Cops Raid Marijuana Dispensary, Destroy Surveillance Equipment, Eat Pot Brownies, Joke About Assaulting Amputee
Thought they'd disabled all the cameras


Cops in Santa Ana, California, donned ski masks to break and enter into a local medical marijuana dispensary, raiding it with guns drawn in a May 27 police action. They then proceeded to remove surveillance cameras and recording equipment, but they didn't remove it all. Video from a camera they didn't disable also caught the officers eating what appear to be marijuana edibles, then acting in a way to suggest they had become intoxicated, with one officer even joking that she'd love to kick a marijuana activist present at the raid, Marla James, an amputee, in the "nub."

As OC Weekly reports, the dispensary that was raided, the Sky High Collective, was one of several in Santa Ana that was not selected in a lottery process in February that permitted a limited number of dispensaries to operate. Via the OC Weekly blog:
James and her husband David told the Weekly that they were present at Sky High because their attorney Matt Pappas, had learned the collective would be raided from Santa Ana's city attorney, Sonia Carvalho."
"When they came back into the back room when David and I were, they asked us why we were there, and I told them we were there to observe them, the police," James recalled. "And they were really surprised about that." When James told the officers that "Sonia" had told her attorney about the raid, the officers didn't recognize the name. "They had no idea and it made them seem kind of stupid and maybe that's why they got mad."
James struggled to understand why the female officer in the video would make fun of her disability.
"You know what, I was really nice to that woman," James said. "I even complimented her on her hair. I treated that woman with respect and I have no idea why she wanted to kick my stump."
The police department insists the video that was made public was edited and not in chronological order, and have started an internal investigation, saying they hope unedited video will give them a "clearer picture" of what happened.
As other states move to legalize marijuana more forcefully and clearly than California has over the last twenty years, the problem of licensing shouldn't be ignored. Where the government legalizes marijuana by creating a legalized monopoly or cartel, they are keeping significant numbers of non-violent people out of the legal framework and in the crosshairs of authorities.

This is one of the worst things I've ever seen but one of the greatest headlines.
It's amazing how frequently cops break the same petty laws they're allegedly 'enforcing.' Maggie McNeil mentioned a report that said the greatest fear of prostitutes is abuse by cops and state agents, which isn't particularly surprising given that there are probably quite a few horndog police officers who aren't above saying 'blow me and I'll let you go.'
This is basically just an extension of the same principle.
Maggie has said she never, ever, ever knowingly takes a cop as a client.
The fact that she was handcuffed and raped by three cops who told her no one would believe her because she's a whore might have something to do with that decision.
I'm wondering about the repercussions about officers becoming intoxicated while on the job, with, you know... video evidence?

The video that got released was reversed. Those law enforcement professionals were actually assembling the cameras because they craved video evidence of their actions.

Its sad to admit, but i am less mad at the cop's behavior (which is unfortunately anticipated now) than I am the place getting busted because they lost a lottery. I cannot for the life of me think of a better definition for "capricious and arbitrary" law, that a random lottery to determine which business will be allowed to sell legally and which will not. They're not charged. It still has to go to a grand jury where, as we all know, the prosecution will do their best to put on a defense for the cops. If they fail, and there actually is an indictment, it still has to go to trial.
And of course there is the possibility that the prosecutor overcharges them or undercharges them and they go free.
I think we can confidently go with "certainty".

"Lesser included" charges usually have to have a jury instruction requested and approved by the court. If the DA is tanking it, they won't ask for that option.
Typically the defendant gets the "all or nothing" choice - though not always. Depends upon the jurisdiction - and a lot of judges will instruct on all LIOs as a matter of course. If the evidence "fairly raises" a particular inference, then the accompanying instruction usually is going to be included.

The guy across the street from me sells Marijuana. The cops raided him and took out about 2 lbs of pot (this is in Florida). They dumped the 4 plastic bags on his front yard. While they were searching his house further, two other cops came up in a car, got out and scarfed up the 4 bags. It was never seen again and my neighbor got off with a warning.
Try to tell me that pot made it to evidence lockup. Hypocrites. The worst.

They obey their master, the state, no matter how wrong or illegal their commands. And they always appear to enjoy hurting or murdering people if they get the oportunity. In this case, all they got to do was bust up someone's property, but you can tell they enjoyed it just the same, even if they didn't get to hurt any people directly.
