Trump's Immigration Policy Was Brutal and Inhumane. Will Biden Fix It?

President Donald Trump likes to win. As his time in the Oval Office comes to an end today, there's at least one accolade he can confidently claim: He has instituted some of the most inhumane immigration policies of any modern president. From separating families at the border as part of a "zero-tolerance" policy, to weaponizing immigrants' legal status for political power, to frivolously pulling visas without explanation or justification, to zeroing in on Good Samaritans, to hiring a ruthless nativist as his primary policy architect, Trump leaves Washington with a record that should draw the ire of anyone who cares about basic freedoms.
But what about President-elect Joe Biden, whose former boss, President Barack Obama, earned the moniker "deporter in chief" for his record-setting focus on expelling immigrants?
He promises to be better. The incoming president has constructed the U.S. Citizenship Act of 2021, which would provide immigrants with a five-year path to a green card and a subsequent three-year path to citizenship if they meet a set of obligations, including passing a background check and paying taxes. In order to disincentivize a rush to the border, the bill requires that recipients have lived in the U.S. since January 1, 2021.
On border security, Biden says he will cease construction of enhanced border barriers and instead will hone in on technology to "to expedite screening and enhance the ability to identify narcotics and other contraband at every land, air, and sea port of entry," the administration notes in a press release.
Biden will also immediately move to reverse restrictions on the Deferred Action for Childhood Arrivals (DACA) program, the policy that provides work permits and deportation protection to immigrants who were brought to the U.S. as young children through no fault of their own. Trump initially sought to terminate the program, but after failing in the courts pivoted to curtailing it instead.
Yet although DACA has widespread bipartisan support, it was always on precarious footing since Obama implemented it via executive order. Biden's plan will reportedly provide the 640,000 immigrants who qualify with an opportunity to apply for a green card, although his administration's press release did not allude to that. He will further move to rescind Trump's travel ban on 13 countries via executive action.
A significant move that will get less attention: Biden will restrict who Immigration and Customs Enforcement (ICE) can arrest and deport, an effort initially put in place by Obama but overturned by Trump. Deportations for immigrants without criminal records will likely be deprioritized in favor of those who actually present a threat.
He has also intimated that he will work to end the Trump administration's "Remain in Mexico" policy, which kept a migrant from entering the United States while their asylum case wound its way through the courts. That will be a lengthier endeavor. The program was "a disaster from the start and has led to a humanitarian crisis in northern Mexico," said Jake Sullivan, Biden's national security adviser, "but putting the new policy into practice will take time."
In that vein, the newly minted president will seek to focus on addressing the root causes of why so many Central American migrants are flooding the U.S. border, though it's hard to see how the result of such efforts will yield more productive results than, say, regime change attempts abroad. Pouring American taxpayer dollars into those countries is a dubious solution, namely because it doesn't work.
"We made a mistake," Biden said during October's presidential debate, referencing Obama's immigration approach. "It took too long to get it right. I'll be president of the United States, not vice president of the United States." In a very short time, he will indeed be president, and time will tell if he gets it right.

This seems to assume that naturalization policy is the president's to fix. It isn't.
Setting the rules of naturalization is explicitly an enumerated power of Congress. The reason some powers are specifically enumerated to Congress is because we can't be a free society if we can have things like wars, taxes, spending, treaties, and, yes, naturalization policies inflicted on us over our objections and against our will.
Democracy has a proper purview, and Congress has proper roles within that. Setting naturalization policy is well within both the proper purview of democracy and Congress' proper role.
It should be noted that overstepping the proper role of Congress within the proper purview of democracy has real world consequences that go beyond the immediate policy--with Brexit, the rise of the National Front in France, and the election of Donald Trump all being excellent examples. All forms of populism, from left to right, are in reaction to elitists inflicting such policies on an unwilling society. To the extent that Biden "fixes" immigration policy, he will merely provoke another populist reaction--maybe even stronger this time than the one that brought Trump to power.
There is no long term substitute for persuasion.
Short term (over the next two years), expect the Democrats, with or without the crutch of Democracy, to inflict their will on us over our objections and against our will. To an explicitly authoritarian party, what's the point of having power if not to lord over the people?

Just so you know, I used to travel regularly across the Canadian border. I was a single father who would often have my kid in tow. Guess what got me pulled out of the vehicle line multiple times, while I cooled my heels for an hour? Something something child in tow that I had to prove was mine.
Even to leave the country on cruise ship or plane with kids in tow requires birth certificates and proof of parenting. For one parent to travel with a kid requires a notarized letter granting permission from the missing parent. Crossing borders with minors is not a small affair taken lightly.

It is not so much President Biden, but the people of this country who need to get our heads around a sane immigration policy. You can't let everyone in and you can't keep everyone out. So consider this;
Give the childhood arrivals a path to citizenship. We invested in these kids with education and training, accept that they are ours.
For the people that come here to work and leave, make it easy for them to do just that.
For those that want to come and stay, make a path available. It doesn't have to be easy, but it should be possible.
For those who don't want to come, but are fleeing troubles in their own country. Find ways to help, so they can stay put. Get rid of drug prohibitions in this country, that support drug cartels in other countries. Don't pour money into countries but find way to effectively help these people. I believe there is a way.
You're missing the other side of the equation. Democrats declared themselves unwilling to give up anything to get such a regime for the immigrants - no fines for lawbreakers, no increased security, no nothing.
That has always been the only way to get a deal done. But the political incentives to get a deal done have not been there for them. Slamming a one-sided deal through the legislature is not a recipe for lasting reform and the lowering of the temperature that Biden professes to be a priority; doing so will create exactly the backlash that led to Trump in the firs place.
This is not about sides, it is about making sense.

Immigration is not that big a concern to most people. At its highest it was about 23%.
"Sides" exist because that's how we communicate what "makes sense." Your not prioritizing security doesn't make it any less of a concern.
There's two interested parties here: the potential immigrants and existing Americans. A truly sensible policy needs to make sense for both.
We have plenty of security on the border. We need solutions. Look at it this way. If a city has a problem with people speeding in a residential area. They can up fines and patrols, but a better solution is speed bumps. Fines (especially for poor people) and patrols are unlikely to lower illegal crossings. We need other solutions. Best idea is to make them more comfortable in their own country.
Making them more comfortable in their own country has been one of the biggest failures in any policy attempted. Are we going to extend welfare to the citizens of these countries and if so how will it be paid for? Are we going to weed out the corruption in their governments that gladly take all the money we want to send and make themselves wealthy. What about the crime? How will we solve the crime and poverty in those countries when we can't even do it here? The latest hoard heading for our border to take advantage of what Biden and Democrats have promised them is numbering nearly 15 thousand and growing. The problem for everyone I know with illegal immigration is that property taxes fund those daycare centers we call public schools. The department of education (teachers unions), the department of agriculture (the farm Bill, lunches) love illegal immigration. Local taxpayers, not so much.
Illegal Immigration would get a lot further with home daycare centers, run by other migrants, and paid for the same way I used to barter (or pay) a family or friend to watch each other’s kids.
