55 Percent of Police Killings Are Misclassified as Other Causes of Death
Plus: Christian flag case coming to SCOTUS, Merck pill could treat COVID-19, a reversal on migrant expulsions, and more...

More than half of police killings aren't labeled as such, according to new research published in The Lancet. The study looks at roughly 40 years of fatal police violence in the U.S. The main finding: Deaths caused by cops are severely underreported in official data.
To reach this conclusion, researchers compared statistics from the government's National Vital Statistics System (NVSS) with open-source databases from the nonprofit groups Fatal Encounters, Mapping Police Violence, and The Counted.
The NVSS data left off 55.5 percent "of all deaths attributable to police violence" between 1980 and 2018, the researchers found. Overall, "the misclassification of police violence in NVSS data is extensive."
A holistic look shows there were 30,800 deaths caused by police during these decades. "This represents 17,100 more deaths…than reported by the NVSS," they say.
To put that in perspective, they note that, in 2019, more U.S. men died from police violence (1140 deaths) than from environmental heat and cold exposure (931 deaths), testicular cancer (486 deaths), or sexually transmitted diseases (37 deaths).
Non-Hispanic black people were most likely to be killed by police. ("The police have disproportionately killed Black people at a rate of 3·5 times higher than White people, and have killed Hispanic and Indigenous people disproportionately as well," notes the paper.) Their deaths were also most likely to be missing from the official database.
"From 1980 to 2018, the greatest under-reporting of deaths was among non-Hispanic Black people, with 5670 deaths (5390–5970) missing out of an estimated 9540 total deaths (9260–9830)," they report. That's 59.5 percent misclassified. The misclassification rate for non-Hispanic white people in this same period was 56.1 percent. For Hispanic people (of any race) it was 50 percent, and for non-Hispanic people of races other than black or white, it was 32.6 percent.
The data suggest more police killings in recent years than in the early years of the study, (though whether this is a function of better tracking or increased violence is unclear). In the 1980s, the mortality rate from police violence was 0.25 per 100,000 people. In the 2010s, it was 0.34 per 100,000—an increase of 38.4 percent over the study period.
Oklahoma, Wyoming, Alabama, Louisiana, and Nebraska were the most likely states to underreport police killings. In Oklahoma, the misclassification rate was 83.7 percent, and in the other four top states, it was over 70 percent.
The states least likely to underreport police killings were Maryland, Utah, New Mexico, Massachusetts, and Oregon.

How does this happen?
"Physicians are typically responsible for filling out the cause of death section of the death certificate, but state laws require that a medical examiner or coroner do so for homicides or cases where there is suspicion of crime or foul play, including police violence," notes the Lancet paper. It goes on:
However, only some cities have forensic pathologists to act as the coroner, and in small, rural counties, the coroner can be a physician with no forensic training, the sheriff, or a mortician. The text fields of the cause of death section are filled out by the certifier; these responses are then translated into International Classification of Diseases (ICD) codes by software and nosologists using WHO's published code selection rules. According to these rules, deaths due to police violence should be classified under the legal intervention codes, which are defined as "injuries inflicted by the police or other law-enforcing agents, including military on duty, in the course of arresting or attempting to arrest lawbreakers, suppressing disturbances, maintaining order, and other legal action". In cases of police violence, many text fields contribute to the coding process, including the causal chain indicating the full sequence of events leading to death and the manner of death section. One text field is particularly crucial: a section that, in case of injury, asks the certifier to "describe how the injury occurred". If this section does not mention that the decedent was killed by the police, then the death will not be assigned to legal intervention.
Previous studies have documented that the death certification system regularly under-reports deaths due to legal intervention. The under-reporting is related to several factors, including the coroner or medical examiner failing to indicate police involvement in the text fields of the death certificate's cause of death section or errors in the process of assigning ICD codes even when the death certificate shows police involvement. There is considerable evidence that omission of police involvement from the description of how the injury occurred is responsible for the misclassification of police violence as homicides. A police violence death might be misclassified as another cause because the certifier fails to mention the police in the "describe how the injury occurred" section, or because the certificate is incorrectly coded after the fact. The "describe how the injury occurred" section is open-ended and comes with no explicit instructions to mention police involvementand a certifier might lack the knowledge or training to fill out the form correctly. There are also substantial conflicts of interest within the death investigation system that could disincentivise certifiers from indicating police involvement, including the fact that many medical examiners and coroners work for or are embedded within police departments.

The dispute involves the Christian group's desire to fly a white flag bearing a red cross over a blue square in the upper left corner from an 83-foot flagpole outside the seat of Boston's city government. Two of the three flagpoles at City Hall are used to fly the U.S. flag (along with a POW/MIA flag) and the Massachusetts state flag.
However, the City of Boston flag that customarily flies from the third flagpole has been lowered on numerous occasions and replaced with flags of various groups or causes, including gay pride, and foreign countries, including Albania, Italy, Portugal, Mexico, China, Cuba and Turkey. Some of those flags contain religious symbols.
The alternate flags flew on at least 284 occasions over the 12-year period, often in connection with events groups held at City Hall, according to the decision from the 1st Circuit Court of Appeals.
But city officials rejected the Christian group's flag on the basis it would appear to convey an endorsement of particular religious views.
The case could "provide an opportunity for the court's relatively new, six-justice conservative majority to expand the rights of religious groups and individuals to use public facilities to advance their views," suggests Politico.

The "mass grave" is an ordinary cemetery, the people were buried individually over 50 years. Most of the "kids" were adults, some as old as eighty, and died of cancer, typhus and heart disease. Politico obtained an agreement Joe Manchin signed with Chuck Schumer--detailing the terms under which Manchin would vote for Biden's $3.5 trillion budget reconciliation bill. The terms of Manchin's support were clear to Biden and the Democrats since at least the date of the agreement--July 28, 2021. You can read the document yourself here:

Some of the interesting terms Manchin demanded:
1) The debate on the floor doesn't begin before October 1, 2021.
2) The maximum amount of the bill is $1.5 trillion, with any resulting revenue going to deficit reduction.
3) The bill ends carried interest.
4) The Federal Reserve ends quantitative easing.
Items three and four appear to be beyond the ability of the House leadership to deliver. The Federal Reserve is dealing with too many problems to allow their hands to be tied by a Senator, and the Democrat party donors won't put up with the end of carried interest.
There are other objections Manchin has to the Green New Deal, caps on new entitlements, etc. The interesting thing is that this deal exists and always existed. It wouldn't be surprising to me if either Manchin or Schumer leaked this agreement themselves--so that the progressive wing of the party understands the new terms of getting the deal done.
Bottom line: the progressives will need to cut $2 trillion our of the $3.5 trillion budget reconciliation bill to get Manchin's vote, and I don't think the progressives are willing to do that, and, ultimately, this is probably why the infrastructure bill wasn't voted on yesterday. The progressives in the House refuse to vote for the infrastructure bill until Senator Manchin agrees to vote for the $3.5 trillion budget reconciliation bill, and Manchin won't vote for the budget reconciliation bill unless the House progressives cut $2 trillion out of the bill.
4) The Federal Reserve ends quantitative easing.

I believe she made those remarks before the House and Senate decoupled the continuing funding from the debt ceiling. I believe that October 18 date she gave is no longer the issue.

Meanwhile, over in the House, Nancy Pelosi screwed the moderate Democrats over again--and broke her promise to bring the infrastructure bill up for a vote, again, for the second time this week! The moderate Democrats are probably lost to Pelosi at this point. If they happen to do something Pelosi wants them to do at this point, it's just a coincidence. It's not because she wants them to do it.
And remember that only 99 out of 220 Democrats in the House are part of the Congressional Progressive Caucus. For every one of the nine moderate Democrats who wanted the infrastructure bill passed first, there may be a handful of others who haven't gone public. As much as the moderate Democrats don't want to go on the record voting for the Green New Deal and the socialist spending in the $3.5 trillion budget reconciliation bill, there are members of the Congressional Progressive Caucus who don't want to go on the record voting against infrastructure dollars for their districts.
Pelosi's career may have jumped off a cliff if she doesn't bring the infrastructure bill up for a vote today. A British PM wouldn't survive this. Pelosi no longer commands the loyalty of a majority in Congress. If things continue as they are now, with the effective defection of the moderate Democrats, we'll be in a de facto multi-party, coalition government with no one in the clear majority.

Because the Congressional Progressive Caucus has moved so far to the left, there is! They moderates will put their careers on the line to stop the radical Democrats, and they are, in fact, moderate compared to the progressives. Look at Manchin's terms. He's saying he will not support the $3.5 trillion budget reconciliation bill, and that appears to be a real world difference between the progressive and moderate wings of the Democratic party. In this case, the moderates are mostly being backed by the unions, too.
Screwing over the moderate Democrats' attempt to get the infrastructure bill passed is screwing over the unions who fought for that bill. They AFL-CIO wants that infrastructure bill passed now, and the progressives are standing in the way on progressives principle.
Net net: Brain Damaged Biden's agenda is stymied.

The existence of the document shows that the deal was always 1.5, and 3.5 was never on the table in the senate. And if it's not on the table in the senate, it's not in the house either.
I find it hard to believe that Schumer didn't communicate that to Nancy. I'm wondering if 3.5T was ever really under consideration. She HAS to know it would be catastrophic for the democrats politically. It wouldn't surprise me if Nana Pelosi knew about Manchin's terms, has just been stalling and running out the clock on the 3.5T, and plans to hang it on Manchin when it gets watered down, giving the moderates cover by not making them vote on 3.5T. Manchin is a D in an R state who can stay reasonably safe as long as he holds the line on this. He can be seen as rejecting the Biden Progressive Agenda to satisfy the Rs, while negotiating some nice bones for his base and his constituents in a 1.5T bill.
The dems are in a bad position. They have to pass something, and 3.5T is absurd. It's never going to make it thru. They can probably get away with 1.5T and still make the base reasonably happy, but then they have to deal with the progressives.
Manchin is the safest moderate Democrat in America so long as he stays moderate. Every article about him standing up to Pelosi and Schumer and Biden makes him safer.
And if, by some miracle, he was primaried by one of AOC's progressive candidates, they'd get beaten so badly by almost any Republican. Maybe a repeat of Roy Moore or the witch in Delaware could lose it but short of that it's either Manchin or a Republican.
Schumer is trying to protect his majority at the expense of Pelosi's majority which is all but assuredly gone after the midterms anyway.

My biggest concern is that Pelosi and Schumer will gladly slash the $3.5T reconciliation bill down to $1.5T (while appearing conciliatory), while keeping many/most of the disastrous left wing policies in the legislation, and that Manchin, Sinema and some RINOs in the House and Senate will give it enough votes to pass.
All democrats truly did was separate their initial 3.5 trillion into two bills worth 4.5 trillion and now will compromise at 2 bills at 3 trillion.
Ultimately, I think that's how it's going to play out. They'll slash it down to 1.5T, but they'll keep some of the most ludicrous bullshit in there as a sop for progs. I don't think they'll keep all of it. The Ds owe too many people, and they need to use this bill as a pork vehicle to pay some of their bills.
I expect that to happen, and can only be pleasantly surprised if it doesn't!

I'm trying hard to remain realistic about this, and in reality, the $3.5 trillion budget reconciliation bill should have been a foregone conclusion. If Biden hadn't squandered so much of his political capital on Afghanistan, vaccine mandates, and Haitian immigrants, we might not be looking at any substantial opposition to the $3.5 trillion at all.
I don't see the status quo as an alternative to the $1.5 trillion. I see the $3.5 trillion bill as the status quo, and the $1.5 trillion bill as a significant improvement. In that light, this is a good thing--even if every bit of it needs to be repealed once it's passed.
But there is hope that it breaks down completely. Everybody wants to go home and fund raise by mid-October. And wouldn't they rather go home with an infrastructure bill to show for their efforts? This could get worse for the Democrats than it is now, and here's to hoping they crater it completely!

So he is advocating two major shots across the bow on major corporate interests. Carried interest is a tax preference that benefits huge mutual/hedge fund managers. And the repeated attempts to remove Oil Recovery deductions are driven by large companies like Exxon because it makes oil recovery only profitable for integrated companies- not small drilling companies that are overwhelmingly all small businesses.

In 2019 San Diego County blacks, with 4.4% of the county population, committed 24% of the murders, 24% of the county’s rapes, 39% of the robberies and 21% of the aggravated assaults.
But bad as this disparity is, this comparison understates the black crime frequency. The statistically correct way to look at the crime rate is NOT to compare black crime rate with the overall average, but rather the black crime rate vs. the average crime rate of everyone else.
Using that criteria, we find that -- compared to the average for all the other races -- with 4.4% of the San Diego County population -- per capita:
* Blacks committed murders 6.9 TIMES more frequently than the rest of the county population.
* Blacks committed rapes 6.9 TIMES more frequently than everyone else.
* Blacks committed robberies 13.9 TIMES more frequently than everyone else.
* Blacks committed aggravated assaults 5.8 TIMES more frequently than everyone else.
Over 85% of the VICTIMS of these crimes are black. Yet the press (including REASON) apparently thinks it's best we not talk about the appallingly high black crime rate. How does THAT help the black communities?

4.4% of the community makes San Diego unusual as large metropolitan areas go--because African-Americans make up about 12% of the population nationally. San Diego is an extremely expensive place to live. Even before the pandemic, back in 2019, the average price of a home is showing up on Zillow at around $640,000 in San Diego. The median home price nationally was around $320,000 in 2019.
In short, I suspect race may be getting blamed here for problems that are actually associated with poverty, in San Diego county, and if poverty is a better predictor of criminal activity than race, then race probably shouldn't enter into this discussion. There are relatively few poor people in San Diego, but it may be that the African-American community is disproportionately represented among what few poor people are there.
I suspect the rate of crime for whites who make less than $25,000 a year is similar to that of blacks who make the same amount. This is certainly the way I've seen it work with studies of illegal immigrants from Mexico and crime. The first generation hardly commits any crime, but each successive generation reverts to the whatever the mean is for their income level.
If the few blacks there are in San Diego are disproportionately among the poor, then finding that they exhibit a higher instance of violent crime shouldn't surprise us. Why blacks are disproportionately among those with the lowest income levels may be the more pertinent question, and racism probably can't be ruled out as a possible explanation for that.
I recall a local study from a few years back that said basically the same thing. Poverty was a better indicator of criminal activity, and black people in our area are over-represented there, in that they make up 25% of our community but over 50% of our poor.
Poor people committed something like 90% of the crime.
Being wealthy is about having a lot of options. Poor people have few of those, and they have less to lose, too. Wealthier people have more fun things to do with their time than spend three to five and a half years in prison for holding up a liquor store, and they don't need to hold up a liquor store for cash.

First off, most blacks are not poor. That's another common misconception. Especially when one looks at all the payments and benefits a "poor" person gets.
Logically poverty DOES have some effect on the crime rate. But primarily on the PROPERTY crime rate. There's little case to be made that poverty is the driving force behind VIOLENT crimes.
Consider San Diego County. The county median household income for blacks ($51,000) is actually a bit HIGHER than Hispanics ($49,900).

If blacks in San Diego are disproportionately among the poor, then you need to eliminate the distinction between violent criminals being black and violent criminals being poor.
