How New Hampshire Plans to Spike Its Sex-Trafficking Stats
No evidence of a real sex-trafficking epidemic? No problem! The state has ways of creating sex traffickers...

According to some New Hampshire media, the state has suddenly made it illegal for teenagers to have sex with one another as part of an effort to prevent sex trafficking. It turns out the measure isn't quite as bad as bad reporters claim, but it's still an entirely unnecessary and harmful piece of legislation.
The basic premise of the bill, according to text filed with the state House of Representatives, is to make it a class B felony "for a person to pay to engage in sexual contact with a person under the age of 18" and require "registration on the sex offender registry" for such individuals. It passed the House earlier this month, and cleared the state Senate on April 21.
As it stands, adults having sex with minors is already criminalized in New Hampshire (as statutory rape or sexual assault, depending on age and circumstances), like it is everywhere in America. Sex trafficking is also a crime already in New Hampshire, as is prostitution between consenting parties. So why the need for the new law?
Because duh: under the old rules, an adult who solicits paid sex from a teenager could only be charged as a rapist and a prostitution offender. Under the new law, they can also be charged as a sex trafficker, thereby triggering more check-marks when tallying up annual human trafficking arrests. Got to keep feeding that moral panic somehow, don't we? I can't wait to see the spurious news reports next year about the "drastic increase" in "child sex trafficking" in the Granite State.
The bill would also add paying to watch a sexually-explicit performance by someone under 18 as a form of human trafficking. This way, if a 17-year-old uses a fake ID to get a job at a strip club, anyone who patronizes that club can also be charged as a sex trafficker.
Then there's the fact that under current New Hampshire law, a) the age of sexual consent is 16, and b) it's only a misdemeanor charge if someone not more than four years older than the alleged victim is accused of statutory rape. Soliciting prostitution is also a misdemeanor offense. So under the old rules, an 18-year-old who paid a 15-year-old for sex could be charged with just two misdemeanors; under the new rule, two misdemeanors and a felony. Under the old rules, a 25-year-old who solicited a 17-year-old for sex would simply be guilty of misdemeanor prostitution. Under the new rules, a felony, plus a mandate to register as a sex offender.
What good does creating more felons and sex offenders do the state of New Hampshire? Plenty, from a pro-carceral and a pocket-lining perspective. Under the new scheme, the state can impose more severe punishments on offenders, including greater fines and more post-release requirements. And, perhaps most importantly, it can use asset forfeiture powers more liberally. The state has no power to seize the assets of misdemeanor prostitution offenders or statutory rapists, but it has ample leeway to seize the aspects of suspected human traffickers.

It makes me wonder if the "libertarian moment" isn't more of a "the things I like to do are OK" moment. Pot legalization has gained momentum as all of the fogies from the original "reefer madness" era die off and all the folks who toked up in the 60's and 70's start taking power. We've gained a new sensibility about homosexuality as the people who grew up with openly gay pop stars move into the majority.
But strippers and prostitutes? Nah, that's still icky. Because nobody is going to be the standard bearer of that one. Who would be the sex-worker equivalent of Elton John, Freddie Mercury, or even Boy George? What politician is going to pull a Bill Clinton and admit that he visited prostitutes (but he didn't enjoy it)?

The current anti "sex-trafficking" measures exist because government realizes they're going to lose the revenue stream that comes with the drug war, so they need the next thing to make money/scare the public/secure votes with.

That's why I think the "decriminalizing prostitution is a criminal-justice-reform issue" frame works the best, and angles that focus on "harm reduction" and other buzzwords like that. Sure, all the old hippies want to smoke pot, but the other animating factor in weed decrim has been "look at the shit this has been doing to poor/black communities, look at the ridiculous prison costs, at the unfairness of civil asset forfeiture for drug crimes," etc. I think a lot of people secretly want to support sex worker rights and prostitution decriminalization, and might if we can give them a frame that makes it publicly palatable

Yeah, that's not going to play with modern feminists, except the not-crazy ones like Christina Hoff Sommers. Anita Sarkeesian has derided this concept as "choice feminism," which she criticizes as meaning "if a woman is allowed to choose things for herself, that's feminism." She and people like her don't agree - they think feminism means women living how *they want women to live.* In particular, these radical left-wing feminists constantly criticize women who engage in prostitution because they're giving into the male gaze and allowing themselves to be objectified and they criticize women who choose to be stay at home moms on the grounds that they're partially responsible for the pay gap and teach girls it's okay not to work.
Basically, the only way to be a real feminist to a lot of people who call themselves feminists today is to hate and fear male sexual desire. All male desire is to them is the driving force behind rape. As such, they'll never get behind prostitution.

I think that's what it is. Almost by happenstance, a couple of issues that libertarians are generally in favor of bubbled to the top. They are the exceptions that prove the rule (in the true sense of the phrase, I believe), with the rule being the continued expansion of the Total State.

Well, apparently they don't. I'm your camp. Drug legalization doesn't directly affect me - in the sense that I'm not a drug user and I'm not going to become one because of legalization. I am not gay or transgender or a member of any other similar grouping. I'm not a sex worker and wouldn't use their services even if it was legal. I don't even have a drink very often, and wouldn't miss it in the least if prohibition came knocking.
But I'm firmly committed to the notion that each of us should have the autonomy to direct our own lives. And in that, we are a tiny minority.
You'd think that the radical left would be a happy home for like-minded folk, but sadly this isn't so. Most sub-groups on the left would happily use the state to enforce their personal morality just as the Moral Majority on the right sought to do.
We see #BLM and think "hurrah! an ally in the fight for criminal justice reform!" But sadly it isn't so. Motivations mater when it is time to seek results, and the major motivator in that movement seems to be race, rather than justice.
Because other people don't think like you. They don't see that it is the vast power of the state stomping on everyone's autonomy that is the problem. They see racists in power. So just change the folks in charge and we're OK. The same is true for all the other groups. Very few people see it our way.

I live in NH and the "law grabs" piss me off to no end. We're the state that said "fuck you" to federal highway money because we didn't want to implement the seat belt law, but now we'll slap together any old retarded law that comes along.
The problem is we have too many nanny state people that have gotten into the executive and into the legislature. Maggie Hassan, the current governor and US Senator-wannabe, has never met a tax she didn't like. Add into the mix that most of the legislature is populated by old people and there's a big problem. Also, we have the same problem as many other states, where the cities, especially the ones near the MA border, tend to be full-on liberal while the outlying area tend to be more conservative.
Yeah, it's getting pretty stupid. And even when the legislature occasionally passes something good (like removing permit requirements for concealed carry) the awful governor vetoes it.

There's always been the conflict between the ideas that punishment for a crime should be primarily as revenge, as rehabilitation, as deterence, or as simply protecting society from harm. The deterence group has a hard time answering the question as to why - if you want to deter the most people - why not have the harshest penalties for the crimes most people need deterence from? A hundred bucks or so fine doesn't seem to deter the illegal parking situation, what if we start chopping heads off? Like in Saudi Arabia where they chop a thief's hand off - it may or may not deter him from stealing again but, by Allah, he's only going to do it twice. On the other hand, you kill your mother-in-law, do you really need a life sentence for that? It's not like you're ever going to do it again.
