Florida Cop Caught on Video Punching Teen Already on the Ground—Tried to Stop Recording
Cop said someone called about the smell of marijuana, said he smelled it too. No marijuana was found, but there are always other charges


Three Florida teens say they were waiting for their Uber driver after a concert in downtown Orlando, in a parking garage to get away from the rain, when they were approached by a bicycle cop who said a resident had called and said she heard teens in the garage and smelled marijuana. The cop eventually told the teens he could smell marijuana too and that they were being detained.
One of the teens pulled out their cellphones, and two teens passed it among themselves in an effort to keep it away from the officer, before the cop moved on to subduing one of the teens, while he was still being filmed. The cellphone video shows the cop taking the teen to the ground and then punching him a number of times while the teen already appears subdued and another cop had already arrived.

The two cops eventually arrested all three teens but, according to One92, the cops found no marijuana. Two of the teens were reportedly charged with trespassing, while Ryan Diaz, the one seen being punched by the police officer, was reportedly charged with battery on a law enforcement officer and resisting an officer without violence and taken to jail.
In Florida, you have the right to record a police officer if you are in a public place with no reasonable expectation of privacy and aren't interfering with a "legal duty being performed by the office." The resisting without violence charge comes from a statue making resisting, obstructing, or opposing "any officer in the execution of legal process or in the lawful execution of any legal duty" a misdemeanor.

You can't beat the enormous loophole they wrote into the statute either.
Except there was no interference with any "legal duty". They had no legal basis to try to take the phone, or to arrest the kids. The charges will go away, and nothing else will happen.

So, if the one kid wasn't charged with trespassing, I take it to me that he lived in the building. Which means his friends with him were not trespassing.
These charges will be dropped. All three of them.
I just love living in a country where a cop can come up and smell marijuana where none is present, there are no signs of intoxication, and lie about it to manufacture probable cause and detain people instantly. Then arrest them for resisting when there is no actual resistance.
This cop should be fired, but we know what won't happen.
At the least, how about any cop who falsely identifies the presence of marijuana or alcohol or any other substance isn't allowed to pretend his nose found probable cause in the future? Seems fair to me. If he misidentified it once, who is to say he ever actually smelled anything at another point?

Coming out of a concert NOT smelling like marijuana is as physically impossible as coming out of a bar not smelling like cigarette smoke (before the bans) was.

I know it may be different in Florida, but in Indiana if you wanted to arrest a concert goer with actual marijuana on him, you should go for the teens who smell like patchouli. They're the one's with the pot. The kids who smell like marijuana were just standing somewhere down wind of him.
3 teens, only 2 cops? I'd've broken both cops' necks, made sure they stopped breathing, & shoved them under 2 cars. Then looked for more cops to kill. Come to think of it, killed everyone else in the world until they were the last 3 persons standing. Then killed the other 2. Then periodically drunk some of my own blood, because you just can't stop that sort of thing.

Criminals need to be prosecuted. Sad to note, sometimes it's hard to tell the difference, except for clothing, between cops and criminals. Some cops also need to be prosecuted, to the fullest extent of the law. They very seldom are, which leads to manifold problems. By the way, re those with superior "smellers", those who could "smell" marijuana, was any found at the scene on in possession of any of these teens? That strikes one as a question demanding of an answer, a plain English language answer, as with YES or NO.
Hopefully there is such a thing as karma and these two jokers get the shit beat out of them, or worse. And the pigs wonder why so many people hate them.
If this happened to my kid - there'd be one or more missing cops in short order.
They would never be seen nor heard from again.
