Alcohol Prohibitionists Aren't Happy About COVID-19 Exceptions for Bars and Restaurants

Too bad. Deregulation could (and should) be here to stay.

Of all the deregulatory efforts undertaken during the pandemic, the loosening of state and local alcohol regulations has been perhaps the most noticeable, welcome, and widespread to date.

Take to-go cocktails. At least 30 states have moved to allow to-go alcohol sales by bars and restaurants temporarily during the pandemic. Many jurisdictions have also relaxed alcohol delivery rules.

Now, some of these moves are being made permanent. Late last month, for example, Iowa lawmakers, who'd already moved to allow bars and restaurants to sell take-out cocktails, decided to make those changes permanent. At least four other states are considering similar permanent legislation.

That's great news. As someone who's long called for relaxing burdensome alcohol regulations, I support deregulation before, during, and after the pandemic. And if deregulating alcohol was a really good idea before the pandemic, the government-ordered closure of bars and restaurants has made that really good idea essential during the pandemic.

After all, alcohol sales can easily be the most profitable part of a meal for many restaurants. And bars that don't serve food cease to exist without sufficient alcohol sales. Smaller (non-chain) bars and restaurants in particular are hemorrhaging cash. Expanding alcohol revenue has helped some restaurants and bars continue to employ and pay their employees. Even regulators acknowledge loosened alcohol rules have "provided a 'lifeline' to eateries during the lockdown."

Is there a downside to loosening booze rules? I don't think so. While data suggest Americans have increased our alcohol consumption during the pandemic, harms tied to alcohol have also decreased. For example, data show drunk driving arrests are "down dramatically" during the same period.

But not everyone thinks alcohol deregulation is a good thing. Indeed, while bar and restaurant owners and members of the public have welcomed looser alcohol rules during the pandemic—with many favoring they be made permanent—a handful of activists are taking the opposite approach. 

Alcohol Justice is one such voice. The Marin County, California-based nonprofit, which pledges to "hold Big Alcohol accountable," has been busy combating temporary (nevermind permanent) rollbacks of alcohol regulations, lest the gilded streets of Marin County start to resemble something akin to the toilets at CBGB.

"Cities in Marin could soon end up looking like seedy, inebriated Bourbon Street in New Orleans, under the guise of reviving patronage for a few struggling licensees" who sell booze, Alcohol Justice's Michael Scippa argued in a Marin Independent Journal op-ed last week.

(Disclosure: I believe drinking alcohol in public in New Orleans is one of life's greatest joys.)

In an April letter to California state alcohol regulators, Scippa's boss, Alcohol Justice head Bruce Livingston, argued that while the group "do[es] not advocate policies that deliberately force licensees to close permanently….ABC should be actively preparing to permanently retire licenses in areas that are already overconcentrated" (emphasis in original).

Others have even used the pandemic as an excuse to ramp up alcohol regulations or even to ban alcohol. In an April column, for example, I detailed calls to ban alcohol sales during the pandemic—ostensibly, supporters argued, to prevent domestic violence during the pandemic—and criticized them as misguided.

Even before the pandemic, one Atlantic writer lamented the purported "dearth of anti-alcohol advocacy" in this country. 

If America is lacking in anti-alcohol advocacy—and it's not—then that alleged shortfall is more than made up for by the sheer quantity of awful alcohol laws we have. From dry counties to happy hour bans to the repugnant, mandatory three-tier system, alcohol regulation in this country is infested with the vestiges of Prohibition. 100 years after Prohibition allegedly ended, its stench lingers still. Deregulation—which is happening now, finally, in a piecemeal fashion—is the only sensible approach to regulating alcohol.

But to say that many alcohol restrictions make little sense is not to say there aren't any restrictions on alcohol sales I support. For example, some jurisdictions have re-closed bars they had allowed to reopen, after COVID-19 cases spiked in those areas. Given experts suggest drinking in an indoor bar puts one at a high risk of catching the virus, reviving that limited, temporary restriction makes sense.

So too, though, does letting bars and restaurants sell cocktails and other alcohol beverages to go. Now. Tomorrow. And forever.

In conceptual terms, the city frames the discussion around the idea that black Americans are reducible to the essential quality of “blackness” and white Americans are reducible to the essential quality of “whiteness”—that is, the new metaphysics of good and evil.

As Lindsay writes, “the goal is no longer to indoctrinate on what is ‘rightthink’ and ‘wrongthink.’ It is to make the [subject’s] thinking be completely in line with the view of the world described by the cult doctrine.”

The left has gone barking mad. This is insane and evil stuff. I can't figure out how this ends. Are white people in this country so stupid and bullied they will bow to a cult that tells them they are genetically defective and undeserving of human dignity? There is one huge difference between this leftist "cultural revolution" and all others -- the amount of money at stake. Mao's cultural revolution merely shrank the economy. Lenin's 1917 revolution replaced one decrepit kleptocracy with another. The US progressive takeover of the late 1800s spent very little money. FDR's new deal was the first that I know of to spend more, it was largely financed by huge tax rises, and it failed in its primary aim of ending the government-caused depression.

Almost everything the left proposes now is tied in with the Green New Deal and costs a fortune, which can only be financed with the Modern Monetary Theory -- ie, money printers go brrrrrrh. Congress found it amazingly easy to spend $3T for this pandemic, not so easy for the second tranche of another $3T, and not even a full Democratic Congress and Presidency could triple the federal budget. Regardless of anything else, no matter how they try to hide it or what kind of fake monetary theory they gin up, the populace would not put up with that.

Culturally, almost everything they spout is nonsense. They might have dreams of putting white people out to pasture, but that's half the population -- they cannot do it. Imagine they passed a law requiring every board of directors to reflect racial parity, or all hiring to reflect racial parity -- it is simply impossible. The economy would flounder so fast that people would wake up, and remember their dreams of tripling the federal budget? *Poof* impossible with the economy cratering.

Their goals are literally beyond their reach. They have lived in their own isolation bubble so long that they no longer understand reality. They'd have to leave the details to Pelosi, who for all her other problems, probably does at least understand that disrupting the economy by destroying business is a lose-lose proposition.

One of the stranger things about this whole thing is that it is occurring in a country where for most people race means less than it ever has. And in the midst of this reality, we have this large group of people who have decided the entire country is so racist that it might as well be Apartheid South Africa.

Maybe I am being naive, but I can't help but believe that at some point that reality is going to cause people to stand up and say enough of this bullshit. It is so destructive and evil. If it doesn't stop, white people are going to start taking it seriously and acting accordingly. And when that happens, we will see the return of white identity politics and the rise of real white supremacy as hasn't been seen in a hundred years. You can't really do too little when it comes to a pandemic like this. As much as I loathe the guy, Woodrow Wilson had the right approach for "Spanish" Flu in 1918.

There should not have been any government-forced closures of, or restrictions upon, any businesses anywhere in the US. There should not have been any restrictions of individual behavior either... no stay-home orders, bans on certain kinds of peaceable assembly, and no mask orders. Not by cities or towns, counties, or states, and certainly not at the federal level as dementia Joe said he wanted to do.

The governments did far too much, too early (if they delayed it until the 31st of February in the first year it appears, that would be fine). Sometime nature (or the ChiComs) throw you a curveball, and you can either lose your mind and do the equivalent of using nuclear weapons to cure a rat infestation of a city, or you can recognize that we are not always in control of everything, and sometimes nature has to take its course, even when we do not like the outcome.

These lockdowns have created a lot of deaths of their own that would not otherwise have taken place, and they haven't actually saved any lives. Until we have herd immunity, there are only two kinds of people: Those who have had COVID and those who will have COVID.

You can delay a person's appointment with COVID an indeterminate amount, but you cannot prevent it, short of having the person live in a positive pressure "clean" isolation ward, only leaving it while wearing a full biohazard suit, with full decontamination protocols on doffing. (That's the reason isolation wards and biohazard suits exist, because standing 6 feet from someone and wearing your T-shirt over your nose are not enough.)

Throughout this whole thing, I've been pondering on how we could make sure this whole nightmare never happens again. I don't mean the pandemic itself, though... I mean the real problem, the batshit response from politicians of all kinds. I'd be on board for stripping the emergency powers from governments at all levels. They've quite unequivocally shown that they cannot handle them responsibly, and having that much governmental power at ones' disposal isn't tenable.

When I go out to eat, I am happy to pay someone to cook something. And for anything nicer than fast-casual, I will pay more for food that is fancier and better-prepared than I can make at home. I will even pay something for the atmosphere and experience.

But why should I pay double the price of a bottle of wine for somebody to uncork it? I can do that as well if not better than most servers. (And if I buy wine on sale or in cases, my home price will be less than 50% of the restaurant robbery.) The same goes for beer, and even for some mixed drinks.

So count me skeptical of the boon for getting alcohol to go. In most of the US, we already have that--at much lower prices.

I’ll explain it for you, even though you’re trying to be a smart ass. CZ quoted someone expressing concern that allowing open containers would turn other places into Bourbon Street, which is known for such things as urinating and throwing up in the street. CZ pointed out that in Europe and Japan, where open container isn’t illegal, people aren’t urinating and throwing up on the street. I added to that by pointing out that, here in the US we already have a city that allows open container, and AFAIK there’s not a lot of urinating and throwing up on the street.
