Congress Wants To Regulate Big Tech. They Still Don't Understand It.

Congress proves how shallow and absurd its anti-tech agenda is. Political preening, petty grievances, and a terrifying cluelessness ruled House lawmakers' Thursday questioning of the chief executives of Amazon, Apple, Facebook, and Google.

During the hearing, Democrats and Republicans on the House Judiciary Committee took turns offering a series of stern looks and fiery (if unsupported by anything more than anecdote) allegations about the illegal, un-American, cop-hating, Communist-supporting, Russian disinformation-spreading, election-throwing, child-abuse-enabling, small-business-quashing, app-suppressing, mob-like, conspiracy-minded, all-powerful behaviors of America's most valuable companies.

Lawmakers barely let the tech CEOs—Amazon's Jeff Bezos, Apple's Tim Cook, Google's Sundar Pichai, and Facebook's Mark Zuckerberg—get a few words out between their wild accusations. And they quickly glossed over any complicated issues, clearly preferring to spend their allotted questioning time getting good video clips of themselves.

As Reason's Eric Boehm and Robby Soave explained in posts yesterday, lawmakers spent the time "using the threat of antitrust action to try to force tech firms to take sides" in political battles and couldn't even keep straight which companies they were mad at for which things.

It was almost enough to make you feel for Zuckerberg, even (almost). Certainly, poor Cook didn't belong there. And—whatever legitimate (and diverse) issues there are with some of the ways their companies do business—none of them deserved the insults and inanity they were subjected to yesterday.

The telehearing stretched on for hours, over the course of which it became abundantly clear that Democrats and Republicans are often diametrically opposed in their grievances while acting like satisfying them is only a matter of tech leaders choosing to do the Right Thing. Neither side admitted that acting as it wished would run afoul of the supposedly simple and common-sense things their opponents wanted "Big Tech" to do.

The most dramatic of these tensions involves web content moderation. It's not that far off to say Democrats want these companies to suppress more content and Republicans want them to allow more content without question.

Democrats are worried about "hate speech" and disinformation; Republicans are worried about being labeled as hate speech or disinformation.

Even within the same side and sometimes the same individual, there were contradictory complaints about tech companies and implications about what they should do.

For instance, when it came to marketplaces like Apple's app and podcast stores, or Amazon more broadly, some committee members acted as if it was dangerously anti-competitive for these companies to reject many podcasts, apps, goods, etc., or to give preferential treatment to their own products and services. Yet Bezos and Cook were also excoriated by lawmakers for failing to completely weed out misleading, offensive, or counterfeit items.

Neither Republicans nor Democrats on the committee would acknowledge the huge tension between expecting tech platforms to be open marketplaces in order to foster competition, avoid discrimination, eschew bias, and satisfy (a perverted version of) antitrust law while simultaneously expecting them to actively thwart spammers, scammers, fakers, foreign influence, sex ads, bigotry, and all the other bad things.

And neither Democrats nor Republicans seemed at all keen on letting these private companies make business decisions as they see fit, with politicians from both parties describing their basic business activities (like trying to improve products, keeping up with current tech trends, etc.) as nefarious conspiracies.

"Undoubtedly, the motivation for many politicians on both sides of the aisle" with anti-tech stuff "is to score political points for standing up to big corporations. Such a David and Goliath narrative plays well on the campaign trail," notes Casey Given at the Washington Examiner.

In order for them to be the good guys, they need tech leaders to be bad guys.

But keep in mind that this wasn't just some lark—the committee launched this investigation "more than a year ago," with the alleged objectives of "document[ing] competition problems in the digital economy" and evaluating "whether the current antitrust framework is able to properly address them."

If yesterday was any indication, it is not.

None of the tech-company docs they dug through or other investigative measures seem to have yielded new or damning information about Apple, Amazon, Facebook, or Google. A handful of gripes from these companies' competitors or customers was almost all Congress offered by way of "evidence." And most of yesterday's questions weren't even about antitrust concerns but election integrity, Section 230, content moderation, stopping crime, protecting civil liberties, etc.

Lawmakers yesterday repeatedly demonstrated a lack of understanding about communications law as it exists and how tech products work.

Rep. Matt Gaetz (R–Fla.) asked if any of them opposed "American values" and demanded a pledge to continue working with police.

Rep. Kelly Armstrong (R–N.D.), bless his heart, was the only member who asked how tech companies are going to protect user data from the police. Armstrong also pointed out that privacy laws can actually help big, entrenched businesses and burden or stop smaller competitors.

Anyway, if you want some quick and potent evidence that this was all about partisan mudslinging, scapegoating, and trying to use search engines, social media, and tech marketplaces to their respective party's advantage, check out the House Judiciary Democrats and House Judiciary GOP Twitter feeds.

Stories from competitors are anecdotes not evidence. With all these documents and time, we'd expect a solid case against these businesses.

The bottom line, as Boehm wrote yesterday: "Wednesday's hearing of the House Judiciary Committee was more about theatrics than seriously considering the use of antitrust law. Perhaps that's because it's somewhat ridiculous to argue with a straight face that Google or Amazon are actually monopolies, or because it's quite obvious that consumers who dislike Apple's or Facebook's products are perfectly free to give their time, money, and business to competitors on or off the web."

One more thing: in all the culture war and political posturing, we often overlook the fact that media businesses—emphasis on the business part there—are pushing political investigations and government regulations out of animosity toward tech companies cutting into their ad revenue and audiences.         COVID deaths were declining steadily in the USA from mid-April to early July, even as many states reopened and many young people hit the beach for Memorial Day.

        Then the mass protest super-spreader event caused a predictable spike in cases, and now a spike in deaths. Masks aren't all that effective (Californians were wearing masks throughout and still had a case spike after the protests), but avoiding crowds and social distancing are still important.

          No, you simply use accurate descriptions of what was actually seen/what is actually known:
          - If a bunch of protestors did something, and there is no connection with BLM, you don't mention BLM.
          - If a bunch of protestors did something, and some of them had signs or t-shirts that said "Black Lives Matter", or were shouting, "Black Lives Matter", you describe exactly that: Some protestors in the crowd had signs that said "Black Lives Matter".
          - If someone did something at a protest event that was officially organized and promoted by Black Live Matter, you can say that.
          - If an actual Black Lives Matter official did or said something, you can talk about that.

          I'd suggest reading Robert A. Heinlein's "Stranger in a Strange Land", where one of the characters describes her training as a "Fair Witness", learning to report only what she really did witness.

              I get my news from the LA county, Ventura County and orange county medical officials. They have stated that anybody testing positive for covid antibodies is being counted as a covid death, even if a person dies of an od or car accident. The only reason I believe the numbers are inflated is because the people making the numbers tell me they are inflating them.

Sometimes they beat up on terrorists or immigrants. In the past, we've had cycles where they beat up on Masons, alcoholics, communists, and Four Loko.

    Right now, outrageously wealthy tech CEOs fit the bill. That's why they beat them up yesterday--because they're one of the few groups who are less popular than incumbent politicians, beating them up on camera makes incumbent politicians seem popular by way of comparison.

    Some of the testimony was especially awful. They'd ask a CEO a question, then scream over the answer that they were taking back their time. It was just intended as a spectacle.

    The news media was lucky the social media people were in the cross-hairs this time. Social media billionaires may be the only part of legitimate society less popular than the news media. If it weren't for social media, we might see the CEOs of AT&T, Disney, Fox, NBCUniversal, and ViacomCBS facing the Inquisitors.

          Cox passed legslation putting decisions about good faith moderations in Congress's hands. The current hearings are a direct result. If you don't like the hearings, repeal section 230 and let it be heard in (lower) courts. Hawley's ability to propose changes to section 230 is also a direct result of Cox's actions. If you don't like it, repeal section 230. The only other alternative(s) are to put the decisions in the hands of Executive, directly or indirectly. The latter two (3) options being more Consistent with the letter of the 1A.

          And I've been generous about 'non-grandstanding' but the fact that you can draw some sort of meaningful distinction between Cox and Hawley calls your evaluations about grandstanding into question:

          Having him [Cox] as a witness on Tuesday’s panel was a bit like having James Madison show up to testify about what he was thinking when he wrote the Bill of Rights.

                Depends. Paddock had an advantage in that he had ready access to an elevated position with a clear line of sight. Doing something similar in Portland or Seattle would be a lot harder, if not impossible, to pull off.

                Anyone motivated to cause real havoc at one of these things would have to do a Haymarket or Boston Marathon-type incident. Vest Boy was the one who made up the IED with a bunch of fireworks, and it wouldn't be that hard to bring something like that to a riot to really throw things into chaos. You can't buy dynamite at the hardware stores anymore like what Weatherman did, but you can get plenty of gunpowder, especially if you buy fireworks by the bucketload during the 4th of July or tubs for reloading at the gun stores.

    "The U.S.-Taliban deal signed Feb. 29 was touted as the best hope for peace in Afghanistan after decades of war. While the U.S. and NATO have already begun reducing their troop strength, the second phase of the deal — which calls for talks between the Taliban and the Kabul political leadership — has been delayed. Much of the delays have been as a result of Kabul’s reluctance to free several hundred of the Taliban prisoners identified for release as part of the agreement.

    Kabul had claimed those Taliban prisoners were hardened criminals, guilty of major crimes.

    But on Tuesday, Afghan President Ashraf Ghani said he was ready to free the remainder of the prisoners, without specifying why the change of heart or if an agreement had been reached with the Taliban to substitute some of them, a proposal the Taliban earlier rejected.

    Under the deal, Kabul is to release 5,000 Taliban and the insurgents had promised to free 1,000 government and military personnel. So far, Kabul has freed bout 4,000 and the Taliban nearly 800.

    “With this action, we look forward to the start of direct negotiations with the Taliban in a week’s time,” said Ghani in the Afghan capital Kabul.

    The Trump administration has withheld aid from the U.S. backed government of Afghanistan because they were dragging their feet on the exchange of prisoners. Now that the final prisoner exchange appears to be happening, the peace talks that he's saying will begin are to be focused on a permanent ceasefire between the Afghan government and the Taliban and a power sharing agreement.

    It should be noted that the Taliban has abided by the terms of the peace agreement that President Trump negotiated with them, and if President Trump is reelected, the United States is scheduled be out of Afghanistan by May of 2021 and almost certainly will leave. I haven't heard Biden say anything about Trump's peace plan, its progress or his support, but I doubt he would have the cajones to negotiate with terrorists for fear that they would make a fool of him like Putin made a fool of President Obama.

    Not... necessarily. There are dozens of technologies and services which which use analytics to determine if an email is SPAM, without any intervention from the user. Google, Microsoft (O365 cloud) utilize these technologies. In this day and age, many users get things thrown into the SPAM folder they never specifically flagged as such.

    This is not to say that Steube's complaints have any merit, but the tweeter above doesn't understand technology any more than congress does.

      And it should be pointed out or clarified that this is true at both the application or user level *and* the protocol or non-user level. Like if Google went to AT&T and said "We need a way to block all residential calls to anyone who uses our services." and AT&T said, "OK". It's not like your residential calls get directed to your voicemail box by Google's voicemail systems. The call just doesn't connect. A point where Google and/or AT&T has arguably infringed on specific contract if not the social one.

      Not to legally conflate email with phone services or say that I (necessarily disagree with all the specific protocol interventions) but to convey that Google and Microsoft influence email delivery at levels far beyond and below the overwhelming majority of users.

      He's really reaching because virtually everybody has a webmail account of some kind, and so nearly everybody (at least a large portion of everybody) has had the experience of losing an email only to find it in the spam folder.

Because the two state sites I've visited said Tennessee had 21 new deaths (out of 1020 total) and 110 new hospitalizations (out of 4482 total) yesterday and 1778 new cases (out of 100,822 total) which doesn't sound like any sort of alarming new uptick in the numbers to me. I suspect that you're seeing the goalpost shifting of "flattening the curve" to "nobody gets the coronavirus at all" that leads to reporting "alarming" numbers that aren't a damn bit alarming. Are hospitals overwhelmed? Bodies stacking up like cordwood? Exhausted doctors and nurses committing suicide? No? None of these things are happening? Then you're just engaging in the panic porn of jerking yourself off wishing and hoping excitedly that something bad were happening and you're just making shit up, it's not real.

    The standard for what constitutes "fringe beliefs" on the right has moved. It used to be that a belief that there was widespread massive vote fraud was considered a fringe conspiracy belief.       Putting aside the 'fraudulent' part, Trump has repeatedly warned about the 'chaos' of massive absentee voting and, to be fair, he has been at least anecdotally vindicated.

      I'd post more 'straight news' links but I'd go into moderation hell. However, even on the fraud part, there have been some alarming cases, the only question is "is it major enough to bitch about it". I won't say without further research.

      But there are progressive groups that are starting to whinge about the mass-absentee ballot situation, after mocking Trump's 'chaos' comments viciously.

      Georgia, Nevada, North Dakota, South Carolina and West Virginia held elections this week.

      Here’s how the primary in Georgia went: “It’s a hot, flaming, f—-ing mess,” Nse Ufot, executive director of voting rights organization New Georgia Project, told Politico.

      The election there resulted in an investigation by the secretary of state and criticism from prominent figures ranging from Hillary Clinton to LeBron James.

      But back to the 'fraud' side, it's not a 'fringe' belief to be concerned about it. It might be wrong-headed to say that the fraud that's been confirmed as occurring has any meaningful effect, but it's not 'kooky fringe'. The media made it out to be 'kooky fringe' because, in my opinion, they knew which way the fraud that does occur tended to lean, and didn't want to shine a light on it.

I still can't believe the DNC rigged their primary in favor of this guy just to keep Bernie from getting the nomination.
