Juror in Breonna Taylor Case Sues for Right To Reveal What Really Happened in Court

A member of the grand jury that did not indict Louisville police for Breonna Taylor's murder is now suing for the release of court transcripts and related records. The unidentified jury member's motion, filed Monday, says it was filed so that "the truth may prevail."

Specifically, the motion asks the court "to release any and all recordings of the grand jury pertaining to what is commonly known as the Breonna Taylor case," and "to make a binding declaration that Grand Juror, and any additional members of this grand jury, has the right to disclose information and details about the process of the grand jury proceedings … and any potential charges presented or not related to the events surrounding that matter."

The motion also takes aim at Kentucky Attorney General Daniel Cameron, accusing him of "using the grand jurors as a shield to deflect accountability and responsibility."

The motion "strongly suggests that Attorney General Cameron's public comments contradict what was presented to the grand jury," tweeted The Washington Post's Radley Balko. "It essentially accuses Cameron of hiding behind grand jury secrecy requirements while misleading the public about evidence the grand jury actually saw."

Last week, the jury returned charges against just one of the three officers involved in Taylor's killing. The charges—three counts of wanton endangerment for Louisville Metro Police Department (LMPD) Detective Brett Hankison—were not for Taylor's death but for potential danger Hankison could have caused to those in the vicinity.

Hankison "was arraigned Monday in Jefferson Circuit Court, pleading not guilty. He is free on $15,000 bond," notes the Louisville Courier Journal.

The judge at Hankison's arraignment also ordered that a "recording of the grand jury proceedings" must be filed with the court by this Wednesday.

Cameron, who had previously refused to release these records, said in a Monday night statement that he will comply with the order for them to be released. "The release of the recording will also address the legal complaint filed by an anonymous grand juror," he said. "We have no concerns with grand jurors sharing their thoughts on our presentation because we are confident in the case we presented."

        Seriously though, I thought the point of a secret Grand Jury proceeding was that it was, well, secret. Evidence that wouldn't and couldn't be shown in open court could be used to help the GJ panel make their decision. Revealing what was said goes directly against that idea.

        Besides, what vital piece of evidence is soooooo important that it would change people's minds about the existing indictment, or decisions not to indict?

      I know a good number of people here expect Biden to stroke out a la Ron Paul on the stage tonight. All I have to say is, don't get cocky. If you only read/listen to the clips circulated in the conservative blogs, you'd expect him to get lost on the podium. But when he is lucid, Biden is comparable to Trump with his rhetorical kill shots.

      Back in 2012, when Biden debated Ryan, the republican came out with a sincere, fact based argument about why we need to deal with social security. Biden just looked at the camera and essentially said, "That was a bunch of Bullshit, and they are trying to steal your retirement. I won't let them do it."

      When Biden says he is going to "Fact Check" Trump, it isn't that he is going to do complex math, or recite labor statistics. It is that he is going to shake his head, blink his blue eyes, look at the camera, and say with that feigned, sincere, protective daddy voice, "Trump is lying to you, and I will protect you." And he will rely on the Washington Post to explain why, the next day, that what Trump said was "True but Effectively False" or whatever.

          Biden'll be awake and likely lucid for the debate. Jiggering his sleep cycle that he wakes up at 7-8 PM now, will do that. I've no doubt that Biden is capable of stumbling through some memorized or cribbed talking points for 90 minutes.

          Trump's job is to rattle Biden enough that he can't stay with repeating only his canned answers. Make Biden go off script. Which would likely work as well as an amateur Everest climber walking off trail.

          Should be interesting.

          Seems fair. It often takes a day to decide what Trump said in incomplete sentences and word salad, and then there’s a good chance that in the next 24 hours, Trump will make another statement saying the opposite of whatever he said the night before.

          The biggest challenge will be dealing with the subject of Hunter, but the questioning may be scripted enough he can avoid the topic.

          The *entire* conservative movement has been all talk on fiscal sanity. The GOP base literally nominated Trump, a formerly blue state democrat who told Ryan to his face that he had no interest in dealing with SS, Medicare or the budget.

          This isn't a strike against Trump- he was very transparent with his views. And the fact is that primary voters elected him as the candidate.

          You cannot blame Ryan for that. He tried for years under a democratic president, and was hit hard for the shut downs. And then when the GOP had a chance to elect its candidate, it explicitly rejected the budget hawks and instead picked the populist who promised to increase the budget for the Military.

        They were clearly doing dry runs on this during the mid-terms. Remember Rubio calling out the Broward County election officials unloading ballots from POVs? I wouldn't be surprised if this is how Synema got her Senate seat in Arizona and Tester kept his in Montana as well.

        You'd think after, what, 20 years of them pulling the "we found all these ballots in a closet/trunk of a car/government official's office" going back to Christine Gregoire in Washington and Al Franken in Minnesota that the Republicans would grow some balls and challenge each single ballot when these "lost ballots" start turning up--as in, going door to door to verify that each person actually voted the way they did.

        It's not a surprise why the Democrats have an aneurysm and claim "voter disenfranchisement" at voter ID laws--they know damn well that voter ID makes it a lot harder to pull off this kind of fraud, where nursing home employees fill out ballots for the residents, for example.

            Yeah, I can't think of any reason that overpayment could be construed as a positive. If it's attempted benevolence or generosity, then I can't think of a more inefficient and wasteful means of charity.

            And I've always been of the opinion that it's nobody's damn business how much or little money someone makes. Though I suppose that a lot of people out there might prioritize that information to judge and collectivize others.

              The debt thing is a concern, I can see why people would be concerned about the President carrying a lot of personal debt. That is one of the things that affects the ability to get a security clearance, or it would if he weren't in an elected position.

        A partnership I am in buys a building for $100M. We are lucky and four years from now it's worth $125M. Using the current FMV of the property we are able to refinance and borrow an additional $10M. The partnership distributes half the loan proceeds to the investors and uses half the money to pay for improvements.

        The partners will show no income on their personal tax returns from this transaction, because distributions are not income. That is how real estate works.

That would need to be defined very very strictly and in great detail in the age where people claim silence is violence but burning down your home is speech.

    You want to claim Trump is fair game since he’s President, fine, whatever. But what people who worked for him made in the decades when he wasn’t a politician is fair how? Riddle me that and you better spin so hard the Earth rotates backwards.

    Also, I’m going to post this one more time for those in the back. Trump paid $1 million in taxes in 2016 and $4.2 million in taxes in 2017 and, per the NYT story, most of that money was rolled forward. Stop LYING. Start READING. Just. Stop. Lying.

      If so, why is Trump saying that they illegally obtained them? That’s a tacit acknowledgement that they have the real info.

    A Biden Campaign operative in Texas is attempting to rig the 2020 election with the help of others in a massive ballot harvesting scheme, according to two private investigators who testified under oath that they have “video evidence, documentation and witnesses” to prove it. With the help of mass mail-in ballots, the illegal ballot harvesting operation could harvest 700,000 ballots, one Harris County Democrat operative allegedly bragged.

    The investigators—a former FBI agent and former police officer—claim that Biden’s Texas Political Director Dallas Jones and his cohorts have been “hoarding mail-in and absentee ballots” and ordering operatives to them fill out for people in Harris County illegally, “including dead people, homeless people, and nursing home residents in the 2020 presidential election,” Patrick Howley of the National File reported.

      I've posted some comments about how real estate developers can avoid taxes (legally and appropriately), and with regards to this strategy - yes, this very common for self-employed people. The key is making the wages high enough to be considered fair market value for similar non-owner employees in the industry and size of the company. Often people cap it at the FICA wage limit, but that's a little riskier than paying something higher and living with the medicare taxes.

    Only makes sense if you ignore: Criminal Justice Reform bill passed, deregulation, the President reducing Obamacare's individual mandate to almost nothing, Republicans allowing the states to continue with Marijuana legalization, the President literally pardoning individuals during the RNC 2020, the President pushing for withdrawals from Syria and Afghanistan, etc.

    Trump may not be a libertarian, but arguing that some how the GOP is less Libertarian than it was when it was just Paul Ryan and Mitch McConnell running the show is insane and ignores reality completely.

        But even going by that definition....the GOP is still ironically better than its ever been. I can't think of anything since Amash has been in national politics ( since 2010) until now that would appeal to the "Far Left Cool kids" other than some of the things I listed above, "Criminal Justice Reform, troop withdrawal, etc."

        Justin Amash should've just followed Rand Paul and Thomas Massie's example, instead of this "NeverTrump" crap.

    Based on all the evidence that's come out, including jailhouse recordings of Breonna Taylor discussing her boyfriends drug business and various people on the street that owed him money, I'm guessing the Atty General is very, very confident in the case.

    Thomas Sowell criticized the "banned book" nonsense in 1994:

    "Usually some school or library officials decide to buy a particular book and then some parents or others object that it is either unsuitable for children or unsuitable in general, for any of a number of reasons. Then the cry of "censorship" goes up, even if the book is still being sold openly all over town.

    "If the criterion of censorship is that the objection comes from the general public, rather than from people who run schools and libraries, then that is saying that the parents and taxpayers have no right to a say about what is done with their own children or their own money."

    Really, at minimum grand jury material should be turned over to defendants, and also the grand jury should be able to disclose information about its own proceedings, eg, through a report or presentment.
