Mississippi Enacts Anti-Competitive Catfish Marketing Law
Protectionism rears its head in the Magnolia State.
One of main subplots of the new-ish movie Mud, starring Matthew McCaughey, involves a poor Mississippi River Delta teen, Ellis, who helps his father catch catfish and sell clear plastic bags of the cleaned fish out of the back of the family's beaten pickup truck.
That entrepreneurial food startup was all the income Ellis's family appeared to have.
While I suspect Ellis's family business probably skirted the laws of Arkansas, where the family's riverbank home was located (and where I've done most of my best catfish eating), I know with great certainty that their simple local enterprise would run afoul downriver in Mississippi, thanks to the latter's newly amended Catfish Marketing Law.
The Mississippi law, which updates a 2008 law, requires every grocer and restaurant in the state to "provide the consumer with the country of origin and method of production of catfish" and, now, of other catfish-like fish.
While the 2008 law required groceries throughout the state to provide country-of-origin labeling for catfish alone, the new law expands the measure to include all catfish-like fish, which is mostly imported, at every "restaurant, cafeteria, lunch room, food stand, saloon, tavern, bar, lounge or other similar facility operated as an enterprise engaged in the business of selling food to the public."
The law expands the state's ability to require "any person that prepares, stores, handles or distributes catfish or fish for retail sale maintain a verifiable record-keeping audit trail."
The rules contain a host of menu labeling provisions that "shall be provided to the consumer on the menu of the food service establishment." They require those engaged in wholesale or in direct sales to consumers also to label their catfish.
In Mississippi, restaurant buyers are subject to the menu-labeling and record-keeping laws. But sellers like Ellis and his dad (who also sold in the movie to restaurants) might be subject to the record-keeping provisions—if a restaurant can be required to keep records, then a smart restaurant would require those selling to the restaurant to do the same—and would probably be subject to the "retail sale" and "wholesale" labeling requirements.
Though the impact here is only hypothetical—Ellis is just a character in a movie, after all—the basis for the actual Catfish Marketing Law doesn't rest on very firm ground, either.
It's true that a small amount of imported catfish has raised food safety issues in recent years.
But while the state bills the rules under the familiar veil of helping consumers "make more informed decisions," most news reports on the catfish law (even those that simply repost the state agriculture department's press release announcing the new rules while claiming authorship) serve up headlines like "Country of origin labeling law aims at protecting local farmers."
If this sounds suspiciously like a protectionist measure, that's because it is. Reports on the 2008 rule made it clear the rule was also "designed to protect the domestic catfish industry from imports of catfish and similar fish[.]"
Though the law was intended to protect Delta residents like Ellis and his family from foreign competitors, its unintended consequences will likely impose new costs for these same people in the form of greater liability, thousands of dollars in potential fines, and confusing or impossible record-keeping requirements.
While I believe Mississippi gets it wrong with the Catfish Marketing Law, that's not to say the state's food laws are all headed in the wrong direction. They're not.
Take the state's so-called "anti-Bloomberg bill." That law, passed earlier this year, is by my estimate the seventh in the country to bar local governments from banning or otherwise restricting consumer food choices in restaurants and groceries. (Ohio's ban was later overturned.)
The Mississippi measure also prohibits local governments from "designati[ng] food as healthy or unhealthy," offering a key bulwark against further potential government interference in the food choices of the state's residents.
Critics have mocked the state for passing the law, noting that Mississippi typically ranks near the bottom on U.S. reports on health and well-being. And they did so in a nasty, condescending manner I don't recall seeing in the case of the Ohio measure or those passed in other states.
The narrow view taken by critics of the anti-Bloomberg bill is that state legislators are hell-bent on making an unhealthy state even less healthy. But I suspect those same critics would cheer two other regulations adopted in recent years in the state— the lifting of sales taxes from farmers markets and passage of a cottage foods law—if they took time to note them.
Mark Twain once defended the catfish as "plenty good enough fish for anybody."
While Mississippi's Catfish Marketing Law puts up more red tape for small food entrepreneurs in the state, other recent laws paint the picture of a state exploring ways to loosen regulations for food sellers great and small alike. And that trend is plenty good.

What's the difference? Do they have a different flavor? If so, you'll know pretty quickly and the advertiser will get a rep.
As far a local or Asian, if you can't tell the difference between fresh and frozen, why would you gripe?
Yes, you are right. Only government can do this. No private party can. Customers are too stupid to know the difference. Private companies are tainted by profit motive, so they can't do it. Can the government? It sounds like the compliance still pretty much comes down to the honesty of the merchants. If consumers actually gave a shit about this they'd demand labeling and it would happen, because fish sellers, oddly enough, kinda like to sell fish. But then, how would food get labeled without government?

Ive got a better idea than that even. When I lived in GA and wanted local, fresh peaches, I drove north of ATL on I-75, looked for a hand-made sign propped up on the interstate, took the exit and found the truck parked by the road.
Sure, I guess I could be fooled that way, but I never was, and if they did defraud me, they defrauded me with the best tasting imported peaches of my life.

The answer certainly isn't more laws and bigger government. The answer is individual responsibility. People need to take responsibility for knowing where their food is coming from. Buy locally from a trusted source. If you are going to purchase catfish do your research first.

But how big is the market for premium products? Is it large enough for people to really make a living or is it left to the hobby producers such as those at Farmer's Markets?
Pretty big. I live in the Willamette valley, which is one of the most productive agricultural zones in the US, and there are plenty of people here making a living on it. Also plenty of people making a living exporting food elsewhere; my neighbors, who we lease our land to for farming, grew wheat last year and ended up selling it to companies in China.

I'm fine with the idea of education to better oneself. My MA in Medieval Lit is a testament to that. But I can't very well sit back and complain that said degree doesn't qualify me for a good job and because of that we need to completely refigure my loans (which I don't have BTW) and then blame the world when I can't make a living with said degree.

That is a good point. Universities are mostly designed to prepare people for the academic world. Problem is that they produce way more graduates than the academic world can take. Which I think is fine, as long as you don't expect your degree to get you your dream job and you develop some other shills besides academics. That's pretty much what I did. I studied philosophy and math and Greek and I work in tech manufacturing.

Bill generation and their Baby Boomer children). However, times have changed but society-at-large still needs to acknowledge that fact.

Students who choose to major in high paying fields will officially subsidize the education for those students who choose to major in low paying careers.
The only way this can work at all is if the payments from students are isolated and put back in to the programs that brought about those payments. Low Art History major payments put back in to Art History programs, and high engineering payments put back in to engineering programs where the funds do not mix.
I'd be really pissed to know that my payments as a highly paid engineer are going towards funding lavish Art History department faculties and facilities.

I'm not sure where that quote comes from but -
economic patriotism is what smashed the Japanes economy in the 90's. The idea that the government knows how to run an economy better than the individuals in that economy is what allowed MITI to get away with screwing everything up.

As such its not surprising that Japanese GDP is rising faster than the US', we're closer to the bleeding edge of efficiency than they are and its harder for us to make headway.

It's not adjusted for cost of living, and current political leanings isn't going to affect historical wealth of a state, which is obviously going to affect current wealth. Ex. Speaking of catfish: There are certain libertarian related things I have trouble wrapping my mind around. I say this being a libertarian since the 1980's. Maybe some of you can clarify for me. Take, for example, wildlife. Catfish for example - I live a short ways from the Ohio River. Although illegal in Indiana and in Ohio, commercial catfishing is allowed in Kentucky. There are many pay lakes in Ohio stocked with catfish caught in the Ohio River. These guys go in there with nets and catch unlimited amounts of catfish to stock their pay lakes and to sell to other pay lakes. They catch many tons of these fish to the point where they have seriously damaged catfishing for sport fishermen. They fish out an area and then move up or downstream to the next area. A nearby farmer I know has a friend who does this. He put some 3 or 4 thousand of these catfish into this farmers small pond waiting for the price to go up in the fall. There is no way these fish can survive for long in this pond and they are already started to die in numbers - hundreds. In a libertarian society, how do with deal with this? A relatively small group of people potentially destroying a fishery for profit. Now, I understand the argument that it is in their interests to protect this fishery, but people are often shortsighted. Who do wildlife belong to? Whoever got there first and exploited it first. Please clarify this for me. thanks
Start with getting rid of public fishing areas by selling them off and most of it takes care of itself.
In short: better-defined property rights. It doesn't sound like the Ohio River is owned by any one person, for instance. However, it isn't necessary for the River to be owned in order to fix this issue. Shares of fishing rights could help solve the problem. Just like with hunting season quotas, there can be sellable claims to a certain amount of fish from the river.
I'm not an expert on hunting/fishing rights mechanisms, I'm basically just repeating some of what I remember being told by Joab Corey, an economist at Florida State. He was part of an IHS seminar I was at last summer, and he was asked a similar question about fishing by one of the students there.
Right. This has been tried in oceanic fisheries and worked wonderfully. Sell shares of fishing rights and limit the percentage of the overall population you can take, and companies will work their asses on to make that population bigger so they can take in more fish.
