A Young Man Recorded a Cop Pointing His Gun Toward Children, So the Cop Arrested Him

An El Paso police officer pointed his gun at some children, then arrested the young man who caught it on camera.

A video posted to Facebook shows an unnamed El Paso police officer detaining a young boy. When surrounding children criticize the officer, he pulls out his gun and aims it at the crowd. Moments later, a second officer comes to help. The officer then pulls out his baton and begins shoving spectators away from the scene.

About a minute into the video, the gun-pointing officer sets his sights on the guy filming his behavior. The young cameraman says "I'm just recording" before the officer places him in handcuffs. The camera is handed off to someone else in the crowd to capture the second arrest.

The El Paso Police Department released a statement on Saturday, a day after the video was posted. According to the statement, the officers on video were initially responding to a criminal trespass call. The officer, who was identified only as a four-year veteran stationed at the Central Regional Command Center, was reassigned to desk duties while the department's Internal Affairs Unit investigates the events captured on video.

Assistant City Manager Dionne Mack told reporters at a press conference that one minor and one adult were taken into custody and "charged with interfering with a police investigation." Mack said the incident was being investigated based on a process that is "clearly defined in our policies and procedures."

According to USA Today, the department declined to provide specifics about the policies covering handgun and baton use.

        We see them at trial. Meaningless filler text that looks like a procedure followed by a clause voiding the whole thing. He clearly feared for his life. Just not justifiably so. One month paid vacation suspension and a score of "1" next to the "Follows directions and works well with others" section on his next employment review.

      ah, an internet tough-man.

      they obviously weren't all 10year olds.. And yes, it can be very unnerving to be surrounding by a mob screaming profanities from all directions, passing behind your back. All within shanking distance. Try it sometime....I'm sure you would have no concern at all for your safety.

      In this case, a private citizen would likely get off on pulling his gun in that situation. No jury would convict a private citizen, so not sure if there is much to blame the cop for, without knowing what led to up to the event and why the arrest was happening. Was it bogus? who knows. Criminal trespass is refusing to leave private property. don't libertarians want enforcement of private property laws?

      The cop didn't shot, hit, taser, or actually use the baton on anyone. The kid getting arrested was quickly cuffed without violence. Outside of the gun pull, which was very brief in an obviously contentious situation, what exactly did the cop do wrong? Arrest the video taker? Doesn't look like it was for the video itself as that continues on. Any self-respecting authoritarian would have confiscated it.

            He behaved professionally in almost all other aspects outside of the brief gun-pull. And without knowing what precipitated that, perhaps judgement should be reserved.

            There are enough egregious instances of poor cop behavior. This is not one of them.

            Libertarians are not well served by hating all cops for every action.

        A crowd that included kids in single digit age? Um...

        Pointing it at them in the absence of a direct threat? No.

        And they were minorities? Hell no.

        In many jurisdictions the mere displaying of a weapon, absent some approved condition, is a crime.

    Or we could rewrite that sentence and make it more reflective of the video.

    When children, young adults and adults surround an officer trying to keep a suspect on the ground, then begin closing in and screaming at him, he brandishes his firearm briefly in an effort to keep the stupid motherfuckers off him.

        He shouldn't have pulled his gun; and the kids weren't merely "criticizing;" they were interfering in the arrest. I don't think he was justified in cuffing the kid filming; but there was at least one other kid he probably should have cuffed for trying to set his friend free that he didn't.

    This is nothing compared to what is going on in the San Antonio area. Cameramen were arrested in Leon Valley for being witnesses to a crime. One is in jail on a harrassment charge for the actions of others. One was just arrested in retaliation on false trespassing charges. He was trespassed from the police station!

    Yeah, but no.

    What I saw here was a crowd of belligerent adolescents and adults attempting to provoke the police. As others have pointed out, people who have never been threatened by a mob have little understanding of just how bad that can turn and quickly.

    Truthfully, when I see crap like this it makes me want to reinstate corporeal punishment. I especially appreciated how the parents on the scene made no attempt to control their children.

    When dealing with a bunch of lowlifes like this group, a good world class ass kicking usually goes much further in correcting their behavior long term than some meaningless fine that they will never pay.

    And when someone cries about "the children", I would encourage them to remember that when this same group of jerks is engaging in a home invasion of your property a few years later. A bunch of 16-17 year olds armed with guns and knives will appear much less innocent.

      Did you see the title of the post? The author's issue is clearly with the arrest of the videographer. Do you have a justification for that? Is it for allowing the refracted light from a public encounter involving the police to enter his camera? Uttering a statement he is lawfully allowed to utter? Does that qualify as "interference" in your world?

    I'm all for criticizing abuses of power by the police state, but clearly the cop wasn't the only one deserving 'criticism.' He shouldn't have arrested the camera kid.

    I'm missing something here. A mob harassed an officer (hispanic, no less) who was responding to a call. Shouting at him, interfering, threatening him. He didn't arrest the videographer until that idiot told the other hooligans not to worry, that they were going to file a complaint. The cop didn't prevent the person who took up the video from filming, so no rights were violated. An officer who feels threatened CAN use DEADLY force. He used NONE. I would have shot at least one warning shot.

    They should have arrested them all. And I am no fan of police brutality or excessive force. The kid the cops killed in Mesa last year, that was bad, this is massive restraint.

      If any cop felt threatened in that scene, they should resign. Being shouted at by small children is not a threatening situation. Being told to 'do your job right' is not threatening. Being filmed sure as hell should never be threatening if you are doing your job right.

      It would be great if all cops had the same extreme-mellow temperament as pilots. All of these unnecessary escalations would vanish. I am a big fan of ultra-mellow cops.

      Most of the complainers here are conveniently ignoring the edited nature of the film that left out the low life parents yelling at the police off to the right side. They are also ignoring how the "kids" were lunging in and around the police officer and were clearly trying to grab the gear he had on his belt.

      If one of them had managed to take the officer's pistol away, I think a far more tragic ending to this video would have occurred.

      It was a mob in the making and only the arrival of backup prevented the whole thing from going sideways.

      And regarding restraint, if these junior league felons had tried that crap anywhere else in the world I'm pretty sure getting cuffed and taken away would have been the least of their worries.

        I would be curious to know how this started. There are clearly events that happened before the camera started rolling we did not see to include cops claiming they were trespassing and some mom of the kids claiming one was getting choked out.

        Either way, some kid there has a world class mouth for a kid whose balls aint dropped. Not sure I would be screaming shit like that at anyone who is armed.

        OFFS, like anyone there doesn't know that would be an immediate death sentence for all involved. This wasn't a mob of crazed gangbangers with a death wish.

        My guess is if they managed to get the guy's pistol they would have just played a hilarious game of keepaway with the cop. "guys, c'mon, give it baaaack

    The kids are a bunch of ill-behaved little monsters. No sympathy for them. Kids that age have murdered people, and they were closing in all around him. No way of knowing if one of them is about to stick a knife in your gut or smash you over the head with a rock.

      Precisely my point. Rampaging groups of adolescents are considered by all populations world wide as being very dangerous. They have no sense of mortality (i.e. the kid mouthing off to an armed man), morality and little to no self restraint.

      All of which are a formula for violence. Particularly of the stupid kind.

      I'm certainly not one to gloss over police abuses, but just MAAAYYYBEE this officer has had some prior interaction with these people and knows them.

      In the same situation, I probably would not have drawn my weapon, but I didn't see what lead up to that action. I would have been very tempted to smack the shit out of at least some of those kids, but that's obviously highly discouraged nowadays.

    Nothing good will come from this. The police will not re-evaluate their tactics, nor the apparently unlawful behavior of their own personnel. But they will reduce their presence and law enforcement efforts in that neighborhood.

    The people in that video clearly did not want the police around, now they are going to get their wish.
