Why I Am a Pro-Life Libertarian
Rand Paul gets attacked for being pro-liberty and anti-abortion. But there's nothing inconsistent about his view.
There's a belief on the American left that says it's impossible to be both a principled libertarian and a principled pro-lifer—that the two positions are somehow intellectually incompatible. It's been popping up more often lately as liberal writers look for ways to criticize Sen. Rand Paul, as in this Salon piece, where the author says Paul and his father "have always played fast and loose with their libertarian principles when it comes to reproductive health."
The unstated premise on which that statement relies is that No True Libertarian could also be against abortion. But in reality, it's not the case that all libertarians believe women should have the right to terminate a pregnancy. More to the point, it's flatly incorrect to suggest that opposition to legal abortion is irreconcilable with the belief system that places a person in the libertarian camp.
What is true is that most libertarians—at least historically—have held pro-choice views. In their 2012 book The Libertarian Vote, David Boaz, David Kirby, and (former Reason Foundation polling director) Emily Ekins looked at the data and confirmed as much. "According to our analysis of 2008 [American National Election Study] data, 62 percent of libertarians are pro-choice versus 37 percent pro-life, similar to percentages of the national population," they wrote. Stated otherwise, as recently as 2008, a six-in-ten majority of libertarians thought women should be able to legally get an abortion.
Here at Reason that tendency has been even more pronounced, with the magazine's editorial staff overwhelmingly favoring a right to legal abortion. You've probably seen my colleague Elizabeth Nolan Brown's writing on the subject, including her recent quasi-defense of Planned Parenthood. From the general tenor of our coverage of this issue over the years, one might get the impression that most if not all prominent libertarians support the so-called "right to choose."
Yes, libertarians tilt pro-choice. But as a young, female, pro-life Roman Catholic who also happens to identify as libertarian (and who works for a magazine dedicated to free minds and free markets), I'm always rather dismayed when someone on the far side of the political universe professes to be an authority on what "consistent libertarianism" requires.
From my perspective, the consistent libertarian position on abortion is contingent—it depends whether you believe the entity developing in the womb counts as a human being.
I accept that some people don't think it does. And if I were one of them, I'd probably be pro-choice too. Like many libertarians, a fundamental question I use to adjudicate whether an act should be considered a crime is whether or not it has a victim. Drug use? Consensual prostitution? Working for less than the wage some politician has decided should be the legislatively mandated minimum? I oppose government intervention to stop any of these things, because none of them involves the use of force by one human being against another.
But for the consistent libertarian who looks at an ultrasound and sees a baby, a person, a fully human life, it's extraordinarily hard to avoid the conclusion that abortion is an act of violence.
That's where I come down. No doubt my Catholic faith has something to do with it, but so does my (admittedly imperfect) understanding of the science of what happens during conception and at the various stages of fetal development. In moments of honest reflection, alone only with my conscience and my God, this is the inescapable conclusion I can't help but arrive at.
And while I may be in the minority among libertarians, I'm definitely not alone. In 1978 Reason published an entire issue dedicated to debating this topic. There, in a piece called "It's a Matter of Life and Death," the author Karl T. Pflock made the pro-life libertarian case as follows:
The unborn are human beings. Unborn human beings are persons. Unborn persons are innocent of aggressive behavior. Therefore, except in a "life-boat" situation, they must be accorded the protection of the nonaggression principle. And, therefore, under normal (nonemergency) circumstances, abortion is a violation of the cardinal principle of libertarianism.
Recall as well that the authors of The Libertarian Vote found more than a third of libertarians opposing abortion. There's even reason to suspect that number might be on the rise. Although millennials are routinely painted as socially liberal, a 2014 Pew Research study found that people 18 to 29 are actually more likely than those 30 to 64 to say the practice should be illegal. A majority of Hispanics, the fastest-growing demographic in the country, also said it should be banned.
For obvious reasons, the largest divide is between what Pew calls "consistent conservatives" (just 19 percent of whom said abortion should be legal in all or most cases) and what Pew calls "consistent liberals" (88 percent of whom answered the same). It's worth noting, though, that even on the political left, few people will go so far as to say abortion should always be allowed.
At a recent Young Americans for Liberty conference, The Washington Post's David Weigel remarked that attendees were largely unbothered by Paul's belief that life begins at conception. "I don't think a civilization can long endure that does not have respect for all human life, born and not yet born," the Kentucky senator said in 2012. Weigel wrote that many liberals see that stance "as antithetical to 'choice.' Doctrinal libertarians don't necessarily agree."
That shouldn't be surprising. The philosophy of liberty simply cannot speak to whether abortion is an act involving one human being or two. For that, you have to look elsewhere—at science or experience or religion or tradition or intuition or a combination of all those things. How you answer the question will determine your starting point. Libertarianism can only show you where to go from there.

Actually it comes down to whether the fetus is a person, not whether it is a human being. There is a difference. A fetus is, and it is human; therefore it is a human being. Although 1 U.S. Code ? 8 (a) says that "the words "person", "human being", "child", and "individual", shall include every infant member of the species homo sapiens who is born alive", that does not mean they are synonymous. (Conceptualize the Venn diagram if this is not immediately clear.)
The question is when the fetus acquires personhood, not whether it is human or whether it exists.
I salute Stephanie Slade for recognizing that this is a sui generis problem that cannot be solved with libertarian theory. It takes courage to write something like this for Reason, which seems to be comprised mostly of the libertine wing of the libertarian movement.
I don't think pro-lifers (myself included) distinguish between "personhood" and "humanity", regardless of what the law says. They're synonymous. So, one can recognize that the law has defined the issue as well as the fact that abortions are currently legal, but it's kind of irrelevant as it regards the underlying discussion.
I don't know about courageous. Yeah, most of the writers are on the other side of that fence, but they seem to understand and accept the libertarian pro-life position, even if they don't accept the base premise (which is outside of the scope of libertarianism).
Maybe some types of human are not persons, but the pro abortions rights side does not serm capable of explaining a reason why an unborn child is not up until birth that does not exclude from personhood humans in other situations where they are protected by law.

Consider Siamese twins. Sometimes only one of two can be viable separately. And sometimes we do surgery to give one infant a normal life and allow the other to die. But this is always a wrenching decision. And this is morally acceptable ONLY because the viable twin is facing a lifetime of extremely debilitating 'parasitism'. If the second twin were definitely going to become viable after a few months of living co-joined, we would never, EVER allow surgery that would kill one of the twins rather than waiting a few months so both could live.
Consider the Greek root terato... It means monster, as in the sort of beast that would force women to reproduce unwillingly, deer populations to starve to death on an island, or humans on a planet. Mysticism requires the initiation of force because the brainwashing that induces it only works on defenseless children. The saddest part is that the practitioners have no choice. Their parents and brainwashers shut of reason as an option so that force is all that remains to them by elimination. No answer will work that does not send men with guns out to threaten and kill rational adults. Arguing with these mystics is as useful as arguing with World Trade Center kamikaze hijackers.
The same thing can be said for a newborn baby. Without another human being around to sustain its existence, it will die.

Unlike other animals, humans are incredibly helpless for a considerable period of time after birth.
But a newborn isn't dependent on one specific person. Anyone can take care of it.

That only narrows responsibility down to a particular person. It does nothing to refute the observation that all small children require close care and attention otherwise they surely will die.

It's not a question of "spreading the burden around". It's a question of, if the birth parents do not want to raise the child, someone else can take over that role. If nobody does, then the child dies. (Or its raising is paid for with taxes via the foster care "system"). Of course, in the latter case, the burden is "spread around" through taxation. Not to put too fine a point on it, but ...Would anything contained within the skin be considered to be internal to the organism? If so, in the running the finger example, while within the uterus couldn't the finger also run along the umbilical cord and any arbitrary path along the fetus's skin without lifting it off? Mother and fetus would appear to be conjoined, or the interior of the fetus would be contained within the extended skin of the mother.
This observation may do nothing to resolve the matter, but getting the biology (or topology) straight might be necessary for a meaningful discussion.
I side with the majority of Libertarians re abortion, but I am not entirely happy about it. That may be because of my Catholic upbringing. It is hard (though not impossible) for me to suppress the sentiments that arise from that upbringing. I don't think I'll ever be able to deprogram them from by brain, and I've been trying for more than 50 years.
I think that abortion may well be the taking of a life. But we deliberately take life in many ways. As with euthanasia, capital punishment, etc. it should be a matter for serious thought.

If you mean this literally, then your grasp of human anatomy is woefully inadequate. The cervix is there to prevent anything that's not supposed to go into the uterus from getting in there. If you mean it as a sort of half-metaphor, then the same is true of the lining of the lungs and stomach as well. In any event, it doesn't make a difference as to whether or not the uterus is a reproductive organ; if human fetuses grew out of fingernails, they'd be reproductive organs too!

The cervix is nothing but a sphincter muscle. Sperm goes through it. The lining of the lungs and stomach are external tissue.
Again, the purpose of that sphincter muscle is to keep out what's meant to be kept out. Sperm, which is microscopic except maybe for Warty's, can pass through; when the muscle is relaxed through labor, a whole baby can pass through. Oxygen molecules pass through the lungs into the bloodstream. Does that make the blood vessels that carry oxygenated blood to the heart external tissue as well? And what does ANY of that have to do with whether a fetus is parasitic?

No, it is not a parasite. "Parasite"has a rather specific biological meaning as a symbiote with negative implications for the host. From a biological standpoint, as the young of the species, an unborn offspring is a beneficial symbiote, otherwise female mammals would not have an organ with the specific finction of nurturing such a symbiote.

I have cracked open a Biology textbook and have some idea of the different classifications of symbiotic relationships. Parasitism is the one with no beneficial results to the host. Reproduction is a basic biological function, passing the hosts genes down to the next generation is beneficial to the host from a biological standpoint. Therefore pregnancy cannot be considered a parasitical relationship.

Sure it can be solved with libertarian theory. Abortion is a question of property rights. The question being who owns the womb? Obviously the woman owns her womb. Since none of those measures is 100%, and that is a well known fact the world over, then yes, they still participated in the act that deposited the "parasite" in the womb.

Except that the woman, in most cases, voluntarily carried out the action that puts the baby in her womb. So, she cannot force the baby out by killing it as she is responsible for it being in the position of dependence on her. It'd be like if i took you out on my boat and drove way out into the ocean, then decided i don't want you on my boat anymore so i kicked you off the boat and left you to drown. An excercise of property rights? sure, but also murder.
Walter Block has a great speech on Youtube talking about how he would propose handling the situation. The mother could not have an abortion until the baby was viable to survive outside of the womb. Then she would be responsible for keeping the baby alive until the baby could take care of itself, or she could find someone else to care for the baby. If unborn human beings are persons (and citizens), and thus subject to all the protection given all citizens, does this also mean that the parents of the unborn child can claim exemptions on taxes?
What about immigration? If we decide, as a nation, that an unborn human becomes a "citizen" at a specific number of hours (be it 24 hours post copulation or any number below 6,720 hours post copulation), does this change when a mother must enter the country in order to secure citizenship for her child?

Why does there have to be a solution? A wide range of abortion positions are consistent with libertarian principles, why not invite them all in?

Actually, the medical community is split. Some say it leafs to lower rates of penile caner, STDs, cervical cancer in the partners of circumcised men, etc. Others dispute this.
I'm aware of that. But like you said, the issue is disputed by many medical professionals. While I'm far from a settled science guy(the term in and of itself is ridiculously anti scientific), I error on the side of caution when there's no concrete facts to make such a judgement.
I'd still say that infant circumcision is wrong even if it does reduce the rates of some diseases.
If some studies found that cutting off ears at birth reduced the risk of ear infections, or cutting off noses at birth reduced the risk of sinusitis, or tearing off fingernails reduced the risk of nail fungus, I don't think many people would support these practices.

Besides, we don't cut off natural parts of the body because they reduce the risk of diseases by a few percentage points. If we're going to do that, why not just slice off babies' ears at birth? The nature of this debate is that any terms applied to either groups will rapidly become "emotionally-laden, inaccurate, and ultimately dishonest". Pro-Life and Pro-Choice are, at least, broadly understood.
I generally find it polite, and often more effective to use the terms that people self-select, which are usually "pro-choice" and "pro-life". Given that many pro-choicers don't recognize choices such as prostitution or illegal drug use, and many pro-lifers are also pro-death penalty, the terms aren't that accurate, but they are in standard use. "Pro-abortion" and "anti-abortion" might be somewhat more accurate but slightly more offensive. "Anti-choice" and "anti-life" are just name-calling.

I don't see it that way. In my view, if you have sex there is a chance you can become pregnant. So, if you choose to have sex you also choose to accept that you may become pregnant and are responsible for the human life thus created. If you don't want that responsibility then take the necessary precautions to prevent pregnancy. To take responsibility after the fact doesn't mean toss it out with the rest of the trash.

Remember that the anti-abortion people consider the embryos (which are clusters of a few cells at that point) created by in-vitro fertilization to be humans. Some of those people even "adopt" these embryos and have them implanted and carry them to term.
For precision, that should read "frozen embryos..." The freezing doesn't affect the humanity (or lack thereof), but the fact that the IVF-created embryos are frozen at a specific developmental stage whereat they only consist of a few cells per embryo.
Isn't the real debate among libertarian circles is "who decides"? Even some pro-life libertarians pause at having government involved. And prefer persuasion, rather than coercion.

My opinion is that you gain rights when you have certain neural structures in place that enable you to develop sentience. So somewhere after 20 weeks in the womb. Probably not till about the 27th week.

Nope. At that point, evictionism kicks in. Once a fetus reaches personhood, the mother can still evict the fetus, but can no longer kill it. In other words, the mother has to pass one the care of the fetus to someone else, if the fetus is viable outside the womb.
I think libertarian philosophy does answer it, just not in a satisfying way. Until some point, it is birth control. After said point, it is murder (subject to legitimate exceptions, of course).

Yeah, that's why I come down pro-choice. You can't draw a line somewhere that is just to everyone. If zygotes are persons then you can't allow abortion even in case of rape or threat to the mother's life. That isn't right. But then who decides how much threat to the mother's life is acceptable? There's no easy answer, so why not let the competent person with the most at stake decide?
That rape/incest exemption has always struck me as a fatal flaw in reasoning. IF it actually is a human how are its rights somehow trumped by the unfortunate circumstances of its conception? Fully acknowledging the horror of asking women to carry those pregnancies to term, but that's really not the issue here.
I think with regard to the question of the mother's life, intent would come into play. The need to end the pregnancy to save the mother does not mean that there is an intent to end the life of the fetus; in fact, in most cases there would be a preference that, were it possible to save the fetus as well, the pregnancy would be ended with the fetus surviving as well.

Actually, yes I do heroic. But pre-conditioning for speech recognition is different than language production and language acquisition does seem to be hard-wired (imprecise term) into the human brain. While I'm not the linguist you are, I used to be a middlin' decent one before I took a phoneme in the knee. Remember that I'm also one of the few people on here who believes that smarter animals deserve some limited rights. I have no trouble with species-neutral definitions of what is or isn't sentient, and no problem with extending limited rights to certain organisms, again species-independent, based on the intelligence of the organism.

OK, assuming you're talking like Australopithecenes here (because someone could spin "pre-language humans" as H. Sapiens fetuses): That's a good question and one to which I have no answer. We'd really need a time machine since (verbal) language leaves no clear archaeological evidence. Tool-making and written language leave evidence.
Getting back to something I said earlier about gray areas: There was probably no "2001" moment, but a slow evolution of sentience and language with a long liminal period of proto-humans using proto-language. Again, I don't know and nobody can ever know without a time machine.
My favorite interpretation of human evolution says there was a 2001 moment: When Australopithecine, or one of our earlier ancestors, discovered how to control fire and cook meat. Without cooking, meat is impossible to digest ( ok you can break down the cell walls other ways, steak tartar, for instance).

That is true only if you don't consider a fertilized egg a person.
at some point, viability enters into the equation. If I remember right, the original Roe decision was for a window in the first trimester, not abortion on demand right up until birth. And as medical science keeps, advancing, the survival rate of premature babies becomes greater at younger ages. Sometimes, "I don't know" really is the right answer.

I think you have to have that term because it becomes obvious that living human being DNA doesn't do all the moral work you need. A person who is in a permanent vegetative state is, objectively, a living human being, but when a loved one looks at them and says 'that's not my father right there' it makes sense to most people. The person is gone.
Human DNA isn't enough as a hand or a tumor has it and they have no rights. "Life", if you include brain death isn't enough either (as the body is "alive" but the brain is already gone).
But, if the Human is not a part, an actual human with its own DNA and not brain dead, that is an objective starting point, no? Also, you can be alive even before you have a brain (jellyfish come to mind).

I would argue that the reason pulling the plug is acceptable for PVT adults is because there 1) is no brain activity AND 2) is no hope of future brain activity.

Myself, I am incredibly squeamish about abortion for the very reason it seems so close to murder, and if I were pregnant, I do not know what I would do, even at the risk of my own life. But laws against abortion are ill-defined and incapable of just enforcement. Until that fetus can survive on its own, any action in its favor works against the mother, and making exceptions for rape or incest only shows how inconsistent laws must be. After the fetus is viable outside the womb, the question is "at what cost" in both money and intrusion into the mother's self-control. If a transplant into an artificial womb, or premature birth and expensive care, costs more than saving any other life, why should the fetus be given priority over those other lives? At the very least, those who want to intervene for the fetus ought to step up to the plate and take that responsibility -- pay for the transplant, or birth and expensive care, and adopt the kid themselves.

If/when the fetus is a person, the only possible justification for terminating the pregnancy is, essentially, self-defense: to save the life of the mother*. If the fetus isn't a person, then the mother needs no justification for terminating the pregnancy.

Pregnancy can be both physically and mentally traumatic, and is always a risk to the mother, however slight with modern medicine. The issue hinges on whether we will allow the state to force a woman to provide blood to the zygote and act as a human incubator. If we allow the women to refuse, then unfortunately the zygote/fetus will die.
Once we have the technology to do fetus transplants, this will be less of an issue. Anyone who doesn't want a woman to have an abortion is free to take the fetus into their own womb and finish gestation.

I think it depends. I've read of cases where there is something horribly wrong with a fetus in the 3rd trimester and it's aborted, and to be honest it struck me as merciful rather than barbaric.

I think there are all sorts of potential problems with outlawing risky behaviors, particularly mission creep. Then you end up with idiots passing laws that send women to prison for driving too fast when they're 24 weeks pregnant or whatever.
It's a tough issue for me since my instinct is that the state getting involved in determining what is too 'risky' leads to terrible consequences, but at the same time, there is something terrible and evil about a mother shooting heroin when she's in her late term pregnancy and having a baby severely developmentally disabled due to her own terrible decisions.

I think it presents another reason to be hesitant to push personhood back to conception, because then there could be justification for some strange, large scale intrusion into mothers (and prospective mothers) lives in the name of protecting their embryo's from things that could be risky behavior.

Jesus, this line of argument is so easily refuted by just comparing it to a child that is already born. Plus, I'm not even against early term abortion, I just think there is some point (which is nebulous and difficult to define) where it becomes a human life and therefore cannot justifiably be killed.

This is where, I think, the fact that the vast majority of pregnancies result from risks taken by the mother (other than rape) is relevant. She is responsible for being pregnant, so its not unreasonable to require her to carry out those responsibilities when doing so will not violate the rights of another person (being pregnant doesn't violate anyone else's rights, after all), and to prohibit her from refusing to carry out those responsibilities when failing to do so will violate the rights of another person.
Conversely, when her refusal to carry out her responsibilities doesn't violate anyone else's rights, she should be free to do so.
It all comes back to when the fetus becomes a person.

I consider myself pro-choice because I have no desire to see abortion made illegal, except during late stage pregnancy. I do not however, want taxes to pay for it. There is already way too much spending on all sorts of stuff that should be paid for by private individuals.
I consider myself pro-life because I don't like or approve of abortions. I would never counsel a female family member or friend to get one. Even performed early on, it's strikes me as a bad idea and form of violence that is completely avoidable with contraception, including RU484 (which I don't view as abortion).
I also think the abortion issue is largely a distraction. It's unlikely even the most hard line conservative, pro-life candidate, if elected, would get Roe v Wade overturned. And yet, the left is always using scare tactics in elections screaming that, "Candidate X wants a War on Womyn!!" I'm frankly sick of this issue. Why can't there be a debate on out of control spending insead?

Use of force is interesting, because if force is justified in saving the life of the fetus, then isn't like force justified from the mother on the claim the fetus is injurious to her well-being, caused fear for her life, and therefore the mother is justified in her election to use lethal force? I would also offer that it doesn't really matter in that case the intent or previous circumstance of the mother or the child; In the same way that an invited house-guest can become violent, so can a mother profess a change of heart, a fear for her life she came upon after careful reflection on the risks of pregnancy. Not saying this is valid reasoning, but it would offer, I think, some considerable obstacles to prosecuting a woman for electing abortion, if indeed the qualifier for lethal force is fear for one's life or threat of bodily harm.

I've always thought those lines sound like someone speaking poetically more than literally, and as such pretty thin support for such a strong movement. The writers of the Bible knew how to plainly and precisely prohibit something when they wanted to.
The fist quote is from the Psalms so poetry would be expected. But, again, at the time seeing an unformed body being "knit together" would have been impossible for a human to see, so there is a definite amount of literalness to the poetry.
The second quote is from Luke and there's no poetry in that quote.
Also, the Bible already prohibited murder and child sacrifice. As far as I know, there were not pre-birth killings (done by mothers) in Israel BC. Though I think there are references to killing the unborn babies of pregnant women (killing both of them and opening the mother's belly to ensure the child is killed too). That was presented as a really bad thing. I'm not looking that one up right now.

If you want to be technical that's in Exodus, it says that if two people are fighting and they bump into a pregnant woman causing her to lose her child they have to pay a fine to the husband, a punishment quite different than the one assigned for murder.

But that is a fascinating verse. Though you must admit that even then, there was a punishment. It wasn't treated as "heck, it was just a clump of cells so whatever". Also, there were different issues for purposeful killing (murder) and accidental. The accidental you'd have to run to the Levitical City before the brother of the victim caught you and killed you. Only then did you get your trial. If you were guilty, you died. If innocent, you lived there until the High Priest died.

It's like when pregnant women today say 'hmm, the baby really likes BBQ potato chips!' or 'I think he's dancing in there!' If I came home to my pregnant wife and she said 'the baby just jumped when you pulled up, he's excited to see you!' I wouldn't take that too literally. It's a way of saying 'there was some movement down there.'

In the creation story of the Abrahamic religions, God breathed life into man. The Greek word for "soul", ????, also means "the vital breath, the breath of life".
This is significant because breathing is something that a baby can only do after it is delivered.

This whole argument ignores the concept of quickening (when the first movements were felt by the mother), which is used represent the initiation of life.

Participation in the lawful killing of another - be it via an execution, or in war - does not lead to excommunication. It is not even a mortal sin.

Being pregnant is a foreseeable consequence to a voluntary act. There is harm to the mother, but it is clearly less harm than killing a child who does not consent to their own death.
I realize this argumentation is only operative to those who accept the child is a person deserving of consideration. But I will make two points on this matter:
1. It is my opinion that a baby about to be born is fully deserving of protection. The difference between a baby the day before it is born and the day after seems more circumstantial than meaningful. Thus most abortion arguments are about the appropriate place to draw the line. Even people who draw it at the earliest position are not wrong merely of a different opinion, and thus are not violating any libertarian principle.
2. My points are not to suggest libertarians become pro-life, I don't have a strong opinion either way about early abortions (in fact I think RVW would have been an admirable compromise were it only legislation). I merely want the libertarian abortion extremists to calm down and accept a wider variety of opinions. I think the best way to attract people to libertarianism is not to adopt one or the other extremist positions but rather to accept everyone of moderate tone and belief. This would appeal both to the great middle and to those who believe abortion has too great a place in our political life.

It harms the mother spiritually, and it harms society by depriving it of a new member. It also inflicts harm on a non-sentient being (the embryo/fetus). None of those are, however, sufficient reason to punish the woman legally.
In addition, the moral wrong of abortion may be balanced by the moral wrong of bringing a child into the world she can't care for. The balance between those two moral wrongs is something that should be up to the individual, not the state.

We do it to people all the time. We call them "parents" or "legal guardians" and drag them into court when it appears they've failed to meet their legal obligations to their charge(s).

It does. Mothers can ask toddlers to leave at any time. We specifically have Safe Haven Laws in the US that make this as easy as dropping off a toddler at a designated location.
Abortion has always been with us and we should keep first trimester safe and legal. But Libertarians believe in informed people making informed decisions even if it is uncomfortable. Abortion DOES end a human life and it is just an argument about the details of when that matters. Women should be given an ultrasound prior to the abortion appointment so that she can make the decision she can live with.
My own opinion is that late term abortion is straight up murder and torturous for the infant being aborted.
That there is a distinction between the question of what is ethical and the question of what is legal is an observation I think almost all libertarians share. Just because cheating on and lying to your spouse is unethical doesn't mean it should be criminal, and just because it shouldn't be criminal doesn't mean it's ethical.
In that light, I think we should strive to be clear about what we mean when we say we're anti-abortion.

My libertarian argument against abortion from the ethical perspective has to do with consent (surprise, surprise!). When we willingly engage in behavior that may have clearly connected if unintended consequences, we accept the responsibility for that behavior. If I willingly start my engine, willingly head down the street, and accidentally smash into someone else's property, by golly, I willingly accepted the responsibility for that damage when I willingly started my engine and willingly pulled into the street.
That doesn't mean I want the government making car crashes a criminal offense. I'm not convinced the government should start throwing people in prison for fender benders--even if the victim is perfectly innocent in every way. Making fender benders illegal and criminal would require much greater interference by the government in our daily lives than I'm willing to tolerate as a libertarian. Lying to your spouse is unethical, too, but who wants the government monitoring what we say to make sure that doesn't happen or prosecuting people at all for lying to their spouses?

Here, I agree with you. However, it's also a tricky thing because many, if not most, peoples' beliefs about when human life begins is in some way informed by their religious beliefs. There is a fine line between acceptance that one's morals flow from their faith, and that one's morals will impact their political positions, and allowing someone to impose their religious beliefs on others.

In this unique situation, what makes sense is to consider the relative values of the embryo or fetus and the mother, and the extent to which it makes sense to confer equal rights to both. Normally we would assert that a human being is a human being and we all have the same rights and the same worth. Perhaps those 70+ years would have been a living hell. We can't know. That's why we have to weigh the factors presently before us, and decide whether the interests and rights of an embryo are equal to those of a woman, recognizing the uniqueness of the in utero condition. Libertarian philosophy answers this question rather succinctly in that it believes that if there you do not have a victim, you do not have a crime. Our laws and constitution were originally drafted to ensure the rights of individuals, and since a fetus is not, by definition, an individual, abortion cannot be considered a crime. Abortion may be regrettable, often sad, and for the sentimental, an outrage, the fact remains that a fetus cannot survive outside of its mother's womb, and therefore the mother's rights to her own body are paramount. Some woman's abortion has NO bearing on your life or well-being. It's a classic mind-your-own-business scenario.

The problem with the pro choice position for libertarians is that it is great example of how winning for the wrong reasons can be worse than losing. The majority of pro choice people are progressives not libertarians and have very different reasons for being pro choice than libertarians.
If you act on the assumption that life does not begin until birth, Libertarians are pro choice because they believe that people should have autonomy over their own bodies and thus the government has no right to tell a woman she can't choose to have a medical procedure be it an abortion or a boob job.
Progressives in contrast don't think that way. They don't believe in personal autonomy. They are happy to ban other medical procedures they view as "unsafe" and are happy to dictate what people can and cannot do with their bodies. Progressives are pro choice primarily because they reject the concept of personal responsibility. Taking away a woman's ability to have an abortion is making her responsible for her choice to have sex. And we can't have that. The bottom line for progressive advocates of the pro choice position is that they think women should have the ability to conveniently avoid the consequences of their actions making it another part of the entitlement state and the program to ensure no one is ever accountable for their actions.

Conversely, as opposed as I personally am to abortion, I'm not entirely sure from a libertarian standpoint that I would want to live in a country that outlawed abortion, any more than I'd want to live in a country that outlawed pornography, which is arguably just as harmful as any drug for some people. I understand that the cure for things can often be worse than the problem. I am not going to encourage people to go and use drugs but clearly banning drugs causes a lot more harm than using them. Abortion, however, is likely an exception to that. If you believe abortion is taking lives, then it is pretty hard to imagine any consequences of banning it worse than the legally sanctioned murder of thousands of people every year.
Libertarianism doesn't necessarily require "banning" murder either, in the sense of felonies, laws, and a criminal justice system. Many forms of libertarianism advocate replacing the current justice system with a private system of voluntary agreements, adjudicators, and private enforcement. That is, ultimately, it should be up to the individual to choose how they would want violence against their own person to be handled.

As for cases of rape and incest, what happened wasn't the child's fault; why should it die for the crime of its father? Where seeing the child would wreak emotional and psychological harm on the mother, there are provisions in place at every hospital for whisking the baby away before she ever has a chance to lay eyes on it. Besides, the genetic risks of incest are greatly overblown. Problems typically only occur in situations of incestuous behavior spanning multiple generations; the ancient Egyptian pharaohs, for example.

Medical technology has advanced to the point that by the time a pregnancy is far enough along to represent any kind of threat to the mother, the fetus is almost certainly viable and can be delivered.

There are problems with: a) time: someone who doesn't even exist can at best disagree "retroactively". But your property can only be violated when both it and you exist. b) disagreeing with what enables one to disagree at least seems paradoxical. c) If your parents are responsible for all you suffer (because they caused you), they would also be responsible for all your pleasure. You'd have to compensate them - consider unjust enrichment; free-riding. Compensation for harm, as well as for pleasure, brings up the problem of verification. I think we can all agree that a society in which each individual gets to decide for themselves when a person is a person and has rights that need to be respected is a society that does not actually respect rights. Nor can such a society be said to have mechanisms for protecting rights. All I have to do is decide someone I don't like is not a person and I can abuse them in any way I see fit.
So there does need to be some legally enforceable definition of when personhood begins and rights attach. There doesn't really seem to be a better mechanism for that than a democratic vote. You're misguided, it's about the prerequisite to choosing (you can't choose that you're able to choose when you're unable to choose), and to others having to "respect you (as X)". It's not self-evident truth that every one is sovereign. Just consider the conflicts over valid consent. Arguably, you are only a valid/sovereign person when you can consent. Who's to set the minimum standard for consent? Why wouldn't it be relatively demanding (just for the sake of illustration: IQ 125)?
Generally, your parent make those choices for you, but, depending on what choices they have made, you may be able to change that.
Just think of the different possibilities as different states, with different rules. Some states might set the age of consent at 18, others at 21, yet others leave it up to the parents to decide when their kids are adults. Some states might allow self-defense using deadly force others might not. Some states might allow abortion, others might not. Some states might have the death penalty, others might not. You choose which rules you like and move there.
That's roughly how an ideal libertarian society works, except that the "states" don't permanently coincide with territory. Adding "feminist" to anything rarely makes sense. What's that supposed to convey? "Equality for women": equal opportunity (what: genetic, preferences, resources, formal law?), equal outcome (utilitarian, sameness?), or egalitarianism? Is it a comment on society's state (women more disadvantaged than men, oppressed by women/men)? On evolved sex differences (there aren't any, barely any)? On epistemology (I look at things through "a female lense")? (A combination of [some] of the above, or "just" preference for female stuff and/or furthering female interests?) What the term practically conveys is something like "special interest socialism". (A favorable historical view of "feminism" would mean that classial and modern feminism, respectively, are analoguous to classical and modern liberalism.)
"Libertarian feminism" would mean "negative-liberty feminism". I'd say the terms aren't inherently contradictory (e.g. negative liberty + feminine epistemology). One could be libertarian politically/in the matters of law, and a feminist in private life and advocacy. That still leaves it unclear what her positions regarding the state of society (relative group disadvantage), evolved sex differences, and epistemology are. What's also missing is a comparison of "libertarian feminist" and "feminist libertarian" I'd make the more fundamental one the noun, not the adjective.

While I agree that a libertarian can be pro-life (I'm pro-choice), I'd suggest also acknowledging that there are many who personally oppose abortion but are politically pro-choice and agree the government should stay out of the issue. Libertarians think everything they view as immoral or bad for society should be illegal. Most don't think cheating on a spouse should be illegal even if they think it is wrong (though it may violate a private marriage contract). There are many people who personally think over-use of recreational drugs is a problem for society, but feel the drug war isn't something the government should be involved in for philosophical reasons, and many who agree it does more harm than good from a utilitarian perspective as well.
Since medicines exist for abortions, outlawing abortion would merely create a new un-winnable drug war that drives it underground and creates a black market for the pills or treatment, with all the negative consequences that ensue from black markets compared to legal markets. Were jury nullification to become widely understood (as the pro-choice crowd likely would help with), it seems likely that there would be few places where convictions were likely, leading the laws to become either a waste of money to enforce or something not enforced. It makes it less likely women will publicly discuss their situation and be led to other alternatives like finding support for pregnancy expenses and then giving up the child for adoption.
Many who are religious (I'm not, and I realize there are non-believers who are pro-life so this doesn't apply to them) consider certain punishments to appropriately be left up to their God rather than man. Again, not everything viewed as bad or immoral needs to be against the law. I suspect many haven't considered what the theological position of their religion since to an outsider it seems likely that to many religious people that an aborted child they view as having a soul is likely viewed as having 1 of two results: either the soul gets a free pass to heaven since they haven't had a chance to come into this world and sin (which suggests others should temper their selfish desire to have seen the child exist in this world) or it is reborn another time. I suppose some might view it as disappearing, but I'm not sure how many religions would view a soul as being destructible that way.
Of course there are libertarians who have truly considered the issues in depth and disagree with the points I made and hold views that can be considered libertarian, while still wanting a minarchist government to have abortion be illegal as murder is. I suspect they are likely in the minority however and that many pro-life libertarians haven't thought through all aspects of their philosophy and are basing their views on an emotional repugnance to the thought of abortion rather than a reasoned philosophical positions.

I think most libertarians are actually anti-abortion. That is we don't like it and wish every pregnancy was planned and wanted but we also don't want it to be illegal.

Most pro choice people are fine with government funding of abortion and do not view ending the drug war with any kind of the same passion they view the need for legal abortion and I would hazard to guess none of them who are not Libertarians have any desire to end the FDA. So, to the extent they want the "government to stay out of it", it is because they want women to be able to avoid bearing the consequences of their actions. The government should stay out of it because no one wants a woman to be forced to have a baby that she doesn't want. The fact that others happen to be pro-choice and have differing political views doesn't seem relevant. Abortion for the left, like most all issues, is about politics, not principles. Over the counter emergency contraceptives and allowing first trimester abortions with a doctors consultation, and rape and life-of-the-mother exemptions, concessions I'm sure you can find a large majority of pro-life folks agreeing to, are simply not enough. Abortion for progressives is a vicious feedback loop of social signaling, to the point you get these retards on college campuses agreeing to post-birth abortions. False. If you have consensual vaginal sex you also must accept that it could result in a pregnancy. Fetuses don't 'barge into' anywhere, they are the result of an act that the mother participated in. If she was raped, you have more of a point (although the fetus still isn't at fault) and she didn't consent to the fetus occupying her womb. If the sex was consensual, and emergency contraceptives weren't taken to prevent implantation, then the mother consented.

The libertarian argument over abortion is practically the same as everyone else's argument over abortion.
The one thing that Libertarians should think about when looking at abortion is why their assumptions about liberty and life are justified. Every libertarian believes that all people have an inalienable right to life, liberty, and the pursuit of happiness or something to that effect. Every person on earth has those rights by virtue of being a human being. We are all equal in that regard and it doesn't matter if you are smart, stupid, rich, poor, nice or nasty. You get the same rights.
You might ask yourself why that is so. We all like it that way but why is it true? A good number of other people would deny it and say your rights are dependent on how smart you are or how much you contribute to society or what economic and political class you are. Like everyone else on here, I find that position appalling. But just because it is appalling doesn't mean it is wrong or that I am relieved of explaining why it is wrong.
Once we go down the road of defining life as "personhood" or as "whenever your brain functions" or "whenever you make the magic trip down the birth canal", how do we then justify that all people are created equal and entitled to a set of natural rights? The reality is we are not equal and there are degrees of every physical or mental ability. What is a "higher brain function" other than whatever we want to call one? You guys say it is when the cerebral cortex starts firing. That is nice, someone else says it is the ability to score over 80 on an IQ test. The point is once you start defining living things out of the human race by virtue of this or that physical or mental characteristic there is no guarantee the rest of the world is going to agree with your definition and won't start defining it in ways that are nothing but rationalizations for murder.
On a deeper level, once you start defining any human entity as being worthy or unworthy of rights, how do you justify claiming everyone is equal at all? If you say "life begins at higher brain function", you are necessarily saying that those living entities that have yet developed that are not equal to other humans and thus are not entitled to any rights. All you are doing at that point is fooling yourself with a semantic trick. Sure you say all human beings are created equal and have natural rights but you happily define a whole bunch of living things out of the definition of "human" to achieve the result you want. That is no better than people who get what they want by re-defining "rights" into something more palatable.
These are all good points, but it does lead to another question: why do humans enjoy all these rights but not other species? Simply having human DNA is very satisfying for me. Because we are humans and we should only look out for other humans? That seems very insular to me, and if you take hypotheticals like strong AI or ET I don't like where it leads.
It's hard for me to think of a reason that doesn't invoke something like intelligence, sentience, or the ability to reason. But infants arguable don't have those capacities, at least not in an advanced way.
I tend to come back around to potential. A zygote isn't able to reason but as a earl-development stage of a human being, it has the potential to do so. I've had trouble really formulating that sentiment in a way I'm happy with, though.

That is a very good question. And frankly, without appealing to God, I don't have an answer to that question other than naked self interest as a species. A lot of Libertarians and classical liberals are atheists. As a group, however, the vast majority of atheists are not classical liberals much less Libertarians. The reason for this I think is the difficulty in answering the question you pose without appealing to God. With a God, it is easy to see why all men are created equal. We were all created by God and are differences so insignificant in comparison to God that we are all equal. Sure, it seems to us that some of us are smarter and better but how significant are those differences in the scope of the entire universe and eternity? Nothing.
Take God away and man is the highest form of life in the universe and those differences mean a lot because they mean a lot to us. And if those differences are real, then everyone isn't equal. And if everyone isn't equal, how can you possibly claim they have equal rights? That is a problem and one that has caused a lot of people to reject natural rights and embrace all sorts of horrible like socialism and fascism.

I don't have a great answer. I'm not sure one exists. At some point we run into the nitty gritty details of a messy reality. Maybe we just have to admit that everything is subjective at some level and do our best to convince people to go along with our preferred system of values. It's not satisfying but maybe that's just the way it is.
It doesn't have to be a Christian God. The bottom line is that if man is just another animal and there is nothing higher than man and this life, it gets very hard to argue against utilitarianism and to justify the fundamental equality of man.
The term "natural rights" is really a non sequiter when you think about it. What rights do I have in nature? That question doesn't even make sense. Nature doesn't care about me or endow me with anything beyond whatever abilities I have. If it turns out I am born sick or deformed and can't hack it or run into some bad luck, nature won't care. Nature doesn't care if anyone treats me fairly. In nature, a male Grizzly bear comes along and kills a female's cubs so he can mate with her. That is how nature works.
So where do these rights come from? I think what a lot of atheist classical liberals do is sneak God back into their universe and call him "natural rights" in that those rights are a set of assumptions that give the life and the universe meaning and moral order.

I think you're fundamentally confused about what the libertarian position means. It doesn't mean "we believe that this group of entities is equal and has the following rights...". Rather, it means "the world consists of rational, conscious agents, and they interact in the following ways".

How would we handle miscarriages? They happen before the 12th week quite frequently. And when a bitter husband or relative decides that the mother didn't sufficiently care for the person in her womb, and brings up charges of child abuse resulting in death, or negligent homicide. How will those be handled?
Does a woman who takes drugs, or smokes during pregnancy deserve to go to jail? What if she fails to get prenatal care? What if the baby is born with a birth defect attributable to alcoholism, or drug abuse?
You handle miscarriages the same way we handle negligence in any other circumstance. Murder or even manslaughter means intent or depraved indifference. Ordinary negligence even if it results in death is not a crime. So in the case you describe, you would have to show more than just "she didn't take her vitamins" or "she had a beer". It would have to be depraved indifference as in doing something so dangerous to the baby that we can infer malicious intent to the act. That would not be a problem.
The bigger problem would be keeping CPS out of things. If they can intervene with a child that has been born, why not a child that is in the womb? How do we keep CPS from monitoring mothers like they do every other parents? CPS is a menace in most cases and would no doubt be an even bigger one if you turned them lose on pregnant women.
My expectation is that IF the government, or some governmental agency, or some bureaucrat, or some ideological judge is given an inch, they will take a mile. Same expectation with regard to personhood for fetuses. I would fully expect a Pandora's box of unexpected and unwanted consequences as personhood plays out. We'll see women brought up on ridiculous charges, new governmental departments (Prenatal Homicide Investigation Unit maybe). Forensic units invading wombs to collect evidence. A whole new population of women in prisons. A new front on the war on drugs ("Won't someone please think of the Fetuses?!?"). A number of women in my life have had miscarriages. But again, *IF* you are coming at this from the POV that an unborn child has rights that need to be protected, then I don't see how that doesn't trump those concerns. Frivolous accusations are awful but they can happen with any law. A good reason to only have laws that protect actual (potential) victims.
If a mother doesn't do anything to intentionally harm an unborn child, or isn't really grossly negligent, then there is no issue. Miscarriages are a sad fact of human biology, just like disease. We don't generally hold one person responsible for making another person sick unless they tried to do it or were maybe were being really grossly negligent (and even then I'm not sure what the case law is). If charges are filed, they get investigated. If they were frivolous, they should get tossed the second the cops ask a few questions. I have no problem with prosecuting someone for making a knowingly false and baseless accusation, even if it is just in civil court.
To the extent that you can prove beyond a reasonable doubt that taking drugs or smoking or drinking does harm to an unborn child, yes, those things should be illegal. I'm not up on the current medical understanding on these issues. I suspect that in practice making that link beyond a reasonable doubt is usually going to be difficult.
There are huge costs associated with banning something. Making something illegal means making the commitment to throw someone in jail or even kill them if necessary if they do it. That is of course an enormously serious undertaking. Indeed, it is so serious that doing it is worse than the harm it solves for most things. The drug war of course being the most obvious example of how the evils of enforcing a law outweigh any good enforcing it could ever do.
So the question is how does this equation apply to abortion? Well, either you think abortion is murder or you don't. If you don't, then it is just another medical procedure and it should never be banned. If you do, then the solution is to ban it. Sure that is a nasty solution with all kinds of associated evils. We are not talking about drugs here. We are talking about murder. If it isn't worth it to enforce a prohibition on murder, then it isn't worth enforcing any law and we should all just give up and become anarchists.

Not necessarily. I think that question is a very close one. On the one hand, if continuing the pregnancy does place the mother's life in danger, then the principle of self defense would seem to make it okay for her to kill her unborn child. On the other hand, the principle of self defense doesn't necessarily apply when you create the danger yourself. For example, lets say a mother puts her child into a car and then the wrecks the car and must choose to either throw the child to safety and sacrifice herself or leave the burning car saving herself but leaving her child to do. Normally you could say that there is nothing wrong with not sacrificing yourself. In this case, however, the child never consented to get in the car and is only in danger because the mother put him in danger. In that case maybe the mother does have a duty to save the child. A pregnancy is a similar situation. The child didn't consent to being created. The mother created the child and the resulting danger to herself. Does she have the right to save herself? Maybe. I could see either answer being reasonable.

If you're asking how can a person maintain that he or she holds a libertarian view regarding human liberty and politics while at the same time arguing that abortion is a right, I can tell you that the person cannot maintain such a position consistently, since libertarianism rests on the assumption that people have a right to their property (their bodies, their things and their liberty) as the Non-Aggression Principle (the moral foundation of libertarianism) implies. This property is to be respected, if one is consistent with the NAP. Since abortion is the murder of a human being (whether in his or her fetal or embryonic stage or as a fully developed person, it matters not), then one cannot argue that abortion is a right because then the implication is that murder is a right, which contradicts the NAP.

Stephanie, the only consistent libertarian position that can exist is the complete acceptance of the Non Aggression Principle and its implications. The NAP is a personal philosophy and a moral razor or standard that allows the person to make a clear distinction between good or moral acts and evil acts. If a particular act hurts a person directly in his or her body, property or liberty, then that act is evil.
The question whether the entity developing in the womb is a human being is an extraordinary one to make since it is obvious that a human woman cannot beget a non-human entity. If what is growing in the womb is the result of the union of a human egg and human sperm, then that entity is a HUMAN. Whatever stage in life that human happens to find him or herself (be it embryonic or fetal) you cannot argue that the entity is not human, for that would mean a logical contradiction as the argument is being made by another human who was also, at some stage in life, an embryonic or fetal human being.

Show of hands: How many people who read this thread with an open mind changed their opinion in the slightest? There are more reasonable points made than normally accompany an abortion...abortion and I see little room for middle ground.
Having said I think the author did a very good job of making the libertarian anti-abortion case. But I came into the conversation feeling that way so I am biased.
It didn't really change my mind much, but I've heard these arguments before and also tried to honestly challenge myself in the past. Again, I come away not being 100% certain in my belief that life begins at conception but not really convinced that the other definitions are any better.
These threads are good sparring grounds for the real world. When you practice, you can easily and unequivocally refute the half-cocked arguments of the people who don't devote their time and brainpower to thinking about abortion. That's when minds are changed.

OK, I've done some thinking on the whole "life begins at conception" thing. I seem to recall that back in the seventies some of the pro-abortion people were claiming that (at least) early-stage embryos were not alive. That has defined part of the debate, and is probably the source of the anti-abortion battle cry that "life begins at conception."
Now, this was the seventies and medical ultrasound wasn't as common as it is today, Lennart Nilsson had only recently published his famous in-utero photos of developing fetuses, and cell-theory had yet to replace the whole-organism view in biology. So I'm not sure whether those pro-abortion people were being dishonest or ignorant - there's certainly enough of both to go around from both ends of the debate.

I'm wondering if you intelligent libertarians have a strong opinion to the idea that abortion is bad....not necessarily morally wrong (though most legislation seems to be moral regulation before defined as based in ethics)... In my simple brain, and ignoring eugenics, the abortion debate is highly limited in fighting for women's rights vs baby's rights (or religious belief); i would think it would be a negative metric for first world society, in a similar fashion as infant mortality is in (usually) third world societies.
I personally don't think that anyone can make a generalized argument that abortion is not tragic for everyone involved in the situation; and is extremely over-indexed on highly preventable situations. Maybe this debate is ultimately a complete distraction to correctly identifying and repairing deeper issues?

Probably true but given how many elective abortions are performed in the United States each year not enough people seem to consider them un-wonderful. The reality is abortions are neither free, painless, risk-free or without incredibly complex psychological considerations both pre- and post-partum. The fact that many pro-choice advocates want abortions safe, legal and rare leads me to believe they get it is a lot more morally complicated than they want to really consider.
A person should not be allowed to kill another person solely because the first persons actions caused the second person to have to inconvenience the first person for nine months or die.

This proves definitively without appeal to religious authority that it was alive at the point of conception. Another question: Is the fetus chattel or a life? Another: Why doesn't the woman have the same custodial responsibility for an innocent fetus as, say, a policeman has for someone under arrest? Another: After conception, what needs a woman do to end the pregnancy? Answer: take forcible, violent and invasive action to "terminate" the pregnancy. It's science. Were you to take the child's DNA and have it examined at a lab. The lab would tell you it is a human, and with enough samples, who it's mother, father and siblings were. I have always been in favor of abortion up till the 75th trimester, when they can get a job, move out and vote.
Arkansas Act 301 allows any woman to abort her pregnancy for 12-weeks and development of a heartbeat. After the female acquires a second heartbeat the right to abort gestation is no longer sustained by the right to privacy. Over forty years have passed since Roe and over twenty years has passed since Casey. Counting all suicides motivated by abortion and then adding all medical deaths due to artificial abortion of gestation for life should be required. This results in abortions done after 12-weeks not being as safe as delivery and this fact sustains banning these to protect maternal health per Roe.
The facts known about aborting gestation today and the impact this choice has on long-term maternal health must now include suicides done thirty-plus years after choosing to artificially abort gestation if aborting gestation caused ANY suicide The bare facts now known are the only time aborting gestation is safer for maternal health than delivery is abortions of gestation done during the first 12-weeks. This is the only time allowed in Arkansas by Act 301.
Act 301 was invalidated by the Federal Court for the Eastern District of Arkansas. This was appealed to the Eighth Circuit Court of Appeals where an en banc request was denied after this mistaken judicial invalidation of Statutory Law was affirmed. The State of Arkansas must appeal now to SCOTUS by November, but Curtis J. Neeley Jr. must appeal to SCOTUS by September 17 after an attempt to intervene as a required party was denied.

It is not enough to admit that a fetus is a human being. We must also posit that the mother is required to provide life support to that being. If it were possible to maintain a viable fetus to term without the mother, I am sure most abortion-seeking mothers would opt for that choice. Since that is impossible, freeing the mother of the obligation of sustaining that fetus results in the death of the fetus. Can we find an analogous situation? Someone on life support, for example. Who is required to maintain the life of that person, assuming they would like their life maintained? That is the question you need to ask. While you ponder, I submit that consenting to unprotected sex constitutes a contract with any future fetus that the mother will support it. You're welcome!

As far as I'm concerned, a human being needs to have a actual brain, not just human DNA and the potential to develop into a human being. After all, sperm cells have human DNA and the potential to develop into a human being.
While I am devoutly religious, I don't think one should necessarily need to be to see why abortion is wrong (at least, I certainly keep hearing atheists say one doesn't need religion to be moral). The only way to see abortion as not violating the NAP is to dehumanize a being that is, by any logical or scientific standard, human?very convenient for those who place a selfish understanding of "liberty" above the concept of inalienable human rights (which, indeed, aren't inalienable by any philosophy I'm aware of in absence of a Creator).
The pro-choice position is about freedom to evade consequences, even by committing heinous violence. The pro-life position is about defending the most fundamental right any person has?to exist?against another's desire to infringe that right because it poses an inconvenience (rape, with which the vast majority of abortions have nothing to do, is a natural exception). The basis for the pro-life position is much stronger, and I think in due time it will become the majority libertarian position. Adopting it is probably the only way the ideology will ever become mainstream, since on the vast majority of other issues libertarians are in far more agreement with conservatives, who trend pro-life, than with pro-choice liberals.

Whenever one uses the force of law a decision has been made to have the political State kill all who resist it if that's what it takes. In the case of murder or arson, it is clear without invoking invisible participants that the wrongdoing in question does indeed merit the full violence of law. But all argument that begins by invoking invisible playmates able to violate physical reality to then conclude that the deadly force of the political state must be applied is superstition, murder, anti-life, evil. In the nonsuperstitious world we do not worship death but affirm uncoerced life as the standard of value. Rather than try to change the already cowardly LP platform, mystics need to demonstrate the existence of their invisible playmates in laboratories dedicated to measurement of things that exist. Their demands that political parties have governments AGAIN order men with guns to break down the doors of medical facilities to kill doctors as "pro life" would sound less like the ravings of mentally deranged victims of mistreatment that amounts to the coercion of children not competent to enter into legal contracts.

I do not believe that ending a pregnancy is immoral, at least during for the first 13-20, or even 25 weeks. By using the law to prevent or impede my access to abortion, you are in favor of using government regulation to push your moral views on sexual health and reproduction. That is something that I have a real problem with.
But I wouldn't question you as a libertarian. I do not believe that being a libertarian is about towing the party line, so much as standing up for what you believe in and defending the right for others to do the same. A simple set of beliefs that covers every situation only works in a simple world. It takes an intelligent person to realize that sometimes you have to shift your viewpoint. So, while I sincerely disagree with you, I certainly respect your integrity.

Let's say another human being ends up in your house, with no possibility to leave before several months have passed, apart from death. If you transported him there while he was unconscious, and you fully knew that he wouldn't be able to leave, are you allowed - based on negative liberty - to kill him in order to remove him from your property? I doubt you are. But consensual sex carries merely a certain probability of that happening (you take a risk instead of having certainty), depending on birth control attempts. Does that change things? -- As for rape, that'd be akin to someone else putting the third party on your property (again without the third party's will; he's unconscious).

That's not a final answer either. Some consider the manifested potential (fetus would develop into a person) as worth protecting. (Others wouldn't grant protection until a distinct personality has developed.) Of course dating means some potential, too. It's not as specific, though (for example, no genetic combination (specific sperm plus specific egg) has been set).

It depends on the stage of development. While I disagree with the "from the moment of conception" position of pro-lifers, I also think it's hard to argue that a fully-developed, ninth-month fetus isn't a human life.

Now, this is completely separate to the issue of whether the mother's right to control her own body overrides any fetal rights. You can argue that a premature infant has a right to live because it is physically independent of its mother, and that doesn't apply to a nine month fetus. But you can't argue that a nine-month fetus is less human than a premature infant.
I'm saying that whatever "human being" means is (1) a matter of definition (criteria and consequences). Then (2) one has to determine whether the embryo/fetus/baby etc. meets the criteria (a matter of some uncertainty). Call it the "human being" law.
Personally, I'm inclined to argue against abortion (not talking about any kind of right to abort), not against the pill after (though I can see how that can make one feel uneasy). However, forcing someone to have something grow inside of him (here: her) can be unacceptable. BUT considering the large body of people on both sides of the argument, you cannot be a Libertarian and insist on a law of the land that takes that freedom of choice away from one of those large bodies.
Put more simply: If you oppose abortion, then never ever get one - and be content that you have never committed murder and/or sinned against your God. But for God's sake, don't force your view/religion on everyone else.
Of course, the down side of this way of reasoning is that all we have to do is declare any given moral issue a matter of individual preference (which by definition they all are), and we're in the same boat. An appeal to consensus of ambiguity means that if 50% of people woke up tomorrow and decided that rape was acceptable under certain conditions, we would necessarily have to accommodate them in the law, because it would be improper to foist our morality onto others.

I find the more I learn about the scientific aspects to this topic, the more I am convinced the evidence is clear: what's contained in the womb is a living human child, extremely early in the pregnancy. That applies to the fetus, too. He/she has no right to compel the mother to continue to support it with her body. If the fetus's rights trump the mother's (or even are considered entirely equal to hers), then some nonsensical court rulings we've seen make total sense, like the judge who ordered a woman involuntarily confined because she was addicted to cocaine and her addiction exposed her unborn child to the drug without its consent.
In fact, under that reasoning, pregnant women should not be allowed most recreational/optional drugs, including concaine, opioids, caffeine, alcohol, naproxen, acetaminophen, and nicotine.
So, sorry, just because the fetus is a human being does not give it -- or us, through the State, the right to force the woman to support it until it is born.

The real solution to this problem is do develop an artificial uterus (and placenta), which can support the unborn child until it is ready to be decanted to face the world, and surgical techniques to transplant the fetus to the artificial uterus. Then let those who are opposed to abortion pay for the surgery and rental and tending of the artificial uterus, either out of their own pockets, or, through the government, out of the taxes that all of us pay.

Is the potential (1) exclusively relevant in order to not miss the moment in which it is actualized/realized (entity becomes human/person), or do you (2) find it necessary to already protect certain mere potential? Put differently, given certainty about it, is it fine to destroy an entity of mere potential (is not yet "human", would become human), or not?
Read "individual liberty". The element prior to liberty is "individual". This is about determining whether there is an individual. Until narrowed, liberty would apply to individual human statues, individual animals, and possibly individual trees. I don't think "originalism" settles the issue; it may if you restrict yourself - your philosophy - to the Constitution. Do you?

The question is whether abortion (behavior X) is murder. The non-aggression principle is fine. Still, it requires defining "aggression". If you leave that to each individual, then your inalienable/natural rights are mostly - if not entirely - dissolved. (You have two things to worry about, defining (the) "individual", and defining "aggression".)
