How Are Social Media Companies Supposed To Handle Government-Sponsored Misinformation?

The trouble with anointing Twitter and Facebook as gatekeepers of coronavirus truth. This is not a post about the Centers for Disease Control and Prevention (CDC) data on COVID-19 being wrong. It is a post about the possibility that the CDC could be wrong—as any government agency or respected private authority might be—about some aspects of the coronavirus, and about how we address government-sponsored misinformation on social media.
In the past few years, a lot of Americans have decided that it's the responsibility of popular tech platforms and apps to police the truth for their users. In a fog of notions about Russia and right-wing trolls, many left-leaning lawmakers, pundits, and politically active social media users demanded that Facebook, Twitter, and their ilk "fact-check" certain types of information, prioritize content from selected media and government sources, and downplay or entirely suppress content that counters experts' claims.
In the run-up to the 2020 election and especially since the start of the COVID-19 pandemic, these sorts of pushes have only intensified. Many people are sure that the way to correct the record and stave off mass hysteria is for tech platforms to play ultimate arbiters of truth, deciding not which version of things is correct but which version can even be discussed.
The impulse is understandable. The sharing of insane conspiracy theories and bad data on social platforms is cross-partisan, is often apolitical, and effectively knows no bounds. But censoring bad ideas and "fake news" has never made them less credible to their believers, and can make them even more popular. Besides, not all unpopular or wild ideas are untrue, and not all government data or recommendations are right.
We needn't even look back to previous crises to confirm this. At the start of the COVID-19 pandemic, government health authorities recommended against people wearing masks.
President Donald Trump has made a slew of questionable coronavirus claims throughout the pandemic, with many Democrats advocating for Twitter and other platforms to affix fact checks to the president's posts or delete them entirely. Meanwhile, these same factions have pushed for tech companies to prioritize data and recommendations from officials Trump appoints and agencies his administration oversees. It's bizarre.
This week, two respected public health experts—Harold Varmus, former director of the National Institutes of Health, and Rajiv Shah, president of the Rockefeller Foundation—wrote in The New York Times that CDC guidelines on testing asymptomatic people exposed to the coronavirus are wrong and should be ignored.
Earlier this week, CDC information on COVID-19 deaths was widely misinterpreted—including by Trump—to mean that the agency was overcounting coronavirus deaths by about 94 percent.
All of this highlights how precarious our grasp on good information is—and how it can only be bettered by allowing open debate, instead of deferring to experts and demanding that tech algorithms do too.

• "August 2020 saw more gun sales than any other August on record as Americans continue to rush to gun stores at a record pace," according to a Washington Free Beacon analysis of FBI data.
• In response to Australian government regulations, Facebook is "threatening to stop allowing Australians to share news articles on its platforms, including on Instagram."

Yeah, it's been obvious since probably late March that containment isn't going to happen. Except for providing data for an after the fact analysis of this pandemic, testing and contact tracing are useless.
Even places that thought they had it contained like Korea are having outbreaks now. Everyone is going to have theirs sooner or later. A place like New Zealand could conceivably keep it contained if they seal their borders forever. But that doesn't seem like a very viable option. This is all just tyranny for its own sake at this point.

The CDC made the announcement, but I’m not sure it is technically true the CDC, per se, is implementing the moratorium. The 1944 Public Health Service Acts gives the Federal government quarantine powers. It’s a bit of a stretch to use it to do an eviction moratorium.

Better to let the property go into receivership, turn it over to the bank, say "good luck getting those deadbeats to pay you anything," and walk away.

The CDC 6 per cent figure is being misinterpreted by both sides. What you can take away from it is that if one does not have a comorbidity then the possibility of dying is very low. Age, interestingly, is not a comorbidity. So, if you are not obese, diabetic, have COPD, heart issues, very high blood pressure, or cancer - the chemotherapy wipes out the immune response - then you are unlikely to die from Covid-19. If you are under 65 years of age and free from these issues, then your risk approaches zero.
In the face of this, a targeted shut-down would work as well at protecting from death, and not impact the economy nearly as much.

The Democrats in California just passed SB145 which allows a sex offender to AVOID registering as a sex offender as long as the sex offender is no more than 10 years older than the victim (minor).
If the rule was no more than 10 years older than the victim and the victim was over the age of say 13 at the time, I wouldn't have a problem with that law. As it is, offender registries are a complete vindictive waste of time. So, I really can't hammer California too much about this.

Different groups have gone different ways at different times.
My understanding is that Japanese immigrants to the U.S. used to be more rural and into farming than other Asian groups, and that they trended more Republican since FDR and internment. I don't know if that's still true. It wouldn't surprise me if Marcos and Duterte supporting Filipinos, who have immigrated to the U.S. from wealthier families in the Philippines, trend more Republican, too. It's sort of like Cuban emigrants to the U.S. in Florida, who for their own reasons don't feel the same way about the Republican party as Latinos from Mexico and Central America.
Asians tend to get caught up in the immigration issue. The things the right tends to say about immigration seem like they're directed at Asian-Americans, even when people on the right aren't thinking about Asian immigrants at all when they're talking about immigration.
Meritocracy is a big deal on the right--the idea that hard work and smarts should be rewarded--and there's a big opportunity here to make common cause with Asian-Americans on the issue of affirmative action. But the right needs to learn how to talk about these issues differently. They can't be defensive about the impact on African-Americans. They need to proactive on opportunities for Asian-Americans who have earned a seat at the table after being unjustly denied it by the left simply because of their race.

I suspect that has deep historical roots.
Historically, in eastern Europe, they had a word for what happens when the central government gets small or withdraws its supervision of local government. It was called a "pogrom", and it was that way for hundreds of years.
Cultural differences are about the ways people fill in the blanks. We know what's in our hearts, and it isn't antisemitism. They don't know what's in our hearts, but throughout history, when they've feared the worst and filled in the blanks accordingly, they've rarely been wrong and they've often been right.

Such regulations may provide that if upon examination any such individual is found to be infected, he may be detained for such time and in such manner as may be reasonably necessary. For purposes of this subsection, the term “State” includes, in addition to the several States, only the District of Columbia.
(2)For purposes of this subsection, the term “qualifying stage”, with respect to a communicable disease, means that such disease—
(A)is in a communicable stage; or
(B)is in a precommunicable stage, if the disease would be likely to cause a public health emergency if transmitted to other individuals.
(e)Preemption
Nothing in this section or section 266 of this title, or the regulations promulgated under such sections, may be construed as superseding any provision under State law (including regulations and including provisions established by political subdivisions of States), except to the extent that such a provision conflicts with an exercise of Federal authority under this section or section 266 of this title.

This is true. The CDC doesn't enforce anything. Local courts will have to enforce it by refusing to issue eviction orders. If I were a judge, I would ignore this and grant any otherwise valid order. If a judge does that, the person being evicted has no recourse beyond the courts. It is not like the CDC can send the cops to stop it.

Rent control and eviction moritoriums sound great in sound bites, but are not so great if you acknowledge owners as people who have to pay their bills, too. Aside from that, the details are legally messy.

From the articles I’ve read, it also sounds like there is language in the executive order about having to pay as much of one’s rent as one can. Paying as much as you can is a fuzzy standard. I wonder how that would be determined, who the burden of proof would be on, etc.
In your opinion, would a federal district judge entertain an injunction motion against a landlord in this situation? I mean normally landlord-tenant stuff, where it doesn't implicate things like the ADA or Civil Rights Act, is as state court an issue as can be, but is the intention here to create a federal cause of action?
Any judge worthy of judgeship, from traffic court to the Supreme, would understand that a random bureaucracy doesn't have the authority to insert itself in contracts between private individuals. Particularly contracts that were already in place before the bureaucrat got a bug up their ass about something.
