Lawsuit: White Student Bragged About Sex with Black Athletes, Then Got Them Expelled for Rape

Allegations of race and gender bias comprise the most unfair campus rape investigation ever, at the University of Findlay.

Two black athletes have sued a private college in Ohio, the University of Findlay, for expelling them without even a semblance of due process after they were accused of rape by a white female student.

The lawsuit, filed by Justin Brown and Alphonso Baity, characterizes Findlay's investigation of the dispute—which was completed in just 24 hours—as a "sham." The university failed to interview witnesses who would have corroborated Brown and Baity's accounts, threatened other witnesses for failing to back up the accuser, and, most damningly, ignored considerable evidence that the accuser did not merely consent to sex—she bragged about it later, according to the lawsuit.

While these kinds of lawsuits often raise the specter of gender bias against male students, Brown and Baity's lawsuit explicitly alleges racial bias. Indeed, this case may represent the most egregious violation of campus due process I have ever heard of. From the lawsuit, courtesy of KC Johnson:

Most troubling, the conduct of the University of Findlay's representatives was intentionally and inherently discriminatory because of Plaintiffs' race, ethnicities, and gender. As explained in detail below, the University of Findlay has a history of discriminating against African American males in allegations of sexual assault by Caucasian females.

Here's what happened: Brown and Baity were friends and sexual partners of the accuser, a white female identified as "M.K." On the night of September 21, 2014, M.K. had sex with them—separately, and while they were in the same room—in the house the two men shared with two other black male students.

According to the lawsuit, the housemates were present in the common area and could hear some of the sexual activities. At least two other white female students were also present. All agreed that M.K. consented to sex, and could at times hear her consenting to sex. Brown and Baity maintain that M.K. was not just a willing participant, but the prime initiator, of their various encounters that night.

M.K. went home the next morning, and bore neither of the alleged perpetrators any ill will. According to the lawsuit, she explicitly told another student (J.F) that the sex was consensual—the lawsuit describes her as "bragging" about it. She also bragged about the encounter to a white female who lived on her floor.

Ten days after the encounter, M.K. filed a sexual assault claim with the university. Findlay administrators interviewed Brown and Baity—without telling them the specific nature of the charges against them—but did not speak to their black housemates because they merely presumed these men would defend their friends. Administrators did speak with the white women who were present (an example of racial discrimination, according to the lawsuit), and then, spectacularly, punished them when they disputed M.K.'s version of events. One of the women lost her work-study job, and the other was threatened with expulsion, according to the lawsuit.

No one agreed with M.K.'s claims except M.K. herself. On the contrary, all relevant witnesses sided with Brown and Baity. They were expelled 24 hours after M.K. filed the claim. There was no hearing, just a letter in the mail.

That wasn't all. A few hours after they notified Brown and Baity of their expulsions, Findlay administrators sent an email to campus that "specifically identified Browning and Baity, falsely stated that they sexually assaulted a female student, and indicated that Plaintiffs were expelled from the University as a result of this conduct."

M.K.'s white female neighbor, who had heard her refer to the encounter as consensual, tried to speak up but was rebuffed by her residential advisor. The male friend who had also overheard bragging emailed officials to inform them. These appeals fell on deaf ears.

Findlay maintains that it did nothing wrong, and is prepared to "vigorously defend" its adjudication process.

"The university conducted this process with integrity and fairness," spokesperson Joy Shaw told The Washington Examiner.

Keep in mind that the lawsuit is only one side of the story—Findlay may dispute the details. But it's hard—impossible?—to imagine how. Assuming the lawsuit does not misrepresent the accounts of more than half a dozen people of all races and genders, there is not one shred of evidence to support M.K.'s claim, and mountains of it to support Brown and Baity's.

"I've read and reported on numerous lawsuits by accused students — and every one has been stunning," wrote The Washington Examiner's Ashe Schow. "So you'll have to believe me when I say this one is the most incredible I have ever seen."

I agree.

Brown and Baity are suing Findlay on counts of racial discrimination, gender discrimination, abridgment of due process, and breach of contract. It will be interesting to see if the racial discrimination aspect gets much traction in the media. Some due process advocates who follow these cases, including Harvard University Law Professor Jeannie Suk, believe black male students are more likely to be falsely accused of sexual assault. The two high-profile accusations of sexual assault in The Hunting Ground film were made against black students Brandon Winston and Jameis Winston (no relation).

And yet, as Samantha Harris of the Foundational for Individual Rights in Education reminded me on Twitter, The Hunting Ground filmmakers have maintained that critics of their perspective (like me) are actually just defending "dominant white male power." It's sure funny how that works.

      Well, they are getting away with much so far. The accuser still has strong defense from PC leadership and organizations, just like the "mattress girl" who got academic honors and a good follow on job from her documented fraudulent rape accusation.

      The main advantage these guys have is not the facts and witnesses, but rather the advantage of being Black, which for a while now has meant more privilege. Because of that, most commentators - certainly me - will probably agree with you.

    Finally a case of false rape and college absurdity the media might actually acknowledge! Of course maybe not. I can see them in meetings right now determining what's more important: protecting the narrative of injustice against blacks or the narrative of campus rape culture. I imagine these meetings anytime something inconvenient to a narrative happens.

      That's funny, crusty. 😉 Both in high school and college after having seen and been the target of enough drunken, horny 18-23 year old white women to know better, I used to say to my friends that said women come with a blinking neon sign on their foreheads that says "DANGER!". The catch is that the sign is only visible to the 18-23 black males whose common sense overrides their own horniness.

      There's something about the distorted, sometimes gargantuan sense of entitlement and impunity many American 18-23 white women operate with that the risk of being caught in their orbit is simply not worth the space travel.     I first saw this BS back in 1982 (Keesler AFB) when a guy I knew was summarily drummed out of the Air Force. On early Sunday morning everyone was talking about how one of the women had done a gangbang in the barracks - I personally overheard her bragging about it in the chow hall, and several of the guys involved were all spilling details. Apparently quite the good time was had by all involved - one young white woman and about six or seven black men, all under 20.

    By that afternoon the other women her barracks were slut-shaming her (literally screaming "slut" at her constantly) - on Monday morning all the men involved were arrested for rape and were given quick discharges. The woman involved was transferred to another base and was gone by Tuesday.

    I blame women for this type of crap.

      They didn't mention libel and defamation. The letter sent to students is pretty clearly libelous and defamatory. The school having heard from several witnesses who disputed the claims should be pretty strong evidence for the "knew or should have known" part of the requirements.

      When an enterprising attorney figures out how to turn Title IX against them, the colleges are going to realize they have a really, really, big contingent liability hanging over their heads if they keep entertaining this. They have ample reason to believe that the administration would provide them support through a friendly interpretation of the law.             Very possibly. Take a look - real close look - at any contract you've signed. It's almost certain that there are clauses which absolve them from actually honoring their part of the deal and if it screws you over in the process, well, too damn bad.

            I'm not saying it's right, but it's the way things work.

    I've got the solution. Create one building on campus that will be a safe house and the students who elect to, will spend their entire time on campus there, and will take classes only taught by certified 'safe space' faculty who will make sure the student is never, ever offended no matter what. No other students will be allow to come into contact with 'safe space' students or communicate with them in any way. They will spend their entire campus life alone outside of their safe space faculty, so that it's not possible for them to ever be offended in any way, let alone raped.

    It's the only way.

        The alleged (and mistakenly assumed) impossibility of a "neutral principle" - in respect to freedom of association - is in play here. See Wechsler and Bork, for instance. // In the same way, you could ask for government to create two legal classes of people, the protected, and the classical liberals. Obviously, the protected don't want to just be "left alone". You will face similar problems when suggesting that "affirmative consent" be an opt-in standard. Imagine a party explicitly excluding those who want the affirmative consent standard.

    The admins at Findlay are retrograde fucksticks. But they are a private organization and in a free society they could discriminate in any way they wish. They also have no obligation to provide "due process", which has no legal meaning wrt private actors anyway. So,

    Brown and Baity are suing Findlay on counts of racial discrimination, gender discrimination, abridgment of due process, and breach of contract.

    but the only one of those things that should matter at all is breach of contract.

    I used to enjoy the SJWs turning on each other. I actually thought that this might help bring about their downfall.

    Until I started noticing that all this SJW on SJW violence was getting blamed on 'conservatives'. The 'conservative' administrators at hellishly leftist, SJW colleges.

    The PC perpetrators of these various affronts names were quickly disappearing to be replaced with attacks on the 'conservative' 'oppressive' attitudes of the administrations.

    The screaming woman in the Yale video is a prime example of this--she screams 'who hired you?' Well, she did, at least in part--she was part of the committee that hired the man she was screaming at--and he was hired because he was one of them.

    And suddenly he's an oppressor.

    They're not 'eating their own'--they're setting Reichstag fires all over the place.

    I predicted pretty much this about a year ago.

    I know of one rape accusation I college, and the event makes me more worried for black men than women. Seriously.

    A white woman I knew (let's call her Barbara) was just progressive and enlightened enough to be willing to enjoy some African man meat, but not quite enough of a diversity fan to actually admit it in public.

    So, when her black partner in coupling started bragging to everyone, she was too embarrassed to admit it. In her brilliance, the solution she came up with was (you guessed it): "I was raped!"

    Next thing you know, she's getting her ass kicked in a restroom by the black guy's sister, who knows her brother better than that.

    Have progressives accurately estimated the number of black men's lives they're going to ruin trying to better protect women? I already know that the feminists don't care.

      Don't get me wrong -- I'm not saying the consequences aren't harsher because of race.. Just saying that in a situation where you have race and jerkiness, people might be responding to the jerkiness.

      Let me hear a story about nice black people who only wanted romance -- and similar white guys who are not disciplined (that's the missing component in the article above), and then I can focus on the racial injustice.

    I totally disagree that this is about Race -- I suspect that if this happened to white guys, whether they are athletes or frat boys, the same result would have happened. This is definitely about Gender. That's why the school feels they are on the right side -- they'd be embarrassed if it were about race.

    So liberal black "victims" are victimized by a liberal female "victim". I'm enjoying the show!!

    If the guys had kept race out of it, I'd have sympathy for their very real victimization by feminist process overreach.

    Not so much now.
