'I've Got a Pen and I've Got a Phone': Obama Launches an Unconstitutional War on ISIS in Syria

Article One, Section Eight of the U.S. Constitution vests the power "to declare war" in the hands of Congress. But as the world now knows, President Barack Obama took it upon himself last night to launch an undeclared war against ISIS in Syria. Just like President George W. Bush before him, Obama believes his vast war powers as commander in chief trump whatever old-fashioned limitations the text of the Constitution happens to impose on the presidency.
This is not Obama's first undeclared war, of course. That would be his 2011 war in Libya, which he also launched after refusing to obtain congressional authorization as required by the Constitution. Nor is it Obama's only unilateral exercise of unprecedented executive power. That list of misdeeds is growing too long to summarize in a short blog post. As Obama himself bragged in January 2014, "I've got a pen and I've got a phone…. And I can use that pen to sign executive orders and take executive actions and administrative actions that move the ball forward."
Perhaps our next president will keep a copy of the Constitution on his desk as well.

I'm no Bush apologist, but he did actually get Congressional approval ahead of time.

Obama is so awesome he doesn't even need Congressional approval!
That's one way to put it. Another way is to say that he got carte blanche to do whatever he wants whenever he wants to whomever he wants so long as he invokes the magic phrase "9/11."
A declaration of war and a complete abdication of congressional authority may both result in US drones blowing people, up, but they aren't the same thing.

I think we should note a couple of things, here:
1) In its own way, getting legitimate approval can be worse for the cause of liberty than not getting approval.
Exhibit 1: The AUMF has been used to justify all manner of evil, from domestic NSA surveillance to assassinating American citizens abroad.
2) If Barack Obama sought an open ended and all-encompassing authorization for this war, he would almost certainly get it.
Obama might only get significant opposition from establishment Republicans--complaining that the resolution doesn't require Obama to put troops on the ground.
Perhaps our next president will keep a copy of the Constitution on his desk as well.

If we had just elected MacGuyver, he would have already used the pen and the phone to rig up something to defeat ISIS, and Ebola for good measure.
Unfortunately, Obama doesn't just have a pen and a phone, he's got a navy and an air force, too.
