, kids were either asymptomatic or had a bad fever and snot at worst. No one lost taste or smell, although my best friend's youngest got it and had his sense of smell jacked up so that meat smells like wet dog. All of them are unvaxxed.

              My long COVID symptom is that, ever since, Ruffles sour cream and cheddar chips have a soapy aftertaste like cilantro has always had for me. Seriously weird, I have been eating those chips for years and never noticed it before.

        Yes, but that's likely because most people are vaccinated so at some point, the vaccinated will outnumber the unvaxxed in both hospitalizations and deaths. As we have discovered, when 165% of your population is vaccinated, 100% of the hospitalizations will be of the vaccinated.

        The problem is as more and more people have gotten vaccinated, we're not seeing a drop in hospitalizations or deaths, which is why they're starting to pivot to more 'nuanced' look at the data. Suddenly co-morbidities, stratification by age and infirmity is now a thing whereas before it was 'died with covid' full stop.

    The Canadian truckers have been threatened with loss of their livelihood if they don’t obey the mandates and get vaxxed. They have been staying in Ottawa despite the bad weather and lack of provisions and are risking fines and arrests to exert pressure on officials. Despite the lack of objective press coverage, the truckers are inspiring people, all over the world.

    The tyrants in government and their allies in big tech and the MSM are trying every dirty trick in their arsenal to try to shut down this peaceful protest against covid mandates. Besides declaring a state of emergency because of a peaceful protest, they have also:
    1) Refused to turn over the $10M collected by GoFundMe on behalf of the truckers
    2) Either ignored or distorted the news coverage of the protest. Besides a few members of the independent media like Rebel News, the MSM has had a dearth of reporters actually on the ground talking to any of the protesters.
    3) They use the same minor incidents and pictures, over and over again to discredit the truckers despite lack of proof that these incidents were caused by any of the truckers themselves, as opposed to agent provocateurs or a few persons who are not representative of the truckers or the protest.
    4) Trudeau using his bully pulpit from afar to mischaracterize the protest and the truckers.
