Alcohol Prohibitionists Aren't Happy About COVID-19 Exceptions for Bars and Restaurants
Too bad. Deregulation could (and should) be here to stay.

Of all the deregulatory efforts undertaken during the pandemic, the loosening of state and local alcohol regulations has been perhaps the most noticeable, welcome, and widespread to date.
Take to-go cocktails. At least 30 states have moved to allow to-go alcohol sales by bars and restaurants temporarily during the pandemic. Many jurisdictions have also relaxed alcohol delivery rules.
Now, some of these moves are being made permanent. Late last month, for example, Iowa lawmakers, who'd already moved to allow bars and restaurants to sell take-out cocktails, decided to make those changes permanent. At least four other states are considering similar permanent legislation.
That's great news. As someone who's long called for relaxing burdensome alcohol regulations, I support deregulation before, during, and after the pandemic. And if deregulating alcohol was a really good idea before the pandemic, the government-ordered closure of bars and restaurants has made that really good idea essential during the pandemic.
After all, alcohol sales can easily be the most profitable part of a meal for many restaurants. And bars that don't serve food cease to exist without sufficient alcohol sales. Smaller (non-chain) bars and restaurants in particular are hemorrhaging cash. Expanding alcohol revenue has helped some restaurants and bars continue to employ and pay their employees. Even regulators acknowledge loosened alcohol rules have "provided a 'lifeline' to eateries during the lockdown."
Is there a downside to loosening booze rules? I don't think so. While data suggest Americans have increased our alcohol consumption during the pandemic, harms tied to alcohol have also decreased. For example, data show drunk driving arrests are "down dramatically" during the same period.
But not everyone thinks alcohol deregulation is a good thing. Indeed, while bar and restaurant owners and members of the public have welcomed looser alcohol rules during the pandemic—with many favoring they be made permanent—a handful of activists are taking the opposite approach.
Alcohol Justice is one such voice. The Marin County, California-based nonprofit, which pledges to "hold Big Alcohol accountable," has been busy combating temporary (nevermind permanent) rollbacks of alcohol regulations, lest the gilded streets of Marin County start to resemble something akin to the toilets at CBGB.
"Cities in Marin could soon end up looking like seedy, inebriated Bourbon Street in New Orleans, under the guise of reviving patronage for a few struggling licensees" who sell booze, Alcohol Justice's Michael Scippa argued in a Marin Independent Journal op-ed last week.
(Disclosure: I believe drinking alcohol in public in New Orleans is one of life's greatest joys.)
In an April letter to California state alcohol regulators, Scippa's boss, Alcohol Justice head Bruce Livingston, argued that while the group "do[es] not advocate policies that deliberately force licensees to close permanently….ABC should be actively preparing to permanently retire licenses in areas that are already overconcentrated" (emphasis in original).
Others have even used the pandemic as an excuse to ramp up alcohol regulations or even to ban alcohol. In an April column, for example, I detailed calls to ban alcohol sales during the pandemic—ostensibly, supporters argued, to prevent domestic violence during the pandemic—and criticized them as misguided.
Even before the pandemic, one Atlantic writer lamented the purported "dearth of anti-alcohol advocacy" in this country.
If America is lacking in anti-alcohol advocacy—and it's not—then that alleged shortfall is more than made up for by the sheer quantity of awful alcohol laws we have. From dry counties to happy hour bans to the repugnant, mandatory three-tier system, alcohol regulation in this country is infested with the vestiges of Prohibition. 100 years after Prohibition allegedly ended, its stench lingers still. Deregulation—which is happening now, finally, in a piecemeal fashion—is the only sensible approach to regulating alcohol.
But to say that many alcohol restrictions make little sense is not to say there aren't any restrictions on alcohol sales I support. For example, some jurisdictions have re-closed bars they had allowed to reopen, after COVID-19 cases spiked in those areas. Given experts suggest drinking in an indoor bar puts one at a high risk of catching the virus, reviving that limited, temporary restriction makes sense.
So too, though, does letting bars and restaurants sell cocktails and other alcohol beverages to go. Now. Tomorrow. And forever.

We cannot let the pandemic shutter businesses whose primary means of existence is telling other people what to do. The activists need a bailout from the reality of what they're peddling.
The entire thing is pure tyranny where the government arbitrarily decides what is "essential" and what isn't. So, why shouldn't the prohibitionists get a say in that tyranny? Lots of other people are.
Whatever you think of the prohibitionists, and I don't think much of them, they are sort of the bottom story here. The top story is that state and local governments have used the pandemic to create police states where the government arbitrarily controls every aspect of life.
Would you say that's the top story, or that people are not only blithely allowing it but cheering it on is the top story?
^1
There should have been rioting in the streets the day Newsom told people to stay inside.
Disaffected right-wing misanthropes -- especially those of the 'nobody can tell me what to do' and 'stop signs and taxes are tyranny' class -- are among my favorite inhabitants of society's impotent, misfit fringe.
We know, gecko. You're into the folks making progressive cities look like German cities after the 8th Air Force rolled over them.

Yep, only those who crawl on their knees are 'acceptable' to the asshole bigot. Keep crawling shitstain; the last stop is a bullet in the back of the head.
Fucking lefty ignoramuses like you are ignorant of that part of history, either as a result of government schools or just simple stupidity.
I'm guessing both here, but regardless, stuff it up your ass, bigot.
There is no "top story" here. Just an article that is presumably inspired by a handful of people who are opposed to the thing he wishes to write about. In a country with 328M people, one can always find this group, or you can at least presume they are there. One could also no doubt find a group of people who are hostile to birdhouses, but it's not a story worth telling and as is this, just a lame segue for an article that is almost as controversial as apple pie. While the author isn't incorrect in his opinions about the changes, his "opponents" here are little more than straw men and his article would have been far better had he simply avoided the "handful of activists" that he doesn't need.
Of course people need to get drunk. With the shuttering of all churches and synagogues that is the only way to get solace in 'these trying times.'
The revived popularity of classic cocktails seems to be accompanied by renewed call for simplistic approaches to alcohol regulation of the type that brought us Prohibition.
You should drink to drown your sorrows over your Roger Stone loss.
A loss? This makes it far more likely that the liberal-libertarian alliance will enlarge the Supreme Court -- 15 year of the Obama Court sounds about right -- and start shoving progress down right-wingers' whining throats in earnest.
Universal health care (including contraception and abortion), improved voting rights, better environmental and consumer protections, enhanced gun safety, diminished public funding of nonsense-teaching schools -- against that background, switching Roger Stone's path toward justice to a state prosecution isn't worth another thought.
You guys have been losing the culture war so long you no longer recognize what winning looks like.
Oh dear you're not taking your loss well.
I propose Obamacare for the name of the universal health care system the United States establishes next year. That way, disaffected clingers must honor former Pres. Obama by using that term for the rest of their deplorable lives, and better Americans get to watch the clingers acknowledge getting stomped in the culture war.
What do you think the system should be named, RHW?
(Not that your preferences matter to your betters.)
Not if Trump first orders you proggies to NOT throw yourself off a cliff. Biden could fund his entire campaign by selling bus tickets up the mountain to resisters, wearing your masks the entire way so as to not get covid before the big splat. Nobody left to vote for the addle-brained codger but at last Hunter would have enough money to put Sleepy Joe on a shelf and let him count the dust floating in the sunrays.
Nice.
“And start shoving progress down right wingers whining throats.......”
Haha. Oh, are you just starting rev? And here I thought that your “culture war” victory was nearly at hand!
Always the bridesmaid, never the bride, eh rev? Don’t change a thing! You’re doing great!
https://www.city-journal.org/seattle-interrupting-whiteness-training
At the beginning of the session, the trainers explain that white people have internalized a sense of racial superiority, which has made them unable to access their “humanity” and caused “harm and violence” to people of color. The trainers claim that “individualism,” “perfectionism,” “intellectualization,” and “objectivity” are all vestiges of this internalized racial oppression and must be abandoned in favor of social-justice principles. In conceptual terms, the city frames the discussion around the idea that black Americans are reducible to the essential quality of “blackness” and white Americans are reducible to the essential quality of “whiteness”—that is, the new metaphysics of good and evil.
It’s important to point out that this “interrupting whiteness” training is not an anomaly. In recent years, nearly every department of Seattle city government has been recruited into the ideological fight against “white supremacy.” As I have documented, the city’s homelessness agency hosted a conference on how to “decolonize [their] collective work”; the school system released a curriculum explaining that “math is a tool for oppression”; and the city-owned power company hired a team of bureaucrats to fight “structural racism” within their organization. Dozens of private companies now offer diversity training to public agencies. The idea that all whites have unconscious, “implicit bias” that they must vigilantly program themselves to overcome has become an article of faith across corporate boardrooms, academia, and law-enforcement agencies, even though the premise is unscientific and impossible to verify.
The endgame is to make Seattle’s municipal government the arbiter of the new orthodoxy, and then work outward. At the end of the session on “internalized racial superiority,” the diversity trainers outline strategies for converting outsiders and recommend specific “practices for interrupting others’ whiteness.” In effect, the activists have organized an ideological pyramid scheme—using public dollars to establish their authority within the government, then using that authority to recruit others into the program. As Lindsay writes, “the goal is no longer to indoctrinate on what is ‘rightthink’ and ‘wrongthink.’ It is to make the [subject’s] thinking be completely in line with the view of the world described by the cult doctrine.”
The left has gone barking mad. This is insane and evil stuff. I can't figure out how this ends. Are white people in this country so stupid and bullied they will bow to a cult that tells them they are genetically defective and undeserving of human dignity? Are minorities so nasty and hateful, they would support such a cult?
What is the backlash if there is one? Do we see the rise of a white identity movement and supremacy movement in response to this? Generally politics is very Newtonian in that one action produces an opposite and equal reaction, but not always. Do people at some point come to their senses and this bout of national madness fades as quickly as it has risen?
I am honestly not sure.
Do people at some point come to their senses and this bout of national madness fades as quickly as it has risen?
"What this country needs is common-sense madness control!"
There is one huge difference between this leftist "cultural revolution" and all others -- the amount of money at stake. Mao's cultural revolution merely shrank the economy. Lenin's 1917 revolution replaced one decrepit kleptocracy with another. The US progressive takeover of the late 1800s spent very little money. FDR's new deal was the first that I know of to spend more, it was largely financed by huge tax rises, and it failed in its primary aim of ending the government-caused depression.
Almost everything the left proposes now is tied in with the Green New Deal and costs a fortune, which can only be financed with the Modern Monetary Theory -- ie, money printers go brrrrrrh. Congress found it amazingly easy to spend $3T for this pandemic, not so easy for the second tranche of another $3T, and not even a full Democratic Congress and Presidency could triple the federal budget. Regardless of anything else, no matter how they try to hide it or what kind of fake monetary theory they gin up, the populace would not put up with that.
Culturally, almost everything they spout is nonsense. They might have dreams of putting white people out to pasture, but that's half the population -- they cannot do it. Imagine they passed a law requiring every board of directors to reflect racial parity, or all hiring to reflect racial parity -- it is simply impossible. The economy would flounder so fast that people would wake up, and remember their dreams of tripling the federal budget? *Poof* impossible with the economy cratering.
Their goals are literally beyond their reach. They have lived in their own isolation bubble so long that they no longer understand reality. They'd have to leave the details to Pelosi, who for all her other problems, probably does at least understand that disrupting the economy by destroying business is a lose-lose proposition.
The problem is that they are so removed from reality, they would destroy the economy if they could. Not because they want to destroy wealth but because they are so stupid and crazy at this point they have convinced themselves that the things you describe wouldn't destroy the economy and would blame it on something else when it did.
To me the wildcard is the rank and file of the black and Hispanic communities. I know a good number of both. And most of them are pretty liberal on the political scale. But none of them that I know anyway believe in this crazy shit. This is the stuff of black activists and really stupid white people. The average black guy or Hispanic in this country may not even like white people but even if they do not, they don't believe in this crazy shit.
One of the stranger things about this whole thing is that it is occurring in a country where for most people race means less than it ever has. There is more interracial marriage in this country than at any time in history. Even thirty or forty years ago an interracial couple aroused at least strange looks in most of the country. Today, such a sight illicit no response practically everywhere. The amount of actual white to black racism in this country is at an all time low. And in the midst of this reality, we have this large group of people who have decided the entire country is so racist that it might as well be Apartheid South Africa.
Maybe I am being naive, but I can't help but believe that at some point that reality is going to cause people to stand up and say enough of this bullshit. It is so destructive and evil. If it doesn't stop, white people are going to start taking it seriously and acting accordingly. And when that happens, we will see the return of white identity politics and the rise of real white supremacy as hasn't been seen in a hundred years. If you didn't know better, you would think that is what these people want. If they did, I can't see a more effective way to bring it about.
My point is that their plans are so expensive that they cannot be implemented; and so disruptive that the midterm elections would throw them out of Congress and leave a lame duck President who couldn't even nominate judges.
Yes. And in 2024, they would end up with a President that made Trump seem reasonable and moderate by comparison.
"Modern Monetary Theory — ie, money printers go brrrrrrh"
Eventually that ends poorly, but people have been fretting about budget deficits since Reagan with no signs of end times yet. That's 30+ years of "it hasn't happened yet Chicken Little / wolf caller".
It's no wonder AOC spouts MMT b.s. - the money machine has worked fine her entire life. Who besides the Fed wants to buy govt debt at close to 0%? When the money machine finally goes ka-chunk, who pays the price?
the midterm elections would throw them out of Congress
Presuming, of course, that we have real, fair elections in 2022.
Presuming the US still exists in 2022.
The amount of actual white to black racism in this country is at an all time low.
As someone once wrote, poverty goes largely unnoticed until it has almost disappeared, and then it becomes a focus of concern.
Same here. Racism has diminished so much, we see dumbing down of the term and lots of innocuous acts being labeled racist. This may be the last hurrah for the race hustlers. Their cries of ‘wolf’ will go unheeded except by the tiniest of groups.
Your theory sounds reasonable, but standing up and saying this is BS has real negative consequences. I know business people that are now being told they have to hire x number of minorities, regardless of qualifications, and they won’t put up a stink because of the known repercussions. I don’t think this ends by people pushing back, by itself. It ends when the implications of the nonsense become obvious. And that’ll be after a big cost to the economy, and more importantly, societal harmony.
all hiring to reflect racial parity
NBA NFL hardest hit.
"I can’t figure out how this ends."
As always, you will comply obsequiously with the preferences of better Americans -- and you will still get to whimper, rant, whine, and cry about it.
Are you really this stupid, or are you just programmed that way?
He is a satire. No one is that ignorant
Let's hear the fairy tale in which the bitter clingers -- Republicans, conservatives, half-educated bigots, backwater rubes, superstitious slack-jaws -- turn the tide of the culture war and stop getting progress rammed down their throats by educated, tolerant, reasoning Americans.
He is a satire. Just not a very funny one. Again, no one is this stupid
Sounds like you been clinging for a long time, old man. The bitterness of unrealized dreams will haunt you for your angry remaining days. Haha.
The trainers claim that “individualism,” “perfectionism,” “intellectualization,” and “objectivity” are all vestiges of this internalized racial oppression and must be abandoned in favor of social-justice principles.
WE MUST ALL BE THE SAME TO CELEBRATE OUR DIFFERENCES!
Alcohol Justice
Nice band name, albeit a bit conducive to squirting milk out the nose.
If nothing else good comes from this pandemic, at least we will have loosened outdated and unneeded alcohol restrictions. Who doesn't like a good Wegbier?
Else good? What is the original good you are referring to?
Working from home?
Now it's alcohol justice. Nice Orwellian twist on the word justice once again. I think we need a Simpsons wacking day except the snakes are far left assholes wearing masks.
You figure the clingers are going to stop getting stomped in the culture war, Kumquat?
Your parents and backwater religious schooling have failed you.
Oh man losing on Roger Stone has really upset you
What loss? I expect Stone to be imprisoned in a couple of years.
You slack-jaws didn't genuinely believe you were going to outsmart your betters, did you?
Haha. Everything you expect is always a couple of years off, eh rev? Keep the faith!
Not sure what's on- or off-topic these days:

Forcing alcoholics to go cold turkey - what could possibly go wrong with that? It's for their own good
Good article, wow, it's almost libertarian except
But to say that many alcohol restrictions make little sense is not to say there aren't any restrictions on alcohol sales I support. For example, some jurisdictions have re-closed bars they had allowed to reopen, after COVID-19 cases spiked in those areas. Given experts suggest drinking in an indoor bar puts one at a high risk of catching the virus, reviving that limited, temporary restriction makes sense.
And you were doing SO WELL Linnekin. Here's a pro tip: people who don't want to get sick should stay home, wear a body condom, whatever. Closing the bars will not save anybody. What is UP with reason writers, I mean come on.
As an addendum in case it wasn't perfectly clear:
Closing the bars will not save anybody
Even if the closures did save lives (dubious), it is anti-freedom to demand bars close because some people want to assume the risk of going to a bar during a pandemic. Allow the owners, employees and customers to assess their own risk and make their own decisions. THAT is liberty.
Pandemic management tips from half-educated, bigoted, anti-social right-wing slack-jaws are always a treat.
Cry all you want, StockofCoins, if it makes you feel better -- but you will comply with the preferences of your betters, just as you have throughout your deplorable life.
You are and will always be a stupid asshole Kuckland.
So long as you comply with my preferences, StackOfCoins, you get to mutter bitterly (and inconsequentially) all you like.
After a half-century of this, you should be beginning to understand it.
Toe that line, clinger.
"Pandemic management tips"
Better than the seamstresses you used.
I hear that putting a plastic bag tightly over one's head will absolutely prevent one from catching COVID.
Because Prohibition worked so well.
Fucking retards still aren’t taking this pandemic seriously. They’ve learned nothing.
Should the next pandemic threaten to kill everyone, dipshits will do to little too late.
No? Consider it practice. Smarten the fuck up.
Maybe your Paul McCartney denying author has some insights on this.
You can't really do too little when it comes to a pandemic like this. As much as I loathe the guy, Woodrow Wilson had the right approach for "Spanish" Flu in 1918.
There should not have been any government-forced closures of, or restrictions upon, any businesses anywhere in the US. There should not have been any restrictions of individual behavior either... no stay-home orders, bans on certain kinds of peaceable assembly, and no mask orders. Not by cities or towns, counties, or states, and certainly not at the federal level as dementia Joe said he wanted to do.
The governments did far too much, too early (if they delayed it until the 31st of February in the first year it appears, that would be fine). Sometime nature (or the ChiComs) throw you a curveball, and you can either lose your mind and do the equivalent of using nuclear weapons to cure a rat infestation of a city, or you can recognize that we are not always in control of everything, and sometimes nature has to take its course, even when we do not like the outcome.
These lockdowns have created a lot of deaths of their own that would not otherwise have taken place, and they haven't actually saved any lives. Until we have herd immunity, there are only two kinds of people: Those who have had COVID and those who will have COVID.
You can delay a person's appointment with COVID an indeterminate amount, but you cannot prevent it, short of having the person live in a positive pressure "clean" isolation ward, only leaving it while wearing a full biohazard suit, with full decontamination protocols on doffing. (That's the reason isolation wards and biohazard suits exist, because standing 6 feet from someone and wearing your T-shirt over your nose are not enough.)
Throughout this whole thing, I've been pondering on how we could make sure this whole nightmare never happens again. I don't mean the pandemic itself, though... I mean the real problem, the batshit response from politicians of all kinds. I'd be on board for stripping the emergency powers from governments at all levels. They've quite unequivocally shown that they cannot handle them responsibly, and having that much governmental power at ones' disposal isn't tenable.
Unless there is some way to demonstrate and quantify the number of deaths and destruction caused by the lockdowns their damage will be ignored.
The media have done an excellent job brainwashing the public into believing that the lockdowns were appropriate, necessary, and effective.
Ohio had an early state-wide lockdown but has now instituted a tiered system where the extent of infection as measured by several factors determines the extent of controls in place. Only 7 of the 88 counties have mask requirements in public. Not perfect, but much improved.
Seriously retarded . Do nothing eh?
The hospital ICU’s would be overwhelmed in a month. The cases rising exponentially.
The hospital staff exhausted would start making mistakes getting sick and dying as well.
Funeral homes would be overwhelmed and we’d need to consider alternatives. Freezer trucks, piles of burning dead.
There would be panic. All emergency services overwhelmed, looting, robbery, closed stores.
And you retard would say “Oh, this is civilized”.

"After all, alcohol sales can easily be the most profitable part of a meal for many restaurants."
Only because all beverages, especially with alcohol, are a rip-off in restaurants.
When I go out to eat, I am happy to pay someone to cook something. And for anything nicer than fast-casual, I will pay more for food that is fancier and better-prepared than I can make at home. I will even pay something for the atmosphere and experience.
But why should I pay double the price of a bottle of wine for somebody to uncork it? I can do that as well if not better than most servers. (And if I buy wine on sale or in cases, my home price will be less than 50% of the restaurant robbery.) The same goes for beer, and even for some mixed drinks.
So count me skeptical of the boon for getting alcohol to go. In most of the US, we already have that--at much lower prices.
For inexpensive wines, I've seen one glass priced at the retail store price for a whole bottle. As I recall, you can get five glasses out of a 750m bottle. All it means is that I don't generally buy a glass to go with the meal.
Alcohol Justice is one such voice.
I can still remember when her pictures leaked online. Wait - that was Victoria.
> "Cities in Marin could soon end up looking like seedy, inebriated Bourbon Street in New Orleans ... "
Yes, all of Europe, and Japan, and pretty much every fucking where else on earth where the government doesn't infantilize adults with open container laws, are EXACTLY LIKE SEEDY, INEBRIATED BOURBON STREET.
Won't SOMEONE think of the CHILDREN????
You don’t even have to leave the States. I’ve never been there for St. Patties Day, so maybe it’s different then, but Savanna allows open containers and both times I’ve been there everything was pretty civilized.
Rumor has it that Bourbon Street as mentioned is in New Orleans, Louisiana, USA too.
Well that went right over your head.
I’ll explain it for you, even though you’re trying to be a smart ass. CZ quoted someone expressing concern that allowing open containers would turn other places into Bourbon Street, which is known for such things as urinating and throwing up in the street. CZ pointed out that in Europe and Japan, where open container isn’t illegal, people aren’t urinating and throwing up on the street. I added to that by pointing out that, here in the US we already have a city that allows open container, and AFAIK there’s not a lot of urinating and throwing up on the street.
CZ pointed out that in Europe and Japan, where open container isn’t illegal, people aren’t urinating and throwing up on the street.
You've obviously never been to Europe.
I’ve never been there for St. Patties Day,
It's St. Paddy's day, you mouth-breather.
Also, Mardi Gras has nothing to do with St. Paddy's day. Fail

Oh, for Christ's sake.
Open up all the businesses.
Start treating people like their adults for a change.
Let the people decide for themselves if they should wear a mask or go to an establishment of business.
Oh, wait.
That would mean the masses would have the freedom to think for themselves instead of having our obvious betters in power do our thinking for us.
That would only allow the light of freedom and personal responsibility to shine through our glorious socialist slave state.
We can't have that.
Scratch all that.
My mistake.
