Kid Twirls a Pencil in Class, N.J. Threatens to Take Him From His Dad and Requires Blood and Urine Testing

In April, Ethan Chaplin was twirling his pencil in class when another kid—a bully, according to Chaplin—called out: "He's making gun motions, send him to juvie!"
The 13-year-old was yanked out of school and thereby commenced his 15 minutes of fame as sites like Huffington Post, as well as local cable news stations, took up his cause arguing that a suspension for pencil twirling was zero tolerance run amok.
The Vernon Township school district's interim superintendent claimed Ethan had never been suspended, but conceded he had been out of school for two days, telling the New Jersey Herald:
"The story that we expelled or suspended a student is partially not true … We did exclude" the student from attending until a proper psychological evaluation was done, interim Vernon Superintendent Charles Maranzano [said.]…
If a student "demonstrates odd behaviors, non-conforming behaviors, it causes us to take a closer look," he told the newspaper. "If a student gestures or demonstrates behavior that could be construed as a threat to others in a classroom… then that's also a trigger for us."
Ethan was back in class quickly, but too often these zero tolerance cases have second- and third-order effects. In Ethan's case, long after they thought the incident was resolved, his dad received some very scary paperwork from the state of New Jersey threatening to revoke his custody rights:
Ethan's father [Michael] received startling communication from New Jersey's Department of Child Protection and Permanency and Department of Children and Families.
"I received a letter from them saying they had found an incident of abuse or neglect regarding Ethan because I refused to take him for psychological evaluation," Michael said.
Panicked by the letter, Ethan's parents took him in for the evaluation, where he was required to give blood and urine samples.
No troubling psychological conditions were found (unless they've recently added "being an annoying fidget" to the DSM) but now the Chaplin family will likely endure a period of uncertainty and perhaps even home visits from social workers with the power to take away Ethan at any time.
Meanwhile, 13-year-olds may be idiots sometimes, but they're not dumb. Remember, the whole incident was triggered by a kid savvy enough to know that raising the specter of even a fake gun is a powerful weapon in the bullying wars.

another kid?a bully, according to Chaplin?called out: "He's making gun motions, send him to juvie!"
Great, a future narc in the making.
Oh, no. That's a future cop in the making.
Precisely.
Nah, any decent cop would have been carrying a "drop gun" to leave in the kids desk the second he left the classroom
A kid who said things like that when I was in school would have gotten beat up weekly for most of the rest of his childhood.
(Third browser attempt to post this.)
"I believe you'd get your ass kicked if you went around saying things like that."
+1 case of "The Mondays."
I really do hope that Ethan has self-actualized and employed self-help in this situation, by repeatedly beating the living shit out of this kid, off school grounds, natch.
I think the biggest reform this country really needs now is the complete overhaul of the civil service sector.
This is just one example of the unthinking, dare I say malicious conduct of our so-called public servants.
And while they're going after this low-hanging fruit, a kid in a foster home is being beaten to death by an "approved" foster parent.
Find out where the idiot who signed this letter lives, go there, and beat the snot out of him/her in front of the family and the neighbors. Do this enough times and they'll stop sending letters.
I doubt if they are being beaten to death, just starved and neglected.
Panicked by the letter, Ethan's parents took him in for the evaluation
I wonder if that will show up if older Ethan ever tries to buy a firearm.
I don't wonder.
If a student "demonstrates odd behaviors, non-conforming behaviors, it causes us to take a closer look," he told the newspaper.
UNMUTUAL! UNMUTUAL!
So kids, make sure that you all pick your noses.
No troubling psychological conditions were found (unless they've recently added "being an annoying fidget" to the DSM)
Yes, kids should learn to sit still because the human body is meant to sit for long periods of time.
Look, how are we supposed to get kids that will sit still for long periods of time if we don't remove the ones who *can't* from the genepool?
Its just like milk-drinking - the human body will *never* become accustomed to drinking milk if you don't drink milk.
What are you, *anti-science*?
How did the dumbest of the dumb get in complete charge of the education system from pre-school through college?
Have you *met* any Education majors?
Letting them certify their own was the worst mistake we ever made.
And I don't mean to be rude here. I had a friend from high school who.was.pretty smart, who went to.Penn State for Education at the same.time.I did for.engineering. Some of her Ed. major friends were.amazingly dumb, however.
Which engineering school and what year?
I was Aerospace/88.
Chemical, '99.
You been back?
Wife and I spent the night there on a trip back east. The entire reason for the stop was to get wings at the G-Man. Unfortunately it was on a Sunday right after finals and they were closed.
Had a beer at the Skeller though.
I hadn't made it back for years until last summer. Wow, has the campus changed! I used to like to hang out at Cafe 210 West, still is pretty good. I hope to make one or two trips there this summer, as part of my campaign to build cross country hours for my instrument rating.
I learned to fly at the University Park Airport. One of my Engineering profs was my instructor. I had 8 months between graduation and the Air Force. I waited tables at night and would spend my tips the next day on an hour of flying.
Good times.
Dumb (probably) question: how likely would I be to be able to fly cool planes if I joined the AF Reserve now, with a private pilot's license? Or would I get assigned something stupid.
Just daydreaming, I guess.
How old are you?
The best way to ensure you fly a cool plane is by trying to get hired by the ANG or Reserve. If they hire you, they will pay to send you to pilot training and you WILL fly whatever they fly.
If you go active duty, you fly the aircraft they assign you based upon their current needs and, to a lesser degree, how well you do at pilot training.
It used to be you had to be in pilot training by the time you are 27 1/2. I know there has been some leniency on this lately, but not sure how much? Best thing is to find a unit you'd like to join and go talk to them.
Late thirties. The local ANG here in Pittsburgh is 171st ARW, so heavy tankers. The AF Reserve is 911th Airlift. So all the action here is heavy. Which I think would be fun. Don't know that I'd be cut out for fighters.
Unless something has changed dramatically, I think you are outta luck at your age. When I first got in, they wouldn't make an exception to the 27.5 rule for a senator's kid. Just before I got out they were waiving it up to 30.
You might just call the unit and ask, in case that's changed, but I wouldn't get your hopes up.
Too bad. Oh, well, I'm probably.not.cut.out.for military discipline anyway.
Ed majors != teachers. About half of them scrub out before becoming teachers.
Teachers have roughly average SAT scores for college grads.
Do some homework, get back to me.
Education is where you end up when you can't hack a real degree.
The only discipline lower is journalism.
No, there are many majors just as bad or worse.
Education is where the people who have absolutely no business being in college end up.
In my college, EDU courses were on top of whatever your major was. You had to have an actual skill, in other words.
That would be because of voters handed the education market to government bureaucrats. It really is that simple.
Those who cant do, teach. Those who cant teach run for local election.
By design.
Read "The Underground History of American Education" (http://tinyurl.com/kw772mo) for details, but it boils down to this: the same people that gave us the Federal Reserve gave us modern compulsory schooling.
Wow...reading that back, it sounds like I'm a conspiracy nut. Let me try again: big business types like Rockefeller and Carnegie realized we'd need a labor force *just* smart enough to work in factories, but conditioned "respect authoritay." At the same time, progressives were trying to figure out how to "scientifically manage" society so as to cure all social ills, which also required people conditioned to follow orders. These two factions put their chocolate and peanut butter together in the form of compulsory education that discouraged critical thinking, deep knowledge of literature and history, and anything else that might encourage free thought. Then they rammed it down the public's throat.
Now, I am not disagreeing with you, I'm just wondering if I missed the "sarcastic" font, or if you really think your second post sounds less paranoid?
But yeah, the Austrian Economic School may rock, but the Austrian School Model is a bit outdated, by a couple hundred years or so, and WAS specifically designed to produce good little cogs for the machine.
"If a student gestures or demonstrates behavior that could be construed as a threat to others in a classroom... then that's also a trigger for us."
Ah, the "trigger". You know what this whole thing about "triggers" is? Another way to avoid personal responsibility. We were "triggered"! There was nothing we could do! We don't need to think, we just act when "triggered".
No wonder it's becoming so popular.

The wonderful thing about triggers
Is triggers are wonderful things!
...for criminalizing the harmless actions of people you don't like.
+ 1 Pooh
Know what else a "trigger" is? It's part of a GUN! How can we have this "Charles Maranzano" character around kids when he's going around talking about GUN PARTS all the time? He needs to be removed from his job and psychologically evaluated before they let him near our kids!
FOR THE CHILDREN!
+1 hammer and safety
He spoke of the forbidden item. *gasps*
Exactly. And that may be the best way to handle it is to ridicule it by pointing out that the word "trigger" is itself a trigger. But do so in an ostentatious way as suggested by a few other posts here.
"Episiarch|6.11.14 @ 11:51AM|#
Ah, the "trigger". You know what this whole thing about "triggers" is? Another way to avoid personal responsibility. We were "triggered"! There was nothing we could do! We don't need to think, we just act when "triggered"."
Which is why i sincerely believe that no one should allow anyone to use this word as though it has meaningful substance.
Just go, "What?" when people say it. "what are you talking about?" "That doesn't make sense - *what do you mean, you were 'triggered'?"
Make people try and explain themselves using other words.
This makes people feel incredibly stupid, and they stop using the term.
I do this sort of thing to people regularly. It works.
The fact that people can use this term and get away with it is only though the cooperation of the audience. stop cooperating.
my $.02
I agree with your approach. However, from my experience it quickly, um, triggers a response to the effect "Well, if you don't want to have a serious conversation ....!"
I do want to have a 'serious conversation'; which is why i want to stop people from using words they can't rationally explain using other terms.
The short of it is, 'Triggering' is a rhetorical device for pretending that people are not responsible for their own reactions.
Its the intellectual equivalent of a kid purposely running into someone then screaming "MOMMY HE HIT ME!!"
This becomes apparent in 2 seconds when they try and explain themselves.
I've noted = the main rationale people make is that they themselves are not 'triggered' per se; but they express concern that *other (unidentified) people* may be potentially 'triggered' by said speech/information/etc.
They use the idea of the 'invisible, ever-present victim' as a device to attempt to restrict and control speech. You can even ask if anyone present really feels this way, and it wont matter- they will continue to argue that certain ideas are better censored in the name of 'reduction of potential harm'. It doesn't matter that no one can actually identify a victim or quantify/substantiate the 'harm' caused.
Taking away the bullshit terminology generally results in people refusing to defend their own stupid ideas. Because they realize that the essence of it it fairly idiotic.
Couldn't you just shorten this to "Trigga, Puleeze!"
Just go, "What?" when people say it. "what are you talking about?" "That doesn't make sense - *what do you mean, you were 'triggered'?"
Or pick another word likely to be used in the conversation and slap them in the face (cluck like a chicken, etc.) every time they say it.
'cause every time I hear the word 'trigger' in this context, I think of hypnotism or epilepsy.
Actually, asking them if they were hypnotized or if they have epilepsy might prove the point equally well.
"When you said 'trigger', I thought you meant like 'flashing lights will trigger my epilepsy'. Triggers are ideo-dynamic and, almost exclusively, motor-reflex rather than behavioral. You meant conditioning or brainwashing."
You don't actually suffer from PTSD or any other severe anxiety disorder, do you? If you did, you'd know why people make a big deal about triggers, and why they were, in the beginning at least, a good idea.
If you really do have a disorder that reacts to triggers, you'd know how much it sucks. I have an anxiety disorder and when I accidentally get triggered, it will often precipitate a full-on panic attack, and a severe worsening of symptoms for the next several days to weeks.
Just because you don't like some of the people using something doesn't mean it is a bad idea in-and-of-itself.
Kinda. . .you know. . .not anybodies problem but your own.
Not that it doesn't suck, but I know I personally wasn't born to walk on eggshells around whatever shithead feels victimized in my general vicinity.
I'd imagine that most people feel that way, in one form or another. You having anxiety sucks. Get therapy. Get medication. Get away from me. I don't care.
But DO NOT get a man with a badge and gun to kidnap me and do violence upon me because YOU have a fucking problem.
He's making gun words, send him to juvie!"
Public schools have successfully taught one lesson.
Yes, that the biggest bullies are on the government payroll.
+1 million! That bully will end up as a cop or assistant DA.
"If a student gestures or demonstrates behavior that could be construed as a threat to others in a classroom... then that's also a trigger for us."
He said trigger! Guns have triggers! Help!!!!!!!!!!
Guns!!! He said guns!!!! Guns are a trigger word!!!! Help!!!!!!!!!!!
Vernon is in the nice rural part of NJ too. Damn disheartening.
Nice part of NJ? Huh. Who knew?
Yep - When I first moved here people were surprised. "Did just drive past a forest and a bunch of nice farms to get to your house in Jersey?"
Is this school among those that Jersey charter schools are hedging out? Because this district can't be shut down quickly enough.
Not even close - it's about as far from the inner city as you can get in NJ. There are some good private and parochial choices in the area but no assistance with the bill.
Good. The more that public schools do stupid shit like this, the more that people will be pushed toward the voucher light.
Making libertarians, one stupid decision at a time.
I'm convinced we're all essentially libertarians except for a few hulking blind spots (public schools being one humongous example). Nobody wants the jackboots beating down his own door, or his healthcare doled out by bureaucratic fiat, or his children subjected to the braindead contrivances of some incompetent adminstrator.
No, but they very much want to inflict those things on other people, which makes them statists through and through.
You know, I try to avoid that thing people do around here where any post by a female contributor becomes a discussion about her looks (I call it the Ekins Effect).
But screw it - click on KMW's name. She's rocking purple hair these days, and it looks AWESOME.
They know they want it.

We already have a word for that, it's TIWTANFL
She really is phenomenally attractive, isn't she?

With all due respect, interim Superintendent, does it have to be a *student*, if you catch my drift?
Every adult who implemented this bullshit should lose its job.
Urge to kill. Rising.
(Wait, that was a threat, and a non-conforming behavior. No big deal, right? Wait, hold on, there's a knock at the door. Be right back.)

Now you're just othering me.
Damn, Mr. Kinison, I thought you were dead.
SAY IT!.....SAAAAAY IT!!!!!!!
This.
As soon as I hear someone use the word in any context not involving Colt, Smith and Wesson, etc. then I cease to hear anything else they have to say.
Some day, someone is going to fight their way into a DCF office and shoot the place up.
And on that day, the media will blame those damn libertarians and their damn hate speech and cynicism.
My problem with that is that collectivizing is wrong and that person will inevitably shoot the social worker who has personally fostered seven severely disabled children of disparate races (not that it should matter) who have grown into productive and happy people. They won't target the four evil and mendacious people who get off on having people grovel and plead to keep their own kids.
Sow the wind.
Reap the whirlwind.
If you don't want to get caught in the backlash against a monstrously evil organization, maybe you shouldn't belong to a monstrously evil organization.
So you're saying the electrician contractors on the second Death Star deserved it?
You have to know your customer!
Reap the whirlwind.
Thanks RC. Now that fucking Ultravox song is stuck in my head.
Whoever actually is psychologically prepared to do that will probably be so nuts that they won't be poster children for anything.
As long as you play ball with the assholes there's a chance you'll get your kids back. Anyone who does that will know that they will likely never see their kids again; and the people who care about their kids would prefer death to that.
Anyone who does that will know that they will likely never see their kids again
Here's the thing:
There are already a very large number of people in that position due to DCF.
And a lot of those people deserve it. And the people who deserve it, in most instances, grudgingly know deep inside that they deserve it, so no matter how angry they act they aren't that likely to fully snap. Unless, as you state, they're crazy to begin with.
But there are people who don't deserve it. And some of those people are fucked over due to misunderstandings or honest mistakes. But a non-zero number are fucked over due to completely insane nonsense like this. Those are the people they should be most worried about.
But most of those people know that in 10 years, their children will be adults and that they can reconnect with their kids freely. You may scoff, but it's the straw I clung to in the terrible days I thought I was going to lose my kids.
That's a good point.
How is that we know the name of the victim, but not the aggressor? What's the name of the kid who ratted him out?

I originally went to school for teaching. Almost made it all the way through the program, when I hit a wall and could no longer handle the derp.
After schools I worked at a museum, it was a micro version of how government operates (ignorant, arrogant, lazy assholes running the show, money disappearing, nothing getting done, way over budget ext.)
Became a paralegal and I don't think I am going to be looking back.
Some day, someone is going to fight their way into a DCF office and shoot the place up.
And on that day, the media will blame those damn libertarians and their damn hate speech and cynicism.
And on the following day, all DCF personnel will armor up. All subsequent visits will be sorties in force.
This makes me terribly sad. I'm a natural-born contrarian. If I were in public school today, I'd undoubtedly be consigned to Bedlam by now.
Yep. Same here. My kids all regularly came home from school with "Can you believe this moron?" stories. I would find myself thinking they were pulling my leg until some teacher would self-report moronity during a parent-teacher conference.
My favorite was a health teach who told me to my face no human society could have ever survived without grains.
// grains
well that's kind of true. maybe not never survived, but there were never any nonmigratory, civilized (centralized) societies that didn't have grain crops, or at least tuber crops. there were hunter gatherer groups in resource-poor places that had no agriculture, but their lives sucked.
Where's your gripe?
His gripe is he didn't want his kids eating so many grains and the teacher was objecting.
I'm speculating...
The she-spawn is one as well and is quite definitely a non-conformist in fashion, opinions and interests. So, if they haven't jacked her up yet for her state of being, there may be hope yet.
You going to Dick Dale @ Birchmere on August 12, J Dubs?
Thinking about it. Maybe this time we can actually hook up.
He talks a bit too much, but holy shit, he can still make a guitar scream at 76 years old.
Speaking of schools - WTF is up with all these "kindergarten graduation" and "pre-school graduation" photos I keep seeing on my breeder friends' Facebook pages?
Little Jenny is growing up so fast. She knows her primary colors and she plays nicely with others now!
"kindergarten graduation" and "pre-school graduation"
Those are for the kiddies who manage not to get excluded due to odd behaviors, non-conforming behaviors.
Coffee is for closers.
With all the ritalin and other psychotropic drugs being given to kids I'm surprised there are any behaviors being exhibited, let alone odd ones.
Are they going to start holding graduation ceremonies for every fucking grade now?
Surprised people like Andrew O'Heir at Salon didn't blow up at the obvious anti-collectivist, pro-individualist themes of that movie.
'The Incredibles' reads like a screenplay Ayn Rand would have written.
Hmmm...interesting! My kids were too young for this flick when it came out. Sounds like we might have to watch it.
The Boy had his 8th grade "adavancement" ceremony last night.
While I'm deeply opposed to these things as a rule, they're idiotic, the kids enjoyed it as more of a nostalgic look back at the year and tolerable rite of passage. Lots of good-natured hooting and hollering all through and a generally positive event that stressed genuine individual accomplishment.
The administrators didn't pat themselves on the back or talk *too* much, so there's that.
Nice! It was similar at my kids' school (going from 6th grade to junior high). I was worried it was going to be one of those "every kid is a winner" things, but the kids (like my daughter)who really excelled were acknowledged, while kids (like my son) who generally screwed around all year were not. No one complained, which shocked me! I expected the worst, but was pleasantly surprised.
Breeders? Is that what you call us now in the post Isla Vista era? Just because we can get laid and you can't...
I'm offended you repeated her slur against me, even just to call attention to the slur. Offended, as I am a breeder, which I am allowed to call myself, because when I do it....it is cool (Whazzup B's? Regularly said to my homies). Please, could you not have said 'the B word'? Deeply offended....
So is it required that someone be brain-dead to be a school admin, or do they get their brains sucked out when they start working there?
yes
Their brains are sucked out while earning their education credential.
They don't actually suck the brains out. If they did that, something else might replace it, and they wouldn't like that. It is more of a numbing process.
... a suspension for pencil twirling was zero tolerance run amok.
Zero tolerance is zero tolerance run amok.
"non-conforming behaviors"
pretty much says it all
"If a student "demonstrates odd behaviors, non-conforming behaviors, it causes us to take a closer look,"
Well, at least this moronic fuckstick is honest about the primary goal of public education.
No troubling psychological conditions were found (unless they've recently added "being an annoying fidget" to the DSM) but now the Chaplin family will likely endure a period of uncertainty and perhaps even home visits from social workers with the power to take away Ethan at any time.
This is the real scary aspect of the story. Siccing CPS on the guy because he dared expose the school's idiocy in the press. Nice custody you got there, shame if anything were to happen to it...
Tinpot dictators that deserve to be tarred, feathered, and run out on a rail.
Conform. What happened to the rebels of the 60s? They have been completely co-opted by the socialists and communists. Conform to the leftists agenda or your life will be made hell. And the kid narcing on the other kid... Sounds like swatting to me. The kid was blatantly lying and should be punished for that. Zero-tolerance should be for character flaws. Like acting in a way that lacks honor, integrity, honesty; not for possession of things, or mimicking possession of things.
Co-Opted? They are the socialists and communists. They successfully rebelled against too much freedom.
"non-conforming behaviors"
What. the. fuck.
This was the original intent of the Frakfurt school when they conceived manditory public schooling. The US government is doing its damnedest to make it realized.
"If a student "demonstrates odd behaviors, non-conforming behaviors, it causes us to take a closer look,"..."
If 12-22 year old me was transferred to the current era, there's no way I would have made it through public school and college. I would be taking kids' lunch money just be terrifying them with hate speech, and I would have been charged with rape once a week in college.
More knee jerks run amuck.
OMG! We twirled our pencils and pens all the time when I was in school. WTH is wrong with people nowadays?
Isn't the HuffPo ground zero for the "OMG guns are evil, why wasn't mass killer ever evaluated psychologically, why won't someone do something?" subculture?
Blood and urine samples? How does pencil twirling turn up in those!?!?!?!?
End your tort abuse and a lot of this will go away. No one wants to take a chance and get sued. It won't all go away, but the 'risk managers' always take the worst case scenario and talk about it as if it were a given.
It won't all go away, because a bunch of people love screwing around with others lives, and they've found a way.
lol this isnt because of lawsuits. Its because anyone who is in charge of ANYTHING in this country is almost by definition a power-tripping fascist asshole.
If a student "demonstrates odd behaviors, non-conforming behaviors,
They aren't even denying that school is just a brainswashing emporium now.
He's a bit obese too! He is defying authority and probably eats candy and drinks soda! I wonder if he has been evaluated for autism spectrum disorder?
There must be a pill we can use to solve this non conforming behavior problem. Do they still make "head on a stick"?
oh yeah, tell us again that it hasn't went over the edge of too far!!!!
When will economists replace the term unintended consequences with abject retardation?
The empowerment of malicious sociopaths in schools to use the massive wheels of school bureaucracy in their favour and the complete banishment of a teacher's, or the bullied, to use deterance or punishment, let's them get away with it.
