Constitutionally Illiterate Michael Bloomberg Doesn't Want the DOJ Monitoring His Stop-and-Frisk "Military"

In November 2011, New York Mayor Michael Bloomberg told an audience at MIT, "I don't listen to Washington very much, which is something they're not thrilled about." He didn't listen because he didn't have to. "I have my own army in the NYPD, which is the seventh biggest army in the world," Bloomberg bragged.
That boast--crude and alarming as it was--sort of just hung in the air, slowly losing its stench. Yesterday, Bloomberg revived it, this time while announcing that he didn't want the Justice Department overseeing the NYPD in the event a federal judge deems stop-and-frisk unconstitutional.
The U.S. Department of Justice filed papers Wednesday saying that if a federal judge ruled the NYPD's practices unconstitutional, then the DOJ would strongly endorse the use of a monitor to oversee changes at the department.
The mayor, however, said that the police department needs a clear line of authority. "No military organization or paramilitary runs where you have confusion in the command structure. You just cannot have that. Lives are on the line," he said in a question-and-answer session with reporters.
Emphasis mine. The NYPD is not a "military organization" or an "army," much less Bloomberg's "own army." Nor is the NYPD a "paramilitary organization"--that would require the department to change its core function to supporting an actual military. The NYPD is a police department. New York, New York is a city, not a sovereign nation. The 14th Amendment says Bloomberg and his police are required to respect the Fourth Amendment. This is basic stuff. You'd think Bloomberg would know it.
As for his claim that federal supervision of a police department that regularly violates the constitutional rights of New Yorkers "would create confusion in the command structure"? New York cops say there's plenty of that already, thanks to their union working with commanding officers to create confusing and possibly illegal quotas for stopping, frisking, and arresting minority residents. In the event that a federal court deems stop-and-frisk unconstitutional, there will be that much more confusion at the NYPD. Bringing in an outside body--one tasked with making sure the department respects the constitutional rights of New Yorkers--would provide the department with a much needed moral compass.

When exactly did cops and soldiers start holding their rifles like they were a bag of poop, with their wrist cocked 90 degrees down and the rifle pointed toward the floor? When I was a kid we carried our guns like men, horizontally across the waist or hips, with two hands if we were expecting to shoot in the near future, or tucked under one elbow if we were just walking.

Of course, by "we", I mean actual soldiers in combat, not police who don't understand the difference.
I guess following basic gun safety tenets (like muzzle awareness) wasn't something "men" did when you were a kid.
And low-ready is faster to the shoulder, because sometimes "men" need to actually shoot at something that might shoot back.

As a long time shooter and hunter, and who sold guns for many years, and who has more experience with guns than most here, his point is that city police don't need to carry their weapons in a combat ready position.
When the National Guard took over New Orleans after Katrina, they were ordered at one point not to carry their weapons in low-ready because it intimidated the people. They slung their weapons over their shoulder. That's not Fudd, that's simply respectful to the people who they serve.

Given his use of "men" with nary a mention of police anywhere in his statement it read like a blanket condemnation of a more effective and safer method of carrying a longarm.

I think we actually agree dude. I don't think cops should be militarized at all. Nor do I think National Guard should be used against the people as heavy duty law enforcement. Meaning, no M-4s or MP-5s. I guess I took offense when you characterized someone who carries a sporting shotgun or rifle in a standard fashion "unsafe" or "fudd like." You cannot carry that fine Beretta O/U in a 3 point tactical sling. And you'd look like an ass doing it. I totally understand carrying your weapon in combat readiness when you're actually in combat. But cops aren't in combat. So maybe we actually do agree. The only people I've ever know to have a gun accidents were two cops who shot themselves in the hands with their own service weapons.
Carrying a rifle "horizontally across the waist or hips" is unsafe. It violates a basic firearms safety tenent, muzzle awareness.

You can still carry it low-ready while walking and high-ready when expecting flush so you don't end up pointing it at somebody.

For me, my appearance is not a primary concern when carrying a deadly weapon.
We agree insofar as militarization of police.
However, if they are carrying longarms (even an old pump shotgun) they should be carrying them in a safe manner, not like Deputy Fife, e.g. "horizontally across the waist or hips."
Muzzle awareness was the first thing we learned. Never point your gun at anything you don't plan to shoot. We lived in the woods, so you could carry a gun without a target in every direction.
It makes sense for a soldier in an urban area to carry that way, but not for a cop on patrol.

I knew Bloomberg felt like this--I have called the NYPD the mayor's personal army many times--but the fact that he thought it was OK to say it out loud is...insane. Just a statement like that should get him removed from office, though I sadly doubt the city council has enough juice any more.
The city council is about to watch one of their own ascend to the throne - and then we will really see the crazy fly.

That's not the point. Offender rates are irrelevant when we're talking about a program like stop and frisk. The point is that race alone should not be sufficient reason for a search, and the vast majority of these searches reveal that the black and Hispanic guys being searched are not doing anything illegal (not to mention all the stuff they can get caught for that shouldn't be illegal). Way to miss the point

NCVS is a crime stat based on interview of crime VICTIMS, not cops. Iow, they interview victims and ask about demographics of their offenders. and guess what? There is racial and gender disparity, almost exactly equal to the disparity seen in terry stops.
This is something even Jesse Jackson concedes.
It is IMPOSSIBLE to skew because it is not based on criminal justice stats, but is based on interview of crime victims. I have posted the link at least a half dozen times. Google it. NCVS and DOJ.
