Thanks to New York City Health Officials, New Yorkers Can No Longer Get CBD in Their Coffee
After cracking down on sugar, salt, and trans fats, the agency's turn against CBD is hardly unexpected.

Last week New York City's health department, long the bane of food freedom supporters, banned city restaurants from adding cannabidiol—a compound found in both cannabis and hemp that's commonly known as "CBD"—as an ingredient in food or drinks they sell.
CBD products, purported to offer health benefits to consumers, also offer quite a premium for sellers. A coffee at Bushwick's Caffeine Underground costs $2.50. A CBD-infused coffee—presumably the same coffee with a couple drops of CBD added—will set you back $6.00.
New York City Council Speaker Corey Johnson (who is also a potential mayoral candidate) blasted the health department's move this week, saying it "doesn't make any sense."
I agree with Johnson. But considering the health department's long track record of targeting food ingredients—including sugar, salt, and trans fats—the agency's latest turn against CBD is hardly unexpected. Neither is it unique. It follows a similar crackdown last month by Maine's state health department. Other locales, including Detroit, have since jumped on the bandwagon.
But is there any merit to the move? The risks of ingesting CBD, if any, are somewhere between unclear and unconfirmed. Its benefits are better known. As New York City's health department noted last year, CBD "has medical benefits but is not psychoactive." (While that last claim is not entirely true, it is that true that CBD does not have the same "high" as THC, the most prominent active ingredient in marijuana.)
But in announcing the ban last week, the agency took a much less sanguine view.
"Until cannabidiol (CBD) is deemed safe as a food additive, the Department is ordering restaurants not to offer products containing CBD," the DOHMH said in a statement reported by the New York Post. The paper reports the health department will begin fining restaurants up to $650 for unapproved CBD food sales, starting in July.
But New York City health inspectors aren't waiting until the summer to launch their crackdown. Last week, health inspectors visited Fat Cat Kitchen and ordered them to stop selling cookies and other foods containing CBD. Eater reports the health department sealed hundreds of dollars worth of pastries in bags affixed with a label declaring it "unlawful to move or disturb" the baked goods.
While city health inspectors are busy quarantining cookies, CBD continues to make its way into all sorts of legal foods and drinks around the country. In only a matter of months, the Seattle Times notes, CBD has gone from niche substance to popular remedy: "from being a fidget spinner alternative for stoners to a mainstream panacea." The same media that treated CBDs as a newfangled curiosity as recently as 2016 now wonder whether there's just too much CBD in our lives.
A key element of media and government skepticism of CBDs stems from claims about their seemingly miraculous curative powers. Health websites regularly tout CBD as a marvel substance that can aid everything from digestion to pain relief and cancer prevention. Critics argue that CBD proponents claim falsely the cannabis derivative "cures everything."
Indeed, CBD proponents have become something like the new Paleo or vegan diet evangelists. Like many of the most vocal adherents of those diets, CBD fanatics have been mocked for claiming that CBD products can cure any and every malady—up to and including rigor mortis.
CBD's "explosive popularity as a hot new luxury self-care product rests on shaky ground," Mike Riggs cautioned this month. "And it's not clear how many consumers (or sellers) have a clue what they're doing."
Despite the moves by New York City, Maine, and Detroit, the popularity of legal CBD-infused foods is only gaining elsewhere, including Kansas City and Philadelphia. The owners of Root Café, a restaurant located just outside of Philadelphia that offers CBD-infused honey to diners, have organized a five-course tasting menu for a CBD-themed dinner later this month. The event menu includes elk meatballs with tortellini in a CBD green chili broth.
I'm neither a CBD proponent nor a detractor. I've used a 1:1 CBD/THC topical ointment for occasional minor aches and pains for the past couple years. I found it doesn't work as well for me as does a more commonly available cream (e.g., Icy Hot). My local grocer in Seattle, New Seasons, offers CBD oil add-ons at their coffee bar. I've partaken and been pleased with the drink, though I can't say for sure if my subsequent elevated mood was due to the very good Stumptown coffee, the added CBD infusion, or the combination.
Pressure to rein in CBD in New York and elsewhere likely stems from the federal government's stance. Last year, the agency announced it would crack down on health claims made by manufacturers whose food products contain CBD. In a statement, FDA Commissioner Scott Gottlieb said the agency is "concerned at the number of drug claims being made about products not approved by the FDA that claim to contain CBD or other cannabis-derived compounds." He also declared that the FDA prohibits the sale of foods it regulates if those foods contain CBD. New York City's health department appears simply to be following the FDA's lead.
If the FDA, Maine regulators, or New York City health department officials who are wary of CBD in the food supply want to help consumers, they can. They could target any clearly fraudulent health claims made by CBD sellers, for example, and consider taking action should any food or drink containing CBD harm a consumer. Otherwise, though, federal, state, and local officials should ensure that people who want to eat and drink foods that contain CBD have the freedom to do so.

American law recognized three types of things you might swallow. There are drugs, which are certified by the FDA to be safe and effective for treating or curing a medical condition. There is food, which is certified by the FDA to not kill you if you are bright enough to eat it properly. Finally, there are supplements, about which the FDA declares, "Fuck it; eat at your own risk if you trust the FTC to keep up with the biological research."
It should be legal to open up a supplement store in New York City that sells a mixture of CBD and hot water that has been infused with ground dried coffee beans.
However, CBD for adding to foods is being classified by FDA as a food additive. In state & federal statute, foods are presumptively safe, food additives are presumptively unsafe. Since neither FDA nor the state Health Dept. has acknowledged CBD as GRAS, the city Health Dept. is treating it as an unsafe food additive. It would probably take an expensive privately sponsored testing & food additive petition process for CBD to be licensed as a food additive by FDA.
To be considered a dietary supplement, CBD would have to avoid being considered as a "new dietary ingredient" by showing it'd been marketed in the USA as such pre-1992.

I understand when people move to New York City because they work in certain industries. If you're in finance, live theater, an artist, work at the port, fashion--there's a good reason to be there. I understand when people go to New York City because they're going to school. Columbia, NYU, Fordham, they're great universities!
I know that breaking family ties can be hard, especially for women with kids. They seem to always gravitate to be somewhere close to their parents, sisters, and other family.
I don't understand why people without those ties and more than $350,000 of equity in their homes stay in New York City.

My brother worked on Wall Street for a long time. He says that after a few years, you forget that you're paying through the nose to live in a shit hole. It was hard for my folks who'd grown up and lived in Virginia, Maryland, and Washington DC to imagine what California was really like before they went there themselves, but that was a long time ago--and there's a lot more places to move than California to start a new life these days. And we have HGTV now. Do people not see what you can get for $150,000 in Mississippi and Waco? I don't understand why a plumber, a carpenter, an electrician, or a truck driver would choose to stay in New York City. It's like trying to understand an economic model of gambling--when the best interests of gamblers is to cash in their chips and leave.
There is culture and restaurants and art centers and hipsters in Greenville, South Carolina, Asheville, North Carolina, Bentonville, Arkansas, and Austin, Texas. And you can watch the Yankees live through a subscription from anywhere in the country! The country's best Shakespeare festival is in Oregon. Utah and Idaho are both incredible.
And we haven't even started talking about the weather, taxes, regulation, crime, . . .
California has an unmatched geographic variety. You can get from beaches to snow in 3-4 hours; or to put it another way, when there's snow in the mountains, you can go home to get away from it too. Redwood forests, deserts, the delta, placid rivers and rafting rivers, farmland, rolling hills, steep mountains and canyons.
You can get all those elsewhere, but not in the same proximity.

I'll see how she likes it. It's a work related move, she is a veterinary surgeon. She was making enough at her previous location, but she was also stressed out because her local vet hospital was frequently understaffed and underequipped. She's going somewhere that has actual techs and also won't require her to cover ER shifts at short notice.

As recently as the '90s, I could rent a one bedroom apartment in Hermosa Beach for $450 a month that was half a block from the beach. Circa 2000, I was paying $650 a month for a one room bungalow cottage on Catalina Ave in Redondo, again, about a half a block from the beach. That was in LA!
There really aren't any great areas for people of average means to live in SoCal anymore, but one of the reasons people used to come in the '70s and '80s was because there was so much in the way of affordable housing. Still lots of other places to go for that now.
Why work for above average pay in a place where the median house price is $548,100 (California) when you can live in place where the median home price is $200,000? Especially if you're looking to live in something that like a KB Home development in Santa Clarita, the new homes where the median home price is $200,000 are pretty much the same! It's the taxes and land prices that are different.
The median price for a home in New York City is $680,000, and it's the size of postage stamp. And, unlike in SoCal, the weather is terrible. Anybody who's working a standard job in NYC, I hope you're happy! You might be just as happy making 20% less in a place where homes cost one-third the price, and the taxes are dramatically lower.
And most of those places have better strip clubs.

Really, this is related to the idea of compulsory cakes. Liberals absolutely cannot seem to grasp the fact that a business owner's business is his property. I am guessing that these CBD restrictions have more to do with BigPharma looking to patent the stuff. They can't bill your insurance for $1000 for a months prescription for something you might pay an extra couple of bucks to have added to your coffee. Pharma also gives tons of money to the fda and local health departments, so they demand a return on their investment...
That's not quite how it works.
Nobody can patent the substance, it's in the public domain. But there are use patents for Epidiolex, a specific prescription product that contains CBD oil, but that is limited to use for the treatment of specific seizure disorders.
Which means that so long as the patent remains in effect nobody else can market (FDA approval of a drug product is all about how a product can be marketed) a CBD product for the treatment of those named condition. Doctors can prescribe/recommend other products containing CBD, and/or people can use other CBD products, it's just going to be off-label.
So, this effectively means the owners of that patent have locked up the prescription insurance business for that condition. Which is a situation, I suspect, they are quite happy with, as it means high dollar volume business with limited levels of liability.

This kind of story is sad but happens everywhere... Over-regulation so the health department can save us from what it perceives as a threat. For example, years ago my kid went to a gymnnastics / diving gymn that sold smoothies. The regul-nazis shut the that smoothies operation down because they decided the gymn needed thousands of dollars in new equipment to meet health code in order to legally make smoothies, which involves chopping fruit and a blender! I think his point was that, if you want CBD in your coffee, it is probably more economical to buy a bottle and add it to your coffee yourself.
Personally, given that CBD products are the commercial Wild West I'm skeptical that whatever anyone says is CBD actually contains any cannabinoids whatsoever.
The same thing is happening in Michigan--it made the front page of the Free Press this morning. Since the Feds haven't approved it they won't permit it to be added to cocktails (a few bars in Detroit were experimenting with it, to great reviews). They'll do anything to keep cannabis products illegal, even if Michigan just voted to allow recreational pot. And the paper predicts it'll be years till it's legal.
