Federal Regulations Keep COVID Patients in the Dark About Which Variant They Have
Plus: Airbnb will host 20,000 Afghan refugees, court rejects Nunes lawsuit against Liz Mair, and more..

It should be relatively easy for coronavirus patients who want to know what variant of COVID-19 they've been infected with to obtain that information. After all, at least 50 public laboratories in the U.S. are capable of testing COVID-19 samples to detect virus variants. But onerous federal regulations keep this health information out of reach.
"The Centers for Medicare and Medicaid Service (CMS), which oversees the regulatory process for US labs, requires genome-sequencing tests to be federally approved before their results can be disclosed to doctors or patients," notes Insider. "These are the tests that pick up on variants, but right now, there's little incentive for the labs to do the work to validate those tests."
That's because doing so is illegal without federal approval, and getting that approval is an involved, expensive, and uncertain procedure. It requires completing a validation process that would have to be newly undertaken for each new variant a lab wanted to test for.
"The process of validating a next-generation sequencing test is burdensome," Kelly Wroblewski, the Association of Public Health Laboratories' director of infectious diseases, told Insider. "It takes a lot of time. It takes a lot of data. It takes a lot of resources. And the thing about the variants is that variants of concern and of interest are constantly changing, so you would have to do a whole validation every time you have a variant."
As a result, patients and the public are left with less information about the virus' spread—information that could be useful for preventing future infections and outbreaks. For instance, someone infected with the delta variant has more cause to alert vaccinated people they've been in contact with than does someone infected with the original strain. And knowing which variants are spreading in a given community, or spreading most quickly, could also provide key information (things like new variants gaining ground, higher transmissibility potential, if some variants seem more prevalent in certain populations, etc.) and early warning signs as we deal with this virus' mutations going forward.
Genetic sequencing of COVID-19 tests was approved by the Food and Drug Administration (FDA) in June 2020. (The FDA, CMS, and the Federal Trade Commission all have a say in genetic testing regulation.) And epidemiologists are allowed to disclose variant status in certain situations, for certain purposes. From Insider:
"The letter of the law from CMS is that if you don't go through this full validation process, you cannot release the results with patient identifying information," Wroblewki said. One major exception, she noted, is if epidemiologists need to disclose a person's variant information over the course of contact tracing.
But under the current regulatory regime, patients—and therefore their communities and the public at large—are left in the dark.
PBS warned way back in February about the problems this can create:
Federal rules around who can be told about the variant cases are so confusing that public health officials may merely know the county where a case has emerged but can't do the kind of investigation and deliver the notifications needed to slow the spread, according to Janet Hamilton, executive director of the Council of State and Territorial Epidemiologists.
"It could be associated with a person in a high-risk congregate setting or it might not be, but without patient information, we don't know what we don't know," Hamilton said. The group has asked federal officials to waive the rules. "Time is ticking."
The problem is that the tests in question for detecting variants have not been approved as a diagnostic tool either by the Food and Drug Administration or under federal rules governing university labs ― meaning that the testing being used right now for genomic sequencing is being done as high-level lab research with no communication back to patients and their doctors. …
Officials representing public health labs and epidemiologists have warned the federal government that limiting information about the variants ― in accordance with arcane regulations governing clinical labs ― could hamper efforts to investigate pressing questions about the variants.
The Association of Public Health Laboratories and the Council of State and Territorial Epidemiologists earlier this month jointly pressed federal officials to "urgently" relax certain rules that apply to clinical labs.

The more important point is that it's not actionable. Meaning, it would not change how you treat a patient if you knew whether they were infected with Delta vs some other variant.
I happen to work in one of the "50" (not sure where they got that number from) labs that are capable of variant-level diagnosis. We're currently not offering this test for the reasons mentioned in the article, and the reasons Bubba mentions. But, if evidence emerges that a particular treatment worked better (or worse) for Delta vs other variants, I think that would change on a dime. It would be pretty easy for diagnostic companies to shame the FDA into fast-tracking approval for this, if it was shown to make a difference in patient outcomes.

My personal observation has been that, individually, refugees can assimilate very well. While communities of refugees reinforce the same tribal behaviors that make the places they are fleeing into crime ravaged shitholes.
These particular refugees are fleeing a country that remains mired in tribal and religious conflicts that stretch back over a 1000 years. They had 20 years of US presence and a population of 32 million from which they couldn't muster a coalition to hold off a Taliban insurgency of 180,000 fighters. The US government is giving priority to those who worked with diplomatic services, intelligence agencies, military, and military contractors. Are those guys typically the best and the brightest, or are they sycophants and grifters?

Exactly! This is not about 'my immigrants were better than your immigrants'. The 19th century Irish were a persecuted people who had spent their entire lives in a region consumed by centuries of tribal and religious conflicts.
From the history of my own family I know that many, if not most, Irish immigrants lacked a basic understanding of the proper way to behave in a free society. Petty thievery and grift was how they survived the Old Country and it was seen as perfectly acceptable for generations. They migrated West, passing down their lack of work ethic and continued as migrant labor when they lost Oklahoma to the Dust Bowl. They popped out 6-8 kids who worked in the fields and orchards before and after school, hated religion, hated Blacks and Chinese they competed with for jobs and resented the government even while they conspired to stay on the dole after the Depression and through the war.
My dad was born in 1943. He never knew his father who was supposedly a sailor on the USS Tennessee, which I have confirmed was in port 9 months before he was born in Seattle, but have not been able to match a name. He hated his grandfather who called him a bastard and the step-father that beat him. My grandmother finally broke the cycle of migration when she married a logger and settled in rural WA in 50's. Dad broke the cycle of poverty when he joined the Navy as soon as he was eligible and never looked back. He told me after his mom died that he did feel bad that she was going to Hell.
Refugees have a lot more than trauma to overcome before they can integrate into American society. It may take 5 or 6 generations.
Seriously though, our Albanians and Serbs were just starting to transition to normal people and now we're getting these folks.

There's a lot to unpack in this statement. Yes, legalizing marijuana is a significant improvement. However, you can still be arrested for possessing said plant if you run afoul of the "liberalized" and often byzantine regulatory systems that are in place.
I recommend you watch an interesting documentary called "Murder Mountain". The primary thrust is about how many people mysteriously disappear with the focus on one case in particular. But the secondary topic is how legalization wiped out more marijuana growers than decades of DEA and state enforcement ever could.
The 'libertarian' in that case would be an affectation rather than a factual description, given the pointed disinterest in civil liberties. Which is fine, but it's best to be honest about what one believes.

Keep in mind, this formal approval DOES NOT cover children under 16--because they've only been testing on them since March. It's basically just a re-wording of the EUA from "emergency use authorization" to "fully approved" without any real reasons cited for it.
I"ll add one final thing here--we've seen the government lie about spying on our allies and American citizens. In the past year, we've seen Fauci change the story on mask-wearing when it was convenient, the CDC say that vaccinated people don't need to wear masks, then come back and said everyone needs to wear masks even if they got the jab. They're not even acknowledging the giant spike in reporting on these things in VAERS. And now Biden is "encouraging" employers to mandate an "authorized" coof shot that apparently is weaker against this current version than the others.
On top of that, we've watched the administration completely implode on the Afghanistan withdrawal in the past week. They've lied about what they knew, indulged in the typical bureaucratic ass-covering, get stun-locked in press conferences by simple questions, and Congressmen are now admitting that we might not be able to get all of our citizens out of there, meaning we're basically leaving Americans to die because of the administration's lack of planning.
At what point do these people, and that includes the NeverTrumper bobbleheads, start thinking, "Gee, maybe these people don't actually know what they're doing, and are just throwing shit against the wall in the hope something sticks"?

Was there extra testing, science and other due-diligence or was it just speeding an administrative effort? If it was the latter, then I don't see how this solves for people who are hesitant about the vaccine. They are going to merely see it as the government ramming through a rubber stamped process.

Are you following the 19th century science? Were polio and influenza typically spread through spittle deposited on a sidewalk? What about people who spit off the sidewalk into the street or a grassy lawn? What about the stairs leading to a building? And even if you do everything right, you can still be denied because they weren't able to find your birth certificate within Afghanistan's excellently kept records, for instance.
I have helped 2 Afghan interpreters with their successful visas, and I am still trying for 2 currently hiding in Kabul. One of the successful ones took 6 years to be granted. He gave up at one point and smuggled himself to turkey, only to be caught and returned. The whole time his family had to relocate frequently whenever the taliban figured out where they were. These men have risked more than you ever will in service to the ideals of self rule, freedom, and American values.

It turns out the Afghan army depended on helicopters to supply their forward lines, which in turn depended on fuel and mechanics for support. When the US withdrew, they stopped delivering the fuel Afghanistan depended on. And they withdrew American contractors, the only people with the knowledge to maintain these helicopters.
Can you believe this? Our government was so corrupt and willfully negligent that we spent billions of dollars on war equipment and then did not provide our allies the basic necessities to keep that equipment running. This isn't about Biden's withdrawal (which I will continue to argue was absolutely botched). This is an indictment of our entire government's ability to execute a mission, rather than line the pockets of cronies. Training mechanics in country who could maintain this gear should have started YEARS ago, and the fact that the US never planned for fueling or training is transparent incompetence.

So, the week before last, we discussed the impending vote on Biden and the Democrats' $3.5 trillion budget reconciliation bill, and the last chapter had it that nine House Democrats wrote a letter to Pelosi threatening to withhold their support for the budget reconciliation bill unless she held a vote on the $1.2 trillion infrastructure bill first.
This was significant because 1) if more than four Democrats fail to support the budget reconciliation bill in the House, it won't succeed and 2) The reason Pelosi and the progressive wing of the House Democrats are insisting on voting on the budget reconciliation bill first is because they're afraid that the House passes the infrastructure bill first, moderate Democrats in both the House and the Senate will subsequently refuse to pass the budget reconciliation bill for being too expensive. In fact, there's no reason for moderate Democrats to care which bill is considered first if they don't plan to vote against the budget reconciliation bill.
In other words, when last we left it, there was a glimmer of hope that, maybe, the $3.5 trillion reconciliation bill would fail. At the time, there was talk that Pelosi would introduce a procedural change that would make it so the two bills would be passed in the House simultaneously. In fact, Pelosi tried to introduce a procedural vote last night to make the two votes happen simultaneously, and guess what? There wasn't enough support from those nine moderate House Democrats to pass the procedural change, and so the motion wasn't brought up for a vote.
"Democratic leaders on Monday evening altered a procedural motion originally scheduled for a vote later in the night so that if it passes the House, the $3.5 trillion budget framework would pass at the same time. I'm still not backing off my statement from the week before last. IF IF IF the House passes the $1.2 trillion infrastructure bill before the $3.5 trillion budget reconciliation bill comes up for a vote, then the budget reconciliation bill PROBABLY won't pass. Because of that, the likelihood of the $3.5 trillion reconciliation bill passing probably depends on the results of the ongoing procedural battles over whether the infrastructure bill will be voted on before the budget reconciliation bill, and we may see that come to a head later today.
I still wouldn't bet on the budget reconciliation bill to fail. I still think it's likely to pass. However, Biden and the progressive Democrats only had so much political capital to spend in getting the budget reconciliation bill over the hump, and Biden had a whole lot more in the way of political capital to spend before last week's collapse of the Afghan military. Moderate Democrats, in red and purple districts and states, are less likely to be willing to stick their necks out for Biden's sake than they were when Biden was more popular the week before last. Why would moderate Democrats want Joe Biden to come to their district and campaign for them in 2022 at this point?
In conclusion, although the budget reconciliation bill may still be likely to pass, it's less likely to pass than it was the week before last. The bill is full of Green New Deal spending and the creation and expansion of socialist entitlement programs, and I remain hopeful that the American people can avoid this awful mistake. Watch the procedural vote today or later this week. If they make it so the infrastructure bill comes up for a vote first, the $3.5 trillion reconciliation bill probably won't pass.
