Omnibus Gives More Money to OCR, the Agency in Charge of Title IX Witch Hunts
Stop the madness.


The Education Department's Office for Civil Rights has been rewarded for its hard work eroding the free speech and due process rights of university students accused of sexual assault: the omnibus spending bill that passed Congress earlier today includes a 7 percent budget increase for the agency.
OCR is charged with ensuring that universities are in compliance with Title IX, the provision of federal education law mandating gender equity. But Catherine Lhamon, President Obama's assistant secretary of OCR, has interpreted her mandate very broadly—issuing guidance to universities that they must adjudicate sexual assault themselves and could lose federal funding if they don't tilt the proceedings in favor of accusers.
Some Republican Congressional leaders are perfectly aware that OCR has effectively become a rogue agency. Sen. Lamar Alexander has confronted OCR bureaucrats and accused them of subjecting schools to regulations that were never approved by the legislature, "circumventing principles of transparency and accountability," he said, according to The College Fix.
The question, then, is this: Why would a Republican-controlled Congress opt to increase OCR's budget? Writes Paul Mirengoff at Powerline, "Why is a Republican Congress about to reward OCR for not following the law?"
This outfit does all it can to impose the left's agenda at the K-12 and college levels. In doing so, it often ignores the law, defining perfectly legal conduct as unlawful.
If the OCR's resources are stretched thin, it's because of the Office's overreach, based on a willful misreading of the law. By increasing OCR's budget, Congress rewards its misconduct. The budget should be slashed, not increased.
OCR maintains that it needs more funding in order to complete is current investigations of colleges. But the Competitive Enterprise Institute's Hans Bader—a former OCR attorney—argues that additional funding will merely incentivize the agency to launch even more witch hunts:
A government official with inside knowledge says that this increase was included after a "couple Democratic Senators recently circulated a Dear Colleague Letter asking for a $6 million budget increase for the OCR, so they could complete their Title IX investigations in a more timely manner."
But this budget increase will not reduce the number of incomplete investigations, but rather increase them over the long run. OCR just uses budget increases to make up new legal obligations for colleges out of thin air, and find violations based on conduct previously deemed legal. That it turn leads to even more open, incomplete investigations.
Expect to see more of the same from OCR in the coming year—particularly if Republicans refuse to rein in the agency.

It's the frequencies (GMRS) that matter, not the Wattage. If you don't use those frequencies then supposedly it's OK, but it's not like I can make sure that the kids stay off the verboten frequencies. If they play around on the wrong frequencies, and some asshat with a license hears them and gets pissed, he could send the feds after me. This is fucked up.

A few years ago I bought some 7 mile range walkies for the wife and I to use when I took her to the Tx Renaissance Festival in case we got separated. Turns out everyone else had them also. Every channel was a cacophony of nonsense.
I didn't have a license and figure no one else did either.
I did use them on a road trip where we had two cars. That was fun. People's kids that had their own were trolling the hell out of everyone in range.
As Sarcasmic says, the frequencies used is what matters. Some are limited to CB band that doesn't require a license. I think the license requirement for GMRS has been around for a long time.
I just bought the damn things and put batteries in them. I threw the packages with the instructions still in them away.
I have no idea how that works and couldn't care less. They came in handy on the road trip and a couple of times when my brother and I were out planting timber. After that they ended up in the never-land that all my useless junk goes into.

I have some 26 mile GMRS radios which require an FCC license to use the higher power channels (which get you the 26 miles - mountain to valley).
It's likely that those radios are the same type-- some channels won't require an FCC license.
And the FCC doesn't generally chase people down. The FAA on the other hand...
The subject of radios comes up on my racing forum occasionally, and there's always some HAM guy who screams that the FCC is going to get your ass for running an unlicensed UHF/VHF radio. And yet, nearly every team at every race does it with no interest at all from the FCC. Hmm, maybe their enforcement budget needs to be increased as well.

As far as implementation goes, it doesn't matter who controls the white house, these institutions will keep doing more or less the same thing.
I don't think it's a matter of turning their own rabid dogs loose on them either, because most of the people getting shafted by the witch hunters are still basically innocent bystanders, mainly just average students.
I would say either 1) the GOP would have to trade something they like better (like defense funding) in order to get away with cutting the OCR's budget, or 2) They are just dumb and shortsighted and therefore don't really care about leftists using universities as indoctrination camps or trial runs for totalitarian government because all that doesn't matter for the next election cycle.
