Biden Applauds Derek Chauvin Guilty Verdict, Condemns Violent 'Agitators and Extremists'
Plus: An anti-tech crusader could be joining the FTC, threats to free speech at Columbia University, and more...

President Joe Biden addressed the nation on Tuesday following the conviction of former Minneapolis police officer Derek Chauvin on all three charges. Biden applauded the verdict and said that George Floyd's death was "murder in full light of day, and it ripped the blinders off for the whole world to see the systemic racism."
Biden said this outcome was a step forward for racial justice, but that Congress should act to pass legislation that would address misconduct in police departments. He said that should be Floyd's legacy—a legacy of "peace, not violence":
Peaceful expression of that legacy are inevitable and appropriate. But, violent protest is not. There are those who will seek to exploit the raw emotions of the moment, agitators and extremists who have no interest in social justice, who seek to carry out violence, destroy property, and fan the flames of hate and division, who do everything in their power to stop this country's march toward racial justice.
We can't let them succeed. This is a time for this country to come together, to unite as Americans.
Remarks by Speaker of the House Nancy Pelosi were less well-received. As SFGate reported:
Shortly after former Minnesota police officer Derek Chauvin was found guilty in the murder of George Floyd, House Speaker Nancy Pelosi, D-Calif., delivered a bizarre speech that immediately angered and disturbed people following along on social media.
"Thank you George Floyd for sacrificing your life for justice," Pelosi said. "For being there to call out to your mom — how heartbreaking was that?" she interjected. "Call out to your mom, 'I can't breathe.' But because of you, thousands, millions of people around the world who came out for justice, your name will always be synonymous with justice. And now we have to make sure justice prevails in the sentencing. But, you know, that's its own procedure."
Obviously, the idea that Floyd sacrificed his life for justice is a bit presumptuous. Floyd didn't choose to be killed. (The Las Vegas Raiders posted a similarly cringeworthy social media statement.)
Meanwhile, Rep. Alexandria Ocasio-Cortez (D–N.Y.) cast doubt on the notion that Chauvin's conviction represented some meaningful achievement of justice.
That a family had to lose a son, brother and father; that a teenage girl had to film and post a murder, that millions across the country had to organize and march just for George Floyd to be seen and valued is not justice.

There were also plenty of questionable reactions from the right. Republican Anthony Sabatini, a member of the Florida House of Representatives, described the outcome as "mob justice." Several other conservative commentators echoed this notion.

Columbia University students filed complaints against Dinah PoKempner, an adjunct professor at the Institute for the Study of Human Rights and former general counsel at the Human Rights Watch, after she used the word nigger in an educational setting while discussing "the comparative legal treatment of hate speech." According to The College Fix:
Students attempted to inform PoKempner why her language was out of line, but without success. They ended up taking their complaints to the Office of Equal Opportunity and Affirmative Action, the Office of Multicultural Affairs and Institute for the Study of Human Rights.
According to Columbia's faculty handbook, professors should "engage their students in discussions about issues that are contentious and emotionally charged" and "challenge them to reexamine deeply held beliefs." It also notes such discussions should embrace "civility, tolerance, and respect for ideas that differ from their own."
While the complaints about PoKempner are being looked into, Institute for the Study of Human Rights Director Elazar Barkan "acknowledged" students' post-episode "anxiety about the course." Another administrator will handle grading for PoKempner's class for the rest of the semester.
Adam Steinbaugh of the Foundation for Individual Rights in Education urged Columbia to refrain from punishing PoKempner. "A class discussing what the First Amendment protects will naturally raise the likelihood of hearing or seeing words people find offensive," he said. "While students have the right to criticize those choices or to complain about them, an investigation or punishment by the university would be a marked departure from its commitment to academic freedom."

The Senate will hold confirmation hearings on Wednesday for Lina Khan, an associate professor of law at Columbia University who was nominated by Biden to join the Federal Trade Commission (FTC). Khan's appointment is notable because she's a major intellectual proponent of the idea that the federal government should use antitrust laws to regulate major tech companies. She was the co-author of an influential 2017 paper that argued Amazon's multiple market functions—as a platform, a retailer, a book publisher, and a web hosting service—create "anticompetitive concerns."
In essence, Khan is an adherent of the progressive approach to regulating "Big Tech." What's interesting is that many conservatives have also soured on tech corporations and some—Sens. Josh Hawley (R–Mo.) and Ted Cruz (R–Texas) in particular—have signaled an openness to regulating or even breaking up Big Tech. If the Republicans decline to get behind Khan—or even deride her pro-government, pro-regulation approach—it might show that their stated opposition to Big Tech is just for show. Sen. Mike Lee (R–Utah) has suggested that Khan is too inexperienced for the job, which could be his way of saying he's not on board.
Assuming that Khan does get confirmed, she is likely to bolster the Biden administration's misguided efforts to rein in tech companies. Biden previously tapped Tim Wu, a Columbia law professor and close ally of Khan, to join the National Economic Council. This is one area of policy where Biden's views seem to be well in keeping with far-left progressivism, and there's plenty of damage that Wu and Khan can do. How Republicans might respond is something of a mystery, given that petty grievances have caused them to abandon free market principles when it comes to tech.

Someone should tell Mr. Biden that treaties require the approval of two-thirds of the Senate before he can ratify them, and that can't be changed--with or without the filibuster.
It's true that Biden can run over the separation of powers and institute the treaty anyway, much like Obama did with the Paris accords and the Iranian nuclear deal.
It's also true that the next Republican president can come into power and undo whatever Biden does just like Trump came in and undid the unconstitutional treaties Obama signed.

Maybe just a little tweaking, but rest assured we have Top Men in charge and you need to just trust that they know what's best for everybody. That's really the problem here - a lack of trust. Nobody knows how exactly the Russians convinced so many good and patriotic Americans to distrust their most sacred institutions of democracy, but perhaps this jury verdict can begin to bring this nation together in a spirit of healing, forgiveness and - most importantly - trust in their moral and intellectual superiors' fitness to rule.

Biden's speech was a disgusting mix of moral incoherence and stoking racial paranoia. That the American system of law enforcement is completely permeated with systemic racism but most cops are decent people cannot both be true. There is no evidence that Chauvin's and the other officer's actions that day were motivated by racial animus, rather than frustration with dealing with a prisoner suffering from drug induced panic. The idea that Biden endorsed that black people who fear for their lives because they are black is irresponsible fear mongering that will divert attention away from solutions to the actual problems with how police are trained and tactically authorized to deal with difficult situations in enforcing the law. This from a man who has spent the majority of his adult life embedded in the system and is considered the representative of its ruling class.
The speech wasn't supposed to mean anything other than be a set piece for Biden's supposed popularity. Everything Biden says in public is presented as a confirmation of his inevitability. He was destined to make that speech, and thank God he was able to make it in the nick of time--right before his mind went completely blank.

Look, reasonable doubt is supposed to be the standard. It is supposed to prevent innocent people from being punished. The logic is that it is better to err on the side of innocence. As Ben Franklin said, it is better that 100 guilty men go free than 1 innocent man suffer.
No honest person can possibly look at the facts of this case and say there is no reasonable doubt. It isn't possible. I have my own opinions about what actually happened but REASONABLE DOUBT is all that's required. Guilt must be proved BEYOND it. That didn't happen.
I hope people would agree that it is an egregious miscarriage of justice to convict someone of a crime where reasonable doubt is present.

Chauvin is guilty. He is certainly guilty of manslaughter, and quite probably of third degree murder. All the other charges are just the prosecution stacking up charges to get a conviction of any kind.
All the points you made will certainly be brought up on appeal. Personally, I feel that Congresswoman Waters crossed the line from advocacy to outright intimidation. POTUS Biden was not much better. The prosecution should be sanctioned for their behavior relative to discovery. And the settlement on the eve of the trial certainly influenced the jury.

Theories and reasonable doubt aside, my 14-yr.-old asked me the Trillion Dollar Question yesterday: They found him guilty of Murder 2, Murder 3, and Manslaughter 2... How many people did he kill?
There is a single fact that is undeniably true in everything that happened that day. Floyd died while being restrained by Chauvin.
The only reasonable doubt is that Floyd may have died anyway. If so, then Chauvin neglected to render aid to a dying man and prevented others from doing so. His only defense is ignorance, which would certainly not be sufficient to acquit anyone who wasn't authorized to arrest Floyd. Why should police get special treatment?
Arguing 'officer safety' and 'what a reasonable officer would do' is fallacious and this jury refused to accept such excuses, as is its duty. Whatever case they could cite where a restrained suspect subsequently injured police or bystanders is immaterial to the facts presented here. Floyd was not faking. Floyd could talk, but couldn't get oxygen. This is something that people authorized to put their knee on another person's chest should know.
This is not injustice. It is accountability.

Many well-intentioned people are saying "well, at least there won't be any riots!" without realizing it will actually be worse in the long run because now the media and BLM know their tactics work for any future trial outcome that they want to influence. I can't judge the jury members too much because I know the tremendous pressure and threats they felt. But the decision to cave to it is still wrong.
I agree with this as well. "There won't be any riots," would be a horrible reason to convict someone. Hopefully that is not what happened, but the jury is not prohibited from rendering an unjust verdict, just as they are not prohibited from nullification.

But... Floyd worked as a bouncer. If he had restrained a guy trying to pass counterfeit $20s until police showed up and that person died, despite bystanders telling him the guy was dying and offering to help, what would prosecutors have charged him with? Would they get a conviction?

Again, there is no question that Chauvin restrained the guy until he was dead. The video shows Chauvin kneeling on the guy continuously for 7 minutes before he expires and then for an additional 2 minutes. The prosecution provided testimony that the methods of restraint were the cause of Floyd's death. If the defense cannot rebut the restraint as the proximate cause of death, the jury is justified in convicting. The argument for reasonable doubt, that Floyd was dying anyway, is irrelevant. Hastening an inevitable death is no less murder.
That is what I meant by they had something to prove.

Shrike apparently missed all the threads, like the one from yesterday (again), that made the case about how the coverage of the Capitol riot was a farce and how defending the shooting of an unarmed protester for trespassing on public property is morally bankrupt.
But we shouldn't miss the fact that after years and years of having his irrational thinking exposed every day, Shrike still can't stop himself from stupidly walking into another ad hominem.
Here's the thing, Shrike: Shooting Ashli Babbitt was wrong or right regardless of whether I defend them because they're team red. Even if I were defending the principle because she was team red, the principle that defending the shooting of unarmed protesters because they're trespassing on public property is morally bankrupt anyway.
We know that, and we've known it since Aristotle pointed it out 2,500 years ago. Every day for 10 years, you've seen someone either make or get called out for an ad hominem fallacy, and you still don't understand what that means--or why it means that you're wrong. The simplest explanation for that is that you're not a very intelligent person, Shrike.

TARP was largely Bush's creation, and the Tea Party rose up against both him and Obama. The Tea Party then set their minds to eliminating practically every Republican who supported him--up to and including John Boehner, the Speaker of the House.
Mitch McConnell managed to survive the Tea Party by making a deal with Rand Paul. McConnell's friends in the state legislature back in Kentucky would make it so Rand Paul could run for president without resigning as Senator, and Rand Paul would do what he could to protect McConnell from the Tea Party in Kentucky.
The only other survivors of note were in such deeply Republican territory and had their feet so firmly planted in the establishment soil, they couldn't be pushed out. John McCain was one of those and Liz Cheney was another. They were mostly neocons, and they became the Never Trumpers.
All the other vestiges of the Bush era Republicans establishment were washed away by conservative forces at the level of the Republican grass roots. In short, George W. Bush was not a conservative in the mold of Barry Goldwater or Ronald Reagan. George W. Bush was a southern Democrat in the mold of another Texan--Lyndon Johnson. Bush expanded Medicare a la Johnson's expansion of social services during the Great Society, and Bush indulged in wars of liberation, just like Johnson did in Vietnam.
The South invaded the Republican party during the Reagan administration and started acting like they owned the place, but another way of saying the same thing is that the Democratic party completely abandoned the South. It doesn't mean that the South stopped being the way it was. George W. Bush would fit into the mold of Lyndon Johnson or Bill Clinton before Reagan became president. In terms of policy, George W. Bush was a southern Democrat in all but name.

Goldwater and Reagan wouldn't have liked the current iteration of the GOP, but in the big picture their careers show the decades-long conflict between the party's northeastern/Beltway, "go along to get along" wing of the party versus the populist wing. The defining characteristics of George Bush's presidency were the Iraq War, the expansion of Medicare, and TARP.
The defining characteristics of Johnson's presidency were his expansion of the Vietnam War and the Great Society.
Both Bush's and Johnson's justifications for their wars were about helping poor unfortunates abroad. Both Bush's and Johnson's justifications for their expansions of the welfare state were about helping poor unfortunates at home.
In those ways, their policies and the justifications for them were so similar to be almost the same--even if, in one case, Johnson was saving the poor unfortunates from communism and Bush, in the other case, was saving the poor unfortunates from radical Islam.
Goldwater's revolutionary contribution to Republicanism was the belief that the threat of communism was so great and such a global threat, that it was necessary for the Republicans to abandon their isolationism. However, he wasn't saying that the point was to save the unfortunates of the world from communism. He was saying that in order to serve the best interests of the United States, we should take our fight against communism global. Reagan's pragmatism was driven by that kind of rational self-interest--whether he was backing Pinochet or retreating from Lebanon.
That is different from what Johnson and Bush were doing.
