Science-Based Policy Means Decriminalizing Sex Work, Say Hundreds of Researchers

Social scientists ask Biden administration to embrace sex worker rights. In an open letter to President Joe Biden and Vice President Kamala Harris, a group of more than 250 researchers and scientists are calling for changes to the way that this country treats sex work and those engaged in it. Most prominently, the letter—which comes in conjunction with International Sex Worker Rights Day, March 3—says that sex work ought to be decriminalized.

"We decided to launch this campaign because, for too long, policies regarding sex work have been largely evidence-free, and we saw an urgent need to intervene in the debate by re-linking scientific research with public policy," said George Washington University sociology professor Ronald Weitzer in a statement. For years, Weitzer's work has tackled questions of police abuse and shone a light on the shoddy statistics and secret agendas underlying activist efforts to rebrand all sex work as human trafficking.

Weitzer is one of four organizers of the Scientists for Sex Worker Rights campaign, along with Angela Jones of Farmingdale State College and Barb Brents and Kate Hausbeck Korgan of the University of Nevada, Las Vegas. All four have doctorates in sociology and have published books and/or peer-reviewed articles on various facets of sex work and sex trafficking.

Drawing on empirical research from around the world, the letter makes the case that decriminalizing prostitution must be part of the broader criminal justice reform movement in the U.S.

"The data clearly shows that criminalizing consensual adult sexual services causes severe harms, which fall mainly on the most marginalized groups—women, people of color, transgender and non-binary workers, workers' with disabilities, and economically marginalized workers," said Jones. This criminalization "does not prevent or minimize violence or abuse ostensibly identified with human trafficking."

As we've been detailing for years here at Reason, this war on sex work not only harms people choosing to engage in prostitution but leaves little room for actually helping victims of violence and sexual exploitation.

In addition to calling on cities and states to decriminalize prostitution, Biden and Harris can demonstrate their alleged "commitment to science-driven policy" by supporting a Senate bill to study the effects of FOSTA—the 2018 law criminalizing online ads for sex work—with an eye toward FOSTA's repeal, the scientists say. Preliminary evidence suggests it has been disastrous for sex worker safety (in addition to having a chilling effect on all manner of sexuality-related content online).

Biden and Harris should also "commit to protecting the First Amendment and free speech" by opposing the bipartisan-supported Stop Internet Sexual Exploitation Act (SISEA) and Republican Sen. Lindsey Graham's EARN IT Act, states the letter.

"We have devoted our careers to the study of sex work, sexual commerce, trafficking, feminism, and law, and we are anxious to assist our nation in developing and advocating for policies that protect the rights, privacy, and autonomy of workers in the sex trade," the researchers conclude. "Doing so will promote public health and harm reduction while decreasing violence and the powerful social stigma that sex workers face every day in the United States and around the world. This is a social justice and human rights issue, and we urge you to act."

The American Civil Liberties Union (ACLU) is joining the fight against making nonprofit organizations disclose their donors. On Tuesday, the ACLU "filed an amicus brief with the NAACP Legal Defense and Education Fund, the Knight First Amendment Institute at Columbia University, the Human Rights Campaign, and PEN America urging the Supreme Court to protect the privacy rights of non-profit donors across progressive and conservative organizations," the group announced in a press release.

The case, Americans for Prosperity Foundation v. Becerra, challenges California's blanket requirement for nonprofits to disclose their IRS Form 990 Schedule B documents, which identify their top donors. The groups argue that the rule violates the First Amendment right to associational privacy. Nonprofits' Schedule B forms contain the names and addresses of major donors, highly sensitive information. Although California purports to keep this information confidential, California has repeatedly failed to keep the information confidential. Recently, for example, California inadvertently published more than 1,700 Schedule B forms on a public website over a period of many years.

      The NRA is sort of non-profit. 501(c)4 is there designation.

      501(c)4s are similar to 501(c)5s and 501(c)6s in that the organizations may inform the public on controversial subjects and attempt to influence legislation relevant to its program and, unlike 501(c)3 organizations, they may also participate in political campaigns and elections, as long as their primary activity is the promotion of social welfare and related to the organization's purpose.
      The income tax exemption for 501(c)4 organizations applies to most of their operations, but income spent on political activities—generally the advocacy of a particular candidate in an election—is taxable. An "action" organization generally qualifies as a 501(c)4 organization. An "action" organization is one whose activities substantially include, or are exclusively, direct or grassroots lobbying related to advocacy for or against legislation or proposing, supporting, or opposing legislation that is related to its purpose.

      They have related lobbying organizations that clearly state donations are not tax deductible.

      The Guardian often confuses me. Usually it's a soft pink rag writing reassuring tripe for the wealthy, urbane, middle-class progressives who comprise the elite. A British version of Vox or the WaPo.
      But occasionally it jumps away and will write something that conflicts with the narrative.

      I've come to realize that the average British, Canadian and Australian paper is still a little more independent of the Davos narrative on the whole, than American ones. It's almost impossible to click on an American paper from USA Today to the Boston Globe and see something that the DNC doesn't want you to read.

    A disturbing story out of St Louis about the courts colluding with lawyers and therapists to bleed parents dry. Judges assigned friendly GALs (court ordered guardians) who would bleed parents of tens of thousands for therapy and fees, ultimately siding with the parent who paid more. This includes cases of sitting the minors with sexual abusers and criminal parents. Included in witness statements is threats of zero custody for parents who refused to pay.       EVERY judge on the circuit recused themselves in the lawsuit. That's evidently pretty rare, which makes it sound ominous, like they are all in on it.

      But I suspect that it's because the primary judge implicated in this scandal is the the presiding judge for the circuit, rather than that they are all potentially corrupted by this.

    It's interesting to note the different players on different sides, here. When Facebook, for instance, complains about Apple and Google having monopolistic like control over the apps in their app stores, and using it to hurt their competition, what he seems to be really talking about is the fear that Apple and Google will tell Facebook in the future that they won't facilitate violating the individual privacy of the people who use their app stores anymore.

    In other words, when we're looking to the Justice Department or the Federal Trade Commission to break Google's ability to arbitrarily exclude competitors like Parler from their app store, we may also be carrying water for companies like Facebook, when Google is trying to stop them from ravaging our privacy.

    The legitimate purpose of libertarian government is to protect our rights, and there may be a legitimately libertarian role for antitrust in doing that. In fact, Google's actions to protect our privacy, here, are probably intended to preempt some of the remedies that will arise as the antitrust proceedings against them come to a head.

            I think we're talking about the uncanny valley. The more like us something is, the more we like it--right up until they become too much like us, and then we feel disgusted by it.

            A lot of people see the uneducated and poor mountain people of the Andes, Nepal, and Tibet as exotic, by which they mean strange but alluring. The uneducated and poor mountain people of Appalachia and the Ozarks, on the other hand, are often treated by the same people with contempt. Our fellow Americans are like us, and familiarity breeds contempt.

            I suspect it's the same kind of thing with suburban progressives. They see fundamentalist Muslims, the street gangs of Los Angeles, and Republican conservatives in that light. Fundamentalist Muslims are exotic, the street gangs of Los Angeles are less exotic but not familiar enough to induce contempt, and they're absolutely disgusted by Republican conservatives.

            Incidentally, I suspect this is also why a lot of people feel more compassionate about apex predators and contempt towards the humans who hunt them. I have a working hypothesis about what's the driving force behind the uncanny valley--which has a lot to do with evolutionary processes. Regardless, it certainly isn't about being rational. Their contempt is instinctive.

    ALL SCIENCE BASED POLICY IS BAD!

    Science is not policy! Policy is not science!

    Science is not scientists!

    Science is not a set of facts, science is a process to weed out what is not true. And it's a never ending process. We will never get the truth, but we can approach the truth.

    Now of course, science should inform policy. That goes without saying. But science itself cannot be policy. That just makes no sense.

    Data can help inform legislators about sex work, but data itself is not policy. The data cannot say if sex work should be legal or illegal or regulated or other. It's neutral.

    Meaning I don't need science to know that voluntary sex work should be legal. But science can inform the debate. The data can demonstrate that legal sex work is safe. But science itself does not provide explicit policies.

      The logic trap is in trying to engage the rhetoric of the politicians rather than the underlying preferences of their constituents.

      People choose to criminalize and marginalize prostitutes because they don't want their husbands using prostitutes.

      It's not about the welfare of the prostitutes.

          If Amazon decides to label conservative books “hate speech,” that’s effectively the end of conservative books. Publishers won’t bother publishing books that can’t be sold on Amazon. This is a hugely important issue. I don’t think it’s getting all the attention it deserves.
