Brickbat: Tales of the Highway Patrol

The California Highway Patrol has agreed to pay $4.5 million to a woman who says she was sexually assaulted by former officer Xavier Aguirre. The woman was a passenger in an SUV stopped by Aguirre. Aguirre turned off the dashcam in his patrol car and directed the woman to the back of the SUV, where she said he groped her breasts and genitalia under the pretense of frisking her. Aguirre later told investigators that he turned the camera off because he was scared for his safety. She said he showed up later that day at her home and assaulted her again. An investigation confirmed he used law enforcement databases to find her home and showed up there. Aguirre was fired, but the Orange County district attorney's office declined to file charges against him. Aguirre denied any wrongdoing.

Aguirre later told investigators that he turned the camera off because he was scared for his safety.
He also said repeatedly that she needed to stop resisting.
Sounds like he could have left the camera on and still would have been safe from prosecution, so he had nothing to fear.
Turning off one’s camera, while on patrol, should be considered misconduct and prima facie evidence of criminal intent.

He's just doing his job, he's the Highway Patrol.
What would he have to do to get charged with something?
Try to feel up a cop and you'd be lucky to live to *be* charged.
Ponch led everyone to believe this behavior is acceptable and even sought after by the Ladies of the O.C.
He can't be charged because he remembered his training and uttered those magical words cops are taught to say about the crimes they commit;
" I feared for my safety "
That it worked in even this scenario, is a testament to it's power!
Hey, holding in your lust can be very stressful.
At least the cop didn't get away with it due to qualified immunity. Assaulting the woman during his off time, makes qualified immunity harder to use as a defense for his actions.

So, reinstated with back pay after arbitration, or hired at a police Department near you?
Would this have played out differently if he and his partner took her and a friend to a swinging disco club later that night? The whole story reads like the plot of most CHiPs episodes.
